Summer is in full swing now. Kids are out of school, families are enjoying beach vacations, and the smells of grills firing up for evening barbecues permeates the warm air. The summer is my absolute favorite time of year. I enjoy the extra time I get to spend with Dylan, knowing each year that he is growing up too quickly and these summers together will end well before I am ready for them to. Being a beach girl, I love planning long weekend excursions to play in the sand and surf. I truly do love our Florida sunshine… hundred plus heat index and all! However, for many local businesses, the summer months also are their tough ones, with our winter residents gone. Many business owners share with us their fears of making it through the summer to see the snowbirds return. This is the time that these businesses have to think outside the box and come up with new ways to generate revenue to keep their business and families afloat. One of the biggest trends right now is “networking.” Networking has been around for centuries, with business deals being brokered over cocktails or dinners, or even on the golf course. Groups like Rotary and Kiwanis were joined by individuals wishing to socialize with other like-minded business individuals, with a common goal of building their business, while strengthening and giving back to their community. Then there were Chambers of Commerce popping up to provide support to local businesses, often in social settings. Branching off of those Chambers, we have seen the formation of smaller networking groups of people committed to doing business with one another and referring business to one another. Whether you are a business owner, or a resident who understands the importance of supporting your local small business owner, I hope you will enjoy the articles this month on select businesses we are spotlighting, as well as our feature on networking.

Progressive Aerodyne Tavares Welcomes Family Business A rt i cle and Photos b y S helly G er i g

Green tree tops, sparkling lakes, a bridge stretching over them and rows of orange groves are some of the fascinating sites to see when flying over Lake County in the Sea Rey Plane. This two-seater sea plane gives you a spectacular front row view of your surroundings, and the water landing is amazingly smooth for coming in at 65-70 miles per hour! Once you get in and take a ride, you are going to want one! This small, but mighty sea plane company now resides outside Tavares on Lake Idamere. They found the town was thrilled that they wanted to make it their home base and house all of the company together under one roof. It has been family owned for over 30 years with

three generations working together to make recreational planes for your enjoyment. You have the option to build some or the entire plane in the Builder’s Assistance Center and there is hanger space available to store it there. The Sea Rey has the same power as a Sea-Doo with a European 4 stroke modern aircraft engine that is quiet, fuel efficient, and environmentally sound. The company has positioned themselves for an opening in the market in China with the assistance of their distributor, Adam Yang. There is definite interest in recreation aviation overseas as well as in the States. For more information go to www.searey.com or call to make an appointment for a demonstration.

MOUNT DORA, YOU’RE IN THE MOVIES! Filming of “Ryann Watters and the King’s Sword” begins July in Mount Dora Article by Lisa Rast July through August Mount Dora residents will be seeing camera crews in the streets of Mount Dora for the filming of Ryann Watters and the King’s Sword. Based on Florida author Eric Reinhold’s book of the same name, the movie is a youth fantasy adventure with a Christian theme. TYG Studios CEO Kerry Fink says the movie targets the youth audience in the six to 14 age group, a demographic that Fink says is noticeably lacking good role models in movies. Ryann Waters and the King’s Sword is the first in a series of “Annals of Aeliana” fantasy adventure books authored by Reinhold. In a classic battle between good and evil, Ryann and his friends Liddy and Terrell embark on a quest for the King’s Sword in the fantasy world of Aeliana. King’s Sword and a second book, Ryann Watters and the Shield of Faith are both available for purchase at the Mount Dora Chamber of Commerce. A third book, Ryann Watters and the Belt of Truth is tentatively scheduled for release in fall of 2010. To date book sales have topped 15,000 units.

The book is based in Mount Dora, with actual streets and businesses in Mount Dora being named. Many of those businesses plan to display the book as a part of the marketing effort for the movie. Casting has been completed and actors will be announced July 5. Emily Humphrey of Kids Corporation will be portraying title character Ryann’s sister Alison, and Erin Bethea of Christian movies Facing the Giants and Fireproof has a role in the film. Notable personalities will be making cameo appearances. Producer Kerry Fink said “You will be amazed at some of the familiar faces…from sports figures to famous movie actors.” Slated to direct the movie is Michael Germaine, Executive Producer of TYG Media and an award-winning filmmaker. Michael’s feature film contributions include Fireproof and Letters to God, and he is currently working on the set of Courageous. The movie will be filmed on location in Mount Dora as well as locations in St. Augustine and the Enchanted Forest

Sanctuary in Titusville. Mount Dora resident and actor/film liaison Jeff Wise revealed part of the Aeliana sequences will be filmed in Gilbert Park, and a harrowing chase scene will be filmed on cobblestoned Dora Drawdy Way. Fink said filming on location in Mount Dora “creates another level of interest of everything that is Mount Dora.” Mount Dora resident Andrea Yatsuk is involved in the project as a liaison between moviemakers and Mount Dora

businesses. Yatsuk and Wise are working together to create “Escape to Mount Dora” vacation packages to promote the movie and stimulate tourism in the area. Plans for a Christian youth summer camp based on the book and movie are also in the works. Fink calls the movie “What everybody goes to the movies for, just a good, fun action-adventure story.” Theatrical release is slated for Summer 2011.

Congratulations and job well done Cuqui, your contributions to the Chamber and the area are priceless!

Clermont Police Investigator Victor Sanchez (far right) was recognized for his superior level of dedication and professionalism and awarded the Chamber “Public Servant” award. Clermont Chief of Police Steve Graham and Chamber Trustee Gary Clark with Ameriprise Financial presented him with the award at the Chamber’s June Breakfast. Ambassador Cuqui Whitehead was surprised with the “Ambassador’s Choice” award

at the June 10th BusinessAfter-Hours, held at Graphics Direct. Cuqui has consistently gone above and beyond the ‘call of duty’ to welcome new businesses to the community and to highlight what the Chamber does in the South Lake area.

The most recent “Gem of the Hills” award was presented at the June Chamber Breakfast to Pastor Kendal Anderson from The Crossing Church. Born in Minnesota, Pastor Anderson has a Bachelor’s of Science Degree in Molecular Biology from the University of Washington, and also a Master’s of Divinity from Bethel Theological Seminary. He came to Clermont in 2005 and immediately became involved in the South Lake Community. He started The Crossing Church and continues to be the lead Pastor for that congregation. He has been a large part of the Pig on the Pond here in Clermont as well as New Beginnings, and also is part of the Steering Committee for the upcoming Boys & Girls Club of South Lake. He also reaches

out beyond South Lake, as he is involved with the Cornerstone Church in Haiti and has lead numerous mission trips to that area. Congratulate Pastor Kendal when you see him in the area! Louise Stockton accepts the “big check” from the annual Howard Stockton Memorial Golf Tournament held at Bella Collina Country Club on May 7th. Chairman Michael Bucher (left) and Golf Committee Chair Gary Clark presented Louise with the $1,600.00 in proceeds raised to benefit the Howard Stockton Memorial Scholarship Fund. Well done to all of the sponsors, participants, and volunteers that work together to assist in this wonderful cause.

Sisters of Sound South Lake Women’s A Cappella Chorus Article and Photos by Lujo Karkovice

Barbershop music is a thing of the past, present and future for a South Lake county women’s a cappella chorus. Three-and-half years ago, a new Harmony Inc. chapter “Sisters of Sound” evolved in Clermont with just a handful of women. Since January 2007 Director Shannon Elswick has helped build the group to nearly 20 singers with ages that span six decades. Sisters recently adopted Abigail, a 12-year-old baritone in a package deal that included her dad, Jim Troeger, who agreed to share his musical talent as assistant director. Along with an annual show each fall, Sisters raise funds by singing Valentines for local folks and performing at holiday and other

venues. While those funds tend to offset “Sisters” competitive endeavors each spring as the chorus and small ensembles compete at Area 6 convention in Jacksonville, the women also have a strong “give back” quality. Many residents of senior nursing facilities, and cancer survivors at local events like Relay For Life of South Lake have enjoyed their old-time renditions. “We just show up and sing,” said one bass charter member of the group, noting there is no set-up involved as “we sing without instrumental accompaniment.” As well as bass, the equivalent of second alto, voice parts include first soprano or lead, second soprano or tenor, and baritone or first alto. FOCUS dedicates the following feature to local businesses. Letting you know where to go for the best services and products in your community. THIS IS A PAID ADVERTISEMENT SECTION

Getting Back to the Basics Somewhere in Time offers real food. Quick, what’s the first thing that comes to mind when we hear the word “organic?” Food that tastes like cardboard embellished with sprouts, that has come from the earth without the use of chemicals? Only partly correct, minus the cardboard taste, and not everything is garnished with sprouts. There’s a new gig in town that opened during the July 4th weekend, called Somewhere in Time – A Victorian Bakery. The Victorian era was a time in which life was not as complicated, nor were our foods. Today’s food is filled with all sorts of chemicals to enhance their look, to keep them fresh longer, and to allow seasonal foods to be available out of season. Somewhere in Time is revisiting recipes from a hundred years ago to present to patrons of its establishment. Proprietor Ken Wild was a frequent customer to Lynette Pate’s oxygen bar and retail store, which sold organic products. Wild was sad to see her store close and approached her with his idea that was already in the works. Pate is the general

manager of the new bakery and says, “we set out to show the world that organic isn’t just cardboard. You can indulge in tasteful food that doesn’t have the chemicals, and you aren’t giving up taste.” Pate is the author of “Fuel for the Body, Lose Weight the Pate Way.” Wild has been intrigued with health food, and an advocate of healthy living and now that his parents are older, he’s working to keep the previous generation healthy in their golden years. Diets tend to get restricted as far as sugars and salt, so this was a focus. Somewhere in Time is a certified slow food bakery, and is the first in Mount Dora. What this means is that everything is made by hand with real and chemicalfree foods. There is only raw sugar, stevia, agave nectar, and local honey used to sweeten the baked goods, and that’s all that is offered for patrons, too. Chef Joe Rosseli has spent six years in New York and various other places, but was really amazed at the number of people who have come in asking for stevia. Parents are so

Story by Marion E. Wildey happy to eat somewhere that their family is not going to be poisoned by the chemicals found in so many foods today. Many of the recipes are over a hundred years old from the families of head baker, Amanda Cotreau, Wild, and Pate. Bread baker, Paul Valenti, has moved from Virginia to join the team. He is a third generation baker who grew up baking in New Jersey. His dad lives in Mt. Dora and will be a guest baker on occassion. The bakery will offer organic wedding and special occasion cakes, along with their assortment of baked delights. Also, old fashioned bottled sodas and all natural smoothies are available. Other specialties include their beignets & chickory coffee, served New Orleans style. So much more to come than the bear claws and muffins of Independence weekend – Wild has big plans to BOOST Mount Dora! He has great venues coming to enhance and build income opportunities. In three weeks, there will be a pizzeria

serving organic pizza, salads and soups, when the bakery closes at 6pm. The restaurant opens in September, and will serve “manly meals with meat,” but is a Florida Cracker restaurant, serving everything from baby back alligator ribs to buckets of seafood. All the food will be organic there as well. All fresh veggies & a variety of 100 year old florida recipes. Next door, the Healthy Cracker sells organic products, meat, produce, skin and body care and vitamins. Somewhere in Time is open from 5:30 AM to 6:00 PM seven days a week. Also find them on Facebook – Somewhere in Time A Victorian Bakery.

Zmax Radio Takes

Lake County To The World: Internet radio is local and worldwide

Story by Marion E. Wildey

T

he last decade has ushered in an astonishing amount of technology, and the pace doesn’t seem to be slowing. The impact of the internet on broadcasting would hardly be recognized by the industry pioneers of the late1800’s when radio first appeared on the scene. Today, radio can be broadcast over the internet to reach worldwide and, at the same time, take it to a community level. Jay Lawrence and Zee Zee Michaelson, founders of Zmax Radio (ZmaxRadio. com) and hosts of the Jay and Zee Show on Zmax Radio, finish each other’s sentences and share their thoughts on internet radio as the station approaches its first anniversary.

Z: They had to differentiate between satellite, and terrestrial… J: …which is broadcast from a tower, where the signal goes across the land. Satellite comes from – up there. And we are internet. Jay Lawrence: Ladies first. Zee Michaelson: No, we’ll do it like we do on the show. J: Oh, I’m Jay Lawrence. Z: And this is Zee Michaelson. FOCUS: You referred to the term “terrestrial radio,” to describe radio not on the internet, where does that come from?

Diane Garvis, Zee Michaelson, Jerry Nordun, Jay Lawrence, Cindy Gore 24

july 2010 thefocusmagazine.com

FOCUS: You both had experience in terrestrial radio, what caused you to transition to web radio? J: My background is, I’m a television producer. I’ve owned a radio station in Lincoln, NE. And I’ve been in Florida since ’95 doing freelance television, acting and radio. And the two of us have always been looking for a way to work

together. Z: Yeah, because my background is in radio advertising as a CRMC (Certified Radio Marketing Consultant), marketing and event promotions. So between his background with production and being coordinator that way, and my background with how to sell something, we decided it was time. J: Well, a year ago, we researched and found out that over 50% of people who are on the internet, are listening to radio on the internet. And since Clermont sits in between Tampa and Orlando; (Z: Two major markets.) broadcast signals without a real direct broadcast signal for South Lake County, we decided to go local. On the internet. Which is an oxymoron. Z: We’re the local station, but it is an oxymoron because as we know, it is the worldwide web. However, because we are self-promoting, a very large percentage of our listeners are from the local region. FOCUS: Why web radio? Z: Because of my background, we realized that terrestrial radio stations were not utilizing the internet to its fullest potential. So, when we decided to do this, we decided to make it to the best of our potential. And we did do a few tests on some other ventures… J: …web stations over the last 5 years… Z: …just to see how it would work. And to see where we needed to be and we realized with the current economy and with what people are doing, local businesses can’t afford terrestrial radio. Not the major stations anyway. So we brought it down to a grassroots type of

campaign. And that’s where the success is. The future of web radio is in helping local businesses. J: We’re reading trade news that terrestrial radio stations are really kind of afraid of web stations because the automobile industry is going to have the ability to have websites in the car, very soon. Even today as we are talking, you can listen to ZMAX radio on your phone. Z: On the Blackberries and iPhones. Any smart phone really, where you can

all over the United States, creating the professional sound you hear everyday on Zmax Radio.

FOCUS: What makes ZmaxRadio.com different? Z: We cater to everyone, which is kind of nice. It is a 25-54 demographic, but because of the music and our requirements to make sure that music stays light and bright, the entertainment and the businesses advertising are aimed at the widest possible audience. We’re always thinking about our local advertisers. Because we are going to help them grow, they’re helping us grow, so I think that is the special niche that we have. Another reason is that people sometimes aren’t allowed to have a radio at their desks. J: We know a major entertainment company in Orlando where they are allowed to listen to certain things on their work computers, and they can listen to Diane Garvis - Around Lake (10 am & 10 pm) ZMAX. upload an application. We don’t charge like subscription radio. FOCUS: What are some highlights of J: If you have a computer and you have your broadcast schedule? internet, there’s no charge to listen to J: Zee and I start the day off with The J Zmax Radio. All you have to do is go to ZmaxRadio.com and click to listen. Z: And we are looking at 2012, when all cars are going to be fitted with internet. FOCUS: Was there a lot to get together for web radio? Z: Yes, and no. J: Basically we built our web station from scratch. When I put a radio station together in Lincoln, Nebraska in 1975, it took a massive amount of equipment and money. Z: And a big antenna sitting outside the door. J: Today we have computers and programs. Our radio station software is from New Zealand. We put it all together at our production center here in Clermont but we draw from talent

Jerry Nordun - Mid Day Rewind (Noon-2pm) & Z show from 6 to 10 am. At ten o’clock we have Diane Garvis, who does Around Lake. At noon, we’ve got Jerry Nordun. He does the Mid-day Rewind. Two hours, ‘80s, ‘90s, a little more focus on the ‘80s and the ‘90s. On the weekends we have the Paul Madison Show and Sunday at the 70s. Z: And he has little informational vignettes in his show. J: At two o’clock, we’ve got Cindy in the Afternoon. Z: We gear that towards a more female audience. We have more music that is geared towards women listeners and businesses that are geared towards the women too.

J: And she features several doctors that she talks to on a daily basis. Z: Pediatricians, things that would really interest women. J: At six o’clock we flip it over and The J & Z Show repeats. Since some people might have missed it in the morning, they can catch it again in the evening. Z: We do Retro Refit at night. J: Retro Refit, oh yes! Z: We kind of gear the music to a more mature audience by playing a few more golden oldies. But it’s always light and bright. When asked what they saw for the second year of Zmax Radio, Jay and Zee’s answer was very cryptic. They couldn’t say, but their plans were big: “ZMAX is growing, that’s all we can say.” So what’s bigger than the entire World Wide Web? We’ll all just have to keep listening at ZmaxRadio.com to find out. In the meantime: Happy First Birthday, Zmax Radio!

Networking Groups Their Value and How They Work for You

Article by Marion E. Wildey asked of the whole, in terms of business advertising, these sites are supplementary. Communicating with business leaders in community meetings increases notoriety amongst society members. Regular involvement in community affairs sets a tone of reliability as others watch businesses grow from the ground up. There are networking groups throughout Lake County that are at the ready to boost community involvement.

As society evolves, the community struggles to keep bonds close, even as we have created simpler, yet sophisticated ways of living. The intricacies of our lives have become so complicated that we can communicate from home and never have personal interactions, which doesn’t improve business, or community affairs. There is something poignant about oneon-one interactions that seals a bond of trust, and for reasons unknown, we need face-to-face interface to cultivate believability. Business can be tricky,

26

july 2010 thefocusmagazine.com

as everything relies on an outstanding reputation, shared most effectively by word of mouth. The spread of business esteem can be both uplifting and, equally destructive when shared through each synapse of human alliances. Over the last handful of years, humankind has developed electronic communication that keeps friends and family in check, manifested through social networking sites like Facebook, Twitter and MySpace. While these sites keep people in touch, and offer a great wealth of knowledge when

South Lake Business Leaders “are all small business owners who are trying to grow our business one lead at time. Individually we take pride in the integrity we possess as business owners and as a group we have surrounded ourselves with others that practice the same work ethics. We have a member who is a mobile mechanic that has tripled his business from the leads he has received from being part of this group,” says April Johnson of SLB. A unique facet of SLB is that one half of all member dues are donated to the South Lake Boys and Girls Club, which helps fund a viable organization, and promotes active community involvement. Meetings are Thursdays from 11:30 – 1:00 pm at IHOP-Clermont. slblclermont@gmail. com 321-231-6675 South Lake Chamber’s ‘First Friday Chamber Connection’, is a facilitated event for Chamber members to meet with

attendees on a one-on-one basis. Ray Villegas thinks that, “In ‘teaching’ about the essence of true networking, we always stress for people to take a ‘givers gain’ approach. That is, look to refer business to other people, and the karma will be returned back to you ten-fold over time. Look to build bridges between others, and get them referring business to each other. As [the] circle of contacts and colleagues grows, make sure to help others grow their contact base as well.” specialevents@ southlakechamber-fl.com 352-394-4191 Tangerine Networking Group was founded by Cyndi Long, who states, “We value your time; every member speaks at every meeting.” With five chapters meeting once a week in Leesburg, Winter Park, Ocoee/Windermere, The Villages and Mt. Dora, it is easy to see how four short years have grown such a vast network. “TNG is a TRUE networking group focusing on grass roots networking. Members get to know each other on a personal level and refer business to other members. People refer and use people they know and trust,” says Long. In fact, one newcomer utilized eight of the businesses in TNG to get their own business successfully up and running. www.tangerinenetworkinggroup.com 407758-7214

Tavares Chamber of Commerce has a luncheon on the second Tuesday of the month, and offers attendees the opportunity to present a two-minute commercial about their business. Director of the Tavares Chamber, Colleen McGinley, says, “Before and after lunch, networking with each other is valuable and extensive. I believe face-to-face networking helps to build trust and confidence in a business relationship. You will do business with people you know and trust.” The Chamber organizes and coordinates the attendees, and ensures that everyone who wants to speak is able to do so. The monthly Tavares meetings have seen an increase in membership, and businesses are getting more traffic because of the face-to-face meetings. McGinley says, “The most rewarding experience is that at least six attendees confided that they had learned to develop their commercial because of this luncheon. They realized they didn’t have that professional response ready when meeting new clients in the past and that this helped them develop one.” www.tavareschamber.com 352. 343. 2531 “Considering today’s ‘time-poverty’ struggle among business people, social media can be utilized to further relationships without being actually faceto-face with someone. [But], you can never discount the power of chemistry. I don’t think science or psychology understands why we get along better with some people compared to others, but it definitely

happens. And this chemistry for the most part can only be determined in person,” says Villegas, of the South Lake Chamber. There are a handful of other network groups to attend around the area:

Strap Up and Get Exercising By Shelley Wagner, National Training Center Exercise Specialist, BS, CPT, TRX Trainer

The typical American day, starts off by commuting one to two hours in a car, working at least eight hours, and eating meals one to two hours per day….. seated! According to the A.C. Nielsen Co., the average American watches more than four hours of television each day, sleeps for seven to eight hours at night, then wakes up and does it all over again! Exercising with the TRX promotes total body exercise on your feet! It is time to eliminate every excuse of why you cannot fit a workout into your schedule. Whether your time is limited, driving to a wellness center is not an option, or you are traveling for business every other week, investing in a TRX Suspension Trainer will help you meet your fitness goals. TRX is a product of Fitness Anywhere, and was designed by Navy SEALs with a few lengths of parachute webbing hand-stitched together with rubber boat repair tools. The SEALs looked for a creative way to stay in peak condition while out on missions away from traditional training equipment. Following the creation of this unique training harness, special operation soldiers and other elite athletes developed various body weight exercises that are the foundation of suspension training today. Suspension training means either the user’s hands or feet are supported by the anchor point, while the opposite end of the body is in contact with the ground. Once comfortable performing major muscle group exercises using the TRX, it is 30

july 2010 thefocusmagazine.com

then necessary to change body position by displacing your center of gravity, thus creating a great need for muscle recruitment. The body will use core stability and muscle strength to control its center of gravity during movements, in a truly functional way. Functional training assists athletes in completing their sports better and helps the general population carry out activities of daily living with more ease. Center of gravity seeks the lowest point. If you were hanging from a bar, or holding a push up position, your body is most comfortable lowest to the ground. Movements using the TRX integrate strength and balance into a dynamic format which taxes the nervous system, a group of specialized cells that coordinate the actions of your body. When a body part is suspended, its’ center of gravity is directly below the anchor point. Using this concept, a fitness professional will direct the user to use center of gravity to assist or resist the movement, making it easier or harder to complete the exercise. TRX’s effectiveness and versatility has pushed far beyond the battlefields and professional training rooms. Suspension training has evolved into parks hanging from monkey bars and trees to homes and hotel rooms attached to doors. This portable training system weighs in at less than two pounds, making it easy to pack and go anywhere. TRX involves easy set up, requiring only a door or pole to anchor the strap system to, and 4 x 8

ft rectangle exercise space with non slip surface. One major benefit of TRX training is that all fitness levels can utilize this piece of equipment. Realizing the basic resistance principles of suspension training, exercises can be modified to a new exerciser or advanced to a professional athlete. Another benefit of TRX training is that exercise occurs in all three planes of motion. Training in multiple planes, will assist in the execution of our daily activities and sports. All fitness goals can be achieved using the TRX, whether a person is looking to build muscle endurance or muscular strength. Resistance, tempo, and power can be altered to achieve these goals.

Most importantly, exercising with the strap system uses all your core musculature all the time. Our body’s core musculature runs from the hips to the shoulders and is where the transfer of energy moves through during movement. Your core is your powerhouse, train it accurately. Using the TRX offers a total body workout incorporating strength, power, endurance, balance, mobility and flexibility. Never miss a workout again with this portable and affordable suspension training system. The TRX Suspension Trainer is versatile to meet the needs of many fitness abilities.

Smith, Seaman land big catch from Harris By John N. Felsher

LEESBURG -- Jeremy Smith and Joseph Seaman beat a thunderstorm and brought in nearly 41 pounds of bass during the American Bass Anglers Toyota Tundra Bassmaster Weekend Series tournament, held June 5, 2010, on the Harris Chain of Lakes. Launching out of Venetian Gardens in Leesburg, the pair fished Lake Harris, the largest in the chain of nine natural lakes encompassing more than 76,000 acres. With all the bass they needed, Smith and Seaman cut short their venture and headed for the landing before a sudden afternoon thunderstorm hit an hour before weigh-in time. American Bass Anglers holds more than 1,000 tournaments per year in 40 states. In each tournament, anglers compete in two separate divisions, Boater Division and CoAngler Division. Smith, 33, of Plant City won the Boater Division, taking home $2,349. Seaman, 36, of Floral City won the Co-Angler Division and a check for $1,174. With five bass weighing an amazing 27.18 pounds, Smith put together an incredible 5.43-pound average. He beat his nearest competitor by more than 10 pounds with his biggest bass hitting 7.80 pounds. Seaman landed three bass going 13.69 pounds with one 4.82-pounder to tally a 4.56-pound average. “We started flipping grass, and then moved out to a little deeper water,” Smith said. “We found some hydrilla growing in the middle of the lake and threw deep-diving crankbaits and 10-inch junebug worms in 8 to 13 feet of water.” In second for the 49 boaters, Bobby Johnson of Gainesville caught a tournament limit of five bass going 16.85 pounds. He fished a pocket in Big Lake Harris, catching a limit by 7:30 a.m. “I caught about 20 bass with most of my fish hitting a junebug worm Texas-rigged with a 1/8-ounce weight,” Johnson said. “I had one bigger fish on. My partner swears it was about 11 pounds. I don’t think

32

it was quite that big, but it was a big bass.” Ted Sullivan of Deleon Springs fished Lake Griffin and placed third with a five-bass bag weighing 14.99 pounds. His bag included an 8.01-pound tournament lunker. “I caught the big bass five minutes after I reached my first spot,” Sullivan said. “It hit a junebug magnum speed worm worked through the grass really slowly. I stayed with the worm most of the day, but threw a few topwaters. I finished the limit in the last hour with a large Producto Buzz Tail shad.” Bruce Scarborough Clermont took second in the Co-Angler Division with three bass for 8.45 pounds. One weighed 5.53 pounds. He fished the Lake Griffin area with a Texas-rigged pumpkinseed worm. In third for the non-boaters, Kenneth Hunnicutt of Jacksonville caught two bass at 7.17 pounds with one 5.87-pound division lunker. The big one didn’t hit until about 2:30 p.m. in Lake Harris. “We flipped grass all day long with a Bitters junebug trick worm,” Hunnicutt said. “The trick worm slides through the grass a little better. We fished slightly deeper grass in about four to five feet of water.” For more information, call ABA at 888-203-6222. For complete results, see www.abaproam.com.

LAURA HARGROVE GETS A GUILTY VERDICT OVERTURNED RESULTS IN CLIENT BEING RELEASED FROM A 15 YEAR PRISON SENTENCE. Article submitted by L aura Hargrove, G & H L aw

The following is a court transcript of a recent case where Attorney Laura Hargrove got her client’s conviction overturned on appeal. Jerry Randell Broxton (defendant) appeals his judgment and sentence which were entered by the trial court after a jury found him guilty of committing the crime of trafficking in Oxycodone, in violation of section 893.135(1)(c) of the Florida Statutes (2007). Determining that the trial court erred by denying the defendant’s pre-trial motion to suppress, we reverse. The defendant was charged with trafficking in Oxycodone. In a pre-trial motion to suppress, the defendant argued that all evidence seized at the time of the arrest should be suppressed because it was obtained following an unlawful search and seizure. At the suppression hearing, the State presented the testimony of Officer Adam, an officer with the Florida Fish and Wildlife Conservation Commission. Adam testified that while on duty he observed four individuals fishing in a pond and he approached them to check whether they possessed valid fishing licenses. While Adam was making contact with one of the individuals, the defendant began walking towards a group of nearby vehicles. Adam followed and made contact with the defendant. He requested to see the defendant’s fishing license. The defendant did not have a fishing license or any identification. Adam testified that he then patted the defendant down to make sure that he did not possess any weapons. Adam explained that, in his experience, it is not uncommon for fishermen to be carrying a knife or a gun. Additionally, Adam noticed

34

july 2010 thefocusmagazine.com

a bulge in the defendant’s pocket. Adam felt the bulge and determined that it had the consistency of a plastic bag, not a weapon. Adam asked the defendant what was in the bag. The defendant opened his pocket and, as he revealed the plastic bag, he said that it contained fishing tackle. The defendant did not remove the bag from his pocket. However, Adam saw pills in the plastic bag. The defendant closed his pocket and Adam asked for the bag. The defendant then handed the bag to Adam. Adam described the encounter as follows: Q: (Prosecutor): At the time when you guys were standing there and you were going to write him a citation, he was not under arrest, was he? A: No, he wasn’t under arrest. He wasn’t free to go. I was going to issue him a citation. The defendant testified as follows regarding the encounter between himself and Adam: Q: (Defense counsel): Why did you open your pocket? A: (Defendant): He asked me to, and I didn’t want to cause no trouble. Q: Did you feel like you could leave? A: No, ma’am. Upon review of the testimony, the trial court denied the defendant’s motion to suppress finding that the search of the defendant’s pocket was consensual. Thereafter, the case proceeded to trial. The jury found the defendant guilty of trafficking in Oxycodone. The defendant argues that the trial court erred in denying his motion to suppress because, among other

things, once the frisk established that the bulge in the defendant’s pocket was not a weapon, Adam was not authorized to search further. The State properly concedes that this argument is correct. However, the State argues that the trial court properly concluded that suppression was not warranted because the defendant’s actions constituted a valid consent to search. We hold that the record does not support the conclusion that the defendant consented, rather than merely acquiesced to police authority, when he handed Adam the plastic bag containing the pills. In Sizemore v. State, 939 So. 2d 209 (Fla. 1st DCA 2006), the First District held that the defendant who was being detained did not consent, but merely acquiesced to police authority, when he removed marijuana from his pocket after he was asked if he had

“anything on his person that would get him into trouble.” Id. at 210. In the present case, the defendant was detained for an investigatory stop. He believed he was not free to leave and Adam testified that the defendant was not free to leave. The defendant removed the plastic bag from his pocket and gave it to Adam only after Adam directed him to do so. The present case is factually analogous to Sizemore. As such, the motion to suppress should have been granted. Accordingly, we reverse and remand for proceedings consistent with this opinion. REVERSED and REMANDED.

“Short Sale”….Buying or Selling? Article provided by Rob Morris, Morris Realty & Investments

What is a short sale? I am sure by now that you have heard the term “short sale”, and probably have a friend or neighbor with a home they are trying to sell this way. A short sale is a complicated transaction in which the lender agrees to accept less than the home owner owes on the mortgage. In some cases, the difference is forgiven by the lender, and in others the homeowner must make arrangements with the lender to settle the remainder of the debt. Short sales typically have less impact on your credit score and may appear as “pre-foreclosure in redemption”, as opposed to “debt discharged due to foreclosure”. Due to the continued economic crisis, including rising unemployment, and drops in home prices, the number of short sales is increasing. Since a short sale generally costs the lender less than a foreclosure, it can be a viable way for a lender to minimize its losses. A short sale can also be the best option for homeowners who are “upside down” on mortgages because a short sale may not hurt their credit history as much as a foreclosure. As a result, homeowners may qualify for another mortgage sooner once they get back on their feet financially. What challenges do short sales present? The rapid increase in the number of short sales, and the short sales process itself present a number of challenges including: 1. Inexperience by the Selling or Buying Real Estate Agent Many Realtors® are new to the short sales process. Even if the Realtor® is experienced, most lenders’ are under-staffed and still not adequately trained, making negotiating a short sale particularly difficult.

36

july 2010 thefocusmagazine.com

2. Absence of a uniform process between lenders Short-sale documents and processes are still lender-specific, making it very difficult and time-consuming for every Realtor® to become knowledgeable and efficient in facilitating these transactions. Other difficulties include; unresponsive lenders; lost documents that require multiple submissions, inaccurate or unrealistic home value assessments, and long processing delays, which cause buyers to walk away. 3 Multiple lenders When more than one lender is involved, the negotiations are much more difficult. Second lien holders often hold up the transaction to wield the largest possible payment, in exchange for releasing their lien, even though in foreclosure they will get nothing. What can you do to address or eliminate these challenges? 1. Hire an Agent with Short Sale Experience Sellers should find out how many short sales their agent has actually closed apart from the number of short sales he/she has listed. An agent with experience in short sales will help to expedite your transaction and protect your interests. You don’t want to miss any important detail due to inexperience or find out your transaction is not going to close on time because no one has followed up in a timely manner. 2. Qualifying the Property and Seller for a Short Sale A lender is unlikely to agree to a short sale unless the seller has no equity and is unable to repay the difference between your sales price and the existing loans. Sellers need to provide a hardship letter to the lender. Keep in mind that sellers may also owe taxes on the amount of debt that is forgiven. 3. Give the Short Sale Lender Time to Respond

If buying a short sale, the offer must be contingent upon the lender’s acceptance. Give the lender a time frame in which to respond, after which, you will be free to cancel. 4. Reserve the Right to Conduct Inspections Generally, the lender will not pay for customary items that a seller would pay; such as home warranties for the buyer, buyer credits of any kind, and any form of inspections. A buyer will be asked to purchase the property “as is,” which means no repairs. It is extremely important that a buyer obtain a home inspection and pay for other types of inspections such as pest, roof, septic tanks, or fireplace inspections. Do not waive your right to obtain these inspections and make your offer contingent on approving them. So, as a seller, know your rights and hire an experienced real estate agent. As a buyer, hire an experienced real estate agent,

and be prepared to wait out the response from the lender. Rob, along with his wife Theresa, is co-owner of Morris Realty and Investments, Inc. How Will You Cover Basic Expenses in Retirement? Receive a guaranteed* paycheck for life to cover basic needs. by Hays Ginn, Ne w York Life Insurance Company

ings, you can purchase a Lifetime Income Annuity* that provides $29,000 per year of guaranteed income for as long as you live. This, coupled with your pension and Social Security, ensures your basic living expenses of $65,000 per year will always be met through guaranteed sources. If inflation is a concern, you may choose an option within the annuity to increase your annual payout every year. The remaining $683,954 of your savings can be used to supplement your other retirement goals, such as the trips and activities you enjoy. Stock market fluctuations no longer make you as anxious now that you know your basic living expenses will always be covered. After all, retirement is a time to enjoy the fruits of your labor. An income annuity can help you prudently distribute the money you have saved along the way so you can enjoy a guaranteed income – and peace of mind - for the rest of your life. The hypothetical example is for illustrative purposes only and is based on a Lifetime Income Annuity, Life-Only policy for a male age 65 years old. Annual income amounts are based on rates in effect as of 1/27/09. Rates are subject to change and payout will vary depending on premium amount, age, gender, the number of lives (one or two) and payment option. Actual amounts a re dependent on interest rates in effect when the policy is issued. Other payment options are also available. Inflation protection option must be elected at time of purchase and the policy owner must be at least 59 ½ at the time of the first payment. Payments for the same premium will be smaller that policies without this feature but will increase each year. *New York Life’s Guaranteed Lifetime Income products are issued by New York Life Insurance and Annuity Corporation, a wholly owned subsidiary of New York Life Insurance Company. A retirement plan has two fundamental parts: accumulation and distribution. All the years of saving (accumulation) are meant to fund all the years you live without working (distribution). Both are equally important and deserve careful consideration. Creating an asset distribution plan can help frame your strategy of how to convert qualified and non-qualified savings into retirement income, including how much to access and when in order to ensure your money lasts as long as possible. Every retiree hopes to maintain his or her standard of living. Depending on individual needs and goals, a well-structured distribution plan can even include components that guarantee* income for life. Look for Stability Imagine you are a 65-year old man about to retire. You have saved $1 million dollars in various accounts and funds. You want to be sure you can meet your basic living expenses as well as continue the lifestyle you enjoy which includes golfing trips, visiting your grandkids, and keeping your season tickets for your favorite sports team. Your savings are well diversified, but stock market swings have you feeling uneasy. You wonder if there’s a more stable place to put your money that will help meet your needs. When you sit down with your budget, you determine you need an annual income of $90,000 to maintain your desired lifestyle. The majority of that amount ($65,000) will be spent to cover your basic living expenses (food, housing, utilities, medical expenses, etc.). The remaining $25,000 is money to spend at your discretion. Your income sources include a pension of $12,000 per year and Social Security of $24,000, which adds up to $36,000 of your income coming from guaranteed sources. You need $29,000 more to meet your basic annual expenses, which you planned to draw from your $1 million of savings. But, after speaking with a financial professional, you learn that an immediate fixed annuity might be appropriate for your situation. Use Guaranteed Sources Using just $316,046 from your sav-

LAKE COUNTY MUSICIANS’ SWAP MEET Networking for Musicians Article and Photos by Lisa R ast

On the second Sunday of every month musicians from all over the state gather at Renninger’s Antique Center in Mount Dora to buy, sell and trade guitars, microphones, banjos, drums, horns, and PA systems. The sense of camaraderie is palpable even on a stifling June day. Organizer “Big Al” Kalka calls the swap meet “a great networking opportunity for musicians.” The monthly event began in January of 2010 with a half dozen vendors. In six months the swap meet has grown to the point where vendor space is quickly sold out. Kalka plans to expand the event even more, incorporating a Computer and Electronics Swap Meet to be held every second Saturday. Kalka’s goal is to plan a twice yearly three-day festival including both swap meets as

well as several live music venues, along the lines of the New Orleans Jazz Festival. Rick Renninger of Renninger Twin Markets said he is happy with the success of the event. “I love this, the people are happy, even if they don’t sell a lot they’re having a great time. This is growing every month and it can only get bigger.” The Lake County Musicians’ Swap Meet is held every second Sunday from 11 a.m. to 5 p.m., featuring a jam session from 2 to 5 p.m. Admission is $2 per person. Raffle tickets for a new amplifier are sold for $5 apiece. Proceeds go to purchasing musical instruments for local high school bands. For more information go to LiveCFL.com or call 352-735-0025.
