Phoenix Adams Rising is renovating the six-floor Lerner Building for the café on the ground floor and for housing for 60 students on the upper floors. Philanthropist Jim Winston donated $100,000 in support of the café’s 12-seat private dining area. The Winston Room will be available for meetings and community groups. The café will operate under the direction of the FSCJ Culinary Arts & Hospitality program and will be open to the public. FSCJ said it will operate as a “farm to table” counter-service restaurant for breakfast and lunch five days a week. It will be available at nights and on weekends for private events. In August, the Local Initiatives Support Corp. nonprofit provided $4.5 million in construction lending and a bridge loan to the building owner to assist with the project. Shealy said the financing included $850,000 for a bridge loan to the developer, who will repay it when federal historic tax credits are distributed through the National Park Service. The remaining $3.7 million is a construction loan that will convert to a five-year permanent loan after construction is completed. “It’s a good project for Downtown and the city of Jacksonville,” Shealy said. He and Owens said LISC is working in partnership with the Downtown Investment Authority to provide funding on projects that they deem viable for the Downtown core. The DIA anticipates a $6.2 million private capital investment to restore the building, which Duval County property records show is 106 years old. Through the DIA, the developer was approved for $600,000 from the Downtown Historic Preservation and Revitalization Trust Fund to restore the exterior and some interior elements. Also, another $600,000 is available for FSCJ in zerointerest loans over 10 years to cover any shortfall between the school’s revenues from student rentals and its financial obligations to the developer. The city approved a permit in January to convert the building from business to multifamily use at a project cost of $4.8 million.

The partners moved into offices on the ninth floor of the Stein Mart Building on the Southbank Downtown to specialize in representing plaintiffs in truck, bus and large commercial vehicle accident litigation. The first time Camerlengo represented a client in a truck crash action was 10 years after a 19-year-old woman was killed when a truck collided with her car. He began specializing in large vehicle cases about five years ago. For Anderson, it was more personal. His brother had a head-on collision with a semitrailer. “Fortunately, he survived. But I understand the impact,”

Anderson said. Camerlengo and Anderson have joined forces with two other attorneys who also specialize in large vehicle accident damages litigation: Joseph Fried of Fried Rogers Goldberg in Atlanta, and Michael Leizerman of E.J. Leizerman & Associates in Toledo, Ohio. The plan is to create the “truck crash dream team,” Anderson said. The overall practice group – branded “The Truck Accident Law Firm” – is licensed in Florida, Georgia, Illinois, Ohio, Michigan, New York and Tennessee. Camerlengo said the federal laws regulating commercial vehicles and interstate commerce are complex. Establishing responsibility and coverage and then proving liability takes experience because the practice is so specialized. The total amount of settle-

ments won for clients in the past year by all the partners in the group was about $200 million and “you’ve got to have the knowledge and the muscle. You don’t want a car crash lawyer on a truck crash,” Camerlengo said. He and Anderson, along with trial attorneys Leslie Sloan, formerly of Coker Schickel, Heather Solanka, formerly with the Akerman firm, and support staff are working in a 6,000-squarefoot office suite with a view of the Northbank skyline and the St. Johns River spanning from LaVilla to Southside. Closed primary elections draw scrutiny “Write-in candidate loophole” shutting out nonpartisan voters.

By Lloyd Dunkelberger The News Service of Florida As Florida’s population grows and more residents shun traditional party affiliations, voters are befuddled, if not angry, about the state’s closed-primary system, including the use of writein candidates. “When it comes to the primary election, our voters are confused,” Broward County Supervisor of Elections Brenda Snipes testified Wednesday before the state Constitution Revision Commission’s Ethics and Elections Committee. Many new voters move to Florida from other states with more open voting systems as opposed to Florida’s closed primaries, which are restricted to voters who are registered with parties. Florida is one of nine states using a closed-primary system. “We have people coming from all over the country, and they bring with them the experiences

that they have had and what they know,” Snipes said. “It’s difficult for them to understand.” Adding to the confusion is that more voters are opting not to join the Republicans or Democrats but register with “no party affiliation” or in a host of minor parties. No-party affiliation is the fastest growing segment of the electorate and is particularly popular with young people, with more than one out of every four Florida voters falling into that category. But no-party voters can’t vote in Democratic or GOP primaries, although they can cast their ballots in nonpartisan primary races and in general elections. Florida has a provision that opens primaries to all voters when all of the candidates are from the same party and there is no general-election opposition. But it has been undermined by a state Division of Elections ruling, upheld by the courts, that says the presence of a general election write-in candidate closes primaries, even if only one party has a primary election. The net effect of the so-called “write-in candidate loophole” is that the primary winner ends up

as the only name on the general election ballot, virtually assuring a win. “What I see happen quite often is the write-in candidate is put into the race as a tool to close the race down,” Snipes said, adding that many write-in candidates drop out before the general election. Steven Hough of Florida Fair and Open Primaries talked to the committee about his proposal to change Florida’s closed-primary system to a “top-two” system where all voters could participate in primary elections. Patterned after election systems now used in California and Washington, Hough said the revision would place all candidates for an office in the primary, with the top two vote-getters advancing to the general election. For Hough’s proposal to advance, it would have to be sponsored by a Constitution Revision Commission member and win support from at least nine other members. It could also be embodied in a proposal filed by commission members, who have until Oct. 31 to submit their proposed constitutional amendments.
