are HVAC systems for commercial buildings. That project was called “Amazon Phase 2.” Phase 1 appears to be interior painting and lighting work. Previous recent permits at the site covered electrical, lighting, power and construction trailers. The location matches the size needs for an Amazon sortation center. A zoning application, which did not identify Amazon, said the building’s user was expected to create more than 200 jobs and represent a capital investment topping $5 million. The building, on 14.87 acres, is owned by a company related to Pattillo Industrial Real Estate. Two Amazon fulfillment centers and a delivery station already have been permitted in Jacksonville, making the Westside Industrial Park operation its fourth in the area. Those centers are in Cecil Commerce Center in Westside and in Northwest and North Jacksonville. The four centers total 3.7 million square feet of space. At least 2,900 jobs would be created — 2,700 full-time positions at the fulfillment centers and 200 at Westside Industrial Park.

J.C. Penney delays store closings J.C. Penney Co. Inc. has delayed the closing and liquidation of 138 stores, including those at Jacksonville Regional Shopping Center in Northwest Jacksonville and in the Palatka Mall. They will close July 31 rather than mid-June and the liquidation sales start May 22 rather than today. Spokeswoman Christina Voss said that since the closings were announced March 17, the affected locations have seen betterthan-expected sales and traffic. “Traffic typically increases

in closing store locations for a variety of reasons, including curiosity, nostalgia and the lure of lower prices,” Voss said Friday in an email. That’s also good for J.C. Penney, she said. “It’s advantageous for the company to continue selling through spring and summer merchandise at current promotional levels by pushing liquidation back another month,” she said. The company said previously about 75 employees work at the Jacksonville store at 3000 Dunn Ave. and about 40 are at the Palatka location. A spokesman said the company will relocate “esteemed leaders” and, if possible, help employees identify other jobs in nearby J.C. Penney stores. Eligible associates who do not stay with the company will receive separation benefits, including an on-site career training class. The company said about 5,000 positions nationwide will be affected by the closures. J.C. Penney continues to operate four Jacksonville area department stores in Regency Square Mall, The Avenues mall,

Orange Park Mall and the Ponce de Leon Mall in St. Augustine.

2014 in the Atlantic North shopping center at northwest Atlantic and Kernan boulevards. Earth Fare wants to develop the Mandarin South store as a “modern and more updated operation” of its organic and natural foods grocery chain. The description was included in a request for a zoning exception to sell beer and wine for offpremises consumption or by the glass in the store. The Shelby Report trade publication reported the Emory Point store in Atlanta was the first of the grocery chain’s locations to use the urban concept design. It said the layout places a greater emphasis on freshly prepared food items, including sandwiches and wraps, juices, smoothies and coffees, plus made-in-house sushi, salads and other entrees and sides. That store also features a 50-seat, indoor/outdoor cafe with free Wi-Fi. Preferred Growth Properties, through PGP Jacksonville LLC, is redeveloping the Mandarin South shopping center. The proposed 27,550-squarefoot Earth Fare location formerly was used as a Winn-Dixie, Wood You Furniture and Ollie Koala’s BackYard, an indoor playground. Plans show the store will have an indoor 62-seat cafe and outdoor cafe seating for 16. Earth Fare will be joined at Mandarin South by new junior anchor PetSmart, which said it planned to open there in fall 2017. Other tenants include AutoZone, Taziki’s Mediterranean Cafe, Tijuana Flats TexMex, Yogurt Mountain and Planet Beach Spray & Spa. Several other units appear to remain available, according to the sign waiver application.

bers regarding networking, technology and practice management and development. I will work to ensure the JBA provides opportunities and resources to aid its members in these areas, including solo and small firm lawyers. I will work to make it easier for members to engage each other and the Bar through committees, social events and publishing opportunities so members continue to realize the value of a JBA membership. I want The Jacksonville Bar Association to continue its leadership role in this community and throughout the state in promoting professionalism and civility among members, enhancing the image and reputation of the legal profession, providing a mentorship program to benefit our younger members and providing pro bono services.

changes, the JBA has the opportunity to grow and diversify its membership, while increasing its connections to existing members. The JBA must be a leader in Jacksonville. Not too long ago, no major civic initiative got traction without heavy involvement from Jacksonville’s legal community – we should aim to reassume our historic position. By partnering with other leading organizations to identify areas of mutual interest, we can solve problems for others, advance our own cause and help make Jacksonville a better place to live and work. To be sure, it is a time of opportunity at the JBA. Our new executive director is forwardthinking and our staff is dedicated and dynamic – if we pair them with a board with new ideas and fresh vision, success will surely follow.

GOALS FOR THE JBA As a member of the board of governors, my goals for The Jacksonville Bar Association are to grow membership and increase involvement by providing resources and value to our membership. By increasing participation, we can improve upon the activities the association has implemented. The Bar must be relevant to its members and the quality of our association can only be enhanced by the programs and committees we offer. By promoting a more diverse slate of programs, services and benefits, we can enhance the quality of life and professional growth. Through outreach to our surrounding communities, we can develop new ideas, goals for the future and tackle community-related legal issues. Involvement and participation are essential to foster professionalism among our members, the Judiciary and the community as a whole. I will continuously work to enhance The Jacksonville Bar Association, I am seeking re-election to the board of governors and I want your support.

GOALS FOR THE JBA I aim to take and support action that will promote competence and collegiality within our legal community and foster respect for our profession. The JBA should grow and diversify our membership through the addition of more worthwhile economic and social opportunities. I intend to work for the preservation of independence for lawyers and judges, and to increase access to legal services within our community.

GOALS FOR THE JBA I believe my strengths are in community outreach and service-oriented projects and creating partnerships with other charitable and professional organizations. I want to see JBA’s stature increase as a leading presence in the community for worthwhile causes. I have assisted with many charity events previously including raising over $180,000 for Equality Florida in greater Jacksonville last year as the co-chair. Another aim would be to increase JBA membership and make every lawyer in the JBA feel like part of a tight-knit, friendly and helpful legal community by promoting each section of the JBA.

GOALS FOR THE JBA Provide our members additional opportunities to come together for socializing and networking with the goal of creating a true sense of community in our profession, which would also contribute to creating greater professionalism and accountability among our members. The path to being appointed to a committee should be advertised more as providing involvement to the JBA membership is one of the JBA’s most important responsibilities. We should continue to create opportunities for leadership in the organization, publish legal articles and allow our members to become engaged in the community. The level of professionalism among lawyers in North Florida makes me proud. We can continue to facilitate collegiality by providing top-notch and new programs, events and happy hours. groups are struggling to maintain members. We can redefine JBA membership to allow easy access while better monetizing the networking and educational value we provide our members. Second, I will advance civic engagement. Our candidate forums provide JBA members invaluable access to elected officials and JBA members, in turn, serve as thought leaders in our community. Finally, I will promote our longstanding commitment to serving the public through our Lawyer Referral Service and probono efforts.

• Volunteer youth baseball coach GOALS FOR THE JBA The most pressing goal for the JBA is increasing membership, both in numbers and involvement. If re-elected, I intend to continue working on three initiatives to promote JBA membership: 1. Build educational and social programming that promotes opportunities for our members to develop their practices and networks. 2. Modernize the Bar’s processes when it comes to enrolling, tracking and communicating with its members. 3. Develop a long-range plan to foster stronger relationships with historically under-represented groups such as young lawyers, solo and small firm practitioners and minority attorneys.

(sometimes painfully) loyal Jaguar supporter and permanent member of this community. I have planted my flag and I am not going anywhere. Because of this, I want to help our community and our local Bar association be the best that it can possibly be. Though I work in litigation, which is often contentious and adversarial by nature, I take pride in always establishing a civil, professional and most oftentimes friendly relationship with my opponents. I genuinely enjoy meeting and socializing with other members of our profession. Camaraderie is something that sets our legal community apart from other local Bar associations around the state, and it is something that I believe in very strongly. I would like to continue to enhance the camaraderie that we as attorneys in Jacksonville enjoy and to serve our community in advancing causes that are dedicated to the enrichment of those in need in our city as well as the needs of the future of our city, its youth.

Law Week art supply and toiletries drive underway By Ingrid Osborn Law Week Committee Law Day is a day set aside each year to celebrate the rule of law. May 1 is the official date, but many celebrations take place before and after that date throughout the U.S by Bar associations and legal organizations. This year’s Law Day theme is “The 14th Amendment: Transforming American Democracy.” Ratified nearly 150 years ago, it guarantees the rights of due process and equality under the law. Through this amendment, most of the protections in the Bill of Rights became enforceable against the states for the first time. It also defined citizenship and barred states from

denying any citizen the privileges and immunities of citizenship. The Jacksonville Bar Association has kicked off its Law Week festivities with a school supply and toiletries drive. The school supplies needed for West Riverside Elementary School include watercolors, markers, sharpened color pencils, clay and clay marking tools, specialty art paper (drawing, watercolor, etc.) and construction paper. Toiletries will be donated to Downtown Ecumenical Services. The organization accepts full or travel size personal care items such as toothpaste, soap, shampoo, deodorant, perfume, lotion, tissues, and shaving supplies.

Busch reveals brewery plans, Mayor releases tax returns From Staff Have you ever wondered what life was like in Jacksonville half a century ago? It was a different era of history, culture and politics but there are often parallels between the kind of stories that made headlines then and today. As interesting as the differences may be, so are the similarities. These are some of the top stories from this week in 1967. The items were compiled from the Jacksonville Public Library’s periodical archives by Staff Writer Max Marbut.

Lobbying pays off with Busch plant Two days after the company optioned a 200-acre site in North Jacksonville, AnheuserBusch Inc. announced it would begin construction of a $40 million brewery there within three months. The brewery would have an annual shipping capacity of 1.5 million barrels of beer, employ 300 workers, and have an estimated annual payroll of $3 million when it begins operation in about two years, said Judson Freeman, local counsel for the St. Louis-based brewer. The site was chosen for its proximity to the main line of the Seaboard Air Line Railroad, he said. Gov. Claude Kirk, who flew to Jacksonville from Tallahassee for the announcement, said he had done his best to entertain August A. Busch Jr. when the beer tycoon was in Tampa visiting the company’s brewery there in March. Busch also attended the Governor’s Baseball Banquet. Kirk said that wasn’t the extent of his lobbying effort on behalf of Jacksonville. “As you know, I was in New

Specialization is coming, lawyers hear at luncheon Specialization likely was on the horizon for the legal profession, members of The Jacksonville Bar Association learned. Al Cone of West Palm Beach, president of the American Trial Lawyers Association, discussed his prediction at the JBA’s monthly luncheon meeting at the Roosevelt Hotel. He said the Bar would soon be faced with the problem of recognizing specialties in practice. “We must develop some specialty recognition and specialty requirements. That’s why the medical profession has surpassed us in their earnings and their service to their patients,” said Cone. In defining the function of attorneys in America, Cone said, “We are to society what oil is to a machine. We function at the points of friction and conflict.”

Planning begins for new prison farm Planning for a new Duval County prison farm was begun by the county commission. It was noted that for a couple of years, commissioners had discussed getting a new facility to replace the existing stockade at Commonwealth Avenue and Superior Street. The matter was brought to a head by receipt of a letter from

York last week, where I was being entertained by bankers in a very exclusive club. August A. Busch III was there, and I enjoyed a Budweiser with him, rather than the expensive wines which were offered,” Kirk said. “Now, I’m torn between orange juice and Budweiser,” he added.

CLASSIC COUNTRY. Tickets were on sale this week in 1967 for the seventh annual WQIK Country Music Festival in the Jacksonville Coliseum. Waylon Jennings (above, circa 1967) was on the bill, along with Porter Wagoner, Buck Trent and the Wagonmasters, Miss Norma Jean, Ferlin Husky, Mel Tillis and Grandpa Jones. Tickets were $2 for general admission $3 and $4 for reserved seats.

Louie Wainwright, director of the state Division of Corrections, who said the old stockade had “outlived its usefulness.” He said while inspection reports stated the facility was well-managed and maintained, it had for several years been “deteriorating greatly” and only minimum maintenance and improvements had been provided. County Engineer John Crosby estimated the cost of a new facility at about $750,000, but also said he suspected a new prison farm would have to be racially integrated, and if so, that would cut the cost by about one-third.

Candidate tax returns in the news Mayor Lou Ritter made public his personal income tax returns from 1953 through 1965 and invited other city officials who planned to run for re-election to do likewise.

Ritter said he intended to operate his campaign in the spirit of the state election law, which required candidates to list who contributed to their campaigns and how the money was spent. “I’m not trying to put anyone on the spot,” Ritter said. “It is my feeling that whenever there is a question about income of public officials that everyone seeking public office — those presently in office to those who aren’t — should show their income.” Ritter’s tax returns showed income of $19,608 in 1965, a combination of his salaries as mayor and as a county commissioner and from Falcon Sales, an oil distributorship he owned with his wife. His 1953 tax return showed $6,273 in declared income. When asked by a reporter how much money Ritter had in his pocket, the mayor reached in his pocket, counted, and replied “$7 and some odd cents.”

Holding that Florida’s compulsory school attendance law was unconstitutional, Circuit Judge Roger Waybright dismissed a suit seeking to ban boycotts of Duval County public schools by African-Americans. His 14-page order also threw out the Duval County School Board’s demand for damages, which could have gone as high as $259,000 for claimed loss of state funds resulting from racial boycotts in 1964 and 1966 protesting the slow pace of school desegregation in Jacksonville. Waybright said it was “blatantly obvious” that a 1959 amendment to the compulsory attendance law made the statute unconstitutional in its application to both black and white students. “It denies equal protection of the laws to any child of school age,” he said. Defendants in the suit were the NAACP and four prominent African-Americans: Wendell P. Holmes, Rutledge Pearson, Charles Daly and R.L. Jones. After Waybright signed the order, school board attorney Elliot Adams said he didn’t know whether the ruling would be appealed, as that would be a policy matter for the board to decide.

JU schedules arts program in Europe Jacksonville University was offering two college credits for a study tour of Europe. The five-week excursion, sponsored by the American International Academy, was organized by Steven Lotz, JU instructor of art history, drawing and graphics The group would leave from New York City July 10 and return Aug. 14. Following three weeks of resident study in Vienna, Austria, the group would spend three weeks traveling through Europe, including stops in Germany and Italy. Cost of the trip was $745, including all expenses and travel from New York and back.

stockholders oppose it. Hedge fund Mantle Ridge, which supported Harrison’s bid to become CEO, was given four seats on the board in addition to Harrison when he got the job. So the pay package will very likely have the support of the board.

None of the major shareholders of CSX Corp. has indicated any opposition to new CEO Hunter Harrison’s compensation package, but one prominent stockholder is urging large shareholders to vote against it. At CSX’s annual meeting on June 5 in Richmond, Va., shareholders will be voting on an $84 million payment to compensate Harrison for money he forfeited when he left his previous position as CEO of Canadian Pacific Railway Ltd. Harrison left Canadian Pacific in January to pursue the CSX job, and he was named chief executive of Jacksonville-based CSX on March 6. Wall Street has been supportive of Harrison’s appointment, with the market value of CSX’s stock soaring by about $10 billion since the news of Harrison’s

interest in the railroad company first leaked out in January. As several analysts have pointed out, the $84 million payment would be a fraction of the increase in market value, so they expect large institutional investors to support it. However, shareholder John Fishwick Jr. has started a campaign to convince the institutions to oppose it. Fishwick was the U.S. Attorney for t h e We s t ern District Harrison of Virginia before resigning that position in January to return to private practice. He has some insight into the railroad industry. His late father, John Sr., was CEO of Norfolk and Western Railway. Fishwick sent a letter to the chief executive of CSX’s largest shareholder, The Vanguard Group, to outline his reasons for voting against the $84 million payment. Vanguard controls 7.18 percent of CSX’s outstanding shares. “A corporation such as CSX should be a much tougher negotiator and not surrender to the demands of an executive to pay his salary for a job which he left voluntarily,” Fishwick’s letter said. “This money is not compensation for work Mr. Harrison performed at CSX but for work which he performed for a competitor of CSX.” Fishwick said the payment would be “demoralizing” for CSX employees, who recently watched the company cut 800 managerial-level jobs, including 500 in Jacksonville. Harrison has said he will quit if he doesn’t get the $84 million, but it may not matter how the shareholder vote goes. The proposition is only an advisory vote for the board of directors, and the board could go ahead and award the payment even if a majority of

its 90th anniversary April 8 by inviting the public to watch a silent movie and a documentary about the building’s history. Other success stories include the transformation of the former Duval High School into the Stevens-Duval apartments for seniors Downtown on Ocean

Street, the current renovation of the former First Guaranty Bank & Trust building at Bay and Ocean streets into the Cowford Chophouse and the ongoing preservation of the steam locomotive at the Prime Osborn Convention Center, Booth said. Other preservation mile-

stones are the conversion of the former John Gorrie Junior High School in Riverside into condominiums and adapting the former U.S. Post Office and federal courthouse West Monroe Street into the State Attorney’s Office. Also on Booth’s success list is the Seminole Club, now home to Sweet Pete’s candy factory and retail store and the Candy Apple Café. He admits there have been attempts at preservation that fizzled, most notably two structures in LaVilla. One is Genovar’s Hall, a former nightclub that was a hot spot in the early 20th century when Jacksonville was known as “Harlem of the South.” The jazz greats of the day, including Louie Armstrong and Billie Holliday performed there, but it’s been fenced off for years. The other is Brewster Hospital, Booth said. The city owns and has preserved what was at one time the only hospital in Jacksonville for African-Americans, but it sits empty. “The city lovingly restored it, but there’s really no use for it,” said Booth. Proxy advisory firm Institutional Shareholder Services Inc. issued a report recommending stockholders vote against 12 of the 15 nominees up for election to the board of directors, in light of the issue. “The Audit and Examination, Risk, and Human Resources Committees, tasked with risk oversight, failed over a number of years to provide a timely and sufficient risk oversight process that should have mitigated the harmful impact of the unsound retail banking sales practices that occurred from 2011-2016,” ISS said in its report. “Votes against 12 directors and members of the committees are warranted for the committees’ failures in this regard,” it said. One of those 12 directors is Jacksonville businessman John Baker, chairman and CEO of FRP Holdings Inc. Baker has served on Wells Fargo’s board since 2009. Baker said last week he couldn’t comment on the shareholders meeting. Wells Fargo issued a news release reiterating support for the board members after the ISS report two weeks ago. “The extreme and unprecedented ISS voting recommendation on directors fails to recognize the active engagement of the Board and the substantial actions it has already taken to strengthen oversight and increase accountability at all levels of Wells Fargo, including important improvements to corporate governance. The Board and management are working tirelessly to rebuild the trust of customers, employees and investors, and are making substantial progress in strengthening Wells Fargo,” the company said. Wells Fargo’s largest shareholder is Warren Buffett’s Berk-

shire Hathaway Inc., which owns about 500 million shares, or nearly 10 percent of the stock. Buffett has remained supportive of Wells Fargo but last week, Berkshire Hathaway disclosed it sold 7.1 million Wells Fargo shares to ensure its stake remains below 10 percent and avoid some bank regulatory issues. “These sales are not being made because of investment or valuation considerations. Rather they are solely motivated by the desire to return to a percentage ownership below the 10 percent notification threshold,” Berkshire Hathaway said in a news release. The firm said repurchases of stock by Wells Fargo had reduced the total number of shares outstanding and caused Berkshire Hathaway’s ownership stake to rise above 10 percent.

Harrison’s CSX compensation deal gets opposition

CSX earnings coming this week We should be hearing more from Harrison about his plans at CSX as the company releases its first-quarter earnings report this week. Unlike his predecessor Michael Ward, who would spend hours in interviews with the media after releasing the quarterly reports, Harrison will be more limited in his post-earnings interviews. But we should hear more from him in the company’s Thursday morning conference call with analysts. Although the first-quarter results won’t reflect an impact from Harrison, most analysts are expecting continued cost-cutting from Harrison to improve CSX’s results in the future. But in a research report last week as he raised his rating on CSX from “hold” to “buy,” CFRA analyst Jim Corridore also cited improving revenue trends for his upgrade. “After a 6 percent decline in revenues in 2016, we see revenues rising 13 percent in 2017, and 19 percent in 2018,” Corridore said in his report. He said the strongest gains will come from intermodal containers, grain and — perhaps most significantly — coal. Coal had historically been CSX’s biggest business before a drop in demand in recent years. “Coal has rebounded after several down years due to low stockpiles at power producers, improved export demand, and on somewhat higher natural gas prices,” he said. Corridore projects earnings of $2.06 a share this year, up from adjusted earnings of $1.81 last year.

Analysts’ forecasts range from $1.99 to $2.18, according to Yahoo Finance.

Punch TV hits the air in Jacksonville An upstart television production company is raising money with an initial public offering as it also launches a TV network, with Jacksonville as one of its early markets. California-based Punch TV Studios Inc. is trying to sell 50 million shares of stock at $1 each, with the intent of using the capital to produce movies and television programs. The company also is operating the Punch TV Network to air its productions and, according to its annual report filed last week with the Securities and Exchange Commission, Jacksonville is one of six markets broadcasting the network. The station is difficult to find but in response to an inquiry about it, the company pointed to a video showing CEO Joseph Collins launching the Jacksonville station in October on Channel 18.2. Punch also has stations in Pensacola, Houston, Beaumont, Tex., Mobile, Ala., and Columbus, Ohio, according to the annual report. “Our goal is to create a melting pot of fresh content and exclusive family-oriented shows, including dramas, comedies, talk shows, documentaries, reality shows, business and sports news, and other genres of television and film. Although the appeal of our content will be universal, it will have an urban slant, providing multi-ethnic to America’s urban — as well as non-urban — dwellers,” the annual report said. The report shows no revenue for the fiscal year ended Aug. 31, 2016, since it hadn’t begun operations, but the company expects to have revenue to report in the current fiscal year. mbasch@jaxdailyrecord.com

renewal, but Booth said there have been some notable rescues in terms of preservation and reuse. “The No. 1 success story in terms of historic preservation in Jacksonville would have to be the Florida Theatre,” he said. It opened in 1927 and marked

rent endangered list are the Ford Motor Co. assembly plant at the west end of the Mathews Bridge and the former Ambassador Hotel Downtown near the Duval County Courthouse. There’s also a mystery in Jacksonville’s history — not about the event, but about why there is so little record of it. It’s also related to Booth’s interest in aviation and it has put him on a quest. Booth said when Charles Lindbergh flew to Jacksonville in October 1927 on his nationwide tour, five months after he became the first to fly an airplane across the Atlantic Ocean, more than 150,000 people came here to see the famous aviator and his “Spirit of St. Louis” that flew from Long Island, N.Y. to Paris. The mystery is that there are only five photographs of the event in the historic archives. “I know somebody took pictures. They’ve got to be sitting in an attic somewhere,” Booth said. “My personal mission is to find more pictures of Lindbergh’s visit.” mmarbut@jaxdailyrecord.com (904) 356-2466
