Sales at handbag maker, which has a distribution center in Jacksonville, fall 3 percent. Coach is an international brand of handbags and other accessories that is highly dependent on its Jacksonville distribution center. So when Hurricane Irma hit the area in September, Coach felt it. Coach’s parent company, Tapestry Inc., last week reported Coach’s sales fell 3 percent in the first quarter ended Sept. 30 to $924 million and comparable-store sales (sales at stores open for more than one year) fell 2 percent. The company said the Schulman sales drop was due in part to certain “anticipated” issues, including the shift in timing of a Chinese festival into October. “However, what we did not anticipate were the additional impacts of the hurricanes in North America and the typhoons in Asia,” Coach brand CEO Joshua Schulman said during Tapestry’s conference call with analysts. “In addition to the direct impact to sales at stores in the hurricane’s path, we also experienced disruption to our Jacksonville, Florida, distribution center, which services all of our North America business,” he said. “That distribution center had trouble both receiving merchandise from the port and then getting it out to the network of Coach stores across the country.” Schulman said sales are

Public defenders are planning a new strategy to convince lawmakers to boost spending and wages. By Max Marbut Associate Editor In 1963, the U.S. Supreme Court in Gideon v. Wainwright held that the Constitution’s Sixth Amendment’s guarantee of counsel is a fundamental right essential to a fair trial and, as such, applies to the states through the due process clause of the 14th Amendment.

In the opinion, Justice Hugo Black stated that “reason and reflection require us to recognize that in our adversary system of criminal justice, any person hauled Cofer into court, who is too poor to hire a lawyer, cannot be assured a fair trial unless counsel is provided for him.” He further wrote that the “noble ideal” of “fair trials before impartial tribunals in which every defendant stands equal before the law . . . cannot be realized if the poor man charged with crime has to face his accusers without a lawyer to assist him.” The ruling changed the law of the land and created a new career: public defender.

But since the office was created, states, including Florida, have not funded public defenders at the same level as prosecutors. According to the state Justice Administration Commission, attorneys in the Office of Public Defender for the 4th Judicial Circuit are paid, on average, about 80 percent of what attorneys in the State Attorney’s Office are paid. That’s an annual salary of $58,138 for the defense, compared to $72,738 for the prosecution. “It makes it difficult for us to compete in hiring new lawyers coming out of law school,” said 4th Circuit Public Defender Charlie Cofer. With a budget set by the state each year to serve all the defendants for whom the court appoints a public defender, it’s a case of divvying up the salary account among the number of attorneys it takes to handle the caseload. “You want to pay people what they’re worth, but you have to have the office staffed so that it works,” Cofer said. The salary disparity is an issue that’s on the agenda for the Florida Public Defenders Association – and it has been for decades, said Stacy Scott, the association’s chair of appropriations and public defender for the 8th Circuit, comprising Alachua, Baker, Bradford, Gilchrist, Levy and Union counties. “Public defenders have been chronically underfunded,” she said. Scott agreed with Cofer that it’s a challenge to build and sustain the highest-quality staff. “The retention problem is huge. Even if people love the work and are dedicated to their work, they can’t afford the work,” Scott said. She said attrition is most likely when an assistant public defender has between three

We train them and then they leave for the private sector — or even other government jobs.” The association lobbies the Legislature each year to increase the budget appropriation for public defenders, but it’s been a tough sell in Tallahassee. “Prosecution and law and order — that’s what people want. It’s not exactly the most political thing to fund defending criminals,” said Scott. There was a bill introduced last session to increase assistant public defender salaries by 6 percent, but it died in the House on the final day of the session. Scott said this year’s strategy will be to work together with the state attorneys association to push for higher salaries for both sides and to diminish the disparity. “We feel good that the prosecutors have come to the table with us to work together on an issue. The focus on lawyers is the common ground,” Scott said. “There are a lot of progressive criminal justice Republicans. You never know what’s going to happen.”

Law school responds to allegations it isn’t meeting standards. Florida Coastal School of Law submitted a 70-page report last week to the American Bar Association in response to allegations that the school is not in compliance with ABA standards and rules of procedure for approval of law schools. “We are fully compliant, based on our data, and all of our projections indicate we will stay in compliance,” said Scott DeVito, dean of the school. In a letter sent to Florida Coastal in October, the ABA said that its Accreditation Committee concluded that the school is not “maintaining a rigorous program of legal education that prepares its students, upon graduation, for admission to the Bar” and the school is “admitting applicants that do not appear capable of satisfactorily completing its program of legal education and being admitted to the Bar.” DeVito said the action by the ABA likely is the result of the February Florida Bar exam results, when only 25 percent of Florida Coastal graduates who took the exam for the first time scored high enough to be admitted to the Bar. “Having a 25 percent Bar pass rate is terrible. The ABA’s job is to make sure we’re educating students,” he said. The report includes more than 60 charts and graphs, DeVito said, that demonstrate that while Florida Coastal graduates have not performed well on their first exam, the ultimate pass rate is more than 80 percent, above the 75 percent standard set by the ABA. On admitting applicants that do not appear capable of completing the program and being admitted to the Bar, DeVito said he and school President Dennis Stone evaluated Florida Coastal’s admission practices two years ago and then implemented a plan to incrementally raise the

minimum Law School Admission Test Score required to enter the school. Florida Coastal’s bottom quartile score increased from 141 in 2016 to 145 in 2017. The spring 2018 class is being enrolled at a 147 bottom quartile. “We raised the standards long before the ABA started looking. If the ABA’s goal is for Florida Coastal School of Law to raise incoming credentials, we’ve already done that,” DeVito said. “My goal is a 75 percent firsttime pass rate. With a 147 class, I believe we can do that,” he added. The Accreditation Committee is scheduled to meet in early December and is expected to evaluate Florida Coastal’s response, DeVito said. “If they determine we’re in compliance, it’s done. We expressly requested that the ABA finds us in compliance,” he said. If the committee doesn’t agree next month with the data in the response, DeVito and Stone will appear before the committee when it convenes in March in Williamsburg, Virginia. “We are confident we will come out well,” said Stone.

Medtronic PLC last week said the financial impact of Hurricane Maria on its Puerto Rico operations was less than originally forecast. The medical device maker said it was able to restart its operations on the island faster than expected and it was nearly back to pre-hurricane capacity by Oct. 18, a month after the storm. Medtronic, which had originally forecast a $250 million hit to its quarterly results, now says Maria reduced revenue in the second quarter ended Oct. 27 by $55 million to $65 million. The storm impact reduced earnings per share by about 3 cents. Medtronic is forecasting adjusted earnings, excluding the Maria impact, to be flat to slightly higher than last year’s second quarter earnings of $1.04 a share. Medtronic, which is headquartered in Dublin, Ireland, manufactures surgical instruments for ear, nose and throat doctors at its Jacksonville facility.

Lawyers get advice on how to ‘be heard’ Council member Lori Boyer, state Sen. Audrey Gibson and attorney Erika Alba offer insights at JWLA meeting. By Max Marbut Associate Editor This year’s theme for the Jacksonville Women Lawyers Association is “be heard,” and invited to the group’s monthly meeting on Thursday were two subject matter experts on being heard in City Hall and in Tallahassee. City Council member Lori Boyer and Foley & Lardner Public Affairs Director Erika Alba comprised the panel. They were joined by a surprise guest — state Sen. Audrey Gibson from Jacksonville — who offered her insights as well. Jackson Lewis attorney and association President Jennifer Shoaf Richardson said that each year, members of the local and statewide women lawyers organizations go to Tallahassee before the legislative session to “walk the halls” to ensure lawmakers know where women lawyers stand on issues. “If you really want to be in the

process, become an expert in an industry,” said Alba, who began her career in public affairs law with Fidelity National Financial before the company moved from California to Jacksonville in 2003. Boyer said building relationships is important and, in her case, relationships are best built outside City Hall. “Broaden your participation beyond your practice,” she advised. “Get out into the community.” With the large number of bills that the Legislature must evaluate each session, Gibson said taking advantage of the unexpected can make the difference in delivering your message. “If you see someone in the elevator that you want to talk to, start talking,” she said. “That is serious time. It may be your only opportunity to get your point across.” There are common traits among the most successful advocates, whether in public affairs or in the courtroom, said Alba. “Lobbying is a lot like litigation. You have to be precise and you have to know your issue well,” she said. Alba also said maintaining a

Robert Gobelman retires from Marks Gray A member of The Florida Bar for 59 years, he started his career in 1958. By Max Marbut Associate Editor Robert Gobelman, of counsel at Marks Gray, retired Oct. 27 from The Florida Bar. He and his wife, Mary Bland Love, joined Marks Gray in 2011 along with other members of the firm Gobelman, Love, Wasilenko and Kendall. A news release from Marks Gray refers to Gobelman’s “distinguished career defending complex litigation in state and federal courts in the areas of business and corporate law, insurance law, and product and professional liability.” A U.S. Navy veteran of World War II and an Army veteran of the Korean War, he graduated with honors in 1955 from Wittenburg University in Springfield, Ohio. Gobelman then attended the University of Chicago Law School on a full scholarship, graduating in 1958. He moved to Jacksonville and joined Osborne, Copp, Markham and Ehrlich, which merged to form Matthews, Osborne, Ehrlich, McNatt, Gobelman & Cobb. That’s where he met Love. The couple formed their own firm, Gobelman & Love, on April 1, 1988. In an article published June 6, 2003, in the Daily Record, Love recalled when she and Gobelman moved into their new offices Downtown on Adams Street in the building that is now headquarters for Jacksonville Area Legal Aid. “When we started, we had no carpet, borrowed furniture and Bob had a trial starting that Monday. We got the boxes unpacked on Saturday, drinking beer from

Scottie’s to get it done. Our first firm picture is Bob and me toasting our new firm with bottles of beer sitting on boxes,” she said. During Gobelman’s 59-year career, he served as president of the Jacksonville Association of Defense Counsel, Florida Defense Lawyers Association and Jacksonville Area Legal Aid. According to an article published Aug. 17, 2009, in the Daily Record, when Gobelman was made an honorary member of The Jacksonville Bar Association in recognition Gobelman of 50 years of m e m b e rs h i p in the Bar, he recounted his early work with legal aid. “In 1958, and for a number of years thereafter, it consisted of volunteer attorneys meeting once or twice a month as a panel of three and reviewing the client problems of the individuals who had presented to The Jacksonville Bar Association and if the problem required attorney representation, one of the three panel attorneys would take it and represent the client pro bono,” he said. Gobelman also was chair of the first zoning board established after consolidation of Jacksonville and Duval County governments in 1968 and was a founding member of the Jacksonville chapter of the American Board of Trial Advocates. “All of us at Marks Gray want to congratulate Bob on a great career and thank him for his contributions to this firm over the past years. The leasing opportunity consist of an aeronautical activity hangar.
