A vacant site next to Deutsche Bank’s Gate Parkway main campus is in review for more of what already is planned or prevalent in the St. Johns Town Center area. Up to 300 apartments, 25,000 square feet of office and medical space, 50,000 square feet of commercial space and 110 hotel rooms are envisioned. “If you look at all of the activity around this location, there is no question in Jacksonville, Florida, that it is the area to live, work and play,” said developer Chris Morgan with the Cantrell & Morgan real estate company. The almost 19-acre site is at southwest Gate Parkway and Deerwood Park Boulevard. It is south of St. Johns Town
Center, on the other side of Butler Boulevard. Ordinance 2017-40 for the Gate Parkway Mixed-Use Village Planned Unit Development was introduced Tuesday. The Planning Commission is scheduled to hear it Feb. 23, followed by its first hearing at City Council on Feb. 28 and the council Land Use and Zoning Committee on March 7. Nine members of the Skinner family own the land, which is
zoned Commercial Office and Industrial Business Park. Sidlyd Investments LLC, managed by Cantrell & Morgan CEO Morgan and President Jim Loftin, is listed as the developer and owner of the project. England, Thims & Miller Inc. is the planning and civil engineer, and the architect is Wakefield Beasley & Associates and others. A conceptual site plan shows the square site lined with the Merchant and Medical Village office-commercial area at the north. You would think a sharp drop in fuel prices would be a boon for a trucking company like Patriot Transportation Holding Inc. because fuel is a significant part of its expense. However, because of fuel surcharges included in customer contracts, Patriot’s margins actually got squeezed early in fiscal 2016 when fuel prices dropped sharply. “That was something that really impacted us in the first two quarters of the year,” Patriot Chairman and CEO Tom Baker told shareholders at the company’s annual meeting Wednesday at The River Club Downtown. It was one of several challenges that made 2016 “a pretty tough year,” he said. Baker Patriot’s business largely consists of transporting petroleum products in six Southeastern states. The company faced unexpected challenges when a couple of major oil pipeline breaks and Hurricane Matthew shutdowns disrupted the business. “When these things happen they really throw the normal supply arrangements out of whack,” Baker said. Patriot also is dealing with the ongoing challenge of hiring and retaining drivers, an issue that has been affecting the trucking industry for several years and isn’t going away. “The tightening driver market just gets worse and worse,” Baker said. Patriot’s revenue fell 2.2 percent in fiscal 2016 to $120.2 million, due to the reduction in fuel surcharge revenue as prices dropped.

It took more than two hours Wednesday morning, but City Council wrapped up the public hearing that began Tuesday night on a proposed expansion of the city’s equal rights laws to include protection for the LGBTQ community. The special session was made imperative at midnight Tuesday when more than 100 people who filled out speaker cards before council’s regular meeting had not been heard after more than four hours of public comments. The morning mood mirrored the evening one among speakers for and against Ordinance 2017-15, which would prohibit discrimination based upon sexual orientation and gender identity in the areas of employment, housing and public accommodations. Morgan said Wednesday that pending the PUD approval, his group would like to buy the property and then start horizontal work this summer. If that proceeds on target, some buildings could take shape by year-end, although he said it was too early to identify potential tenants. Morgan said his group will offer the property for sale, ground lease or build-to-suit, based on user needs. He envisions those users as being complementary to the
neighborhood of businesses, residents and others who patronize the area. “We think that we are going to be able to provide some services to that community that will benefit them and serve the traffic that is already there,” he said. His group is willing to invest $1.4 million in traffic improvements at Gate Parkway and Deerwood Park Boulevard, he said. He said that will be part of the PUD agreement. Morgan considers the site “the hub of the wheel.” “I can’t think of another submarket that has everything going on like this particular area,” he said. For example, Gate Parkway is the location for a new Hines
mixed-use development, another Deutsche Bank building and the Ikea under development. Morgan considers the Gate Parkway project to be in the position of offering complementary services to those at Town Center, but on the south side of Butler Boulevard. According to the PUD application, of the 18.72 acres, the apartments could use 5 acres and the office, medical and commercial uses would take up 8.47 acres. Lake and greenway, active recreation and open space would comprise much of the rest.

this (law),” said Wandall, whose husband was killed by a red light runner in 2003. “I’m not just an advocate, I know the statistics. I work with law enforcement. We’re taking all these tools away from law enforcement,” she said. For motorists, the proposal would eliminate $158 fines imposed on the owners of vehicles caught on camera running red lights, starting July 1, 2020. State and local governments split the fine revenues, with the fines yielding nearly $60 million for the state budget last year, according to the Florida Department of Revenue. Red light camera opponents have tried unsuccessfully for years to repeal the law.
But Avila believes a study released Dec. 31 by the Department of Highway Safety and Motor Vehicles will bolster the case for the bill during the upcoming legislative session. “This program simply has not met its intended purpose of enhancing public safety,” Avila said. “The facts show that there has been a significant increase, in terms of rear-end crashes at these intersections, due to the red light cameras.” In a survey of 148 intersections in 28 cities and counties across the state, total crashes were up 10.14 percent when comparing data before the cameras were installed and after they were in place, according to the state report.

Make that 11. The Ferber Co. Inc. intends to buy 2.5 acres in West Jacksonville to develop a Wawa Inc. gas station and convenience store, which is the 11th location identified in Northeast Florida for the chain. The location is at southwest Normandy Boulevard and Normandy Village Parkway. Ferber executive Tom Mundy, vice president of retail development services, said Wednesday the company expects to complete the land acquisition from the Setzer family by early fall. The property owner is Normandy Boulevard LLC, led by Leonard Setzer. A fall purchase puts the possible opening in summer 2018, Mundy said. Ferber would lease the location to Wawa. Mundy said it’s the second area Wawa that Ferber
is developing. It owns and is developing the location at 6787 Wilson Blvd., also in Westside. He said Ferber, based in Ponte Vedra Beach, is a preferred developer for Wawa and the company is working on several more Northeast Florida sites for the Pennsylvania-based chain, but he declined to identify them. Wawa spokeswoman Lori Bruce said Tuesday the company would break ground in the spring on its first Northeast Florida stores in Duval and Clay counties. The company then will share information about its construction schedule, specific store locations and which will open first. Lawmakers again looking at turning off red light cameras The latest effort to end red light cameras got a green light from a House panel Wednesday. The House Transportation and Infrastructure Subcommittee voted 13-1 to support a measure (HB 6007) by Rep. Bryan Avila, R-Hialeah, and Rep. Blaise Ingoglia, R-Spring Hill, that would repeal a law known as the Mark Wandall Traffic Safety Act of 2010. A repeal would prevent the state Department of Highway Safety and Motor Vehicles and local governments from using the cameras for traffic enforcement. Avila said the law may have been well-intentioned, but it has become “a revenue stream” for governments. He also said a recent state study shows the cameras have failed to enhance public safety. Opponents, including the Florida League of Cities and Melissa Wandall, the wife of Mark Wandall, argued local officials should be able to decide whether to use the cameras. Medicaid outpatient rates
By The News Service of Florida Dozens of hospitals across Florida, including from Jacksonville, have filed legal challenges against the state in a dispute about payments for outpatient care in the Medicaid program. The challenges have been posted during the past week on the state Division of Administrative Hearings website and involve major players in the hospital industry from various areas of Florida. Challengers include hospitals in the St. Vincent’s HealthCare and Baptist Health systems in Jacksonville; the Tenet health system; the HCA health system; the Adventist health system; the Bayfront health system in the Tampa Bay area; the Sacred Heart health system in
Pensacola; Jackson Health System in Miami; UF Health Shands in Gainesville; Orlando Health; and Lee Memorial Hospital in Fort Myers. The challenges, which raise similar arguments and were consolidated in a single case Wednesday, deal with a complicated process in which the state Agency for Health Care Administration determines payment rates for hospitals in the Medicaid program. Changes proposed last year by the agency would reduce outpatient rates for the hospitals. The challengers argue, in part, the agency overstepped its authority and that a proposed rule and a related plan involved in the dispute are invalid. In its challenge, the Public Health Trust of Miami-Dade
County, which operates the Jackson Health System, said the state agency posted what are known as Medicaid “rate sheets” in July that raised concerns. “The calculated outpatient reimbursement rates were significantly lower than prior years, and significantly less than what was anticipated by petitioners based upon their data and the fact that the Legislature had not implemented an outpatient rate decrease for 2016,” the Jackson challenge said. The Division of Administrative Hearings website, as of Wednesday, did not include a response from the state agency. Administrative Law Judge J. Lawrence Johnston has been assigned to hear the consolidated case.

doesn’t feel safe without legal protection from discrimination. “I want her to come home and feel welcome,” Bennett said. The difference of opinion about the ordinance in the faith community also was reprised Wednesday. The Rev. David Erickson, an Episcopal priest, spoke in support of the bill. He said the baptismal rite is based on the respect and dignity of every human being and being LGBTQ is “a blessing.” “Passing this ordinance honors the city and it honors God,” he said. Orange Park resident Marshall Wood has a different impression — that the protections laid out in the proposed ordinance imperil the basic beliefs of the Christian faith. “We can’t point our finger at God and say ‘back off.’ I don’t care what the Episcopalians say,” he said. Two speakers Wednesday said the main beneficiaries of the bill if it’s enacted could be members of the legal community. John Beehner predicts a possible flurry of lawsuits against businesses that might run afoul of the expanded protections. “The only winners in this law are the attorneys,” he said. Bodie Catlin called the ordinance “a weapon of litigation for disgruntled employees who want
to punish a business.” Local artist Chip Southworth urged council to approve the legislation and commented on the possibility of a referendum on the issue, which was brought up by quite a few speakers Tuesday and Wednesday. He said Jacksonville has a national reputation for being a “hot mess” of discrimination. “The protections of the few are never given by the masses,” he said. “It’s unreasonable to assume a bunch of discriminatory white people are going to vote for minority rights.” “An unaffected majority cannot protect an oppressed minority,” said Victoria Hatcher, who spoke in favor of the ordinance but against including the proposal on an election ballot. Another speaker who referenced Jacksonville’s national reputation was radio talk show host Andy Johnson. He said what he was hearing Wednesday reminded him of the local conversations about school desegregation in the 1950s and civil rights in the 1960s. “This city has been an embarrassment,” Johnson said. Speaking in favor of the status quo, Bennett Brown, who lives in Mandarin, said Jacksonville has been “blessed by God” and he doesn’t want to see the discrimination law amended.
“We don’t want to be San Francisco. We don’t want to be L.A (Los Angeles). We like who we are and we want to stay who we are,” he said. Before the meeting adjourned, council President Lori Boyer said in addition to those who went to the podium during the hearing, 500 people who did not wish to speak had filled out cards in favor of the ordinance and 193 nonspeakers filled out cards opposing the bill. Boyer also said there will be no public comment on the ordinance Feb. 6-8 when it is reviewed by the Finance, Neighborhood, Community Investment & Services and Rules committees, upon recommendation of the committee chairs. After more than six hours of hearing all sides of the issue “the committees have the benefit of the public comment,” she said. Boyer encourages constituents to contact their council representative or an at-large member if they have further comments on the proposed legislation. Scott pitches major tax cuts amid tight budget

Despite a tight budget environment that will leave little room for extra spending, Gov. Rick Scott launched a media blitz Wednesday as he challenged lawmakers to slash taxes by $618 million. Scott launched his “Fighting for Florida’s Future” Tax Cut Tour in Jacksonville, the first of six stops planned as he pushes for reductions in a tax on commercial leases, sales-tax “holidays” for consumers and a modest reduction in the state’s corporate income tax. In remarks unveiling the proposed tax cuts, Scott suggested that lawmakers who had campaigned on calls for smaller government should rally behind his package. “Most people, when they run for office, they always talk about how they want to reduce taxes. This is their chance,” Scott said. But Scott used a narrow reading of a forecast of state revenues to make his case that the Legislature could afford the tax cuts. That raised questions about how easily the proposals could be sold to lawmakers already thinking small about the budget year that begins July 1. The largest portion of Scott’s proposal would reduce a sales tax on business leases by $454 million, cutting the tax by 25 percent. Scott noted Florida is the only state with such a tax. The governor also would offer a series of sales-tax holidays at a cost of $98 million. The biggestticket holiday, at $72 million, would provide a 10-day period when Floridians could make back-to-school purchases without paying sales taxes. Another $51 million proposal would go toward tax breaks on books, the majority of it providing for a sales-tax exemption for college textbooks. The rest would be for book fairs. Also, Scott would raise the exemption on the corporate

income tax from $50,000 to $75,000 — at a total cost to the state of $15 million. After the increase in the exemption, the third of Scott’s tenure, more than 80 percent of the state’s businesses would not owe corporate income taxes, according to the governor’s office. Business groups quickly endorsed the package. Randy Miller, the president and CEO of the Florida Retail Federation, said his organization “is excited about what the governor’s tax cut package will mean for growing Sunshine State businesses, creating new jobs for Florida families and ensuring our state remains competitive.” Legislative leaders were more measured. A spokeswoman for Senate President Joe Negron said Scott’s proposals would be weighed along other ideas for tax relief. “The Senate president gives great consideration to any proposal put forward by Governor Scott,” the spokeswoman said in an email. “In the coming weeks, Senate committees will discuss a broad range of tax cut options, including those outlined today by Governor Scott.” Lawmakers have cautioned that budget writers will need to be careful with the spending
plan for next year, given that the state’s financial picture is tightening. Corcoran has gone as far as to say that when all factors are accounted for, the Legislature might face a shortfall by the time it returns to session March 7. Scott pushed back on that narrative, emphasizing the state will bring in $2.8 billion more in the coming budget year than it will face in year-to-year expenses. But Scott’s figure excludes expected increases in funding for education and health care, some of it driven by an increased demand for state services. A three-year forecast of state revenues prepared this summer said the surplus would likely only amount to about $7.5 million, though economists later added about $141.9 million to their estimate of general revenues. The forecast accounts for a three-year average of tax cuts approved by lawmakers, but that number would be far exceeded by Scott’s lease-tax proposal alone. Legislative leaders also are troubled by the forecast’s predictions about the future, with a shortfall of $1.3 billion projected the year after next and a gap between expected revenues and spending of nearly $1.9 billion in the third year of the forecast.

ings of 28 cents a share for the first quarter of fiscal 2017, which ended Dec. 31. The company earned 42 cents a share in the first quarter of fiscal 2016, but last year’s results included a 31-cent gain from a settlement with BP in the 2010 Deepwater Horizon oil spill. Revenue for the quarter fell 2.1 percent to $28.8 million but expenses also fell, so operating earnings increased.

However, the company’s operating profit jumped 39.5 percent to $7.8 million. “We think that’s an excellent accomplishment given the hurdles we faced during the year,” Chief Financial Officer John Milton said. Patriot made two small acquisitions of trucking businesses in Tampa and Asheville, N.C., last year and is looking for more opportunities to grow. The state university system is advancing $125 million in proposed construction and maintenance work that could be bolstered by a $283.5 million list of supplemental projects. The system’s Board of Governors, meeting at Florida Polytechnic University in Lakeland, is scheduled today to review the proposal for the next academic year. University leaders are fashioning the 2017-18 Public Education Capital Outlay, or PECO, proposal against the backdrop of a state budget with limited resources. The primary list includes $65 million for eight construction projects at seven of the state universities and $60 million in maintenance funding shared by all 12 state universities. The proposal is modest compared to the $142 million in university projects and $62 million in maintenance funding the Legislature approved last year, although that list was pared when Gov. Rick Scott vetoed over $53 million in university and state college projects from the 2016-17 state budget. The new proposal, though, would allow the Legislature to add more university projects from a supplemental list that includes 16 projects with an annual $283.5 million cost. But the supplemental list drew debate Wednesday from the board’s Facilities Committee, with member Wendy Link questioning why the supplemental list did not include all the projects that had been reviewed by the board. She said the $285.3 million total was arbitrary, after being told some projects had been dropped from the list. “It reeks of something that does not smell very good,” said Link, who voted against the supplemental list. Tom Kuntz, chairman of the Board of Governors, said the primary PECO list was the “real request,” with the supplemental projects providing the Legislature, which has the ultimate authority to decide what will be funded, more options. Lawmakers will consider projects during the legislative session that starts March 7. One purpose of the supplemental list is to give university advocates a way to keep additional projects up for consideration under a new House budget procedure. By being on the list, the projects may not need to be filed as separate bills, which would allow the projects to remain under consideration during final budget negotiations. “We have given the Legisla-

The major projects on the “primary” PECO list include $16.6 million for the University of South Florida’s Morsani medical facility in Tampa; $14.5 million for Florida State University’s earth ocean atmospheric sciences building; $11.85 million for a STEM-life sciences building for Florida Atlantic University in Jupiter; and $8.6 million for a nuclear sciences building at the University of Florida. All the projects have required multiyear funding. For instance, the $8.6 million for the University of Florida building would represent the final year funding for a $55.4 million project. New College of Florida, the state’s smallest institution, has two projects on the primary list, including $1.85 million to complete a $9.7 million addition to a natural-sciences building and $4 million to begin planning a “multipurpose” building on the Sarasota campus. The multipurpose building represents the start of a plan to boost the school’s enrollment to about 1,200 students, which will help increase the school’s diversity and is part of an effort to move New College to the upper tier of liberal arts colleges in the nation. The top project on the “supplemental” PECO list is actually $10 million in additional maintenance funding for the universities. The top-ranked construction project is $25 million for an applied research center for Florida Polytechnic. Last year, the Legislature approved a $625 million PECO program, which also included construction and maintenance funding for the 28 state colleges and the public-school system. The funding included $350 million in cash and $275 million in bonds. The size of this year’s PECO program will be impacted by a decision about whether to use bonds again.
