Wawa scouting sites in St. Johns
Wawa Inc. is actively seeking sites in St. Johns County for its gas stations and convenience stores, expanding from its initial search of Northeast Florida locations in Duval and Clay counties. Brian Duke, regional real estate manager for the Pennsylvaniabased chain, said Wednesday that Wawa initially is interested in two to four St. Johns County sites. He told attendees at the International Council of Shopping Centers North Florida Idea Exchange that Wawa considers the Northeast Florida area a 30-40 store market. He said later Wawa thinks Duval County could accommodate 20 to 24 stores and Clay County would have six or seven. Duke Nassau County isn’t in review now, but sites rely on traffic and population. Duke announced Wawa’s intentions to go “all in” within Northeast Florida at last year’s ICSC meeting. The company rolled out its initial plans in June. He said Wednesday the first three area stores would open by year-end, although he didn’t identify the locations. At least another 10 will open in 2018 and then two to four stores would open annually after that. Duke told the group that nine locations are under contract in MATHIS CONTINUED ON PAGE 2

It’s been a long road, but the destination is in sight. The project to revive the Barnett Bank building and the Laura Street Trio Downtown that was unveiled nearly seven years ago is $4 million away from reality. The Downtown Investment Authority approved Wednesday its $5.8 million share of a $9.8 million incentives package that would complete the financial side of the $90 million historic preservation and reuse project. “You just kept bouncing back,” said authority Chair Jim Bailey to Steve Atkins, principal of SouthEast Development Group, who first presented the project in 2010 at a ceremony in former Mayor John Peyton’s office. “Let me tell you how long I’ve been working on this,” Atkins said after the incentives were approved. “When I started, my daughter was in
second grade. Now she’s in high school and looking at colleges.” The key to moving the project forward is Atkins’ partnership with Las Vegas-based The Molasky Group of Cos. Molasky last week reached an agreement to buy the Barnett building from Stache Investments, Jacksonville Jaguars owner Shad Khan’s venture capital firm. Atkins borrowed $3 million from Stache in 2013 to purchase the building, but last July the court ruled in favor of Khan’s company in a foreclosure action after Atkins didn’t make payments on the loan. In addition to $4 million from the Downtown Historic Preservation and Revitalization Trust Fund, the authority approved a $1.8 million Recapture Enhanced Value grant — a rebate of 50 percent of the property taxes generated by the project for 20 years. Gate Petroleum Co. and Gatlin Development Co., both based in Jacksonville, are launching the 80-acre Pavilion at Durbin Park within the much larger Durbin Park project. The initial 700,000 square feet of development will include WalMart Supercenter and Home Depot, along with more than 350,000 square feet of retail, restaurant and junior anchor-tenant uses. Bondi’s office to decide whether to retry the case By Marilyn Young Editor The Florida Supreme Court denied a request Wednesday by the Attorney General’s Office to review an appellate court’s decision that granted Kelly Mathis a new trial. The former Jacksonville Bar Association president was sentenced in February 2014 to six years after being convicted by a jury of 103 gambling-related charges in the Allied Veterans of the World case. Last October, the 5th District Court of Appeals threw out the convictions because the Seminole County trial judge did not allow key testimony that would have supported Mathis’ defense. His defense attorney Mitch Stone said Wednesday he Mathis expected the Supreme Court’s decision. “We did not think the state had sufficient grounds to take it to that level,” he said. What did surprise him was how quickly the court made its ruling. Mathis’ appellate team filed its response Jan. 9 to the state’s request for the court’s intervention. Stone said the Attorney General’s Office has 90 days from the date of the mandate to the trial court to decide whether to retry Mathis. If that occurs, Stone would APPEAL

The Pavilion at Durbin Park will be developed with national tenants, outparcels, junior anchors and small shops. It is the first phase of the larger Durbin Park. as well as keep sales tax dollars local and support countywide programs and services. The first phase, estimated at a $125 million investment, is expected to start opening in 2018 and be completed in 2019, Gatlin said. He said about $10 million of infrastructure work has been let and the clearing and grading have begun. Pads should be delivered by midyear. Gate expects to open a store and Gate Express Carwash at the site in the first quarter of 2018, Gatlin said. He declined to identify the other stores and restaurants in negotiation for the Pavilion, although the location lends itself to the many retailers that locate in major shopping centers. The Shopping Center Group is the leasing representative. The Pavilion is the first phase of the 1,600-acre Durbin Park,

Florida 9B is on target for completion, providing more access to Durbin Park. The first phase of big box, junior anchors and other stores will lead to development of the second phase, which will feature the long-awaited Bass Pro Shops as well as more department and specialty stores, higher-end retailers and entertainment, such as a theater. While layouts can change, Duke said, each store would offer the same experience, focusing on coffee, hoagies and smoothies, as well as its staple — fuel. According to Wawa, it serves more than a million customers a day throughout the chain, annually serving 195 million cups of coffee and 110 million made-toorder sandwiches and hoagies.
That works out to more than 500,000 cups of coffee and 300,000 sandwiches daily. Duke said Wawa continues to look at the I-95 and Florida 9B corridor south of Jacksonville. “As Jacksonville and Northeast Florida continue to grow, we’ll be right there,” he said. Two years after spinning off its transportation business and turning its focus to commercial real estate, FRP Holdings Inc. may go one step further and convert the company into a real estate investment trust, or REIT. But the final decision on whether to convert will have to wait until new tax policies come out of Washington, D.C. At Wednesday’s annual shareholders meeting at The River Club Downtown, Executive Chairman John Baker said FRP may not follow through with the REIT conversion if there is a drastic drop in corporate tax rates, as President Donald Trump advocates. On the other hand, he said, “If the rates don’t go down, we’ll definitely do it.” REITs are real estate companies that pay out most of their earnings to shareholders in the form of dividends. The company doesn’t have to pay federal income tax on those earnings before they are passed on to stockholders. That’s why the conversion is advantageous if tax rates remain high. company from Florida Rock Industries Inc. in 1986 and has never paid out cash dividends. The company also had a trucking business that was spun off into a Baker separate company called Patriot Transportation Holding Inc. in 2015. FRP already took one step toward REIT conversion by changing its fiscal year. It has historically ended the fiscal year on Sept. 30 but is now changing its fiscal year to coincide with the calendar, which is required for REITs. Although the fiscal year has been changed, Chief Financial Officer John Milton said that doesn’t mean any decisions have been made on the conversion. “We’re strictly creating optionality,” he said. Because of the new fiscal year, FRP on Wednesday reported earnings for the three-month transition period that ended Dec. 31 of $1.7 million, or 17 cents a share. That was 77 percent lower than
earnings in the same period of 2015, but the 2015 results included two one-time gains. Without those gains, operating profit rose 11.2 percent. “All told, we’re still going in the right direction,” Milton said. Jacksonville-based FRP traditionally has developed office and industrial properties, mainly in the Baltimore-Washington, D.C., area. However, the company last fall completed the first phase of a multiuse project along the Anacostia River, adjacent to the Washington Nationals’ baseball stadium, which includes retail space and 305 residential units aimed at millennials. FRP President David deVilliers said Phase 1 was completed ahead of schedule and the company is working on Phase 2, which will include 250 to 270 apartments. “We’re really proud of that program,” deVilliers said. Baker said FRP has come a long way since its creation in 1986. “It’s been a neat program to see this company evolve and begin to throw off income,” he said. mbasch@jaxdailyrecord.com

be allowed to present evidence, including testimony from legislators and lawyers who agreed the Allied Veterans of the World internet cafes legally operated under the state’s sweepstakes law. “This time there will be a lot more that we can do,” he said. “No stone will be left unturned.” Statewide Prosecutor Nick Cox, who tried the case against Mathis, issued a one-sentence statement Wednesday: “The Office of Statewide Prosecution is reviewing our options at this
time.” Mathis was allowed to remain free after his conviction, during the appeals process. His Florida Bar license has been suspended since shortly after the jury’s verdict. Mathis was the only one of 57 defendants in the Allied Veterans of the World raid who went to trial. The others either accepted plea agreements or had their charges dismissed. Mathis said early on he would not agree to a plea agreement.
Prosecutors said Mathis was the “mastermind” in what they described as a $300 million illegal gambling operation hiding under the guise of a nonprofit that helped veterans. The Allied Veterans of the World case also helped spur the resignation of former Lt. Gov. The city will not transfer any of the funds to the developers until the work is complete and the occupancy certificate has been issued. “No public funds are at risk during construction. This is being led by the private sector, If they don’t perform, it’s not paid out,” said Aundra Wallace, DIA CEO. City Council will now consider an ordinance for a $4 million redevelopment grant that would green-light construction. When completed, the Barnett Bank building will have a bank, office and retail space and about 100 market-rate apartments. The Laura Trio will be transformed into a Courtyard by Marriott hotel, bodega market, café, restaurant, rooftop bar and retail office space. A 550-space parking garage also is part of the project, to be built by the developers at a cost of $11 million on property the city owns at Adams and Laura streets. The city will operate the garage and lease 250 spots to the developers, leaving the remaining 300 for other customers. The Molasky Group was established in 1951 and specializes in build-to-suit projects for the commercial, governAtkins ment and residential markets. In the past 15 years, the company has completed 2.2 million rentable square feet of office space, developed 425,000 square feet of special use rental space and 850,000 square feet of retail space, according to molaskyco.com. The Barnett Building and Laura Trio comprise about 320,000 square feet. Deciding to take on the largest historic preservation and adaptive re-use project in Jacksonville history was due to Atkins’ enthusiasm for the project and the development opportunity, said Matthew Connolly, senior vice president of development for Molasky. He said he heard about the project soon after he met Atkins at a developers conference in 2015 and “within a few minutes you could see the grand nature of those buildings.” Connolly, who works in Molasky’s Atlanta office, said another factor was the timing for the project was perfect, and it meets the company’s intent to expand its presence in the Southeast market. “And we like unique, complex projects. This is certainly that,” he added. Legislation for the remaining $4 million grant could be introduced to council as soon as Feb. 14.
The deputy’s dashcam video showed a dark-colored pickup truck traveling down a Clay County road in the early morning hours. That much is clear. But what the video captured — and how it should be used in a drunken driving case — sharply divided the Florida Supreme Court this week and even led to a copy of the video being embedded in the majority opinion. The case centered on a question about whether a circuit judge should have used the video in overturning an administrative hearing officer’s decision that backed the suspension of Joseph Wiggins’ license for driving under the influence. The circuit judge reviewed the video and found it refuted a deputy’s arrest report and testimony about the traffic stop of Wiggins. The 1st District Court of Appeal, however, ruled the circuit judge didn’t have the legal authority to reweigh such evidence in the case — a decision that prompted Wiggins to take the dispute to the Supreme Court. In a 23-page opinion Tuesday, the five-member Supreme Court majority backed the circuit judge’s decision to use the video evidence and pointed to the technological changes that have occurred in police work. “We respect the authority and expertise of law enforcement officers, and thus rely on an officer’s memory when necessary,” said the majority opinion, written by Justice R. Fred Lewis and joined by Chief Justice Jorge Labarga, justices Barbara Pariente and Peggy Quince and Senior Justice James E.C. Perry. “But we would be remiss if we failed to acknowledge that at times, an officer’s human recollection and report may be contrary to that which actually happened as evinced in the real time video. This is the reality of human imperfection; we cannot expect officers to retain information as if he or she were a computer,” the ruling said. Therefore, a judge who has the benefit of reviewing objective and neutral video evidence along with officer testimony cannot be expected to ignore that video evidence simply because it totally contradicts the officer’s recollection. Such a standard would produce an absurd result,” the ruling added. But Justice Charles Canady, in a dissent joined by Justice Ricky Polston, disputed the majority’s interpretation of what was shown on the video. He said the deputy’s “testimony and the video are competent, substantial evidence that support the hearing officer’s findings.” The Supreme Court only iden-

Also, the dissent said the circuit judge improperly waded into the detailed evidence in the case. “Instead of simply determining whether there was competent, substantial evidence in the record to support the hearing officer’s conclusion that the stop of Wiggins was lawful — which the circuit court conceded that Deputy Saunders’ testimony and report provided — the circuit court applied the wrong law, incorrectly concluded that the video conflicted with Deputy Saunders’ testimony and report, and substituted its judgment for that of the hearing officer as to the relative weight of the supposedly conflicting evidence,” Canady wrote. But the two sides of the court offered vastly different views of whether the video showed Wiggins driving erratically, leading to the deputy pulling him over. “The dashboard camera on Saunders’ vehicle recorded Wiggins’ driving pattern from the time Saunders first saw the vehicle to the time Wiggins was stopped,” Lewis wrote in the majority opinion. “As Saunders trailed Wiggins’ vehicle that night, the video showed Wiggins driving totally within the proper lines. Wiggins did not cross any lines, nor did he nearly hit the curb. Wiggins did change lanes only once in an apparent attempt to clear the lane for Saunders, but he utilized his turn signal before doing so,” he continued. “Wiggins then activated his turn signal to move into a left turn lane, braked in preparation to turn at a traffic light, and made a normal left turn once the traffic light turned green. As Wiggins turned left, Saunders activated his emergency lights,” Lewis wrote. But that isn’t what Canady saw. “What Deputy Saunders described in his narration can be seen on the video,” Canady’s dissent said. “Wiggins was not driving within the proper lines but was repeatedly driving on or over the fog line, nearly hit the curb on multiple occasions, and was drifting within his lane. “The video shows that Deputy Saunders observed this driving pattern for several minutes before initiating a traffic stop. The video also clearly shows that just prior to the initiation of the traffic stop, Wiggins passed an opening for a left-turn lane and then slowly drifted over a solid white line into the turn lane before turning left,” he continued. “Additionally, Deputy Saunders testified and wrote in his report that Wiggins was driving 30 mph in a 45-mph zone and that these observations occurred at approximately 2:10 a.m.”
