versity, part of the Texas A&M University system; followed by active duty as a military police officer. Her shift toward a legal career began when Charbula served with a fellow officer who was a lawyer in the Judge Advocate General Corps. “He offered me the opportunity to learn how to do legal research. I volunteered in the JAG office on my own time. That inspired me to want to be an Army lawyer,” Charbula said. When the Army declined to send her to law school, Charbula applied to several, including her first choice as a native Texan, the University of Texas at Austin Law School. “I applied to eight law schools and got accepted to every one — except UT Austin,” Charbula said. She settled on the Florida State University College of Law, graduated and was admitted to the Bar in 1987 while serving in the Army Reserve. Her first job was assistant state attorney in Florida’s 2nd Judicial Circuit, where she served until she returned to active duty in 1989. She was deployed to the former Yugoslavia and served as command judge advocate and legal adviser to the task force commander. After receiving her master of laws degree in 1994, she became chief of administrative law at the U.S. Military Academy at West Point. In 1997, Charbula left the Army and returned to Tallahassee, where she was deputy general counsel at her law school alma mater.
She returned to government service when she became chief assistant prosecutor in the Office of Statewide Prosecution, then staff attorney in the 1st District Court of Appeal. Charbula was assistant attorney general in the Capital Appeals Division from 2003 to 2013 before moving to Jacksonville and private practice with the Arnold & Sichta law firm. She joined the 4th Judicial State Attorney’s Office in 2014, where she was director of the Legal Division until being appointed to the bench. Charbula first submitted an application to a Judicial Nominating Commission in 2004. “I was persistent,” she said. After 13 years of seeking a seat on the bench, she’s looking forward to the next phase of her career. She began a few minutes after being sworn in by shadowing County Judge Gary Flower, who also was Roberson’s judicial mentor when Roberson transitioned from his law practice to county judge. Charbula moved into Roberson’s former office and will share the suite with County Judge Pauline Drake. First Judicial Circuit Chief Judge Mark Mahon said he’s known Charbula as a distinguished assistant state attorney and is looking forward to seeing her presiding on the bench in county court. “Let’s see if she’s as good a referee as she is a player,” he said before administering the oath. mmarbut@jaxdailyrecord.com (904) 356-2466

Topaz Lighting will lease almost 90,000 square feet at 780 Whittaker Road.
Topaz Lighting expanding, relocating to Northside Company moving to Imeson International Industrial Park. Topaz Lighting Corp., which leases space in Northwest Jacksonville, is relocating to a larger warehouse. The New York-based company operates at 2020 W. 26th St. and intends to move to 780 Whittaker Road in Imeson International Industrial Park in North Jacksonville. Topaz, based in Holtsville, applied for a Certificate of Use to move into the 281,000-squarefoot distribution center and seeks a building permit to renovate space there. Topaz will lease 89,600 square feet. The pending permit calls for $542,336 in renovations for the space to include offices, a meeting room and a break room. Jacob Horsley and Tyler Newman, directors with Cushman & Wakefield, represented Topaz in the lease negotiations. Horsley said Topaz employs 15 to 20 people in Jacksonville and he anticipates three to four more upon the move. Horsley said Topaz distributes in the Southeast. “Sales are good. A lot of this is organic growth. They are meet-
ing their goals and outgrowing their existing space,” he said. Horsley said Topaz has been leasing 42,552 square feet in the West 26th Street building since 2012 and is renting another 53,760 square feet month-tomonth until the Whittaker Road warehouse is ready. Luke Pope, senior vice president of JLL, represents the landlord, MDH Partners LLC. John Richardson, president and principal of Newmark Grubb Phoenix Realty Group, represents the 204,000-square-foot West 26th Street structure. Topaz representatives did not return calls for comment. According to its website, Topaz makes electrical fittings and LED lighting products. It says it has been in the manufacturing business for more than 30 years. Topaz applied to do business in Florida in 2007 to distribute electrical and lighting components and items. Its sales offices are in Holtsville; San Fernando, California; and Vero Beach.
Floor & Décor again is confirmed More confirmation surfaced for Floor & Décor’s plans for a store near St. Johns Town Center. The St. Johns River Water Management District is reviewing plans for a 74,000-squarefoot “proposed retail flooring outlet” on 6 acres at 10595 Brightman Blvd. south of Topgolf.
Plans filed with the district application are labeled “Floor and Décor.” Floor & Décor also was identified on a civil plan application filed with the city. The Smyrna, Georgia-based company said it comments about stores closer to opening. Developers of the project have not announced the identity.
Fogo de Chão to open Nov. 13 Southern Brazilian steakhouse Fogo de Chão announced it will open for lunch and dinner Nov. 13 at 4784 Town Center Parkway in The Strand at Town Center. It will be its third location in Florida. The menu features fire-roasted meats prepared and carved tableside by gaucho chefs. Fogo Jacksonville will debut a new dinner menu. Fogo also offers lunch, weekend brunch, the Bar Fogo and group and private dining. The Jacksonville culinary team is led by chef and General Manager Marcio Welter, who grew up on his family farm in Brazil. The company was founded in 1979 in Porto Alegre, Brazil, and expanded into the U.S. in 1997. Attorney keeps athletes ‘winning the right way’ 21-year-old cold case closed Travis Tygart, CEO of the U.S. Anti-Doping Agency, visits JU. A homecoming visit by a member of one of Jacksonville’s most prominent families in the legal community turned out to be an opportunity for the Davis College of Business at Jacksonville University on Thursday. Attorney Travis Tygart, CEO of the U.S. Anti-Doping Agency, was guest speaker at the college’s Davis Leadership Forum: The Business of Sports. Son of attorney Tom Tygart, nephew of Senior Circuit Judge Fred Tygart and brother of Lyndsay Tygart, a member of The Jacksonville Bar Association board of governors, he leads the U.S. national organization for anti-doping for Olympic, Paralympic and Para Pan American sports and manages drug testing of amateur athletes in a variety of sports. The organization is perhaps best known for its investigation of the U.S. Postal Service Cycling Team that determined team members were using prohibited performance-enhancing drugs. The results led to the International Cycling Federation in 2012 stripping seven-time Tour de France winner Lance Armstrong of his titles and banning him from the sport for life. “The question is ‘can you play by the rules and win?’ Whether in business, law or politics,

there’s an idea that it’s tough to win if you play by the rules,” Tygart said. “But winning the right way is the only way to truly win,” he said. The organization has administered to athletes about 150,000 tests for prohibited substances in the past 10 years, Tygart said. About 1.6 percent of the tests were positive. Athletes knowing they can be tested at any time, including during their off-season, is an important part of the program, Tygart said. “We know we can’t catch all the violators, but we are confident that our testing programs reduce the number of athletes who use banned substances. Without a mechanism to get caught, it would be a free-forall.” Tygart became the agency’s CEO in 2007 and has worked with the organization for more than 15 years. After graduating from law
school at Southern Methodist University in 1999 and being admitted to the Bar, Tygart initially considered pursuing a career as an agent for professional athletes, “but that wasn’t for me,” he said. While in private practice, he was outside counsel for the Boulder, Colorado-based antidoping agency until 2002 when he joined the staff as director of legal affairs and later, senior managing director and general counsel. He serves on the Sports Lawyers Association board of directors and the board of governors for the Partnership for Clean Competition. The Davis Leadership Forum will convene at noon Thursday at JU’s River House when Thomas Kennedy, chairman and CEO of the Raytheon Co., will talk about the latest developments in national defense and government cybersecurity. The State Attorney’s Office closed a 21-year-old cold case last week when Terrence Keith Payne, 44, was found guilty by a jury of armed sexual battery. He was accused of raping a woman at knifepoint in October 1996 at her Arlington home. The victim reported the crime immediately, but was unable to identify her attacker because his face was concealed. She was administered a sexual assault exam, but the DNA in the rape kit was not tested until September 2014. Payne was identified as the perpetrator. The case was prosecuted by assistant state attorneys Coreylyn Crawford and Erin Wolfson. Payne is scheduled to be sentenced this week by Circuit Judge Steven Whittington and could face a life sentence in Florida State Prison.
Jacksonville attorney suspended The state Supreme Court issued 11 disciplinary orders for the period Sept. 13 to Oct. 26, including one against a Jacksonville lawyer. Case No. SC17-1632: Christopher Michael Ochoa, 212 Trout River Drive, is suspended until further order. According to a petition for emergency suspension order, Ochoa appeared to be causing great public harm. More than $1 million was transferred into Ochoa’s trust account for a business deal, and he failed to return the money upon request. He also solicited

In this case, it meant that one of the children could not be discharged from a hospital because of the environment in the home. What were you able to accomplish for your client? Through extended negotiation with the contractor’s attorney, we were able to secure a monetary settlement for the family. The money will allow them to make needed repairs to the home including mold remediation.

What were the basic facts of your case? My client is a wife and mother to eight children. The family owns and operates a small business in order to provide for the children. They purchased a mobile home and, in 2014, sought repairs to the roof through a contractor. Although verbal and written warranties were provided to my client and her family regarding the contractor’s work, the job was poorly executed. The shoddy work resulted in significant leaks throughout their home, which then caused mold growth. One of their children is diagnosed with leukemia and mold is dangerous to his suppressed immune system. After some of the child’s treatments at the hospital, the child could not be discharged to their home due to the conditions caused by the faulty repairs. The roofing company refused to provide adequate repairs and stopped taking my client’s phone calls. The family was very worried they would not be able to pay for additional repairs, a critical need due to their son’s illness.

Bold, beautiful and worth preserving: Let’s tell Jacksonville’s stories

For years, Jacksonville identified itself as the “Gateway to Florida” or “Where Florida Begins.” Instead of being a beginning or a gateway, we need to be an end or a destination that embraces our identity as a city. Just as each person has an identity, so do cities. This sense of identity or place is important. It helps to partially define a people and elicits feelings, tastes, thoughts, scenes and neighborhoods. Just like you or me, a city’s history and experiences, good and bad, help form a sense of identity for any place. Jacksonville has a rich and fascinating history which is lost on most, even in Florida. This is why historic preservation, resources, and presentation are so important. Earlier this year, during her term, City Council President Lori Boyer discussed the issue of tourism and a lack of authentic identity when presenting Jacksonville to our friends across the country and world. She discussed a path forward for the city and our identifying centerpiece, Downtown, that included better access to the river, new exciting development, and a focus on more heritage tourism that tells Jacksonville’s story. She also proposed the city consider opening a welcome or history center for people visiting Jacksonville. I applaud Boyer’s leadership on this issue because we have so much to offer. Let’s celebrate Jacksonville’s music, arts, athletics and culture that have impacted our state and our country. Jacksonville is James Weldon John-

son writing “Lift Every Voice and Sing.” Jacksonville is the Ritz Theatre, Ray Charles and the LaVilla music scene. Jacksonville is the Southern Rock genre that originated in this region making the band Lynyrd Skynyrd a household name, giving a start to the Allman Brothers, and inspiring countless country and rock artists that continue to cover “Free Bird” at their concerts. With the recent deaths of so many well-known musicians, it is time to start a conversation about how to preserve and present this vital and interesting history of our city and region. Jacksonville raised business leaders
Charles Merrill, who founded Merrill Lynch, Louis Wolfson, Jessie Ball duPont and Ed Ball, all with complicated and fascinating stories. Jacksonville is our naval history and servicemen and servicewomen. There is so much that sets us apart: The Florida-Georgia football game (for which a museum should be open to the public regularly) and the “World’s Largest Outdoor Cocktail Party” that surrounds it that have been going on since 1933; the PGA Tour and The Players golf tournament, the Jacksonville Jaguars and the authentic culture of aquatic sports at our Beaches.
Our story also is riddled with problems, racism and epic failures. The full story always needs to be told. The scars define us as much as our triumphs. There is no place in Florida that has as many historic neighborhoods and structures as Jacksonville. From Riverside to Avondale to the Beaches, and from San Marco to Downtown to Springfield, Jacksonville is unique in its historic stock of buildings. The Laura Street Trio and Barnett Building being adaptively reused is a massive step toward ensuring that sense of place and identity for Jacksonville. Cowford Chophouse recently opened in the old Bostwick Building, which was constructed in 1902 after the Great Fire. It was only three years ago the city discussed tearing down the building in favor of a parking lot. I hope that the community and the city will continue to preserve other structures that provide a glimpse into our history, even from the midcentury, like the current JEA headquarters originally known as the Universal-Marion Building, rather than building another parking lot. It’s hard to imagine, but in 1901, this city burned to the ground in what is considered the largest urban fire in the history of the Southeast. Yet, literally from the ashes, Jacksonville rebuilt with its own style and character that is decidedly Southern but also Floridian. In a time when so many of us have been displaced, or rebuilding, after Hurricane Irma, we can find inspiration in that bold past. Fifty years after consolidation, let’s be bold again in telling the story of our beautiful home and giving the world some Southern hospitality with a Florida flair. Let’s embrace our history. Let’s preserve our history. Let’s present our history. Our experiences are what authentically define us and inspire us for a better tomorrow. THE JBA SENIOR HOLIDAY PROJECT
It’s the most wonderful time of the year Join the annual project and give back to your community. The Jacksonville Bar Association partners each year with Meals on Wheels and Aging True to give back to those who are in need through the Senior Holiday Project. Participating members of the JBA are matched with a senior in the Meals on Wheels program after that organization and Aging True contact seniors who submit a list of items they would like as gifts. The items range from appliances to clothing and snacks. The holiday partner then purchases a gift from their match’s wish list. While some members choose to personally deliver their gifts and even spend time with their senior, the Jacksonville Sheriff’s Office steps up and delivers the remainder. Last year, JBA members were able to provide gifts to 275 people. We hope to provide gifts to even more seniors this year. What we want to share with the community is how rewarding this opportunity is for those who participate. While the purpose of the Senior Holiday Project is to bless others, as is often the case, those who participate are the ones who end up feeling truly blessed. The Defenders, having dominated the league since its rebirth in 2015 with two full undefeated seasons, suffered two losses by only two points each. ‘I’m going to make you live by the Constitution if I have the power to do it’ Sheppard law firm spent year gathering information for bail system lawsuit. BAR BULLETIN STAFF
In 1974, just six years out of law school, William Sheppard was appointed to represent Duval County inmates in a federal case over living conditions at the jail. The legal battle over those issues, including overcrowding, ultimately led to the construction of a jail that opened in 1991. It was an early victory in Sheppard’s path to building a law practice rooted in civil rights work, though many others followed, including the 2015 marriage equality case in Florida. Now, as he nears his 50th year in practice, the firm has another federal civil rights case involving the jail. This time, the fight is about how bail practices impact misdemeanor offenders who can’t afford to pay. They either plead guilty even if they’re not or “languish” in jail, the lawsuit said. Florida Department of Corrections records show Duval County detains, by far, more pretrial misdemeanor defendants than any other county in the state. The lawsuit, with three misdemeanor offenders as the plaintiffs, was filed Aug. 30 against 4th Judicial Circuit Chief Judge Mark Mahon and Jacksonville Sheriff Mike Williams. It contends the bail system violates the equal protection and due process clauses of the U.S. and Florida constitutions. Sheppard and Elizabeth White, his wife and law partner, talked last week about why they filed the suit over the long-standing policy now; some of the resourceful techniques they used to gather the information, including putting people in first appearance court to help gather statistics; and why civil rights cases are important to the firm. Here is an edited version of the discussion: The bail bond procedure has been in place for a long time. Why did you decide to challenge it now? Sheppard: Well, I think it’s like everything else, its time has come. There’s a nationwide movement going on and we’re kind of at the lead of it. Not the lead, but not too far behind the lead pack. It’s happening across the country and it’s going to accelerate. And it’s going to skyrocket to the U.S. Supreme Court, I predict in about two years. I think the issue of why, too, is we are beginning to realize that just the sheer numbers are not sustainable. The number of people who are being locked up for misdemeanors that really don’t belong there is costing the system so much money. White: Millions of dollars. When you think about where the money could be going in terms of prevention, or even providing education programs and mental health programs within the jail, it’s just money that needs to be spent elsewhere. Sheppard: I have been trying to do this since 1974 ... when I recognized the jail was overcrowded. How do you un-crowd an overcrowded facility? You let people out. Who do you let out? The ones least likely to be hurtful to anybody. That would be nonviolent misdemeanants.

White: This even becomes an issue when you talk about the facility itself. You think about a house that was supposed to be built for a family of four and family of eight is living in it. That’s when you start getting plumbing issues and you’re seeing a lot of the plumbing issues. The plumbing in that facility was not designed for the number of people using it. Is the process driven by money for some people? Sheppard: If you drove around Jacksonville five years ago, I wonder how many bail bonding companies you would have found. I remember when I started there were about two. Now there are probably 200. Where does that money go? There’s about five major national insurance companies that all this money funnels to. It is big, big corporate America and they make millions of contributions to lobbyists every year to keep this in place. In all of these cases around the country where people are bringing these suits on behalf of the inmates, inevitably the bail bondsmen intervene in the cases. Talk about the process you went through to investigate the issue. It must have taken an amazing amount of research, interviews and reviewing public records. And it had to be expensive. Sheppard: Because I’ve spent so much of my life litigating over jails and prisons, I’m tuned in to what’s going on. And I talk convict talk. I represent a lot of people who are in and out of the jail. I have lawyers that I work with that are in and out of the jail. About a year ago I picked up on movement in this area.I followed all of the cases that are traveling through the court system.
White: Then you tried to put a court reporter in J-1 (court) and she got thrown out. Sheppard: Yeah, they weren’t welcome. White: We were trying to get our court reporter in there just for the information to avoid the considerable expense that would be incurred by having to order official transcripts. ...We were not going to use it as an official transcript. (The request was denied by Mahon, White said.) Sheppard: I devised another method to get the numbers, so I got them several different ways. I sat people in the courtroom. White: We literally put people in the courtroom. For a long time. Over six months. Sheppard:I talked to a jillion people in and out of the system. And obtained (public) records. It took a lot of legal research to feel confident that I’m on solid ground, too. How did you piece it all together? White: We were comparing, OK, what do we see here? What is this agency saying here? Then we also actually interviewed inmates in the jail. That becomes a little tricky because they get worried, “I’m going to talk to these lawyers and the next thing I’m going to get in trouble or they’re going to add more charges.” We tried to be protective so that people didn’t feel like they would be in jeopardy if they gave us information. Can you talk about the impact on a person who is held for so long because they can’t afford bail? Sheppard: You lose your job, you lose your family, you lose your money. They’re on the street because they lost their job because they couldn’t make bail.
White: It could be my age, but I see how it affects the mothers. You see these women in their 60s there every weekend to see their sons. They may have grandchildren and may be taking care of them. One person never goes to jail. It’s the family. There’s a real lack of looking at the big picture of who gets affected. You cannot discount the mental health factor of this. It’s not like this is somebody that says, “Oh, I’ve graduated from college and I know what I need to do X, Y and Z.” They don’t have anybody to help them understand the process to begin with. That’s why they end up at the jail. There’s no place for them. Yes, there are nonprofits here that are doing their very best. It’s not enough. It’s just not enough. Why are these types of cases so important to you? Sheppard: Mine’s kind of hokey. When I went in the Army, I took an oath to uphold the Constitution and I was willing to kill you for it. When I became a lawyer, I took the same oath. I’m not going to kill you, but I’m going to make you live by the Constitution if I have the power to do it. White: I became a civil rights lawyer because my dad was in the Air Force and saw the death camps after they were liberated and he saw Japan after it was bombed. I have very clear memories of him telling me the measure of a society is how we treat the least fortunate. We feel like we have a duty to uphold the Constitution. This guy (Sheppard) keeps free copies of the Constitution in his waiting room and has done it long before anyone else. The bottom line is we are talking about human beings and they are not being treated in a humane way. I think at a minimum that we have the right to expect that from the system. I really do.

Hurricane Irma canceled annual family law CLE

Each September, The Jacksonville Bar Association Family Law Section holds a family law CLE seminar. The goal of the seminar is to instruct, inform, educate — and hopefully, entertain — family law practitioners. September 2016 was the first year that I, with a lot of help from others, had the pleasure of organizing the event. Rather than most CLEs, wherein one lawyer speaks to a group of lawyers about updated case law, Laura Giovannetti and I wanted to provide family law practitioners with information and advice from those who affect our practice. Along with individual presenters, we had a mediator panel, a mental health professional panel and a judicial assistant panel. Giovannetti and I received
positive feedback; however, in retrospect, we may have had too many panels. Christie Guerrero and I began working on September 2017’s CLE in December 2016. We predicted that if we could quickly set the schedule and pin down most of the details, then we would be able to advertise the event, create some buzz, and hopefully, have more attendees than before. I am proud to say that by May 2017, with the assistance of Blane McCarthy and Carla Ortiz-Ramos, Guerrero and I were able to find presenters, create the schedule, secure a location and create a flyer for our event. We had a fantastic event planned. We went back to the one-presenter format; however, we chose topics which were interesting and unique. Our topics ranged from competency and the mental health of our clients to tax consequences in a divorce (i.e., a discussion on capital gains and equitable distribution shortfalls). We were scheduled to present an intermediate-to-advanced discussion of the hidden issues found in QDROs and Divorce Power Analyzer. Presenters were going to educate practitioners on the differences between temporary and concurrent custody, as well as the difference between domestication and registration of a foreign judgment. Unfortunately, our CLE was scheduled
at the Duval County Courthouse for the Friday after Hurricane Irma hit Jacksonville. We had to cancel the event. As I look back on the planning of both of the CLE seminars, I realize that most of the people who were assisting me were fellow members of The Florida Family Law American Inn of Court. While I am rather new to the organization, it is celebrating its 20th anniversary this year. Our Inn started when Duval County Judge Gary Flower, Homer Bliss, Cindy Catalan and David Garfinkel began meeting monthly for dinner to discuss trends in the law and current cases. Shortly thereafter, the group decided to become more formal. In May 1998, Circuit Judge Jean Johnson became our first president. The Inn has adopted goals through which membership is an honor, members are encouraged to collaborate with each other, and members are provided with educational programs. Ned Price is our current president. Under his leadership, the Inn continues toward its goal to help its members become better citizens. We are working to promote professionalism and legal education, and to become a beacon of civility for our local practitioners. Most of our meetings qualify for CLE credit for the attendees. Throughout the year, we work to sup-
port the community. Our members have made donations to domestic violence shelters, worked to improve and promote visitation centers, and have donated time to serve the less fortunate. Currently, the Inn is supporting those affected by Hurricane Harvey and Hurricane Irma. All of our hard work is paying off. The Inn has reached Platinum Status, which is the highest possible level. At the end of October, our presidentelect, Circuit Judge John Guy, attended the Celebration of Excellence hosted by U.S. Supreme Court Justice Elena Kagan. Guy attended a reception and an awards presentation, followed by dinner in the Great Hall of the U.S. Supreme Court in Washington, D.C. Other public proposals moving forward include: Closing a loophole in the homestead property tax exemption to block protection for those obtaining homestead using proceeds from a fraudulent or dishonest act, or causing creditor damages or losses by a criminal or fraudulent act. Prescribing a “right to earn an honest living” free from government infringement unless the government can demonstrate evidence to show infringment is necessary to advance an important government interest and less restrictive alternatives have been sincerely considered. Prescribing the personal right to a clean and healthy environment, enforceable against any party subject to reasonable limitations under the law. Narrowing the language related to Florida’s right of
privacy. This measure would limit governmental intrusion into private lives only “with respect to privacy of information and the disclosure thereof.” Removing an obsolete provision about developing a high-speed ground transportation system. Other proposals of note include: Increasing the mandatory retirement age for justices and judges. Removing the prohibition against using public revenues in aid of any church, sect or religious denomination or any sectarian institution. Automatic restoration of civil rights to certain felons upon completion of sentence. Mandatory uniform technology for all Florida courts. Electing the secretary of state (rather than the post being appointed by the governor), establishing the secre-
tary’s duties, and including the secretary as a member of the Cabinet. Next, the commission will hold a series of meetings to discuss and accept public comment on the surviving proposals. When the final votes are held, at least 22 of the commissioners must vote to approve an amendment for it to be presented to the voters on the November 2018 general election ballot. Until 2006, a proposed constitutional amendment needed only 50 percent of the popular vote to become law. Now, if 60 percent of the voters approve an amendment, it will become law. Working on those committees, or working with the Young Lawyers Section, provides a great way to build strong relationships while letting others know your interests and skills. I can think of no better way for a young attorney to build a career than to work on a committee side-by-side with senior attorneys and judges. A strategy of involving oneself in important committee work and building reputation through service to JBA or The Florida Bar committee efforts is bound to be more successful than buying into some pay-toplay recognition system and getting a plaque.
