UPS to shift workers to Westlake center United Parcel Service Inc. seeks an administrative deviation that would allow for 304 parking spaces for cars and 112 spaces for truck-trailers at the warehouse it is leasing in the Westlake Industrial Park. UPS will use the 399,190-square-foot warehouse on almost 40 acres at 12400 Presidents Court for hub capacity while its Westside Industrial Park center is being expanded. Property owner LIT Westlake LLC applied for an administrative deviation to the city’s zoning code to increase the maximum number of off-street parking spaces from 220 to 304. “The tenant (UPS) will have more employees working at this facility than what the parking code will allow,” says the application. By Caren Burmeister Contributing Writer Later this year, the state Supreme Court is expected to consider a parental leave rule that would let judges postpone a court case when a lead attorney needs time to be with their newborn. The Florida Bar Board of Governors recently voted in favor of the parental leave rule and will be filing a petition for the state court’s approval in July, said Francine Walker, the Bar’s information director. If the Florida Supreme Court grants the petition, it will hear oral arguments in the matter in six months, she said. Many lawyers see the parental leave rule as pivotal to balancing their career and family life, said Jennifer Shoaf Richardson, president of the Jacksonville Women Lawyers Association. “I am thrilled by the Board of Governors’ unanimous support of the parental leave rule and the men who stood up to speak in favor it, including our own Michael Tanner,” she said, referring to the Jacksonville trial law-
yer who is a member The Florida Bar Board of Governors. “In doing so, it showed that The Bar intends to take action and does not mean to only pay lip service to gender bias in the legal profession.” The parental leave rule was a key issue in the State of The Florida Bar 2017 presentation to the JWLA in April. There, nine women raised their hands to show they had met resistance in getting a judge to grant a continuance so they could care for their newborn. The JWLA sent a letter to the Board of Governors to show its support for the proposed rule. The letter summarized the experience of a Jacksonville lawyer who had recently given birth and been denied a continuance in her court case. As a result, the woman was forced to choose between telling her client to get a new lawyer, or traveling to a trial 200 miles away from her 7-week-old baby, whom she was breastfeeding. “The Florida Association for Women Lawyers has had a seat at the table on the Board of Governors for years and I feel like the

The Board of Governors, which is authorized to formulate and adopt court policy matters, voted 5-4 in favor of the new Rule of Judicial Procedure on May 26. Under the proposed rule, a judge shall grant the lead attorney in a case a three-month parental leave continuance if it’s made in reasonable time and there’s no substantial prejudice to the opposing party. In denying a motion, the judge must provide grounds for denial. If the opposing party objects on the grounds of substantial prejudice, the attorney making the motion has the burden of demonstrating there’s no substantial prejudice to the opposing party. One the Bar files the petition with the state Supreme Court, there will be a period of time for people and organizations to make comments, Walker said. The state court can amend the rules, deny the amendment, or send it back to the Bar with suggestions.

lion to be paid out over 20 years. The incentives hinge on Atkins’ ability to finish the project within 60 months. For the past seven years, Atkins has been working to start the restoration. He came close in 2015 before a partnership with Jacksonville Jaguars owner Shad Khan fell through. Even with the setbacks, Atkins said he remained focused and never lost his desire to take on the large project that is significant to the Downtown core. “I’ve been told this deal was dead several times,” he said. “But something’s only dead if you allow it to die.” Atkins is a partner with Las Vegas-based Molasky Group on the $90 million project for the two sites. The Laura Street Trio, which includes the Florida Life, Marble
Bank and Bisbee buildings, will be gutted. It will be transformed into a Courtyard by Marriott hotel and also feature a market, restaurant and rooftop bar. When completed, the former Barnett Bank building will add about 100 market-rate apartments to the urban core, along with retail and office space. A 550-space, $11 million parking garage also is part of the project and will be built by the developers on property the city owns at Adams and Laura streets. Atkins wouldn’t say when crews would begin work. “As you know, we’ve applied for a few permits, and we’ll be releasing a timeline for construction very soon,” Atkins said. “I think we’re going to take a bit of an exhale before we continue,” he said. Atkins said the legislation
shows that revitalizing Downtown is a priority for the city’s leadership, and he referred to several other projects. “We’re seeing the beginning of some real traction with everything else that’s starting to pop up around the city,” he said. Developments in LaVilla, the Cathedral District, Brooklyn and the Southbank are planned or underway. she said. “No other city has the natural resources Jacksonville has.” In her role as council president, which ends this week, Boyer said she’s had plenty of conversations with businesses and individuals. Boyer said embracing tourism would help Jacksonville distinguish itself nationally and globally. “It’s not that we have a negative reputation, we just don’t have a reputation,” she said. Boyer represents District 5, which covers San Marco, San Jose and much of South Jacksonville. She outlined her year as council president Wednesday to the Southside Business Men’s Club and talked about her plans. She said tourism and the area’s natural resources are natural fits. “As you know, the state of Florida has a brand and makes a lot of money on tourists,” said Boyer. “Jacksonville has never really engaged and worked to be part of that Florida brand.” Doing so, she said, would provide jobs for “people who want to find work, but could not otherwise find jobs.” Boyer said she’s talking about hospitality, dining and other service-industry jobs generated

by tourism. “I think it’s especially important for areas of the city where unemployment remains high,” she said. Boyer also plans to continue her crusade to “stitch both sides of the river back together.” For the past few months, she has been presenting her ideas on how to activate areas of the St. Johns River near Downtown. It includes “nodes” or places along the riverfront that would include river-taxi stops, features and interactive visitor kiosks. “It’s not just one project, it’s multiple projects, and marketing and capital,” she said. Boyer said the first “node,” Corkscrew Park, will be completed this year and council set aside funds for the next two projects. She said repairs for Friendship Fountain on the Southbank are budgeted, “which will include more landscaping and some of those enhanced features.” Finally, she said, she’ll continue pushing developers to expand the Riverwalk on their own, or provide easements for the city to do it, when they present plans for riverfront development. “Our idea is to create a complete loop, connecting both sides
of the river,” she said. Her year at the helm was highlighted in part by controversial legislation reforming the city’s pension fund and expanding the human rights ordinance to include protections for the LGBTQ community. “As a city and as a governing body, I think we handled those issues pretty smoothly,” Boyer said. She said council probably achieved about half of what it set out to do a year ago. Even so, Boyer said she’s proud of the progress on other hotbutton issues, like funding more positions at Jacksonville Sheriff’s Office and improving infrastructure around the city. Boyer and Vice President John Crescimbeni will leave their leadership positions tonight as incoming President Anna Brosche and Vice President Aaron Bowman are installed. The Duval County Law Library features more than 10,000 volumes and is open to all.
By Max Marbut Associate Editor North Florida’s largest collection of state law includes reference materials dating back more than 170 years. Along with more than 10,000 volumes of bound books and other printed documents, online legal research and one-to-one technical assistance are available 8 a.m. to 5 p.m. Monday to Friday. And like all public libraries, it’s free and open to everyone. “The intent is to provide the most comprehensive, complete collection of Florida law available,” said Bud Maurer, director of the Duval County Law Library on the second floor at the Duval County Courthouse. The library’s operating budget — about $280,000 this year — is derived from a portion of the $65 fee imposed by the court on anyone who pleads guilty or nolo contendere (no contest) to, or is found guilty of, any felony, misdemeanor or criminal traffic offense under the laws of the state. On the shelves are volumes of state cases and statutory law as far back as 1845, the year Florida became the 27th state. Also available are business and legal forms, pleading and practice guides and forms and legal topic treatises. On average, more than 1,000 people visit the library each month, Maurer said. About 25 percent are attorneys who pre-

fer to open a law book to do their research instead of logging on to the internet. “I think a lot of people want to see the real book,” Maurer said. “The older attorneys want the books. The younger attorneys are more adept with technology.” For those who prefer to point and click instead of turn pages, the library has free access to the WestLawNext and Lexis
Advanced online legal research services as well as the HeinOnline collection of college law journals. Seventy-five percent of the library’s patrons are pro se litigants: people who wish to — or have to — represent themselves when initiating or responding to a legal action. “It’s people who are filing their own lawsuit and they need help,”
said Maurer. Although he and another of his staff members have law degrees, they aren’t practicing attorneys and do not offer any form of legal advice to patrons or prepare legal forms. “We’re here to guide, facilitate and educate,” said Carol Forbes, the library’s assistant director of research services. “We point them to the
resources and help them find what they’re looking for,” said Assistant Director of Technical Services Tracey Murphy. For a small fee, the library can provide photocopies of documents and legal forms. Fax service also is available. There’s a CD collection of the most requested continuing legal education programs from The Florida Bar available for attorneys in good standing to borrow for a $30 fee. Maurer, who’s been director of the library since 2000, said that out of the 67 counties in the state, Duval is one of 17 that maintain a physical law library. He’s confident that if Duval’s isn’t the No. 1 public law library, it’s behind only Miami-Dade County.
