First phase of Powers Bay in concurrency 60-acre commercial park is proposed on Philips Highway. The first phase of the Powers Bay Business Center appears to be a 12,000-square-foot building on the 60-acre site at 14485 Philips Highway. The city issued a Concurrency Reservation Certificate on Wednesday for the project. Civil engineering firm Waitz & Moye Inc. is the agent. St. Johns River Water Management District filings show Powers Bay is planned as an almost 600,000-square-foot commercial park along Philips Highway south of Florida 9B and north of Race Track Road. The district issued a permit in October for a stormwater man-
agement system to service a 61-acre commercial center to be constructed in three phases of development. The center is led by applicant and landowner Frapag Powers Bay LLC and would start with two phases at a budget of more than $60 million, according to the district application. Applicant John Zehmer with Frapag Powers Bay said Thursday he could not comment on the first phase and that he had no update on the previously filed plans, which he said were “highly conceptual” The property is 1.7 miles south of Florida 9B along Philips Highway. “Although we are optimistic that the U.S. 1 site will eventually mature into a highly desirable location for the planned project, we believe that a realistic timeline for development is in the five- to 10-year time frame,” Zehmer wrote in a July 8, 2016, letter to the district. Zehmer said Thursday nothing was imminent.

UPS lands permit for Westlake site The city issued a permit Thursday for United Parcel Service to build-out the 400,000-squarefoot former Samsung center in Westlake Industrial Park at a project cost of $4.9 million. Atlanta-based UPS will lease the structure, previously used by Samsung Electronics America Inc., for additional packageprocessing capacity while its hub expansion at Westside Industrial Park is under development. Renovations are expected to be completed this fall in time for the holiday season. UPS said in late July it is hiring about 1,600 new part-time positions across four shifts between the Jacksonville hub being expanded in Westside Industrial Park and the Westlake Industrial Park relief hub. It said it is hiring through October, with a goal to have the package-sorting positions filled

Edley’s Bar-B-Que coming to Ortega Nashville restaurant Edley’s Bar-B-Que announced Friday it has chosen Jacksonville for its first Florida location and will transform a former gas station into restaurant space in the historic Ortega neighborhood. The 2,600-square-foot space is at 5344 Ortega Blvd. at Roosevelt Boulevard. Edley’s said it plans to provide a large indoor dining area and an open patio. CBRE associate Lara Bahri said that a nationally recognized eatery like Edley’s choosing Jacksonville
as its fifth location “is a testament to the city’s growing retail market.” Virginia and Todd Ogletree will own Edley’s Bar-B-Que in Jacksonville. Virginia Ogletree said the project will bring an old building “back to life.” Edley’s Bar-B-Que is a family-owned business, named after the owner’s grandfather, Edley Newman. The restaurant offers traditional barbecue menu items, such as brisket platters and pork sandwiches, as well as Mexicaninspired meals like catfish tacos and barbecue nachos. Downtown Subway store closes Landlord Dalton Agency to convert it to “space with attitude.” By Karen Brune Mathis Editor Subway franchisee Joseph Moore closed his Downtown store at 140 W. Monroe St. on Tuesday, blaming the city’s decision to allow food trucks in the adjacent Hemming Park. He also said that vendors at the monthly First Wednesday Art Walk were allowed to park in front of the building, hindering access to his sandwich shop. “The city forced us to close,” Moore said Friday morning as he was packing shelving into a vehicle. He said he has been paying rent and utilities while the food trucks can hook up to city electricity for free. Moore said he has owned the Downtown Subway for six or seven years and has 10 more shops from Mayport to Middleburg, a stretch where “I don’t have any trouble.” He ended his comments as he began to meet with landlord Jim Dalton, CEO of the Dalton Agency, whose leaders own the building. Dalton said Friday that when the ownership group bought the
building a decade ago, it signed a 10-year lease with the Subway franchisee and the lease is up at the end of the year. Dalton leadership bought the structure in February 2008. A news release from the agency said the Subway lease was month-to-month. Dalton said he did not know why Moore closed the shop. Dalton said it operated Monday-Friday from 7 a.m. to about 5 or 6 p.m., and on some weekends during events. “I’m not privy to their business decision or why they shut down. I just know their lease is up and they didn’t want to renew the lease,” he said. Dalton said he learned of the decision about two weeks ago. Subway leased about 2,000 square feet of space, which Dalton Agency intends to convert into a multipurpose space for use by clients, staff and Downtown groups. Dalton, a national advertising and public relations firm, said in the release that the building ownership group comprises agency principals Jim Dalton, Dave Josserand and Michael Munz. “Our vision is to create a meeting and workspace that offers a catering kitchen, meeting rooms and entertainment space with attitude,” the release reads.

Dalton said he hoped to complete the space design by the end of the year and build it next year. The release said the staff’s ideas and desires will be part of the design. It said the space provides a way “to bring an adaptive reuse philosophy to how we make this space fun, not just for our staff and clients but for the community as well.” Dalton said the ownership considered leasing out the space and there was interest, “but I think it’s difficult for a retailer only to be open Monday to Friday during the day because there is not a lot of night and weekend business.” kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466

Her first legal task was to prepare an order for Dyer to sign declaring a state of emergency to activate the Florida Department of Law Enforcement. Other legal issues during the hostage standoff involved coordination of 27 law enforcement agencies that responded to the scene, including the FBI. After the crime scene was secured, Mateen’s body was taken to the medical examiner’s office. When it wasn’t claimed by a family member, the city, which Downs said had jurisdiction, was planning to have the Coast Guard bury Mateen at sea. “But, fortunately, a family member picked it up,” she said. The legal issues didn’t let up post-event, Downs said. One issue was what to do with more than $33 million that had been donated to victims who had been injured and the families of those murdered. The city retained a professional funds manager to consolidate the donations and ensure the money was properly disbursed. “Every dime we collected, we distributed to victims and families,” Downs said. Another legal issue involved thousands of public records, such as 911 calls and cellphone videos made inside the club that were the focus of a lawsuit filed by The New York Times and other plaintiffs when the city refused to release some of

the records. Downs said while most 911 calls are subject to disclosure under Chapter 119 – the “Sunshine” laws – certain records were exempt under Chapter 406, which exempts from public records law audio or video recordings of the killing of a person. Legal issues surrounding the incident even extended to building and safety codes weeks after the tragedy, Downs said. When the building was inspected, the city felt it was structurally unsafe because of the number of bullet holes. Downs said she learned from the experience that “senseless acts remind us that nothing is promised” and “where there is tragedy or a community problem, there is always a lawyer willing to help.” The association’s next meeting is scheduled at noon Oct. 20 at the Omni Jacksonville Hotel with guest speaker Al Letson, a nationally recognized public radio host, poet and performer from Jacksonville. mmarbut@jaxdailyrecord.com (904) 356-2466

Rayonier AM hit by Irma costs Rayonier Advanced Materials Inc. became the first Jacksonville company to specify a cost from Hurricane Irma, saying the storm could reduce this year’s earnings by more than 20 percent. Rayonier AM shut down its cellulose specialties products plants in Fernandina Beach and Jesup, Georgia, as Irma approached the area two weeks ago. The plants reopened Sept. 12 after Irma passed, and the company said Tuesday they were back operating at full capacity. However, the cost of stopping and restarting operations is expected to reduce net income by $6 million, and shipment delays will cut sales volume and lower earnings by another $1 million, the company said. At the end of the second quarter, Rayonier AM forecast earnings of $32 million to $39 million for 2017. It now is forecasting earnings of $31 million for the full year. Rayonier AM’s stock moved little after the lower forecast last week, with investors more focused on the long-term outlook and the company’s pending merger with Montreal-based Tembec Inc. The companies have received all antitrust clearances for the merger, which will more than double Rayonier AM’s size and expand its geographic reach. Rayonier AM said it expects to complete that deal in the second

Irma postpones CSX listening session Irma caused the U.S. Surface Transportation Board to postpone its scheduled “listening session” for CSX Corp. to hear complaints about service disruptions from its customers. The STB last week said it rescheduled the session, originally set for Sept. 12, to Oct. 11. CSX freight customers have made numerous complaints about service disruptions on the railroad as new CEO Hunter Harrison implements his Precision Scheduled Railroading system. In its weekly service update, CSX said key metrics continued to improve and “Hurricane Irma did not interfere with broad recovery momentum.” After the storm, CSX “re-
established rail service in most of the Southeast U.S. within hours, into and out of Northern Florida within 24 hours, and throughout the vast majority of the state within one week,” the company said. CSX said it had to clear nearly 8,000 fallen trees from its tracks and deployed more than 700 generators to provide power to signals and crossings. The company has not announced additional costs related to Irma.

ence, Stifel analyst John Larkin said attendees continued to complain about CSX’s service. “CSX service, while improving off the bottom, is still subpar, according to numerous attendees,” Larkin said. “Norfolk Southern clearly has picked up some service sensitive market share and truckers have been deluged with calls looking for truckload capacity to run freight around frustrating CSX delays,” he said. Larkin didn’t mention Jacksonville-based trucking firm Landstar System Inc. in his report, but he did discuss the trends that have been helping Landstar’s stock recently. “Truckload supply and demand was tightening in May and June and remained relatively tight during the early stages of the third quarter,” he said. “Hurricanes Harvey and Irma, though, have accelerated the rate of tightening fairly dramatically.” Landstar, which has provided trucking services for hurricane recovery efforts in the past, is expected to benefit because it has more capacity to handle the demand than its competitors. That has sent the company’s stock higher since Harvey hit Texas last month. “Capacity is flowing to Texas and Florida with emergency supplies on board. As the emergency/rescue phase of the recovery winds down, we expect the rebuilding effort to kick off. Demand for rebuilding supplies should be strong for an extended period,” Larkin said.

Regency Centers Corp. has been dealing with short-term challenges as Irma shut down the Wells Fargo Center, where the shopping center developer maintains its corporate headquarters. However, one analyst is concerned about longer-term trends in the grocery industry impacting Regency. Most of the company’s shopping centers across the country are anchored by supermarkets. “The grocery environment has become more challenging and will likely only get worse,” Jefferies analyst George Hoglund said in a research report on the industry. Hoglund downgraded Regency from “buy” to “hold” and lowered his price target on the stock from $74 to $67, with the stock trading at $65.47 at the time. “While we acknowledge that Regency has a high-quality portfolio and management team, we think that increasing concerns on
the grocery sector following the Amazon/Whole Foods combination will weigh on Regency, as approximately 79 percent of its portfolio is grocery-anchored,” he said. “While we still believe that Regency will continue to outperform its shopping center peers on a same-store net operating income basis in the near term, we think that the increased grocer headline risk will weigh on the group and impair stock performance in the near-to-medium-term, relative to other REIT sectors.” Hoglund said Jefferies’ grocery analyst, Chris Mandeville, is negative on the sector because of Amazon and other trends. “The confluence of factors includes the Walmart and Kroger investment in lowering prices, the expansion of the hard discounters (Aldi/Lidl), Target’s greater focus on the grocery category, and growing online competition,” he said. Regency has long been considered a strong and stable real estate investment trust, or REIT, because grocery-anchored shopping centers had been seen as more resistant to economic downturns. Hoglund noted he upgraded Regency to “buy” in June because of that. “Admittedly, the timing of our upgrade was pure bad luck, as it occurred the same morning of the Amazon/Whole Foods announcement. As such, Regency sold off 4.1 percent that day,” he said.
Northrop rises on Orbital deal Northrop Grumman Corp.’s stock jumped to a record high last week after announcing a $9.2 billion deal to buy Orbital ATK Inc., another aerospace and defense technologies firm. Orbital, which specializes in missile defense systems and rockets, will become a fourth business sector for Northrop, which currently operates in the aerospace, mission systems and technology services sectors. Virginia-based Northrop’s operations include an aerospace facility in St. Augustine. Northrop said it expects to achieve $150 million in cost savings when it integrates operations of the two companies and it will be accretive to cash flow and earnings, but it did not give forecasts. Northrop’ stock rose $8.94 to $275.97 last Monday after announcing the merger and reached a high of $282.93 on Friday. mbasch@jaxdailyrecord.com

The applicant’s authorized representative and mailing address is: Chip Osteen, Operations Manager, West Fraser, Inc., Whitehouse Lumber Mill, 109 Halsema Road South, Jacksonville, Florida 32220. Facility Location: West Fraser, Inc. operates the existing Whitehouse Lumber Mill, which is in Duval County at 109 Halsema Road South in Jacksonville, Florida. Project: On September 9, 2014, the Department issued Permit No. 0310197012-AC (PSD-FL-430) to West Fraser, Inc. pursuant to Rule 62-212.400, Florida Administrative Code (F.A.C), Prevention of Significant Deterioration (PSD). The permit authorized the construction of two new continuous lumber kilns (Kiln Nos. 4 and 5) to replace three existing batch lumber kilns (EU 001 – EU 003) at the referenced facility while also authorizing and increase in production from 110 to 170 million board feet of lumber per year. The project also involved replacing the existing fuel storage silo to increase the capacity for storing dry shavings for the kiln burners. The Department conducted PSD review and Best Available Control Technology determination for volatile organic compounds. On May 3, 2016, the original authorization to commence construction was extended 18 months, with a new deadline of September 9, 2017. On August 30, 2017, the Department received an application requesting a second extension of Permit No. 0310197012-AC (PSD-FL-430). According to the application, this request for a second extension to commence construction, is necessary due to certain economic market conditions that have not justified proceeding with the construction. Specifically, there was a delay in purchasing land adjacent to the Whitehouse Lumber Mill that is necessary for finalization of the planned construction. This land has now been acquired, and West Fraser is moving forward with the proposed construction. West Fraser is requesting that the commence construction be extended until March 9, 2019. The Department will extend the authorization to commence construction requested by the applicant. Authorization to construct shall expire if construction is not commenced by March 9, 2019. The expiration date of the Permit No. 0310197-012-AC (PSD-FL-430) will also be extended until January 1, 2020, to provide the necessary time to complete construction and submit a Title V air operation permit revision application to the Department. Permitting Authority: Applications for air construction permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210 and 62-212, F.A.C. The proposed project is not exempt from air permitting requirements and an air permit is required to perform the proposed work. The Division of Air
Resource Management’s (DARM) Office of Permitting and Compliance is the Permitting Authority responsible for making a permit determination for this project.
