By Max Marbut Staff Writer While many business categories have been in decline during the past 10 years, the number of nonprofit organizations in Florida has grown by 80 percent to more than 83,000. The sector’s workforce has grown 40 percent to more than 530,000 people with an annual payroll of more than $26 billion, according to a report released by the Florida Nonprofit Alliance. “We did the survey to showcase the impact of the nonprofit sector and we’ll share that knowledge with elected officials

in Tallahassee and Washington (D.C.). We want to make sure they’re aware of the nonprofit sector in their districts,” said Sabeen Perwaiz, alliance executive director. The report combines data from charitable organizations (arts, philanthropic, health care and social services that exist for the benefit of the community or society) and non-charitable organizations such as business leagues, civic associations, chambers of commerce federal- and state-chartered credit unions and mutual insurance companies. United Parcel Service Inc. has leased the former Samsung building in West Jacksonville for additional package-processing capacity while its hub expansion is under development. The facility will be completed this fall in time for the holiday volumne surge. The 400,000-square-foot building is at 12400 Presidents Court in Westlake Industrial Park. “This will give us hub processing capacity while the construction of the Jax hub is underway,” spokeswoman Susan Rosenberg said by email. She said UPS will be able to use that extra processing capacity during the November-December holiday shipping season. Rosenberg, UPS public relations director, said the new portion of the Jacksonville hub will be partially open by fall 2018 but the full project won’t be open until fall 2019. UPS does not disclose the terms of its real estate contracts, she said, so the length of the lease was not available. Rosenberg said the interior build-out with conveyor systems at the Westlake building won’t be completed until the fall. She said UPS will shift some workers from the existing location in Westside Industrial Park while it is under construction as some tractor-trailer loads move to Westlake for processing. UPS

guys, two intelligent lawyers, two smart politicians … how once they became speakers of the Florida House they would invest so much time, money and intellectual and political capital in the battles they waged and are waging against the Florida Supreme Court justices and the state’s appellate court judges. We are referring, of course, to House Speaker Richard Corcoran and his efforts to place a

constitutional amendment question on the state ballot to impose term limits on Supreme Court justices and appellate court judges. And six years before Corcoran, after becoming speaker in November 2010, Dean Cannon tried mightily in the 2011 legislative session to split the state Supreme Court into two divisions, criminal and civil, and make it tougher for the justices

‘Gate University’ coming to Philips New Gate Petroleum Co. hires will soon be heading to “Gate University” along Philips Highway. The center is planned at 9100 Philips Highway, where the Jacksonville-based company will train its convenience-store employees. “The new space will allow a dedicated location for training, which is a critical component of our business to ensure our employees provide excellent customer service,” said Gate spokeswoman Misty Skipper. A building-permit application shows an estimated $500,000 project to renovate the space, among two floors. Duval County property records show the roughly 25,000-square-foot building is owned by Gate Fuel Service Inc. Those plans show Gate will use at least 5,500 square feet for the center, while existing tenant Stonecore will remain in the space it leases. Most of the Gate renovations will be on the second floor. Plans show two training rooms, a multipurpose room, a break room, work room, offices for the director and manager, and a mock-up store, all part of “Gate University.” Plans show the mock-up store will offer training, including for lottery machines and the fueldispensing station. The plans explain that the contractor will demolish the interior of the second floor to build the training center. There also will be a two-story addition with stairs, an elevator and two multipurpose rooms providing access to the center. The addition will include lobbies and multipurpose rooms. Skipper said “Gate University” has been used to describe the training program. Skipper said employees previously were trained in a dedicated center that has since been converted into a warehouse. After that, Gate trained employees in conference rooms at corporate headquarters, she said. Gate is based at 9540 San Jose Blvd. Current employees will take ongoing training at the center, too. The convenience store division has about 1,000 employees.

Skipper did not have a breakdown of how many work in the stores or how many are in Jacksonville. Plans also show that Stonecore, an existing tenant, will remain. It has an office, showroom and storage. The 9.5-acre site is along Philips Highway, south of Sunbeam Road. Property records show the structure was built in 1986 and bought by Gate Properties II Inc. in 2006. Gate Petroleum also applied to the city for a Certificate of Use to use the building for office and training space. It lists the enclosed size as 24,960 square feet. In other Gate news, the city approved the demolition permit Thursday for Realco Recycling Co. Inc. to demolish the Gate store at 9540 San Jose Blvd. Gate will redevelop the site with a larger store.

Dollar Tree headed to Shops of Philips Dollar Tree is the dollar store headed to the Shops of Philips, according to a St. Johns River Water Management District application. A recent city application indicated that Dollar General would open there, but the district filing specifies a 9,973-squarefoot Dollar Tree on a more than 1-acre site at 3100 Emerson St. The site is along Philips Highway, south of Emerson Street.

Shops of Philips is under development by Jacksonvillebased DBSB Inc., led by J.C. Demetree Jr. Thomas Engineering Group of Tampa is the agent and designed plans for Dynamic Commercial Real Estate Advisors, based in Virginia Beach, Va. DBSB is redeveloping a former call-center site. It demolished the building and designed a multi-parcel retail project. A Gate Petroleum Co. gas station and convenience store and a Wendy’s fast-food restaurant operate there. Gate also wants to build a car wash at the site. A mobility fee application for the car wash also referred to a Dollar General store as well as an unidentified self-storage project. Corporate websites show almost 130 dollar-named stores within 25 miles of Downtown Jacksonville. Those comprise 35 Dollar Tree stores and 50 Family Dollar stores within 25 miles; Dollar Tree bought Family Dollar in 2015. There are also 42 Dollar General stores within 20 miles.

Auld & White gets permit for cyclotron building

Clinic campus at 4500 San Pablo Road. Mayo Clinic announced in March 2016 that it would invest $100 million in construction projects at its Jacksonville campus. Among those projects, Mayo Clinic is building a state-ofthe-art positron emission tomography (PET) radiochemistry facility. It will house a radiochemistry laboratory and a cyclotron, which is a particle accelerator used in the production of radiopharmaceuticals. Mayo Clinic said the facility will produce Mayo-developed choline C-11 used in certain PET scans. The scans are advancements in imagery that “light up” prostate cancer when it is found and provide targets for therapy. Dr. Gianrico Farrugia, CEO of Mayo Clinic in Florida, said at the time that the facility will enhance Mayo’s clinical practice and play an important role in research. The Mayo Clinic opened in 1986 in Jacksonville at 4500 San Pablo Road S. and has expanded since.

Customers won’t see the familiar brown trucks coming from Westlake, though. “They will continue to be dispatched from the delivery center adjacent to the main hub,” Rosenberg said. The former Samsung Electronics America Inc. warehouse became available after Samsung’s lease expired at the end of February. Samsung initially leased part of the building but expanded into the entire center. While Samsung did not previously respond to questions about leaving the center, news reports said Samsung would lease space in the Orlando region.

Samsung had been associated with the Westlake warehouse for more than four years. The Westlake warehouse was built in 2007. Westlake is west of Pritchard and Chaffee roads, north of Interstate 10. It is owned by LIT Westlake LLC, whose manager is Clarion Partners executive John Killian in Dallas. Atlanta-based UPS is investing $196 million to expand its Jacksonville ground package hub, adding more than 260,000 square feet to its building at 4420 Imeson Road in Westside Industrial Park and adding advanced technology and operations automation.

City Council adopted a resolution for a $4.3 million taxpayer incentives package for Project Mountain, the city’s code name for UPS as it went through the legislative process. The company filed plans with the city to expand its 532,000-square-foot regional package distribution center, creating a nearly 800,000-squarefoot center. UPS said when the expansion is completed in the fall of 2019, the hub’s capacity will increase by one-third to more than 80,000 packages processed per hour. That’s about 12 percent of the private employment in the region, double the statewide average reported in the alliance study. In terms of sector share, human services providers lead the list at about 24 percent of the nonprofits. Organizations devoted to arts and culture, gen-

eral health, general education and public support and benefit each represent about 10 percent of the area’s nonprofit organizations. The Nonprofit Center’s study indicates that charitable organizations mirror the for-profit sector in terms of size. Less than $500,000 in annual revenue was reported by 66 percent of the organizations. About 10 percent reported revenue of $500,000 to $1 million. On the high end of the scale, organizations reporting revenue of more than $100 million include Nemours Foundation, Baptist Health, Mayo Clinic Jacksonville, its associated St. Luke’s Hospital, and St. Vincent’s Medical Center. The statewide nonprofit workforce represents about 6 percent of nonfarm employment, comparable to the construction industry at 6.6 percent and manufacturing, which employs 5.2 percent of the workforce, according to the study. Zooming in on the sevencounty Northeast Florida region designated in the report (Baker, Clay, Duval, Flagler, Putnam, Nassau and St. Johns counties), more than 47,400 people are employed by nonprofits and have an annual combined payroll of $2.24 billion. The Nonprofit Center of Northeast Florida also studies the sector with its focus limited to organizations in Baker, Clay, Duval, Nassau and St. Johns counties formed for the purpose of benefiting society that are classified by the IRS as 501(c)(3). According to its study, about 58,000 people in the five counties are employed by about 1,000 charitable nonprofits, second to the finance, insurance and real estate sector (about 69,000)

remember — although memories of speakers’ terms often fade quickly — neither Weatherford nor Crisafulli showed even an inkling of trying to mess with the courts. The ghost left them alone. Or maybe they just knew it wasn’t worth the effort to lob grenades at the courts and better to give priority to other issues. OK, we know it’s not an antiSupreme Court ghost-lawyer in the office closet. The conventional explanation for Cannon and Corcoran targeting the courts is politics. We do remember Florida’s Supreme Court rankled Cannon when it blocked from the ballot three Republican Legislature-supported constitutional amendments from the ballot in 2010 — one regarding Obamacare; another on property taxes; and a third on redistricting. Afterward, in Cannon’s first speech as speaker, he took aim with his political gun, referring to the justices as “unelected justices” and criticizing their three decisions. OK, so we know his motivation. Corcoran was a freshman legislator when that happened, although he was already a Capitol insider, having served as Marco Rubio’s chief of staff when Rubio was speaker. No doubt, Corcoran still has some residual powder burns from those three High Court decisions, being part of the hard-conservative, Republican lawmakers, as was Cannon at the time. And Corcoran is among many Republicans who chafe over Florida’s liberal-leaning Supreme Court, thanks to the appointments of the late Gov. Lawton Chiles (Justices Lewis, Pariente and Quince) and former Gov. Charlie Crist (Chief Justice Labarga). Libertarian-oriented conservatives, as Corcoran is, put Florida’s High Court in the category of legislating from the bench, rather than following the Antonin Scalia approach of originalism. Those who say the court is legislating cite such recent rulings as blocking waiting periods for abortions; rejecting the Legislature’s redistricting; and ruling against business and the Legislature on workers’ compensation. So it makes some sense, then: When the High Court rejects so many of your initiatives, you get angry. And when you’re angry, you want to get even or win. Waiting for the justices to turn 70 for mandatory retirement

doesn’t cut it. As Corcoran puts it: “It boils down to this — we believe that no government job should be for life.” Term limits are the answer, Corcoran contends. HOW’S THAT WORKING OUT?

What’s the saying: Sometimes you can’t see the forest for the trees. For instance, how are term limits working out in the Legislature? But first, let’s do the math. In truth, Supreme Court justices and appellate court judges don’t hold their jobs for life. Say you’re appointed to a circuit court judgeship when you’re 40, considered on the younger side of the spectrum. Now say you serve on the circuit for a dozen years and then are selected to serve on the state’s appellate court. That’s age 52. Then either you finish your career on the appellate court, or maybe receive an appointment to the Supreme Court, say at age 58. Either way, you must retire from both benches at age 70. That’s 18 years on the appellate and High Court. Now consider the legislative branch, which has term limits. You can serve four two-year terms in the House and two four-year terms in the Senate — 16 years. You can serve even longer if you want to take a twoyear break and run for office again. But altogether, when you think about it, 18 years on the High Court or appellate court is not a job for life. U.S. Supreme Court justices and federal appellate court justices have jobs for life.

That’s the quantitative argument. WHY WE HAVE TERM LIMITS

Now let’s look into the forest: how term limits have worked on the Legislature. Thanks to Winter Park businessman Phil Handy back in 1991 and 1992, and his “Eight Is Enough” grassroots campaign, Floridians overwhelmingly adopted legislative term limits. Handy was compelled by the entrenched Tallahassee closed club of lawmakers who held the golden keys to power and legislative initiatives. The poster boys at the time were two Panhandle lawmakers — Sens. Dempsey Barron and W.D. Childers, and South Florida Sen. Gwen Margolis. They were like busts cemented in the Senate chambers. Barron served 28 years in the Senate; Childers 30 years; and Margolis, 18 years in the House and Senate, with 11 years on the Miami-Dade Commission, and then six more years in the Senate. They were emblematic of a system that protected their turf, protected each other and practiced what Handy called “government in the margins.” With their grips on the Legislature, it was difficult for newcomers to wriggle into the power system and, more important, enact bold reforms. The classic goodol’-boy system. Handy saw term limits as a way to flush out the dinosaurs and create a system that constantly would allow fresh, energetic lawmakers to bring new and bold ideas to Tallahassee. In that regard it worked. Term limits retired the Old Guard. And for the past 25 years, every

Turnover is tough on any organization. New people practically always create some type of disruption. Add to that, the fact Florida’s House and Senate change speaker and president every two years. The system is in a constant state of flux, which is contrary to what most organizations and people need to thrive at their best: predictability and consistency. You have heard this criticism of Florida’s term limits, too: A loss of institutional memory. You know the importance of this in your own companies and businesses. Former Sen. Nancy Detert of Sarasota, who served in the House and Senate, told us after she resigned last year from the Senate that lawmakers, especially in the House, simply don’t know as much about the state’s issues as they did before term limits. What you hear is true: They rely much more on lobbyists and permanent legislative staffers to educate them on the issues. Something else has happened. Detert described today’s new legislators this way: “They’re getting younger. And more arrogant. I don’t see courage. I don’t see commitment. It’s not about principles. They see it as an entry-level job to use to climb to the next step. They’ve had no life experiences. They’re politicians. “They don’t read the bills. Everything is a trade. It’s not the floor of the House; it’s like the floor of the stock exchange. Everything is about power, climbing and trading,” she says.

THERE IS ACCOUNTABILITY

Here’s the point: If judicial term limits were to be made law, there would be negative unintended consequences. Count on it. And it is not difficult to discern what they would be. Just look at the Legislature: • Loss of institutional memory. When you talk to lawyers whose livelihoods are in the courtrooms, they see how most judges become better, wiser judges with time and experience. That’s institutional memory.

You would lose that — years of experience and wisdom, which we know is valuable, especially in the courts. Likewise, with that loss of institutional memory, combined with more frequent turnover on the bench, consistency inevitably will diminish. • Quality of those willing to serve will decline. If you’re 50 and offered an appellate position, would you take it — knowing that at age 62 you’d be forced off the bench? Who can re-start a practice or find a commensurate job at age 62? Conversely, if you look at the forest for the trees — at the existing system, you can say it works. Those supporting judicial term limits would disagree with that; they contend Supreme Court justices and appellate court judges are unaccountable to the electorate. One fact they cite is there never has been a Florida Supreme Court justice or appellate judge who wasn’t retained in his or her retention elections every six years. Actually, flip that. It says the selection and appointment process has worked; voters believe there are good, independent and wise justices and judges on the bench. Or, another way to look at the retention of judges is from a market perspective. If there are bad judges, the market always corrects. Just look at what happened to former Circuit Judge Mark Hulsey III here in Jacksonville. What’s more, there is, in fact, accountability in the judicial system: the Judicial Qualifications Commission, Florida’s independent body of judges, lawyers and lay people charged with investigating and ruling on alleged judicial misconduct. If Supreme Court justices are legislating from the bench, which we’ll agree, it sometimes seems that way, term limits will never stop that. The best way to stop that is to the elect the right governor. In his heart and mind, we want to believe, Speaker Corcoran knows this. He has invested much in this issue — in fact, it started out as House Bill No. 1, arguably Corcoran’s top priority. While the House gave the bill its required three-fifths approval to put it on the ballot, the Senate version is languishing in committees. That’s where it should stay. JWLA backs proposed parental leave rule By Caren Burmeister Contributing Writer The Jacksonville Women Lawyers Association supports a proposed parental leave rule that would require judges to postpone a court case when a lawyer asks for a continuance to attend to their newborn child. The parental leave rule became a focal point of a State of the Florida Bar 2017 presentation Thursday when nine women raised their hands to show they’ve met resistance getting a continuance to take care of their newborn child. The JWLA sent a letter to The Florida Bar Board of Governors, stating it strongly supported the proposed rule, which would require the judge to grant a continuance for parental leave. The March 30 letter said the proposed rule was the only way to create fairness across the state and help parents thrive. About 70 lawyers attended Thursday’s meeting sponsored by the JWLA at The River Club Downtown. The parental leave issue came up last year when The Florida Bar’s Diversity Committee said it had found evidence that some judges weren’t seriously considering lawyers’ parental leave requests. The Diversity Committee adopted a resolution for a rule on judicial procedure that would force judges to grant such requests. The proposed parental leave rule comes as more women

lawyers in Florida are reporting hostility and gender bias in the justice system. That was revealed in a survey released in December by The Florida Bar’s Young Lawyer Division. It found that about half of the 400 lawyers questioned had experienced some level of hostility or bias. A statewide Gender Equality in the Legal Profession survey is scheduled to be released in May. Bill Schifino, president of The Florida Bar, raised the issues in his presentation Thursday, saying he’s heard from some Florida Bar members who believe the

parental leave issue should be left to the judge’s discretion. Others, he said, have remarked that parents could use the recent birth of a child to “game the system.” The Rules of Judicial Administration Committee has disagreed with the Diversity Committee, refusing to recommend or draft the rule addressing family leave. On May 26, The Florida Bar Board of Governors will vote on the proposed parental leave rule, which would require that judges grant such continuances unless it would cause substantial harm

to participants in the case. The association’s letter summarizes the experience of one lawyer who works for a small law firm and had recently given birth. The letter states she requested, but was denied, a continuance in her court case. As a result, the letter states she was “forced to go to trial over 200 miles away from her 7-week-old newborn daughter in Jacksonville, whom she was breastfeeding.” Because she had been working on the case since the start, and was intimately knowledgeable about the facts, she couldn’t

turn the case over to another lawyer, the letter said. Furthermore, the letter said, the judge was reluctant to give her breaks during the trial to pump breast milk to feed her child and maintain her supply. “Effectively, her choice was to tell her client to get a new lawyer or to go to trial no matter the circumstances related to her health and the health of her child,” the letter states. “This is not a choice that any attorney should have to make in the absence of substantial prejudice to the opposing party.” The Florida Bar is tackling other issues this year, including: • Trust account oversight. The Bar is working with a software vendor on an accounting program that could help lawyers, especially those at small firms, better oversee trust accounts and reduce the number of client complaints to The Florida Bar. • Florida legislative issues. The Bar opposes proposals that would implement judicial term limits, allow the legislature to override appellate court rulings, and a judicial pay-by-performance bill that would increase the salary for judges who push cases along and clear court dockets. • Constitutional Review Commission: One of the topics being considered by the commission, which reviews the Florida Constitution once every 20 years, is a proposal to restore voting rights for non-violent felons.
