Hulsey steps down from bench

By Marilyn Young Editor Six months after being accused of making racist and sexist remarks, 4th Judicial Circuit Judge Mark Hulsey resigned Monday. It came a day before the Florida House of Representatives was scheduled to begin discussing rare impeachment proceedings against him. Chief Judge Mark Mahon said Hulsey was “very quiet, very reserved” when he delivered his resignation letter Monday morning. “I know this has been very stressful on him,” he said. “But I

know there is some relief the matter is over.” Mahon said he recently learned the House Public Integrity and Ethics Committee was considering the impeachment process, but was asked to keep it confidential. House Speaker Richard Corcoran told The News Service of Florida it was “disconcerting at best” that the Florida Judicial Qualifications Commission process was taking so long. Hulsey was first notified by the JQC of formal charges in July, followed by two amended notices, including the latest filed Dec. 9. A five-day trial was scheduled for June. The allegations included

Hulsey saying African-Americans “should go get back on a ship and go back to Africa” and using derogatory terms when referring to a female staff attorney. He also was accused of creating a hostile work environment, having his judicial assistant handle personal tasks for him and using the circuit’s FedEx account to mail campaign materials. Last month, Hulsey made a series of admissions and apologies, ranging from saying he should not have had his assistant put a letter from his campaign treasurer to the Florida Elections Commission on judicial letterhead to not getting written HULSEY CONTINUED ON PAGE 4

At 91, Gerald Hines sees his privately held global real estate investment, development and management company from the point of view of one who’s been there and done that. Make that a lot of “there” and “that.” The Hines company has a presence in 192 cities in 20 countries. Reflecting on his career, Hines shared with developers, brokers and other real estate industry professionals Monday night that his success came from identifying and pursuing opportunities, with a twist. “We’ve always tried to do something that creates a point of difference in our projects,” he told 310 members and Hines guests at a sold-out meeting of the Urban Land Institute North Florida at the Omni Jacksonville Hotel Downtown. Hines, a graduate of Purdue University with a degree in mechanical engineering, founded the company in 1957 in Houston. As founder and chairman, he also is a coowner with his son Jeffrey. He sits on the executive committee, continues to participate in deal-making and advises the firm’s offices about architecture. Jacksonville-based developer Peter Rummell, chairman of RummellMunz and former global chair of ULI, led the interview with Hines. When Rummell asked Hines about his current attitude, Hines said he was fairly comfortable with the world, although he had one concern. “I’m a little concerned about Mr. Trump, where he is going to be taking us,” Hines said. Hines said “hopefully he will have some very good advisers and will be in good hands.” Rummell quickly summarized that as “guarded optimism” and the only other comment about new President Donald Trump was when he opened up the event to questions. “We do not want to talk about Mr. Trump, but anything else is fair game,” Rummell said. Hines told the group he started his career building warehouses then expanded his base, but always with a focus on quality materials. He said the company’s reputation was built “brick by brick.” As an honorary Fellow of the American Institute of Architects, Hines has a focus on design. It led to his support of the Gerald D. Hines College of Architecture and Design at the University of Houston. Asked about trends, Hines said two were how society handles the automobile and how land in major cities was becoming more difficult to find for development. The group also talked about trends in driving, such as autonomous automobiles, ride-sharing services such as Uber and organized transportation that could change the parking and commuting needs for residents and employees. healthy lifestyles is designed to bring generations together. Hines then shared that his company plans a project in New York City for elderly residents with diminished mental capacity. Designed for New York families who can afford it, rent will be $18,000 a month, a reflection of the cost of real estate there. While Hines doesn’t see that price point being replicated in many places, he does see more housing being created for senior living. He said his group is “quite positive and optimistic about Florida.” He considers development to be less complicated in Jacksonville than in South Florida. “In Jacksonville, you know pretty much where you stand,” he said. The event also included a look at the annual Emerging Trends in Real Estate report researched and reported by the Urban Land Institute and the PwC advisory and tax services firm. Metropolitan Jacksonville’s overall real estate prospects are looking generally good, it found. Actually, they appear to be better than Palm Beach, Naples, Gainesville and Tallahassee, and a lot sunnier than Daytona Beach. Those points were made clear on a map included with the 38th edition of the Emerging Trends in Real Estate report. There was Jacksonville with a green dot — “generally good” — sharing that status with Fort Lauderdale, Miami, Orlando and Tampa/St. Petersburg. Cape Coral/Fort Myers/ Naples along with Gainesville, Palm Beach and Tallahassee were scored with a yellow “fair” dot. The only red dot, signifying “generally poor,” was for Deltona/Daytona Beach. Overall, Jacksonville ranked No. 47 of 78 U.S. metro areas for the “Markets to Watch” for overall real estate prospects this year. Last year it was No. 53.

Last on the list was Buffalo, N.Y., preceded by Hartford, Conn., and Deltona/Daytona Beach. “Neighborhood and niche are the way to look for investments in Jacksonville in 2017,” the report wrote in its analysis, citing a quote from a ULI focus group participant. That means performance in the market likely varies significantly by location and product type. For example, strong population growth supports housing growth, but difficulty in finding developable lots and enough qualified labor is holding back supply and possibly pushing prices that could cause market affordability to suffer, it said. The plus side, it said, is the multifamily market continues to be solid. The report said Jacksonville shares a number of characteristics with other secondary and tertiary markets in the survey. Those markets tend to offer affordable business and living cost structures; economic and demographic growth that exceeds the national average; and steady real estate fundamentals. While that creates an active local real estate market, the report said, it also is one that has difficulty attracting the attention of national real estate market participants. There are bright spots. “Jacksonville may have an advantage in reversing this trend due to the popularity of the region as a vacation and second-home mortgage market,” the report found. The intent from the beginning was to create “an inspiring environment” where the staff could do its best work for the agency’s clients, such as Southeastern Grocers, Daytona International Speedway, Under Armour, JEA and Zaxby’s. There’s also a café on the third floor that can accommodate up to 90 people for breaks, meals, meetings and social functions. “We spend a lot of hours here, so we wanted the space to be very comfortable,” said St. John. “When we had our first staff meeting, I said, ‘Welcome to your new home away from home.’” St. John and the staff moved in Jan. 3 and began unpacking boxes that were moved from Southside during the holidays. Even after just three weeks in their new urban home, St. John and the staff are discovering what Downtown has to offer — such as being able to walk to several places that serve food or take the water taxi for dining and meeting clients on the Northbank. Several people who work at the agency live in San Marco and Riverside, so they ride their bicycles to work. Court rules against injured worker By The News Service of Florida In what could be a first-ofits-kind decision in Florida, an appeals court Monday ruled against an injured worker who sought a change in physicians under the workers’ compensation insurance system. The ruling by a three-judge panel of the 1st District Court of Appeal was rooted in part of state law that allows workers to request a one-time change in physicians while being treated for workplace accidents. Worker Brenton Davis requested such a change, but insurer Retailfirst Insurance Co. and his employer didn’t respond in a timely way to the request, according to the ruling. Because of the lack of a response, Davis sought to change his doctor from a family

practice physician to an orthopedist. A judge of compensation claims said Davis was entitled to select a physician of his choice, but the 1st District Court of Appeal said he could only change to a physician of the type originally approved for workers’ compensation treatment. “In essence, Davis’ reading would allow a claimant to add a new physician, rather than change from the originally authorized one,” said the fourpage ruling, written by Judge Scott Makar of Jacksonville and joined by judges James Wolf and Stephanie Ray. “And it would allow a claimant, at least in theory, to select a specialist who is wholly unsuitable for the ‘course of treatment’ that has been authorized. As such, we read that statute as a whole to reflect a legislative

intent of allowing only a onefor-one exchange of physicians within the same specialty under these circumstances,” the ruling continued. “Procedures exist for claimants to seek authorization for physicians beyond the specialties originally established for their workplace accidents. But (a section of state law) cannot be read to allow that result simply because an employer/carrier has not timely responded to a onetime change of physician,” the ruling said. It does not give details about Davis’ employment or injuries, but appealing with Retailfirst Insurance Co. was Servpro of Southeast Tampa. The ruling said it was a “case of first impression” — indicating the first time the appeals court has dealt with the issue.

Higher ed changes clear first hurdle By Lloyd Dunkelberger The News Service of Florida

State colleges on Monday raised concerns about a Senate higher education package that cleared the Education Committee in a unanimous vote. The two bills (SB 2 and SB 4) encompass the bulk of Senate President Joe Negron’s initiative to elevate Florida’s 12 public universities and 28 state colleges. Among other proposals, the bills would extend Bright Futures merit scholarships to cover the full tuition and fees for top-performing university and college students, known as “academic scholars.” It would double state support for scholarships for “first generation” university students. It would require state universities

to create block tuition programs. It would also create funding pools to help universities attract top-quality faculty and recognize high-achieving graduate and professional programs, including law and medical schools. In addition, it would mandate each state college develop at least one “targeted pathway” agreement with a state university that would guarantee students a place in a university program once they finish their two-year associate degrees and meet the program requirements. But state college officials questioned the Senate proposal to hold the 28 schools to a new performance measure based on how many students finish their degrees “on time” — two years for an associate degree and four years for a baccalaureate degree.

Meeting the performance standard would make the colleges eligible for more state funding. It might be a difficult goal to reach as a Senate analysis of data on students who started attending state colleges in 2009 showed only 4 percent finished their baccalaureate degrees in four years at either a state college or a state university. The four-year graduation rate ranged from zero percent at Florida Keys Community College to about 13 percent at Santa Fe College, the Senate analysis showed. In contrast, about 44 percent of university students finish their baccalaureate degrees in four years. Michael Brawer, executive director of the Association of Florida Colleges, said it was important the Senate legislation

take into account differences in the demographics of university students versus state college students. He said the college population is a “non-traditional” group, with data showing 65 percent attend the colleges part time, with an average age of 25, and 58 percent are minority students. “These are working adults who may not be able to realistically set aside all of their life responsibilities to attend college full time and attain that baccalaureate degree in that neat little four-year period,” Brawer said. He also urged the senators not to change current performance standards, which were recently put into state law. Sen. Bill Galvano, R-Bradenton, sponsor of the legislative package, said the performance

Jay Fant, R-Jacksonville, is part of a group that plans to fight for state dollars to protect North Florida waterways. the trust fund for land and water maintenance and acquisition across Florida for 20 years. “I just want us to be mindful of all of our Amendment 1 dollars, that they’re not all spent in one place, in one project,” Drake said. “This may not be the best long-term solution statewide, especially not for the Panhandle, or the spring areas and Northwest Florida, that are in need of their own funding.” Negron has acknowledged the money for his proposal — intended to reduce the toxic algae blooms that have appeared in waterways in his East Coast district as a result of the releases from the lake — would have to come from other parts of the state budget.

Coalition members said in the current fiscal year, South Florida has received 75 percent of the trust-fund dollars while, 1.6 percent was directed toward the Suwannee River region, 4 percent to Northwest Florida, 4.4 percent to Southwest Florida and 14.4 percent to the St. Johns River region. Southerland said Negron’s plan is a “subject of concern” as the state faces projections of declining revenue. “South Florida receives the majority of these funds, and that is not the way Amendment 1 was sold to Florida voters,” he said. Southerland said North and Central Florida contain the majority of the state’s natural springs and 70 percent of Florida’s river watersheds.

By Jim Turner, The News Service of Florida A coalition that includes two state House members and a former congressman announced Monday it will fight for money to protect waterways in North Florida as Senate President Joe Negron tries to move forward with an ambitious proposal to spend heavily on cleaning waters in South Florida. Called “Stand Up for North Florida,” coalition members said during a news conference at the Capitol that a more equitable distribution of money is needed statewide from a conservation trust fund after passage of a constitutional amendment in 2014. Coalition members didn’t offer specific uses for money they’d like to see go to North Florida. State Rep. Brad Drake, R-Eucheeanna, and Rep. Jay Fant, R-Jacksonville, along with former U.S. Rep. Steve Southerland, said Negron’s $2.4 billion proposal further floats most of the trust fund dollars to the south. “My great concern is that North Florida and North Central Florida are already derelict in receiving funds that is shared by the state for the environment,” Fant said. “The notion of sending billions of dollars to an unproven land-grab in South Florida, for potentially dubious results, continues to leave the rest of Florida alone,” he added. Despite pushback from sugar growers and other farmers, Negron proposes to use the money to buy sugar industry and farm land as part of an effort to store and clean water and reduce releases from Lake Okeechobee into the Caloosahatchee and St. Lucie estuaries. Negron’s plan, which has received a mixed reception from experts throughout South Florida and in Senate hearings, would require a 50-50 funding match between the state and federal government to buy the land, with the state’s portion involving the bonding of $100 million annually. Voters overwhelmingly approved a constitutional amendment in 2014 — known as Amendment 1 — that directed 33 percent of the proceeds from the existing real estate tax, known as documentary stamps, go into

Mahon said he never discussed the accusations with Hulsey, but thinks they stemmed from statements allegedly made a long time ago. He reassigned Hulsey in July from the criminal division to handle probate cases. Mahon said no one has ever complained to him about how Hulsey sentenced defendants, as it relates to the allegations against him. “Not in a racist fashion. There was no hint of that,” he said. Mahon thinks the allegations sometimes made it difficult for Hulsey to do his day-to-day job. “I was disappointed to see a judge ever go through this,” he said. Gov. Rick Scott will appoint a replacement for Hulsey, who was re-elected in November to a second six-year term by a 753-vote margin. The process typically takes four to six months. The circuit already was short one judge, with the recent retirement of Henry Davis, who handled juvenile cases. Several senior judges are available to handle the extra workload. Hulsey is the son of the late Mark Hulsey Jr., a local legal icon who, while president of The Florida Bar, encouraged the board of governors to create the JQC.
