City wants to end civil rights suit Would pay $425,000 settlement, $25,000 fine over denying Springfield veterans center
By Max Marbut Staff Writer A settlement of $425,000, a fine of $25,000, a $1.5 million development grant and amending the municipal zoning code. Plus a new policy to make sure it doesn’t happen again. That’s what the city wants to do to make a lawsuit filed in federal court alleging housing discrimination go away. It started with the nonprofit
Ability Housing Inc.’s proposal to renovate a 12-unit apartment building in Springfield to create housing for chronically homeless and disabled people. Ability Housing later said it was for disabled and homeless veterans. When Ability Housing began in March 2014 the permitting process for the project to be funded with a state grant, the city found the project was a new “special use” that was prohibited by the
Springfield historic district zoning overlay. Ability Housing sued the city in November 2015, alleging it violated the Federal Fair Housing Act and the Americans with Disabilities Act for blocking the project that was intended to support people with disabilities. The suit was joined by Disability Rights Florida and the U.S. Department of Justice. After Ability Housing filed the complaint, the city ruled the orga-
nization ineligible to compete for Jacksonville Journey grant funding because of the pending litigation. Three ordinances related to the lawsuit are being considered by City Council to: • Amend the Springfield overlay and city zoning regulations to ensure compliance with federal law • Appropriate $425,000 for a settlement with Ability Housing and Disability Rights Florida to

cover the organizations’ out-ofpocket legal expenses and a portion of their attorney’s fees • Appropriate $25,000 for payment of a federal civil penalty The city also would be required to designate a fair housing compliance officer to oversee its compliance with federal housing regulations and provide ongoing fair housing and ADA training for city officers, elected and appointed officials and employees with Ability continued on Page 2
In light of CSX Corp.’s intention to cut 1,000 management jobs, it appears the Jacksonville-based company won’t need to lease space in the Bank of America Tower Downtown after all. CSX spokesman Gary Sease did not directly address the question of how the cuts would impact interest in that building, but it seems doubtful a deal would go forward. “Last week’s difficult decision to reduce our management workforce by approximately 1,000 positions has resulted in the need to reassess our Jacksonville headquarters office space needs,” Sease said by email. Most of those jobs will be in Jacksonville and will be cut by late this month. CSX’s management ranks comprise 2,500 people in Jacksonville and 4,500 managers systemwide. Through Jan. 6, CSX confirmed in letters to the city that it wanted to cut costs and move 550 jobs from leased space in Southpoint into the Bank of America Tower. CSX’s world changed Jan. 18 when news broke that Canadian Pacific Railway Ltd. CEO Hunter Harrison was leaving CSX

Record gift helps establishes JU’s Keigwin School of Nursing Jacksonville University’s nursing school bears the names of two longtime supporters, thanks to the largest donation in JU’s history. The newly established Keigwin School of Nursing was named in honor of Beverly and Jack Keigwin, pictured with JU President Tim Cost. The couple donated $3 million to the facility in what Jack Keigwin said was one of the most meaningful gifts he and his wife have given. He is a trustee and executive-in-residence at JU. Beverly Keigwin is a former nurse who serves on the external advisory board of JU’s Brooks Rehabilitation College of Healthcare Sciences.

TriBridge Residential started work at the end of February on a $49 million apartment community at Town Center Promenade, opposite St. Johns Town Center. Through TBR Town Center Property Owner LLC, TriBridge paid $6.8 million for about 9.06 acres at 4450 Tropea Way for construction of a 287-unit apartment community. It is expected to be completed in 24 months, said Katherine Mosley, TriBridge Residential vice president of development. TriBridge is partnering with Sefira Capital for the project. Joy Lee said she supports the settlement and even though Springfield Preservation and Revitalization Inc., the nonprofit neighborhood advocacy organization, does a great job, “we need housing for homeless mentally ill veterans.” Other speakers made a plea for more discussion of possible overlay changes. Thomas McCaffrey said he appreciates the city “protecting the neighborhood” but asked for time to properly vet the changes proposed in the settlement. SPAR Executive Director Christina Parrish-Stone said she accepts that the Springfield overlay probably needs to be amended, but “we want a thoughtful process.” Before the public hearing was closed Tuesday, council President Lori Boyer directed that the ordinances be deferred next week by the Land Use & Zoning Committee in order to give the Office of General Counsel, residents and the plaintiffs time to fully review the proposed zoning regulations and possibly make amendments. his job early. Harrison, backed by the Mantle Ridge hedge fund, is negotiating with the CSX board to take the CEO role. The job cuts surfaced Feb. 21 after CSX announced Chairman and CEO Michael Ward and President Clarence Gooden would retire May 31. Executive Vice President Fredrik Eliasson was named president, but no CEO was identified. Harrison is known for maximizing railroad efficiencies and reports peg his compensation request at $300 million. Mantle Ridge, which is working with Harrison, wants six of 14 seats on CSX’s board. Mantle Ridge controls 4.9 percent of CSX’s stock. CSX plans to schedule a special meeting to let shareholders decide if they want to accept Harrison’s and Mantle Ridge’s demands. That means it’s no surprise that CSX would put additional space considerations on hold. The expected lease of 120,000 square feet at the Bank of America Tower at 50 N. Laura St. would have made CSX its largest tenant. Owner Hertz Investment Group said the lease would have boosted occupancy from 70 percent leased to 85-88 percent. James Ingram, Hertz executive vice president and chief investment officer, could not be reached for comment Tuesday or Wednesday. CSX wanted the Downtown Investment Authority to work with Hertz to close the gap to make a lease work. That amount was $1.9 million over the seven-year lease. DIA CEO Aundra Wallace could not be reached Wednesday. In a Jan. 20 report to the city, Wallace said DIA staff had discussed job expansion opportunities with CSX but was waiting for the company to get back with the DIA. In Nov. 30 and Jan. 6 letters to the DIA, CSX Real Property Inc. President Richard Hood said, “CSX is under pressure to reduce its overhead costs company-wide.” It decided to consider consolidating operations that have occupied two adjacent buildings in Southpoint for more than 25 years and move them Downtown.

Ingram said assuming the parties can come to agreement on the final terms, the ordinance could come back to council for a vote on March 28, which would be plenty of time to meet the deadline. “Our hope is that our opponents will identify specific components in the zoning they want changed. We need specifics to determine whether the changes would allow the city to continue to discriminate,” he said. If his clients can’t come to terms with SPAR and the city, the settlement could be in jeopardy, Ingram added. “The consent order is based on Ability Housing and Disability Rights Florida accepting the final terms of the settlement. “If it’s unacceptable, they may proceed to trial,” he said. duties related to planning, zoning, construction, permitting, code enforcement or occupancy of housing. That includes the mayor, City Council, planning commissioners and members of the Certificate of Use Board. Also in the settlement is a requirement for the city to award a $1.5 million grant for development of permanent supportive housing for disabled people within one year following dismissal of the lawsuit. “The intent is to prevent discrimination,” said attorney Tom Ingram, who represents Ability Housing. Changing the overlay would put Springfield “on an equal footing with the other zoning districts” and would ensure “disabled people can live anywhere in Jacksonville,” he added. During a public hearing at the council meeting Tuesday, several speakers urged rejection of the proposed settlement. Springfield resident Charlotte Cudd characterized it as a “one-sided solution” and said if the settlement is approved and implemented, “treatment facilities can open in your neighborhood.” Christine Farley, a Springfield resident and member of the Springfield Improvement Association and Woman’s Club, said she fears if the zoning overlay is changed to allow more supportive housing development, it could again lead to “speculators and absentee landlords” that were prevalent there before the overlay went into effect nearly 20 years ago in an effort by the city to help revitalize the neighborhood. Fran Downing, who moved into Springfield before the overlay was adopted, said she remembers day-and-night foot traffic and a lot of prostitution and drug activity related to unlicensed lodging facilities such as boarding houses. “The police came out a lot,” she said. Not all residents of the neighborhood are against the settle-

CSX owns its Downtown headquarters buildings at 500 and 550 Water St. That’s likely where CSX could consolidate the Southpoint operations in light of the downsizing. The workers to be moved were in the company’s finance, technology, labor relations and corporate real estate organizations. Ingram said previously CSX would move by the middle of the first quarter of 2018 as the Southpoint lease expires in March 2018. Colliers International is marketing the structures leased by CSX at 6735 and 6737 Southpoint Drive S. Together, they provide 275,229 square feet of space. Colliers Executive Vice President Chuck Diebel said Wednesday the company continues to market the buildings to new tenants, having heard nothing different from CSX. He said he doesn’t know what CSX’s plans are for the functions in those buildings, but thinks they might move to the company’s Downtown locations. Dwell Design Studio of Alpharetta, Ga., is the architect and interior designer for the Town Center Promenade apartments planned by TriBridge Residential. TriBridge Residential Construction has applied for permits totaling $2.2 million to build the footings and foundations for the three-building community. Atlanta-based TriBridge Residential, a multifamily owner, operator and developer, has a Jacksonville area track record. It developed the Uptown project in St. Johns Town Center as well as the BluWater Apartments, Seagrass Apartments and Cottage at North Beach, which is under construction. The Promenade project is along the west side of Town Center Parkway between Brightman Boulevard and Midtown Parkway. TriBridge bought its site Feb. 7 from CPC Jacksonville SJTC LLC and CPC Jacksonville SJTC Hospitality LLC. The permit applications show the project team includes Dwell Design Studio LLC of Atlanta as the architect and interior designer and Prosser Inc. of Jacksonville as the civil engineer. Attias and Aby Galsky formed Sefira Capital in September 2015 to establish a Miami-based investment boutique platform to acquire and develop commercial real estate. Attias said the Town Center Promenade investment came after the group’s first three jointventure projects in the acquisitions of a Hilton Hotel in Cocoa Beach and the 170,000-squarefoot Cypress Point office park in Tampa, and the development of a self-storage facility in Naples.

On track for a midyear move, Aetna Inc.’s new offices at Gramercy Woods were approved for renovations. The health insurer will leave the Aetna Building on the Downtown Southbank for the Southside office park. The city issued a permit Monday for Gilbane Building Co. to renovate space at 9000 Southside Blvd. at a construction cost of $5.9 million. That follows a permit issued for almost $587,000 for interior demolition. Aetna announced in May it would leave the tower as its lease expires in late summer. It will leave 170,000 square feet Downtown and lease 133,503 square feet among six floors of the 10-story Building 100.

Circle K seeks permit at Southside and Beach
Circle K is preparing to build a gas station and convenience store at northwest Beach and Southside boulevards. The city is reviewing a building permit application for a 5,301-square-foot store at 8837 Beach Blvd. No contractor was identified on the application, which shows a construction cost of $800,000 for the store and a 6,622-square-foot gas canopy that would cover 10 fuel pumps. The application says the store will sell beer and wine for off-site consumption and will operate 24 hours a day. A mobility fee calculation certificate for the gas station and convenience store shows it would be on 2.05 acres and include 20 fueling positions. Tallahassee mayor says he’ll run for governor
Tallahassee Mayor Andrew Gillum became the first prominent candidate to jump into the 2018 governor’s race Wednesday, beginning a 17-month march to what could be a crowded primary for the nomination of the state’s struggling Democratic Party. “I can’t wait to be able to move forward a vision in this state that puts people to work at every rung on the income level,” Gillum said in a short video released by his campaign Wednesday morning. “That’s what I want to do for the state of Florida.” He also mentioned infrastructure and education in the largely autobiographical video, which runs nearly six minutes. If elected, Gillum would be the first black governor in Florida. But even before he has a chance to try to break the Democrats’ 20-year losing streak in gubernatorial races, he could have to navigate a primary featuring higher-profile candidates like trial lawyer John Morgan and former U.S. Rep. Gwen Graham. Gillum, 37, has been laying the groundwork for a statewide run for months. He laced into term-limited Gov. Rick Scott and Agriculture Commissioner Adam Putnam — a Republican front-runner for governor — in a speech to Florida Democrats at the party’s national convention last summer. And Gillum has become increasingly outspoken about progressive causes. But Gillum, who was elected mayor in 2014, comes from the state’s isolated capital city, nestled in a sparsely populated media

market. “He’s very well-known in his metropolitan area, but not very well-known throughout the rest of the state,” said Aubrey Jewett, a political-science professor at the University of Central Florida. Jewett said Gillum could gain an advantage by getting into the race early. It could also prompt Morgan, Graham and other candidates to consider their own timelines for decisions and join the fight for endorsements and campaign donations. “Once somebody jumps in, other potential candidates begin feeling a little more pressure to make their plans clear,” Jewett said. Alison Morano, a Jacksonvillebased Democratic strategist who has not decided whom to support in 2018, said she was glad that Gillum entered the race. She credited him with being a strong leader and a good listener. The GOP group also highlighted questions raised by Politico Florida about whether Gillum’s launch video was produced before he filed for governor — a potential violation of campaignfinance laws. “Florida’s next governor should be someone who will uphold the rule of law and uphold the public’s trust in its elected leaders,” the association said. “Andrew Gillum has already failed that test.” Other candidates have been ramping up their nascent campaigns. Gov. Rick Scott has tapped Bradenton homebuilder Carlos Beruff to chair the Constitution Revision Commission, a powerful post for the governor’s political ally who last year lost a Republican primary bid for the U.S. Senate to incumbent Marco Rubio. Announcing the appointment Wednesday, Scott praised Beruff — a wealthy businessman born in Miami to Cuban emigres — for living “the American dream in our great state.” “My goal for the CRC (the commission) is to fight for policies that will ensure a strong future for Florida, and I know Carlos also shares this vision. As we undertake this historic review, I am hopeful that this commission will propose policies that build a legacy upon which the families and businesses in our great state will thrive for generations to come,” Scott said in a statement. The commission, which meets every 20 years, is charged with crafting constitutional changes for voters to consider on the 2018 ballot. Beruff, 59, will be the first chairman who is not a lawyer and the first Republican to head the panel. Talbot “Sandy” D’Alemberte — a onetime president of the American Bar Association who also served as president of Florida State University — was chairman of the first commission in 1977. Attorney Dexter Douglass, a close ally of the late Democratic Gov. Lawton Chiles, held the post 20 years later. Scott policy director Jeff Woodburn, a lawyer who has worked in various capacities for Scott since shortly after the governor took office in 2011, will take over as the commission’s executive director, Scott’s office also announced Wednesday. Woodburn “has one of the sharpest policy minds of any person in this state,” and his “legal and policy expertise will be of tremendous value” to the commission, Beruff said in the announcement. Republicans took full control of the Legislature and the governor’s mansion in 1998. Scott, who is closely aligned with President Donald Trump and is mulling a run against U.S. Sen. Bill Nelson, could find himself on the November 2018 ballot alongside constitutional-amendment proposals that could help propel turnout among his GOP base. During his U.S. Senate race last year against Rubio, Beruff — a conservative who dumped nearly $10 million into his campaign — earned comparisons to thencandidate Trump. Beruff was an early supporter of Trump. Beruff earned national headlines for calling then-President Barack Obama “an animal,” a characterization Beruff denied was racist. And Beruff had harsh words for Rubio, who said during his unsuccessful 2016 presidential campaign that he wouldn’t run again for the Senate but later backtracked on the pledge. Rubio’s Senate primary victory drew a harsh rebuke from Beruff. “I made the miscalculation of taking Mr. Rubio at his word that he wouldn’t seek re-election if he lost the presidential primary,” Beruff wrote. “I guess I was silly to believe the words of a Washington politician.” He also chaired a commission created by Scott to look into public hospitals’ funding and spending and was appointed by the governor in 2008 to the Sarasota Manatee Airport Authority Board, a position he still holds. Scott will name his other 14 selections to the commission “in the coming days,” according to Wednesday’s statement. In addition to the governor’s appointees, House Speaker Richard Corcoran and Senate President Joe Negron — who has already announced his selections — each have the power to name nine members. Florida Supreme Court Justice Jorge Labarga recently named his three selections, including Jacksonville attorney Hank Coxe. Attorney General Pam Bondi is an automatic member of the 37-member panel.

The construction services are broken down into two (2) specific scopes described below. The first scope of work is the Northside Generating cooling water discharge basin is located in Jacksonville, FL. The scope work includes the erection of 478 linear feet of sheet piling per the Technical Specifications. A complete scope of work and technical specifications are provided in Appendix C. The second scope is the St. John’s River Power Park (SJRPP) Intake Structure is located in Jacksonville, FL. Notice To Proceed (NTP) for the NGS water discharge basin is expected to be issued upon completion of the SJRPP discharge piping relocation, which is currently in progress. Additionally, the Bid Form has an options provision if only first of the two (2) scopes can be performed this year that will allow the Bidder a second mobilization and a price adjustment on the sheet pile price. The pricing of the sheet piling will be broken out for tracking price adjustment. Should the project be split into two (2) mobilizations, the Bidder shall be allowed to charge the second mobilization fee and price adjustment on sheet pile materials.
