As Jacksonville companies reported third-quarter earnings over the past few weeks, nearly every one disclosed some kind of financial setback from Hurricane Irma. For fashion retailer Stein Mart Inc., the storm was particularly untimely because it coincided with the launch of a new campaign to reinvigorate its sagging sales. Stein Mart last week reported total sales for the third quarter ended Oct. 28 fell 4.7 percent to $285.4 million and comparable-store sales dropped 6.9 percent. C o m p a ra ble-store sales are sales at stores open for Kleffner more than one year and are considered a key indicator of a retailer’s performance. As sales dropped, Stein Mart recorded a net loss of $14.6 million, or 31 cents a share, in the quarter. During the company’s conference call, Chief Financial Officer Gregory Kleffner said 44 of Stein Mart’s 293 stores are in Texas and 46 are in Florida and most of those had to close or reduce hours as hurricanes Harvey and Irma came ashore. One store in Bonita Springs remains closed because of storm damage, but is expected to reopen at the end of this month. Kleffner said the direct impact of those closures reduced comparable-store sales by more than 1 percentage point. “The indirect impact from lower traffic caused by concern

Rogers Towers added to its staff a chief operating officer and a chief financial officer who are handling the business side of the firm, which has grown over the past 112 years to 55 attorneys in five offices. “These hires are a part of a long-term strategy calculated to enable us to continue to provide our clients with the high-quality service that we are recognized for and, at the same time, deliver the level of value that the marketplace demands,” said Rogers Towers Man-

aging Director Fred Franklin. Thomas Birdsong, COO, came to the firm after 16 years as executive director of operations at BorFranklin land-Groover Clinic. He will oversee management, administration, information technology and marketing. He received his MBA from the University of North Florida. Census service center opening at Imeson General Dynamics Information Technology hiring bilingual customer service representatives. Jacksonville counts toward the 2020 Census. General Dynamics Information Technology is hiring bilingual customer service representatives for its Jacksonville team to support its U.S. Census Bureau contract. More than 40 job postings seek bilingual customer-service representatives and quality assurance specialists in the lan-

guages of English and Tagalog, Cantonese, Mandarin, Arabic, Spanish, Vietnamese, Korean and Russian. Jobs are full- and part-time. Some of the postings explain the jobs are for temporary employment. Those hired would answer questions from the public, enter information to process requests for forms and collect and enter data at a Census Questionnaire Assistance contact center. General Dynamics Information Technology opened a customer center in late 2014 at One Imeson in the Imeson International Industrial Park. In April, it held a hiring event to continue staffing up the center that provides call center support services for customers. The company has not provided employment numbers, but building plans approved in May for an expansion indicated occupancy of more than 400.

The city approved a permit Thursday for Dav-Lin Interior Contractors Inc. to build-out 50,462 square feet of space at the center at 1 Imeson Park Blvd. for Census operations. Build-out costs are shown as $729,893. General Dynamics Information Technology, based in Fairfax, Virginia, won a $430 million five-year contract to provide contact-center systems and operations support for the U.S. Census Bureau’s 2020 Census Questionnaire Assistance program. General Dynamics Information Technology is part of General Dynamics, which is based in Falls Church, Virginia. One Imeson was developed in 1974 as a Sears catalog distribution center. The building contains about 1.6 million square feet of distribution and warehouse space along with office space.

The office space previously served as an America Online call center and an operations center for Prudential and Aetna Inc.

Three industrial properties sold in Jacksonville

Clarion Partner sold three North and Northwest Jacksonville properties, comprising three industrial buildings and vacant land, to three partnerships for $76.35 million. The deeds were executed Nov. 10 and recorded Tuesday with the Duval County Clerk of Courts. The partnerships’ New York address is shared by the Blackstone investment group. State corporate records show the partnerships’ principal and mailing addresses are in Chicago at Equity Office. The properties total more than a million square feet and encompass 126 acres.

Last year, The Jacksonville Bar Association’s Senior Holiday Project filled the conference room with gifts members purchased that were delivered to seniors by the Jacksonville Sheriff’s Office. This year’s gifts will be delivered Dec. 13.

JBA Senior Holiday Project seeks helpers Members needed to purchase, wrap and deliver gifts. With help from the nonprofit Aging True, more than 330 wish lists were collected from senior citizens for The Jacksonville Bar Association’s annual Senior Holiday Project. As of Friday, all but about 100 lists had been picked up by association members who will purchase the gifts and either deliver them directly, or take them to the JBA office for delivery by the Jacksonville Sheriff’s Office. It doesn’t happen often in legal procedure, but in keeping with the project’s 16-year tradition, the deadline for filing a wish list was extended past Nov. 1, said Baumann, Gant & Keeley associate Kimberly Jones, chair of this year’s project committee. “We know seniors are on their own schedules, and many don’t use the internet, so we receive their list in the mail. We want everyone to have a chance,” she said. The committee still needs about 100 association members to purchase, wrap and deliver the gifts to the association’s office at Wells Fargo Center after Dec. 4 and by Dec. 11. Jury instruction committee seeks volunteer attorneys

The Supreme Court Committee on Standard Jury Instructions in Criminal Cases is now accepting applications for committee membership. The committee is charged with updating the criminal jury instructions based on changes made to Florida statutes and opinions issued by the Florida district courts of appeal, the state Supreme Court, or the U.S. Supreme Court. The committee usually meets four times a year in the Central Florida area. All appointments are made by the chief justice. Lawyers licensed to practice law in Florida may apply for appointment. However, there currently are no open positions

The Florida Bar Leadership Academy seeking applicants

Starting Dec. 1, The Florida Bar Leadership Academy will accept from Florida Bar members in good standing applications for the 2018-19 Class VI. The deadline to submit an application is Jan. 15. By Mark Basch Contributing Writer Job growth resumed in the Jacksonville area in October after a one-month hiatus for Hurricane Irma, and the unemployment rate continued to drop. The jobless rate in the Jacksonville metropolitan area (Duval, Baker, Clay, Nassau and St. Johns counties) fell from 3.4 percent in September to 3.3 percent in October, the Florida Department of Economic Opportunity said Friday. The state agency does not adjust the data for seasonal factors. However, the University of North Florida’s Local Economic Indicators Project said when it is seasonally adjusted, it still shows a decline from 3.49 percent in September to 3.4 percent in October. The Department of Economic Opportunity also said after a big loss of jobs in September after the hurricane, Jackson-

ville area businesses had a 2.3 percent job growth rate from October 2016 through October 2017. That’s basically back to the August growth rate of 2.5 percent. UNF economist Albert Loh said the latest data is good news for the area economy Loh heading into the holiday hiring season. “That probably will push the job numbers even higher,” he said. Duval County’s unemployment rate fell by one-tenth of a percentage point to 3.5 percent, the state agency said. Loh said the county’s seasonally adjusted rate fell from 3.8 percent in September to 3.56 percent in October. Florida’s statewide unemployment rate fell by 0.2 points last month to a seasonally adjusted 3.6 percent. Ameris Bancorp, which moved its executive offices to Jacksonville last year, is making a bigger push in the market by acquiring Atlantic Coast Financial Corp. Ameris announced a $145 million agreement Friday to buy the parent company of Atlantic Coast Bank, which has eight branches in the Jacksonville metropolitan area and four in Georgia. This follows the March 2016 acquisition of The Jacksonville Bank, which had eight offices in the metro area. It entered into a consent order with banking regulators in December 2016 that prevented it from making any deals until it resolved compliance issues with the Bank Secrecy Act, a federal law requiring financial institutions to help the government prevent money laundering. The company blamed the problem on software glitches and said last month it had fixed the issues and regained compliance. Under the merger agreement, Atlantic Coast Financial stockholders will receive 0.17 shares of Ameris stock plus $1.39 in cash for each of their shares. Based on Ameris’ closing price of $47.30 Thursday, that values the deal at $9.43 for each Atlantic Coast Financial share. Atlantic Coast Financial’s stock closed at $8.69 Thursday.

“It’s the same approach here. We want to do everything we can for our attorneys so our attorneys can take care of their clients,” he said. The new financial management strategy is designed to benefit the firm’s board of directors and to allow the attorneys to devote more of their time to practicing law and serving clients, said Simmons. “We’re streamlining operations on the financial side and we’re getting more sophisticated software so we can do better analysis,” she said. “Attorneys will have a dashboard with all their metrics. They’ll be able to see their hours and collections, which is much better than having to call accounting,” she said. “Our focus is to take care of the attorneys so they can take care of their clients. When we do that, the rest falls into place,” Birdsong said. The first phase of the new strategy is management and administration. The next phase will be growing the firm, possibly in terms of the number of attorneys and the range of services, such as additional practice specialties. “We don’t want to stay as we are. We don’t have a set number, but we know that if you’re not growing, you’re dying,” said Birdsong. Decisions will be based on sound business practices and planning, he said. “We will go where the business is. We may have a big client that has work in other areas that loves what we do and asks us to set up shop in another area. The margins are just too narrow in this business to just randomly pick places. We will be very pinpointed,” he added. The campaign seemed to have an impact, as comparable-store sales were flat in October after the sharp declines earlier in the quarter, with “slightly positive traffic” in the stores, Hawkins said. The company last month eliminated 48 positions at its Southbank headquarters, leaving it with 293 corporate staff employees in the offices at 1200 Riverplace Blvd. “These actions are part of our ongoing efforts to control costs and simplify our business processes in this challenging retail environment,” Hawkins said. The job cuts and other expense reductions are expected to save $10 million in 2018. “We have made meaningful progress across a number of the initiatives that are beginning to positively impact our results. This will become more evident in the fourth quarter, when our business is not disrupted by hurricanes as it was in the third quarter and our initiatives take even greater hold,” Hawkins said.

Still no revenue for ParkerVision ParkerVision Inc. was supposed to have revenue to show for its third quarter, but once again last week the Jacksonville-based developer of wireless technology reported no sales. ParkerVision has not had any products on the market for several years, so it has not been generating any revenue. The company has become best known for a series of lawsuits against major electronics manufacturers that ParkerVision alleges have been infringing on its patented technology. Those legal actions remain ongoing. However, in August ParkerVision began taking online orders for its new product called Milo, which is designed to enhance inhome Wi-Fi performance. With shipments scheduled for September, that seemed to assure the company would have revenue in the third quarter, but it didn’t happen. “We made the decision to delay shipments by about one month in order to further refine our mobile app, which is important to the user experience,” CEO Jeff Parker said in the company’s conference call last week. Parker said product shipments began Oct. 13. Chief Financial Officer Cindy Poehlman said the company did begin recording revenue from Milo sales in October, as the fourth quarter began. “I am pleased to report that we are tracking exactly in line with

our forecast and I do believe it’s reasonable to expect, at a minimum, revenues in the hundreds of thousands of dollars in Q4 of 2017, and ramping towards millions of dollars in subsequent quarters,” she said. Parker also is optimistic. “The feedback that we have heard thus far is confirming our own belief that Milo fits into a significant market opportunity, where tens of millions of Wi-Fi home users are unhappy with their current Wi-Fi coverage, but they don’t want to spend hundreds or thousands of dollars to fix the Wi-Fi,” he said. Milo systems start at $129. “We continue to believe that Milo has the potential to generate significant revenue over the next several quarters and well beyond,” Parker said. With no revenue, ParkerVision reported a net loss of $4.4 million, or 24 cents a share, for the third quarter.

Highstar sells more Advanced Disposal For the second time since its initial public offering 13 months ago, Advanced Disposal Services Inc.’s largest stockholder is selling shares. Affiliates of Highstar Capital controlled Ponte Vedra-based Advanced Disposal before the IPO, holding 63.7 percent of the stock. When the company sold new shares in the IPO, Highstar’s stake fell below 50 percent. In May, Highstar sold off about 14 million of its shares, reducing its stake to 31.6 percent. Last week, a Securities and Exchange Commission filing by Advanced Disposal shows Highstar intends to sell another 6 million shares. That will reduce its stake to

almost 22 million shares, or 24.8 percent of the stock.

FIS exits China Fidelity National Information Services Inc., or FIS, announced an agreement last week to sell a business that serves the China market. FIS is selling SunGard Kingstar Data System (China) Company Ltd. to Zhongping Capital. Terms of the deal were not disclosed. The business provides software and processing solutions for China’s financial markets. “The divestiture is consistent with FIS’ primary goals of serving financial institutions and maintaining leadership positions in markets where the company has meaningful scale,” FIS said in a news release. FIS, which provides technology services for banks, sold another business that provided software to Chinese financial institutions in early 2015, saying it was not part of its strategic plans. FIS acquired SunGard Data Services Inc., the parent of Kingstar, in November 2015. FIS has not provided any financial data for Kingstar, but Robert W. Baird analyst David Koning estimates it produces about $10 million to $20 million in annual revenue and a penny per share in earnings to FIS. Goldman Sachs analyst: CSX a ‘sell’ Goldman Sachs analyst Matt Reustle initiated coverage last week of Jacksonville-based CSX Corp. with a “sell” rating on the stock. “While we believe new CEO Hunter Harrison can drive a turnaround in operating performance, we believe investors are overestimating the speed and magnitude of the earnings benefits,” Reustle said in his report. CSX’s stock has outperformed the S&P 500 index by 26 percent since reports s ta r te d in January that Harrison was interested in the CEO job, he said. Harrison Harrison had been credited with big improvements in performance at previous positions at Canadian Pacific Railway Ltd. and Canadian National Railway Co. “While we acknowledge Mr. Harrison’s success as an operator, we believe he is entering a materially different situation at CSX (versus CN and CP),” Reustle said. “We see headwinds to CSX’s margin initiatives given constraints on operating a dense eastern rail network and note that CSX is starting from a stronger operating position than CP and CN had at the time of Mr. Harrison starting at these firms,” he said. Besides his belief that investors have overvalued Harrison’s

1 cent per share. Revenue quintupled to $1.05 million due to the acquisition of two Dick’s restaurants which formerly were owned by franchisees. Results could have even been higher, ARC Group President Seenu Kasturi said in a news release. “Our revenue was negatively impacted by Hurricane Irma, which forced the closure of our company-owned stores and those of some of our franchisees for a few days, and our operating expenses were negatively impacted by some one-time rent expenses that we incurred,” he said. Dick’s Wings has 17 restaurants in Florida and five in Georgia.

Katie Dearing is the founder and owner of The Dearing Law Firm and president-elect of The Jacksonville Bar Association. She also is currently the only candidate who has filed for the 2018 election to replace her father-inlaw, retiring Circuit Judge Peter Dearing, on the 4th Judicial Circuit bench. Admitted to The Florida Bar in 1999, Dearing was an assistant state attorney until 2003, and then a shareholder at Liles, Gavin, Costantino, George & Dearing before she established The Dearing Law firm in 2012. Who or what inspired you to become a lawyer? I do not remember a time when I wanted to be anything other than a lawyer. I grew up watching “Law & Order” and I liked to convince people I was right. Being a prosecutor seemed like the only job for me.

How do you relate your undergraduate degree to your practice of law? My practice now is business litigation. My undergraduate degree is in criminology. There is not much common ground between those fields, so I don’t rely on it as often as I did when I was a prosecutor.

What community service have you pursued and why? I sought out leadership in The Jacksonville Bar Association because I like lawyers and I wanted to contribute — to help make our lives and work easier, better and more fun. The JBA gave me an opportunity to meet other lawyers (which is good for business) and to forge true friendships with people who understand the life of a lawyer. I chair the school advisory council at my kids’ elementary school because I am passionate about education and ensuring differentiated learning experiences for all children. I volunteer as a Sunday school teacher at our church because it’s important to contribute in all aspects of our community and to set that lesson for our chil-

I served on the Jacksonville Ethics Commission because I believe it’s important to engage with government at all levels, and make sure that government is open and transparent. I served on the board of Girls Inc. because, as the middle child of three girls and the daughter of a strong mother, I know the importance of being strong, smart and bold, which Girls Inc. inspires all girls to be. As the mother of sons, I wanted an avenue to assist girls who were not as fortunate as I was. One piece of advice for new lawyers? Network early. Get out of the office for lunch and get involved in Bar and community organizations. There is a pressure as a young lawyer to do nothing but bill time and please the partners. That is important, but it’s equally important to carve out time for your own career. Networking will generate business and help you meet lawyers outside your firm, some of whom will become your dearest friends.
