A 14-foot glass storefront system will be installed, and the interior will feature special touches like wood from Belgium. Jordan declined to provide the renovation estimate, only to say “it will be substantial.” And to think it all started because the young couple needed some dining chairs and couldn’t find what they wanted at a favorable price. Jordan, 36 and Anne, 38, met as teenagers in 1995 on a mission trip in South Carolina. She was from Texas, he lived in Hilton Head, S.C. They kept in touch and chose to attend Emory University, where she graduated with a master’s degree in theology and he earned a bachelor’s degree in history. They married in 2005 and lived in North and South Carolina and in Jacksonville for a time. She worked with Baptist churches, including Hendricks Avenue Baptist Church, and he was in real estate and economic development. In 2009, the couple lived in Beaufort, S.C., and began looking for dining chairs for their new home. Jordan connected with manufacturers and found the chairs they wanted. The idea struck: Identifying the best furniture for individual and corporate needs could be a business. If they loved those chairs, why wouldn’t others? They figured that people wanted quality furniture without having to spend thousands. Their original slogan was “Design for the People.” Their garage became storage until it wasn’t large enough, so the business began leasing rented space for warehousing. Anne continued working fulltime while Jordan built the business. When the recession took its toll on his job, they decided to return to Jacksonville. They reg-

Today they lease space in 68,000 square-foot warehouse space at 4011 Morton St. in Southside and a 60,000-squarefoot distribution center in California, where they have many clients. Four years ago, they moved the office into the Hendricks Avenue space after being home-based. “It’s been very organic, and a love for design and a love for travel,” said Anne England. They work with manufacturers worldwide to identify and curate furniture, such as barstools,

chairs and sofas along with lamps and other accessories. They work with local businesses for finishing the pieces as needed. The couple travels worldwide to identify and work with manufacturers. Its slogan now is “Furnishing Modern Creativity.” Their industrywest.com site describes the company as “supporting and mobilizing people who strive to be creative, whether it’s at home or at home. The whole word needs to achieve its creative potential,” it says. For example, the site says the Marriott Flagship in Portland, Ore., ordered 700 bar stools for individual rooms, while Mellow Mushroom in Wrightsville Beach also ordered bar stools and chairs, all to achieve a cer-

In the city, Industry West furniture or barstools are used at M Shack, Town Hall, Moxie, Orsay, Taverna and Bold Bean Coffee. “We try to key in on products people would use in their homes, offices or at the bar down the street,” Jordan said. “We’re kind of little bit edgy,” he said, describing styles such as industrial, Italian, European and French bistro. Industry West relies on analytics and data to plan for its products. It knows what sells and what doesn’t. “We know where to stock and we know what turns over the most,” Jordan said. Jordan England and friend Christian “Andy” Allen, who is the owner and founder of Corner Lot Properties, are managers of England Allen Holdings. Course Contracting LLC is the contractor for the renovations. The Flying Iguana restaurant had considered the space for a restaurant, but parking and other concerns changed those plans. Returning to Jacksonville was fortuitous, the Englands said, because they found the warehouse space along with shipping and importing options, which aren’t as accessible in smaller towns. The couple also moved their household to a 1936-built San Marco home, which they renovated and expanded. “Raising a family, San Marco just felt like the right spot for us,” Jordan said. “It’s walkability, creativity and overall feel truly align with our way of thinking not just as a company but as a family.” kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466 Matt Walsh Publisher JaMes F. Trucker’s job regained, foreclosure avoided By Kathy Para The JBA Pro Bono Committee chair Attorney David King has provided pro bono assistance to more than 200 clients during his legal career. The majority of those cases involved filing for Chapter 7 bankruptcy. Each situation triggers stressors that have the potential to destroy lives and families. King describes a recent case that resulted in a dramatic and positive outcome for his client. What were the basic facts of the case? The client was a professional truck driver who depended on her driver’s license to earn a living. She was involved in a traffic accident in her personal vehicle. Unbeknownst to her, her personal vehicle insurance had lapsed while she was out on the road. Due to the accident, and the resulting judgment, the Florida Department of Motor Vehicles revoked her license. Her employer immediately discharged her for lack of a valid driver’s license. She found herself without a job, her bills were mounting, and she was about to lose her home in foreclosure. What were you able to accomplish for your client? We successfully filed a Chapter 7 bankruptcy for her, wiped out the judgment and worked

with the Clay County Clerk’s office to have her license reissued. Why was this outcome important to your client? She was able to go back to work immediately when her driver’s license was reinstated. With her change in employment, we were able to save her home from foreclosure. What advice do you have for other attorneys considering pro bono involvement? Money cannot buy the “warm fuzzies” that you get from helping people. We suggest that the reward goes beyond “warm fuzzies” when a client regains employment and avoids foreclosure as a result of an attorney’s pro bono efforts.

King’s positive impact on this family is beyond measure. He has practiced in the Northeast Florida area since 1985, with an office in Orange Park. King considers himself to be a transactional attorney for primarily business clients. He now files Chapter 7 actions for legal aid referrals only. Sincere appreciation is extended to King and so many other lawyers who choose to share their expertise with those who are not able pay for legal services. Because of them, families are stabilized and people have opportunities to thrive. Attorneys interested in pro bono opportunities in the 4th Judicial Circuit may contact kathy.para@jaxlegalaid.org

acquisitions until it regained compliance. Ameris blamed the problem on software issues. During the conference call, Hortman said he expects the regulatory issues to be resolved as soon as it fixes the glitch. “We continue to make excellent progress there and we remain on track to have every item of the consent order completed by June 30, as we talked about previously.” Ameris reported first-quarter earnings of 59 cents a share, up from 37 cents in the first quarter of 2016. Hortman said about half of the growth came from its acquisition last year of The Jacksonville Bank and a new joint venture that provides credit on property and casualty insurance premiums. “The rest of the growth in earnings is from organic growth in the balance sheet, coupled with really impressive management of operating expenses. Our organic growth, with lower efficiency ratios, is going to continue to be an impressive earnings driver that should hold our operating ratios in the favorable place they are today,” he said. SunTrust Robinson Humphrey analyst Jennifer Demba raised her rating on Ameris last week from “hold” to “buy.” “We believe another solid reported quarter has set the stage for an upgrade. A return to bank acquisitions once the Bank Secrecy Act/anti-money laundering issue is resolved, along with a continued strong loan

ACFC earnings show 3-cent gain Atlantic Coast Financial Corp. last week reported its firstquarter core earnings rose by 3 cents a share to 10 cents. “Our first-quarter progress also is noteworthy because it underscores the diversity of business, which has helped us maintain the momentum we achieved last year, even as we prepare for the potential effects of possible interest rate increases or other macroeconomic events that may affect the industry nationwide, as well as the seasonally slow nature of the first quarter,” CEO John Stephens said in a news release. However, the one analyst who follows Atlantic Coast Financial, Bob Ramsey of FBR, expressed caution. “Atlantic Coast’s first-quarter EPS exceeded our estimate given strong gains on the sale of loans held for sale, which more than offset a 10 percent decline in net interest income this quarter,” Ramsey said in his research note. “Our concern is the net interest income trajectory going forward, as the drop in both net interest margin and average earning assets may make it tough to maintain ACFC’s profitability in quarters with more normalized levels of loan gainon-sale income,” he said.

Friday reported first quarter earnings of 28 cents a share, up from 20 cents the previous year. As the Jacksonville-based banking company waits to complete its acquisition by Teachers Insurance and Annuity Association of America, it did not detail its financial results in a news release. It only released its quarterly financial schedules in a Securities and Exchange Commission filing.

Landstar beats its own forecast Landstar System Inc. on Wednesday reported firstquarter earnings that beat its own forecasts. The Jacksonville-based trucking company earned 77 cents a share, up from 69 cents in the first quarter of 2016 and above the company’s forecast range of 70 cents to 75 cents. Landstar regularly provides quarterly forecasts and analysts who follow the company usually agree with those predictions. First-quarter revenue rose 9.7 percent to $780.9 million, also beating the company’s forecast range of $725 million to $775 million. “Considering the continued soft U.S. economic environment, especially the soft U.S. manufactur- Gattoni ing sector, the Landstar model continued to demonstrate how well we perform even in a soft economic environment as we generated record first-quarter revenue, gross profit and diluted earnings per share,” CEO Jim Gattoni said in the company’s conference call. Landstar is forecasting second-quarter earnings of 84 to 89 cents a share, compared with 76 cents in the second quarter of 2016, with revenue of $820 million to $870 million.

Lower gas demand hurts Patriot Patriot Transportation Holding Inc. reported earnings of 8 cents a share for its second quarter ended March 31, down from 26 cents the previous year.

Revenue fell 5.7 percent to $27.4 million. The Jacksonville-based trucking company, which transports petroleum products and other goods, said lower demand for gasoline during the quarter affected results. Patriot also was hurt by the loss of business from one large customer which sought out lower bids from the company’s competitors. During Patriot’s conference call, new CEO Robert Sandlin said the company is not willing to lower its rates to match low bidders. “We have been successful adding back business at better prices in some markets. However this Sandlin generally does not happen simultaneously with any business loss,” he said. Sandlin was promoted from vice president of Patriot to president and CEO last month when Tom Baker resigned to take a position with Vulcan Materials Co. Baker remains chairman of the board of Patriot.

CSX upgraded CSX Corp.’s stock jumped as much as $4.35 to $51.28 on April 20 after Hunter Harrison’s first conference call as CEO, but at least one analyst heard enough to expect more gains. Raymond James analyst Patrick Tyler Brown raised his rating on the Jacksonville-based railroad company from “market perform” to “outperform” and set a $55 price target for the stock after Harrison’s long, sometimes rambling conference call. “Following a review of the opportunity for CSX under its highly experienced and successful new CEO (Hunter Harrison), we are upgrading shares to outperform,” Brown said in a research note. “While material value recognition has already been garnered (preventing us from being even more constructive), we believe CSX is at an inflection point and should see significant improvement in service, margins, and free cash flow in coming years,” he said.

Wall Street already was expecting big things from Harrison, who became chief executive of CSX in March. The stock reached a new high of $51.66 last week, 40 percent higher than the stock’s price when word of Harrison’s interest in the CSX job leaked out in January.

Mantle Ridge puts Harrison pay at $17 million yearly Speaking of Harrison, hedge fund Mantle Ridge, which backed Harrison’s effort to become CSX chief executive, filed additional proxy materials last week to try and convince CSX shareholders to approve Harrison’s compensation package. Specifically, shareholders at the June 5 annual meeting will be voting on an $84 reimbursement payment representing money Harrison forfeited when he left his previous position as CEO of Canadian Pacific Railway Ltd. to pursue the CSX job. CSX has not said what the total value of Harrison’s compensation package is, other than to say he will receive $2.2 million in salary, an opportunity to receive $2.8 million in annual bonuses and options to buy 9 million shares of CSX stock. The value of the options are subject to several interpretations, depending on the formula, but Mantle Ridge said in one of its proxy filings that “we value” the options at $12 million a year. That would put the total value of Harrison’s package, excluding the $84 million payment, at $17 million a year for four years. Harrison’s predecessor, Michael Ward, received $13.6 million in compensation last year. Mantle Ridge also filed questions and answers about why shareholders should approve the $84 million, including the question: “Could CSX hire another executive that did not require reimbursement but could be reasonably expected to deliver similar results?” Mantle Ridge’s answer: “No. There is no one in the industry whose record comes even close to Mr. Harrison’s.”

ParkerVision in Nasdaq compliance ParkerVision Inc. is back in the good graces of Nasdaq after an increase in the price of its stock and the number of shares outstanding. The Jacksonville-based developer of wireless technology said in January it was in danger of losing its listing on the Nasdaq Capital Market because the total market value of its stock had fallen below the $35 million floor required for listing. ParkerVision, which reported 13.2 million outstanding shares at the end of 2016, was trading at about $2 at the time of the notification. However, ParkerVision’s stock price has risen some, reaching a high of $2.72 last week, and its most recent SEC filing showed 17.7 million outstanding shares, so the total market value is above $35 million. ParkerVision said it was notified by Nasdaq on Thursday that it has regained compliance. mbasch@jaxdailyrecord.com

50 years ago this week

Taxes and city council race dropout Have you ever wondered what life was like in Jacksonville half a century ago? It was a different era of history, culture and politics but there are often parallels between the kind of stories that made headlines then and today. As interesting as the differences may be, so are the similarities. These are some of the top stories from this week in 1967. The items were compiled from the Jacksonville Public Library’s periodical archives by associate editor Max Marbut.

Judge: Tax system ‘discriminatory and unfair’ Florida’s ad valorem tax system, which granted low rates to intangible property and levied higher rates on real estate and tangible property, was discriminatory and unfair, said Circuit Judge William Durden. But it couldn’t be declared illegal because the people imposed it on themselves by voting it into the state Constitution, he added. Those points were from a ruling by Durden as he dismissed, with obvious great reluctance, portions of 18 assessment suits seeking to have the controversial ad valorem tax system declared unconstitutional. On behalf of the plaintiffs, who were challenging their 1966 property tax bills, attorney William Bostwick asserted the ad valorem tax laws violated federal and state constitutional provisions guaranteeing equal protection of the law. Durden said in his 13-page opinion that under Florida law, there really was no ceiling on the ad valorem tax rate which could be imposed on real estate and tangible personal property by county taxing authorities. However, he pointed out, intangible personal property — such as money, stocks and bonds — was broken down into classifications and under the state Constitution, could not be taxed at a rate higher than 2 mills, or $2 per $1,000 valuation.

Rutledge Pearson dies in car accident Rutledge Pearson, president the state and local branches of the NAACP, died of head injuries near Waynesboro, Tenn., when his automobile went out of control on a rain-slick highway and struck a bridge abutment. Pearson, 37, had left Atlanta for Memphis, where members of the Laundry, Dry Cleaners and Dyehouse Union were on strike. He was the international agent for the union. Pearson had lived in Jacksonville all his life and was known nationally as a civil rights leader. At the time of his death, he was a member of the NAACP National Executive Board and was president of the Southeastern Region of the organization. He would be succeeded as state NAACP president by Rev. J.E. Atkins, pastor of Zion Hill Baptist Church in Winter Haven. Pearson was a “straightforward and fearless leader” and one who “believed in the human dignity of all men. He was work-

ing hard for all branches (of the NAACP) to put in motion a program to remove Florida from every vestige of segregation and discrimination,” Atkins said.

Wife drops out of City Council race citing spousal duty Gerry Hembree, who qualified as a Republican candidate for City Council in the Sixth Ward, withdrew from the race. She was the wife of Dr. William Hembree, a Republican candidate for mayor and former chairman of the Duval County Republican Executive Committee. Hembree said her decision was based on her desire to help her husband win the race for mayor. “I feel that my first duty is as a wife,” she said, “So I am withdrawing at this time in order to help and support him in his campaign.”

Firefighters seek responsiblility for ambulance service The Duval County Firemen’s Association petitioned the county legislators to give responsibility for ambulance service in unincorporated areas of the county to firefighters. The request was submitted to the delegation by Michael Hadden, chairman of the association’s Legislative Committee. Hadden said county firemen were trained in rescue and firstaid operations and because their departments were strategically located, they felt they could perform the service “at a cost of 40 cents on the dollar cheaper than the city.”

Police make beach auditorium safe The Jacksonville Beach City Auditorium was one of the few places in Duval County where parents would allow their children to attend activities without fear for their safety, said Jacksonville Beach Mayor William Wilson. In a discussion of the policing of the venue at a meeting of the Jacksonville Beach City Council, Wilson defended the use of additional police officers at auditorium functions. He said “rowdyism and vandalism were practically non-existent” at dances attended by teens due to the increased police presence.

Funeral held for William Rogers Graveside funeral services for William Rogers, senior partner in the law firm Rogers, Towers, Bailey, Jones & Gay, were held at Oaklawn Cemetery. He lived at 2400 Seminole Road in Atlantic Beach, and died in his home after a long illness. He was 83. Born in New Haven, Conn., in 1884, Rogers graduated magna cum laude from Dickinson College with a bachelor of philosophy degree in 1905 and received a bachelor of laws degree from New York Law School in 1909. He came to Jacksonville in 1911 after practicing law in New York City and the Panama Canal Zone

and was admitted to The Florida Bar the following year. Throughout the Great Depression, Rogers served as chairman of the Duval County chapters of the Works Progress Administration and the Emergency Relief. At the time of his death, he had been president of Florida Title and Guaranty Co. and was the Duval County agent of the Lawyers Title Insurance Corp. for 38 years.

McDuff Appliances plans expansion McDuff Appliances Inc., a 12-store chain that was North Florida’s largest appliance dealer, launched a reorganization and expansion program aimed at increasing its $6 million-ayear sales volume by 50 percent by August 1968. The firm planned to add three stores to the nine it operated in Duval County, and three outlets in other North Florida cities to bring its volume up to $9 million annually. Company President Randolph Thomas said the expansion would include stores near the new Regency Square shopping center and on Normandy Boulevard near Lane Avenue.

were filed in U.S. District Court in Jacksonville. The suits, brought on behalf of 38 heirs of those who died in the Dec. 29 fire, were against the U.S. Fidelity & Guaranty Co., the hotel’s fire insurer. On March 6, the hotel owners settled out of court for a sum reported to be $1.26 million. Cases against the owners of the hotel were subsequently dismissed in Circuit Court, leaving USF&G as the only defendant. Attorneys for the insurance

company, a Delaware corporation, asked for and received a removal order, having the remaining cases against them transferred to federal court. The fire occurred on the morning after the Gator Bowl football game and apparently began in the ballroom. No one was killed by the fire, but instead by smoke that filled the interior. (The structure is now The Carling apartment building on West Adams Street between Laura and Main streets.)

FIRST INSERTION STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF INTENT TO ISSUE PERMIT REVISION The Department of Environmental Protection gives notice of its intent to issue a permit revision to JEA, Paul K Steinbrecher, 21 West Church Street T-8, Jacksonville, Florida 32202 for the Blacks Ford WRF. This permit revision includes a proposal to increase the surface water discharge from Outfall D-001 to Blacks Ford Swamp from 2.0 MGD AADF to 6.0 MGD AADF. This permit revision is accompanied by an Administrative Order, AO-191-NE which is a specific requirement of this permit. The facility is located at latitude 30° 4’ 39.38” N, longitude 81° 35’ 5.56” W, on 1310-100 Roberts Road, Southeast of Fruit Cove, Jacksonville, Florida 32259 in St. Johns County. The Department has assigned permit file number FL0174441-019-DW1P to the proposed project. The intent to issue and application file are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the FDEP Northeast District Office, 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256, at phone number (904)256-1700. The Department will issue the permit with the attached conditions unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, Florida Statutes, within fourteen days of receipt of notice. The procedures for petitioning for a hearing are set forth below. A person whose substantial interests are affected by the Department’s proposed permitting decision may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, Florida Statutes. The petition must contain the information set forth below and must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Under Rule 62-110.106(4), Florida Administrative Code, a person may request an extension of the time for filing a petition for an administrative hearing. The request must be filed (received by the Clerk) in the Office of General Counsel before the end of the time period for filing a petition for an administrative hearing. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), Florida Statutes, must be filed within fourteen days of publication of the notice or within fourteen days of receipt of the written

notice, whichever occurs first. Section 120.60(3), Florida Statutes, however, also allows that any person who has asked the Department in writing for notice of agency action may file a petition within fourteen days of receipt of such notice, regardless of the date of publication. The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition or request for an extension of time within fourteen days of receipt of notice shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, Florida Statutes. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, Florida Administrative Code. A petition that disputes the material facts on which the Department’s action is based must contain the following information, as indicated in Rule 28-106.201, Florida Administrative Code: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any e-mail address, any facsimile number, and telephone number of the petitioner, if the petitioner is not represented by an attorney or a qualified representative; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the determination; (c) A statement of when and how the petitioner received notice of the Department’s decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the Department’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the Department’s proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and (g) A statement of the relief sought by the petitioner, stating precisely

the action petitioner wishes the Department to take with respect to the Department’s proposed action. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice. Persons whose substantial interests will be affected by any such final decision of the Department have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. In addition to requesting an administrative hearing, any petitioner may elect to pursue mediation. The election may be accomplished by filing with the Department a mediation agreement with all parties to the proceeding (i.e., the applicant, the Department, and any person who has filed a timely and sufficient petition for a hearing). The agreement must contain all the information required by Rule 28-106.404, Florida Administrative Code. The agreement must be received by the Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, within ten days after the deadline for filing a petition, as set forth above. Choosing mediation will not adversely affect the right to a hearing if mediation does not result in a settlement. As provided in Section 120.573, Florida Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and 120.57, Florida Statutes, for holding an administrative hearing and issuing a final order. Unless otherwise agreed by the parties, the mediation must be concluded within sixty days of the execution of the agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be affected by such a modified final decision must file their petitions within fourteen days of receipt of this notice, or they shall be deemed to have waived their right to a proceeding under Sections 120.569 and 120.57, Florida Statutes. If mediation terminates without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing processes under Sections 120.569 and 120.57, Florida Statutes, remain available for disposition of the dispute, and the notice will specify the deadlines that then will apply for challenging the agency action and electing remedies under those two statutes.
