New anti-discrimination bill filed Religious groups, small businesses would be exempt

By Max Marbut Staff Writer If all goes according to plan, Feb. 14 will be marked in Jacksonville as something more than just Valentine’s Day. That’s when City Council could vote on the latest version of legislation that would expand the city’s anti-discrimination laws to include protection for the LGBTQ community. Council members Aaron Bowman, Tommy Hazouri and Jim Love co-sponsored a human rights ordinance filed Wednesday that distills from 40 pages to not quite five pages previous legislation that was defeated or withdrawn since 2012.

Bowman, who called the meeting to gather support among his colleagues for the bill, said he’s been asked by many people what’s different about this proposal compared to the others. Attorney Jimmy Midyette, a member of the Jacksonville Coalition for Equality who helped draft the ordinance, explained how it evolved from 2012 to its current form. He said it’s the culmination of best practices adopted by other cities and input from previous council action and the public. The bill provides protection based on “sexual orientation and gender identity” as they apply to discrimination, he said. Sexual orientation is defined as “an individual’s actual or perceived orientation as

heterosexual, homosexual or bisexual.” Gender identity means the “genderrelated identity, appearance or expression of a person.” In addition, gender identity must be demonstrated by “consistent and uniform assertion” and “sincerely held” and shall not be asserted for any improper, illegal or criminal purpose. Businesses would be allowed under the proposed ordinance to provide single-sex restrooms, locker rooms, showers, dormitory lodging and similar facilities that are by nature distinctly private. New owner Scott McAlister wants to add dinner service, along with the sale and service of alcohol, to Whiteway Delicatessen in Riverside, according to a lawyer working with him. McAlister, already an owner in three King Street bars and lounges, has applied to the city for a zoning exception to sell liquor, beer and wine and a waiver to reduce the required minimum distance between the 1239 King St. location and a church and school from 500 to 400 feet. Rogers Towers lawyer Wyman Duggan, the agent for the zoning applications, said the 5,200-square-foot restaurant space has 140 seats. Whiteway is open for breakfast and lunch. It’s not clear how the menu would change for dinner or whether the name would be altered. McAlister could not be reached through calls or by message on his Facebook page or those of his

other establishments. Duggan said the requests are scheduled Jan. 19 at the Planning Commission. McAlister bought the property in September through 1239 King Street LLC. The 8,200-square-foot building comprises three businesses — Whiteway Deli, Sweet Theory Baking Co. and Uniforms Unique. Two zoning signs are posted at Whiteway Deli. A previous set of zoning exception and waiver requests described the project as up to three establishments, but Duggan said Tuesday after a meeting with city planners, that just the Whiteway Deli space would be involved. Whiteway Delicatessen posted zoning signs in its windows. It seeks an exception and waiver to sell liquor, beer and wine. A site drawing filed with the zoning documents calls it “Whiteway” and shows a kitchen, counter and seating in the deli space. It also shows a bar and seating in each of two adjacent spaces, which Duggan said are not part of the current plan. The structure was built in 1927 and sits on 0.28 acre, property records show. McAlister bought the property for $1.025 million Sept. 6 from Samir and Hanan Salem, who operated Whiteway Deli. The restaurant traces its roots to 1927 at a nearby King Street location. His father bought the business in 1962 and Samir Salem moved it to 1239 King St. in 2008. He bought the building in 1999. At the time of the September acquisition, McAlister was quoted as saying he wasn’t changing anything. The menu continues and the interior remains largely the same, although with a newly installed large wood counter and stools just inside the front entrance.

The applications dated Dec. 13 said no off-street parking is required to be provided because the building is a contributing structure. A contributing structure in the Riverside/Avondale Overlay area is one that was at least 50 years old as of 1998 and contributes to the historic or architectural character of the district. The exception application says the building has an off-street unpaved parking area in the rear of the property. It also notes the King Street corridor has commercial uses and zoning in place, including restaurants and bars with alcohol sales. “The proposed development will have fewer impacts than other similar developments in the corridor because some accessory off-street parking will be provided,” the application says. Duggan said the deli space already could sell beer and wine, but McAlister wants a full liquor license. McAlister owns The Rogue whiskey bar and The Loft night-

Doing some heavy lifting at the port Stevedores from Seaonus at JaxPort’s Talleyrand Marine Terminal recently moved four 35-ton Caterpillar dump trucks onto a cargo ship bound for a Morton Salt facility in the Bahamas. The trucks will haul salt harvested for water softening and road de-icing, according to a news release. The port’s 100-ton multipurpose whirly crane lifted the vehicles — which are 14 feet tall and 30 feet long — onto the VI-NAIS chartered vessel. The vehicles had been refurbished by a heavy equipment dealer in St. Augustine.

Also exempt would be religious organizations, including churches, synagogues, mosques, schools of religious instruction and nonprofits affiliated with them. In addition to the Office of General Counsel, Midyette said the ordinance was vetted by Buddy Schulz of Holland & Knight and Fred Franklin of Rogers Towers. Bowman pointed out that since the previous bill was withdrawn in March, President-elect Donald Trump has come out in favor of LGBTQ protection and Mayor Lenny Curry put in place an antidiscrimination policy that also was adopted by the Jacksonville Sheriff’s Office, city independent authorities and the Duval County School Board. In addition, legislation adopted in North Carolina that was seen as unfriendly to the LGBTQ community “has been a disas-

ter,” Bowman said, in terms of the state losing business — and even sports and entertainment — opportunities. “There is no spot in this world to discriminate against people,” he said. The new ordinance has the support of the business community. JAX Chamber Chair Darnell Smith, Florida Blue market president for the Florida region, described it as “a Jacksonville solution” with a “tenor and tone of togetherness” that will allow all people to be protected while “no one will have their religious and personal rights taken away from them.” Baptist Health CEO Hugh Greene also supports the proposal. He said not having an antidiscrimination law on the books “casts a shadow” over the city. “This is long past due in our

community,” said Greene. Council President Lori Boyer said it is her goal to “see this go through the committee process deliberately” since “we’ve had a long time to think and debate.” Bowman said he doesn’t anticipate the upcoming discussion to be based on party affiliation or partisanship. He’s confident the third try at an anti-discrimination ordinance will gain the support of at least 10 council members when the bill is brought up for a vote. “We have three co-introducers,” Bowman said. “We wouldn’t have been here today if we weren’t confident we have the other seven.” Ten votes are necessary to carry a bill on the 19-member council. mmarbut@jaxdailyrecord.com (904) 356-2466

Community First partners with Florida Theatre From Staff The Florida Theatre and Community First Credit Union announced Wednesday during Art Walk the credit union will become the theater’s first season-long sponsor and partner for all programs and events. It’s a three-year agreement and the largest partnership in the 30-year history of the theater as a nonprofit. Monetary details were not released. The announcement was dubbed “New Year, New Sea-

son, New Friends.” John Hirabayashi, CEO and president of the credit union, in a news release described the venue as a “community treasure” and “an integral part of our downtown as well as our local cultural history.” The sponsorship will support the operations of the Florida Theatre Performing Arts Center Inc., the nonprofit that has since 1987 managed and programmed the venue in a public-private partnership with the city. The theater offers more than

175 music, dance and other performances of myriad genres each year and a summer film series. It also is the venue of choice for nonprofits that produce the annual Community Nutcracker ballet and the Theatreworks... Live! performance season for children. “Our partnership with Community First Credit Union supports that effort, ensuring we can do more for our community,” said Numa Saisselin, president of the Florida Theatre, said in the release.

Report: State pension fund projections may be too rosy By Lloyd Dunkelberger The News Service of Florida While Florida has a financially healthy state pension fund, a new report from the Department of Management Services warns the $144 billion system is relying on a projected investment return that independent financial consultants say is too optimistic. State analysts lowered the projected rate of return to 7.6 percent in October, down from 7.65 percent. But the Department of Management Services’ annual report notes that Milliman, the state’s actuarial consultant, recommended a 7 percent rate of return, saying that is more in line with the uncertain financial climate. The 7.6 percent assumed rate is “materially above” the estimates developed by Milliman and Aon Hewitt, a financial consultant to the state Board of Administration, which oversees the pension fund, the report noted. The consultants developed financial models that estimated the fund had a 50 percent chance of achieving its long-range rate of return if the projection was 6.3 percent to 7 percent.

The chance of meeting the longrange 7.6 percent projection is much lower. “All models developed in 2016 indicated a likelihood of 35 percent or less of actual long-term future average returns meeting or exceeding 7.6 percent,” the report said. The report said a lower projected rate of return would result in higher short-term contributions to the pension fund by the state, school boards, county governments and other entities that rely on the fund to pay benefits to retirees. The issue of lowering the projected rate of return was debated in October by the Florida Retirement System Actuarial Assumption Conference. The state House and the Office of Economic and Demographic Research had pushed for lowering the rate to 7.5 percent but were opposed by the Governor’s Office and the state Senate, which wanted to maintain the 7.65 percent rate. The panel compromised on the 7.6 percent rate. But the analysts were in agreement that Florida could not abruptly lower the rate without causing financial disruption for the

governmental entities that contribute to the fund on behalf of their employees. Lowering the rate of return to 7 percent would have yielded nearly a $38 billion unfunded liability, with the fund only being able to pay 79 percent of its long-term obligations. That would have required a significant increase in the pension contributions made by the government agencies to cover that actuarial deficit. With the 7.6 percent rate, the pension fund is projected to meet 85.4 percent of its future obligations, representing a $24.9 billion unfunded liability. It will still require a projected contribution increase in the range of $90 million. As of July 1, the Florida pension fund had 630,350 active members, including 114,000 enrolled in an alternative 401(k)-type investment plan, according to the Department of Management Services’ report. The department oversees employee benefits, including pension benefits. A little under 400,000 retirees rely on the pension fund for benefits, with an average annual payment of $21,245.

The seminars also will utilize the expertise of government officials and other local campaign professionals. Daigle and Hipps met when he covered her campaign as a Florida Times-Union reporter. The longtime friends said the endeavor will be both similar to and different than the Jacksonville Regional Political Leadership Institute, a former JAX Chamber program. “It’s overwhelming to think of what goes into deciding whether to enter politics and what to do after making that decision,” Hipps said. “John and I are hoping this new program will be a good resource for those people.” Like the chamber program, the upcoming seminars will address a variety topics ranging from voter targeting to what to consider when running for office. Unlike the free chamber seminars, which were sponsored by donors and aimed at businessminded candidates, the Leadership Jacksonville program is open to everyone, who must pay $1,500 tuition. “Leadership Jacksonville is really the anchor of community trusteeship in Jacksonville,” Hipps said. “I thought it was the perfect place for (the political leadership program) to be housed, particularly with its emphasis on ethics.” The practical application of bipartisan cooperation, along with ethics in campaigns and in public

hope (the program) is not a onetime deal,” she said. Dame said the program directly carries forth Leadership Jacksonville’s mission to “educate, connect and inspire diverse leaders to build and strengthen their communities.” The seminars will be 8:30-11:30 a.m. Fridays at the Jessie Ball duPont Center, 40 E.
