By Max Marbut Staff Writer Companies that rented caps and gowns to students who graduated from Duval County public high schools this year should report very good business in 2016. That’s because for the fourth consecutive year, Duval County Public Schools earned its highest graduation rate in history. More than 78.8 percent of high school seniors received a diploma, an increase of 2.2 percentage points over 2015 and more than 11 percentage points’ improvement since the school year that ended in 2012. (See chart on Page 2.) The numbers, released Dec. 16 by the Florida Department of Education, indicate Duval County is the state’s leader in graduation rate improvement among the seven largest school districts — better than Broward, Dade, HillsborVitti ough, Orange, Palm Beach and Pinellas counties. The statewide graduation rate compared to 2015 increased by 2.8 percentage points to 80.7 percent and up from 74.5 percent in 2012. In addition, the African-American graduation rate in Duval County also continued to go up, rising to 75.2 percent — an increase of more than 4.1 percentage points compared to 2015 and 12.9 percentage points higher compared to 2012. Duval County’s African-American graduation rate this year also is the highest among the seven largest school districts, as it was in 2015. The graduation rate for Hispanic students this year was 79 percent, a 15.2 percentage point increase since 2012. to develop neighborhoods By Maggie FitzRoy Contributing Writer As a young man in the spring of 1973, Hawley Smith experienced a huge shock on the first day of his first job in the real estate industry. He had just moved from Georgia to Jacksonville to work at a development firm. But the man who hired him resigned without warning, taking about 30 key employees with him. Smith, who majored in chemical engineering at the Georgia Institute of Technology, was a complete novice to real estate. But the crisis in which he found himself soon proved to be an outstanding opportunity. “I went from not knowing anything about real estate to being vice president because I was one of the very few people left,” Smith said. That, he said, meant “at someone else’s financial risk, I learned a lot about what has been a very lucrative business for me.” That kind of luck, timing and the willingness to recognize opportunity and grab onto it has served Smith well during his 43-year career as a developer of neighborhoods throughout Northeast Florida. Andrew Jackson at 11.6 points and Ed White at 12.6 points. All 21 traditional high schools increased their graduation rate or maintained a rate higher than 95 percent. Twelve (57 percent) of those schools exceeded the 90 percent graduation rate, up from 29 percent in 2015. Among magnet schools, Darnell-Cookman School of the Medical Arts achieved a graduation rate of 100 percent for the
third consecutive year and Stanton College Preparatory School became the second high school in the district to record a 100 percent graduation rate. “What is particularly a point of pride is that nearly all our schools continue to show improvement and that our work with AfricanAmerican students is leading the state,” said Duval County Public Schools Superintendent Nikolai Vitti in a news release. Appellate court overturns guilty verdict based on ‘crash’ definition By The News Service of Florida Pointing to a Florida Supreme Court ruling on the definition of a “crash,” an appeals court Friday overturned the conviction of a man who drove away from the scene of a confrontation in which another man had fallen off the car and suffered a fatal head injury. A three-judge panel of the 5th District Court of Appeal sided in the Volusia County case with Joseph Wayne Daugherty, who had been sentenced to four years in prison for leaving the scene of a crash involving death. The decision was based on a Supreme Court ruling this year that defined a crash as meaning a “vehicle must collide with another vehicle, person or object.”

The appeals court said the man who died in the Daugherty case had been holding on to the car through an open window during a confrontation and fell off, fatally striking his head on the ground. The ruling, written by appeals court Judge William Palmer and joined by judges Thomas Sawaya and Jay Cohen, said the Supreme Court “has now held that such an occurrence does not constitute a crash under the statute” and that Daugherty should receive an acquittal. Gwen Graham wrapped up her two years in Congress with a final news conference last week, saying she was most rewarded by helping her North Florida constituents and that she is looking ahead to a possible bid for governor in 2018. “All that we’ve done during my term in Congress, nothing means as much as the ability to make a difference in people’s lives and helping them with the challenges they face,” the Democratic congresswoman said at Tallahassee City Hall. Graham said her office worked to return $2.5 million in benefits, which had been stalled or withheld by the federal government, to her constituents, including $1.4 million in Social Security, Medicare and Medicaid benefits. She also cut her office expenses by $375,000, returning the money to the federal treasury. “Our office is an example that you can get a lot done and still be fiscally conservative,” she said. Graham, 53, who is a lawyer and former Leon County school administrator, won her first elected office in 2014 when she unseated U.S. Rep. Steve Southerland in a sprawling district that included the Tallahassee area and Panama City. She was one of two Democrats nationally who beat a Republican incumbent that year. Graham’s plan to run for reelection this year was scuttled by a court-ordered redistricting, which left her in a Republicandominated district that was won by incoming U.S. Rep. Neal Dunn, R-Fla. But Graham has made it clear she is interested in running for governor in 2018, which is a post

He performed more than 100 workdays during his initial campaign for governor and continued them throughout his public service. once held by her father, Bob Graham, a two-term governor and three-term U.S. senator. “This is a very bittersweet moment for me,” she said. “But I’m very much looking forward to the future.” Graham’s political future has been complicated by her husband’s diagnosis of prostate cancer. She said she will put off a decision on the governor’s race while her husband, Stephen Hurm, undergoes treatment. As a congressional member, Graham often characterized her leadership style as the “North Florida way,” where she emphasized trying to find pragmatic solutions rather than partisan solutions. “I believe in a balance in government. I believe in having multiple voices in the room who have different opinions,” she said. Graham adopted one political technique from her father, conducting 32 “work days” in her
district over the last two years, working side by side with her constituents in a variety of jobs, starting with a food truck operation and ending by selling Christmas trees. “Obviously, it’s about the job that you do for the day, but it’s so much more than that,” she said. “It’s about really getting to know people and really building those friendships and relationships that allows you to better serve them.” Whether Graham can translate her political experience as a oneterm member of Congress into a statewide office remains to be seen. She is likely to face a crowded Democratic field, where potential candidates include John Morgan, the prominent trial lawyer who has led the medical marijuana movement in the state, and a number of mayors, such as Bob Buckhorn of Tampa, Philip Levine of Miami Beach and Andrew Gillum of Tallahassee.

After three valuable years of on-the-job training, he left to start his own company, H Smith Inc., in 1976. Huntington Forest, off St. Augustine Road in Mandarin, was the first community Smith developed. His most recent is River Story, a gated-community on the St. Johns River, also in Mandarin. Smith had purchased the land during the economic downturn in 2008 for a very good price and held onto it until the economy improved. The first families are now moving into the cozy enclave, where every home sits on an acre lot, surrounded by 100-year-old Spanish moss-draped live oaks. “In my business, you make your money the day you buy the piece of land, not the day you sell it,” Smith said. “If not overly leveraged and if you are conservative and careful, you have set yourself up to make money.” Smith started his company with $1,000 of his own money and a $265,000 loan from Jacksonville National Bank. He sold his first lot in Huntington Forest for $3,600. Two years later, he was selling smaller ones in the same neighborhood for about $23,000 because inflation was rampant at that time. “Those were nerve-racking days with many sleepless nights,” he said. But his business continued to grow.
Having the patience to buy low, sell high
Smith has lost count of how many communities he has developed over the years, but one of his most notable is Palencia, a golf course community in St. Johns County that overlooks the Intracoastal Waterway. He bought the land in 1980, at a time it was considered the “boondocks,” and held onto it until the late-1990s, when it wasn’t. He paid $3,000 an acre for the one-and-a-half-mile frontage on the Intracoastal Waterway, in what was then considered the middle of nowhere. Smith said he envisioned what the 1,500 acres of live oak canopy could someday look like as a community. Homes started going up in the late 1990s. “With the right piece of land for the right price at the right time,” Smith said, “you are going to make money. The rest is mechanical.” He said he applied the same kind of vision and savvy around 2000 to North Jacksonville, buying up land there “when everybody thought I was crazy.” At that time, Mandarin was hot, with lots selling for up to $30,000 an acre. He looked at the Northside and saw beautiful farmland going for $5,000 to $6,000 an acre. Most

Marsh Winds was his first community there. Shortly after that, he developed Victoria Lakes off Yellow Bluff Road, purchasing the land for $10,000 an acre and selling it within three years for up to $70,000 an acre. Victoria Lakes was named after Smith’s grandniece, Victoria “Toria” Hale, who works for him. She is the granddaughter of his sister, Mary Louise Dungey, who joined him early in his business and who he says was his “best friend” as well as his partner. The first female president of the Northeast Florida Builders Association, Dungey was an artistically creative woman, Smith said, who came up with the names for many of their communities, including River Story. That neighborhood’s grand red brick entryway was Dungey’s vision, Smith said. She died in 2008, he said, “but I think of her every day.”
Family business supports charities
Smith, who grew up in the small town of LaGrange, Ga., has purposely kept his business a small family one. His daughter, Taylor Day, and her husband, Nathan Day, work with him. Smith’s wife, Emily, serves on the board of Seamark Ranch, a community in Clay County where children in Florida’s foster care system are provided homes with loving families. Smith and developer Chester Stokes, a longtime friend and former college fraternity brother, donated the land for Seamark. Together they had purchased 16,000 acres south of Middleburg, with the intention of hold-
ing onto them until the right time to develop. When Smith heard the founder of Seamark give a speech, “I heard the Lord speak to me,” he said. Stokes immediately agreed to their joint donation of 500 acres. Charitable giving is important to Smith, who also supports Young Lives, a ministry for unwed teenage mothers and their children, and helps orphaned children in Nicaragua. “I feel called to it,” he said. “We have been blessed beyond
