Insetta bringing Bellwether Downtown
Restaurateur Jonathan Insetta’s newest venture Downtown will be called Bellwether and should open by early April. Work is taking place behind the walls on the street level at 100 North Laura, the 10-story building at Laura and Forsyth streets. Insetta’s group — which also owns Orsay, Black Sheep Restaurant and BLK SHP at Intuition — says on the bellwetherjax.com website, “This casual yet sophisticated restaurant will offer an eclectic mix of timeless fare for lunch and dinner.” It will feature outdoor dining, a full bar and private dining options. Bellwether will open in the former Midtown Deli space, which is undergoing significant renovations. Insetta is president Insetta of Black Sheep Restaurant Group Inc. Orsay is in Avondale, Black Sheep is in Five Points and BLK SHP operates in Intuition Ale Works near the sports complex. He said Wednesday that a bellwether is the leader of a herd of sheep. “And we really liked the idea behind it and the way it looked in print, as well,” he said. When restoring and preserving an historic building, don’t be surprised if the project turns out to be more involved and costly than first expected. That’s the case with the Florida Theatre facade improvements project that was finished in January. Originally budgeted at $334,000, a bill is moving through City Council committees to appropriate an additional $150,000 for work that included cleaning and restoring the exterior terracotta, caulking and grouting, as well as replacing some of the architectural elements on the seven-story, 90-year-old building, which is owned by the city and listed on the National Register of Historic Places.
Council approved the project in May 2015, along with a $75,000 grant from the Capital Improvement Program. The state Division of Historical Resources contributed a $150,000 grant, $50,000 was drawn from the Downtown Historic Preservation and Revitalization Fund and the Downtown Investment Authority voted to contribute up to $75,000 from its economic development fund. The appropriation currently being considered would come from the city’s Facilities Capital Maintenance account. “There were no surprises with patching, repairing and restoring the terracotta,” said Mitchell McDaniel, president of McDaniel Contractors, which handled the project. Though the Florida Legislature’s session doesn’t begin until March 7, Realtors and homebuilder associations are busy laying the foundation for the agendas they’ll promote. The chief concerns in the state’s real estate and construction industries focus on taxes, workforce and regulations. “Workers’ Comp. Workers’ Comp. Workers’ Comp,” said Douglas Buck, the director of governmental affairs for the Florida Home Builders Association. “Any insurance rate increases are a real, direct cost to everyone.” Since 2003, the construction industry has seen its workers’ compensation rates trend downward after the Legislature passed a bill to base lawyer fees in cases

on the amount of the defendant’s award. But that changed after an April ruling by the Florida Supreme Court that awarded attorneys an hourly rate for their work. The state assigns individual workers’ compensation rates to more than 600 professions. Hines announced Wednesday it broke ground on what it has branded Southside Quarter, a 105acre mixed-use property along Gate Parkway at Interstate 295 and Butler Boulevard. It will include office, residential, hotel, retail, commercial and other uses. Hines also released preliminary design and site plans for the first Class A build-to-suit office sites that are available for corporate tenants. The international real estate firm said office sites in the first phase include up to two 125,000-square-foot buildings with signage opportunities and parking. Southside Quarter is designed so residents, visitors and employees can walk to their destinations within the development. Hines said more announcements are pending for the residential and other sites. Some parcels are available for retail, high-density single-family residential, commercial, hotel and additional office uses. The development is at southwest I-295 and Butler Boulevard, south of St. Johns Town Center. Hines called the location “the epicenter of Jacksonville’s key entertainment, retail, transportation and employment areas.” The company is working with RTKL Associates, engineering firm, ETM, and the city to develop a master plan. It set up the southsidequarter. com site to provide more information. In early February, Hines submitted building plans to the city for a proposed 306-unit apartment community on 11 acres. on the building wasn’t fastened to the structure as securely as it should be. Making those improvements extended the scope of the project beyond just cleaning and sealing and into rehabilitation. McDaniel said 100 years ago, when terracotta was a popular veneer material for buildings, it usually was fastened to the frame of the structure. But that didn’t happen when the theater and office building was constructed. “There wasn’t really anything to anchor the terracotta,” he said. And about 200 bricks on the northeast and northwest corners of the building had to be replaced, McDaniel said.

JCCI successor ‘more necessary than ever’ Much like the typical Jacksonville Community Council Inc. studies of the past four decades, the evolution of the citizens group to succeed it is a work in progress. JCCI, formed in 1974 to tackle critical topics facing the area, transitioned Wednesday to the Citizen Engagement Pact of Jacksonville. Kevin Hyde, the immediate past JCCI board chair, and J.F. Bryan IV, a director and the 2013 chair, told a group gathered for the news the pact will comprise area organizations who want to continue the work. The announcement was at WJCT Studios, where JCCI had most recently leased space. Specifics were few because the concept is new. Hyde emphasized the need for citizen engagement to identify, study and recommend change about important community issues. JCCI has produced 80 reports. Hyde cited the foresight of the 2009 study chaired by Bryan. That report, “Our Money, Our City: Financing Jacksonville’s Future,” recommended pension reform, an example Hyde used

Hyde and Bryan will serve for now as the organizers and are working with the Burdette Ketchum media agency. Hyde said he will convene the groups in March that are expressing interest.

“It’s beginning to coalesce now,” he said. How the pact evolves depends on those who take steps to participate. Historically, JCCI would host and staff the scheduled group meetings at which citizens would study a topic, make recommendations and draft the report. JCCI staff would work with study leaders to put the final report together and help guide the volunteer group to implement the findings. Hyde and Bryan said the pact’s studies will depend on the hosting organization. Bryan said an organization could hire a consultant to staff a study, for example. The primary reason JCCI is no longer operating is money, which is why the pact will comprise organizations that can fund the work.
Bryan said JCCI itself might be phased out as an organization at the end of the year, although Hyde, a partner with Foley & Lardner LLP, said he was evaluating that. The University of North Florida has archived JCCI’s work. Some studies are on the jaxpact.org site, and the jcci.org site also posts many. Hyde and Bryan sent a letter last week to Mayor Lenny Curry’s Chief Staff Kerri Stewart that explained the pact. The letter said the framework

El Jefe could be next restaurant in Murray Hill
Chef Scott Schwartz, owner of 29 South Restaurant in Fernandina Beach, intends to open a new concept in Murray Hill. Schwartz declined to provide details about the menu, pending a news release expected next week. Public documents show the restaurant will be operated by El Jefe Jax LLC, led by Schwartz and Bradley Walters. El Jefe is heading to 947 Edgewood Ave. S. in Murray Hill, a rejuvenating Westside neighborhood that blends vacant buildings, established businesses and trendy hangouts. The proposed 158-seat fullservice restaurant is planned in about 4,000 square feet facing Edgewood Avenue in the former Curry Thomas Hardware building, according to documents and the landlord. “I love Murray Hill and all of the great restaurants and shops that are established and coming soon and look forward to being a part of the community,” Schwartz said by email Wednesday night. It will open starting with lunch only. Dinner Thursday-Saturday and brunch Saturday-Sunday come later. Insetta said there also will be a private dining room as well as delivery with a corporate catering menu. Bellwether will seat 120, with the private dining room having capacity for 40. That area also can be for regular seating. It will offer a full bar with draft beer, wine and craft cocktails. A daily happy hour is planned. Insetta said the bar program will be similar to that at Black Sheep. Bellwether brings Insetta’s culinary focus back Downtown. He formerly operated Chew restaurant at 117 W. Adams St., which closed in January 2012.

Zoning applications were filed for a 158-seat restaurant to take vacant space at Edgewood Avenue and Post Street. the group behind Bullbriar Restaurant LLC, which proposes to operate in the Marble Bank building Downtown after it is renovated. Schwartz said Bullbriar appears to be moving through the City Hall process as City Council considers incentives to help redevelop the Laura Street Trio and Barnett Bank building. The Marble Bank is part of the trio at Laura and Forsyth streets. “We are excited about getting started on this project,” he said. He will be operating in both Fernandina and Jacksonville. The vacant Curry Thomas Hardware space is owned by Glocal Lee LLC. The building is at Edgewood Avenue and Post Street. Glocal Lee has applied for a zoning exception to serve alcohol outside; a waiver to reduce the required minimum distance between a liquor license location and a church or school; and
an administrative deviation to reduce the number of required off-street parking spaces from 45 to 35 in a shared lot. “The addition of an established business-owner with a novel restaurant to the area will diversify dining options,” the deviation application said, “contributing to both the walkability and the appeal of the neighborhood as a whole.” The waiver application notes there are existing liquor licenses in the immediate vicinity of the property and that most are closer to the churches. Building owner Maxwell Lee said Glocal Network will maintain ownership of the property and lease to the restaurant. Stand your ground shift moves in House
Senate version already cleared committees By Jim Turner The News Service of Florida A move to shift the burden of proof in stand your ground selfdefense cases is off to a fast start in the House, where the controversial proposal died a year ago. The House Criminal Justice Subcommittee, voted 9-4 along party lines Wednesday to approve the National Rifle Association-backed measure (HB 245), which would shift the burden of proof from defendants to prosecutors during pretrial hearings in stand your ground cases. The bill, sponsored by Rep. Bobby Payne, R-Palatka, and Rep. Jason Fischer, R-Jacksonville, only has to clear the Judiciary Committee before reaching the House floor during the annual legislative session that starts March 7. A Senate version (SB 128) has cleared its committees and could be one of the first bills approved by the full Senate next month. The proposal stems from a Florida Supreme Court ruling in 2015 that said defendants have the burden of proof to show they should be shielded from prosecution under the stand your ground law. In stand your ground cases, pretrial evidentiary hearings are held to determine whether defendants should be immune from
Fischer prosecution. Payne said the bill would strengthen the self-defense law and that concerns by critics are “certainly overstated.” “It does not protect those that are creating some type of felony or assault,” Payne said after Wednesday’s meeting. “That is not what self-defense is for.” Opponents maintain the change would end cases before all the facts are revealed and contend that the stand your ground law has disproportionate effects, as it is used more successfully as a defense when white shooters kill African-Americans. But Rep. Gayle Harrell, a Stuart Republican who was in the House when the stand your ground law
was approved, said the proposal meets the intent of lawmakers who crafted the law in 2005. “It’s a shame that we have to come to this point of having to clarify, but I believe that that was the case,” Harrell said. Meanwhile, Rep. Jared Moskowitz, D-Coral Springs, said he could support the change if it were more narrowly defined to situations where there is “overriding evidence.” But he expressed concerns about people who may use the defense when the only witness was killed in the encounter. “It’s blanket immunity and then we’re saying to the prosecution, ‘You have to undo that immunity if you have enough evidence,’ “ Moskowitz said. “And, ‘Oh by the way you have to do it at a pretrial hearing,’ when usually all witnesses may not have been identified and all the evidence may not have been gathered at that point.” The proposed change, which is supported by the Florida Public Defender Association, was approved by the Senate in a 24-12 vote last year, but failed to advance through the House committee process. New House leaders, however, appear to have put this year’s version of the bill on the fast track.
Judges look at Sunshine Law issues in workers’ comp case By Jim Saunders The News Service of Florida An appeals court weighed arguments Wednesday about whether Florida’s Sunshine Law was violated before regulators last year approved a 14.5 percent increase in workers’ compensation insurance rates. A three-judge panel of the 1st District Court of Appeal did not issue a ruling. But its decision will have high stakes: A Leon County circuit judge said in November that the rate increase should be rejected because of Sunshine Law violations. The case, filed by James F. Fee Jr., a Miami attorney who represents injured workers, focuses heavily on the inner workings of the National Council on Compensation Insurance, an organization that files rate proposals with the state for insurers. Leon County Circuit Judge Karen Gievers ruled the organization, commonly known as NCCI, did not comply with legal requirements about holding pub-
lic meetings during its deliberations on the rate increase. She pointed, in part, to a state law that requires open meetings when rating organizations, such as NCCI, hold committee meetings to discuss workers’ compensation rate changes. But James McKee, an attorney for NCCI, told the appeals court Wednesday the organization in 1991 disbanded a committee that dealt with rates and that the work was done by an actuary. As a result, he said the organization did not violate public meetings requirements. “If a committee does not exist, there is nothing to apply the Sunshine Law to,” McKee said. But John Shubin, an attorney for Fee, cited meetings the actuary, Jay Rosen, had with other staff members at NCCI and said that effectively was the same as the activities of the disbanded committee. Shubin then said Rosen was “doing exactly what the classification and rates committee was doing.” In questioning the attorneys,
the appeals court judges at times seemed skeptical the Sunshine Law had been violated. As an example, Judge Lori Rowe appeared to draw a distinction when she asked McKee about whether the disbanded committee had been made up of insurance company representatives and whether it had been eliminated because of anti-trust reasons. McKee responded a short time later by saying the committee was not disbanded to avoid complying with the Sunshine Law. “These types of committees were disbanded nationwide at the same time,” McKee said. Workers’ compensation insurance has re-emerged as a major issue since last spring, when the Florida Supreme Court issued a pair of rulings that found parts of the workers’ compensation system unconstitutional. Those rulings, including a closely watched decision that found caps on attorneys’ fees unconstitutional, led to NCCI filing a proposed 19.6 percent rate increase.

will be a significant part of their legislative agenda. “Expanding the workforce is an issue that’s been around a while, but this year it’s higher up on the list because we’re seeing a recent surge in demand,” said Felix Beukenkamp, chair of the National Home Builders Association’s governmental affairs committee and manager of BBG Design-Build LLC. He and others formed a workforce task force, including lawmakers, to tackle the task of rebuilding the residential construction workforce after what he said was an exodus of qualified labor following the housing market collapse in 2008. Builders associations also are seeking a reform of how the state adopts its building code, known as the International Building Code. Every three years, the code must go through a laborious process to be amended. “We’ve got a dilemma here in Florida because of our large coastline and geography, we need special codes,” Beukenkamp said. “A lot of that is driven by codes that reflect our exposure to natural disasters, winds, water and rain.” The builders association also is eyeing changes to homeowners’ association regulations, as well as a process known as “assignment of benefits.” That is where a homeowner can designate a third-party contractor — such as a water mitigation company after flooding — be paid directly by the insurance company. The process is susceptible to fraud, Beukenkamp said. As for Realtors, their agenda has three main points, according to Florida Realtors President Maria Wells, of Lifestyle Realty Group. The group’s first priority is the property tax cap on second homes. “The Legislature passed a bill in

2007 that created a 10 percent cap on increases to assessed values of non-homestead properties,” she said. “We want to make that permanent.” The second priority is what is known as the commercial lease tax or, as Wells calls it, “the business rent tax.” In this effort, Realtors have been joined by a large coalition of chambers of commerce and port groups. The tax charges a 6 percent fee on any business leasing commercial property. Florida is the only state in the country with such a tax. It’s been in effect since 1969. The elimination of the tax, Wells said, would allow small businesses to flourish and create more jobs by decreasing overhead. Finally, Florida Realtors is targeting estoppel certificates. The certificates serve as a certified promise the property has no outstanding fees against it, such as liens or association fees. “It’s something that is now required to be at the closing table to make sure the buyer isn’t inheriting any unknown fees — which is fair,” Wells said. “The problem is, Florida law says that you can charge a ‘reasonable fee’ to prepare it. “However, we are now seeing that some associations are charging the seller up to $1,000 for this piece of paper,” Wells said. The beginning of the legislative session, like baseball season, abounds with hope for those seeking to have their agendas at least make the playoffs. And for those involved in industries that have been as volatile throughout the last decade as the state’s real estate and residential construction markets have been, hope truly springs eternal. “I wouldn’t say we’re more optimistic or less this year,” Beukenkamp said. “I think we have to be perpetually optimistic because we’re builders and it’s a tough business.”

The engineering services provided shall include the preliminary design, 100% design, bid phase, and engineering support services during the construction and acceptance testing. The Southwest-5104 118th St.-Class III/IV Pump Station is located on 118th Street adjacent to Ringhaver Park and the Ortega River and discharges directly to the Southwest WRF approximately half a mile west on 118th Street. The pump station was constructed in the early-1970s and although improvements were made to the sewage pumping systems within the last five years, the majority of the other equipment and systems at the facility is the original equipment which has reached or is nearing the end of its useful life. Corrosion is excessive in many areas of the pump station facility including the influent splitter box, the wet well area, and within the electrical equipment in the Motor Room; accordingly, structural repairs and equipment replacement are necessary. Improvements are also necessary to replace non-functional or inefficient equipment including screening, influent and wet well flow control, and ventilation. Additional improvements are needed for safety including installation of guardrails along the raised loading dock areas.
