ANSONIA “LA VENDEE” ROYAL BONN PORCELAIN MANTLE CLOCK.

This clock has good original black hands, enamel dial with black Roman hour numerals and black minute markers, Brocot exposed escapement with steel pallets, fancy brass bezel with beveled glass crystal. The dial has one hairline at the 7 minute marker, the clock has a brass eight day time and strike signed movement with typical brass pendulum bob. The case is signed “La Vendee:” “Royal Bonn”, has a very rich multi colored case with flowers and is in overall good condition with light crazing to the surface. 13.5”W x 15”H x 5”D. GERMAN JUNGHANS ELEPHANT SWINGER.

The clock has good hands, dial and brass swinging frame. Some of the gilt is worn on the surface of the frame. The elephant statue is in very good condition and has a nice color. The base is signed “Made in Germany”: 11”W x 7”H x 4”D. Estimate $250 - 400.

SETH THOMAS UMBRIA OAK WALL CLOCK.

This clock has good original hands, original dial with paint chips scratches and nicks around the winding arbor holes. There is paint damage to the Roman hour numeral #8. The clock has a typical signed Seth Thomas eight day brass time and strike movement with Geneva stops intact, the movement is marked number 40. The clock has a black painted wood pendulum stick with brass bob and nice oak case with untouched old surface. 14.5”W x 41”H x 6”D. Estimate $700 900.

ANSONIA “HUNTRESS” SWINGING ARM CLOCK.

The figural statue wears flowing garments, with her hair tied back; her right arm holds birds and her left arm is holding the rod from which the movement is supported at the “X” suspension spring. The long gridiron pendulum is mounted with a figure at the bottom and the cylinder at the top, encasing the movement. This clock is in good clean condition. 5.5”W x 25”H. Estimate $800 - 1,200.

A wonderful gothic cathedral style bronze case; signed Charles Hour, with shaped beveled glass on the front and back doors and on the 2 sides. Round bronze time and strike movement; signed Jappy Freres, has a steel pin pallet escapement and a rack and snail striking mechanism striking a single coiled anvil on the hour and half hour. The back plate of the movement is also signed Charles Hour, France - and John Wanamaker, Paris. Complete with a mercury pendulum. The suspension spring needs repair. 6.5”W x 12”H x 5”D. Clock has good gilt hands, metal dial with Arabic hour numerals, brass bezel with beveled glass crystal, exposed Brocot escapement and a nickel eight day time and strike movement. The bronze statues and all case trimmings have lost most of their gilt finish. ANSONIA, BRASS & COPPER CO. DROP EXTRA CALENDAR.

This clock has good original hour, minute and calendar hand, original dial signed Terry Patent Manufactured by the Ansonia Brass and Copper Co. Ansonia, Connecticut. The dial shows much crazing, cracking and minor paint loss. The months of the year has slight paint loss. The clock has a brass eight day time and strike spring driven movement and old brass pendulum bob. The clock has a dark Rosewood veneer with many small repairs, imperfections and the lower case drop is missing. The lower door has original reverse painted glass, and has a half of a label left on the inside of the case. 15”W x 24”H x 4.5”D. Estimate $600 - 800.

The clock has delicate blued moon hands and a brass 4.5” dial with black Roman hour numerals and black minute markers. The dial has a decorative brass bezel. Brass eight day time and strike French clock movement with a count wheel strike system and high-grade Lyre compensated grade iron pendulum with decorative trimmings and clock has an ebonized wood case with brass trimmings, wood columns and decorative grass capitals. The silvered 5 ½ inch dial is signed “Chelsea Ships Bell”. The dial is pristine. The Clock has perfect blued “Moon” style hands, an 8 day time and ships strike brass movement with platform escapement that is running with a good motion. The solid brass case has a 7 ½ inch bezel, 8 ½ inch brass base and is 3 ½ inches deep. The case is signed on the lower front fame “1787- Constitution of the United States”. EARLY AUTOMATED PICTURE CLOCK ON TIN W/ GRAND SONNARIE MOVEMENT.

Wonderful country village scenic painting on tin with an animated woman pumping water at the well in the lower left. The clock tower to the right bears the timepiece, with the 3 arbor holes hidden behind a sliding door. Complete with a Grand Sonnarie movement, striking on 2 coiled anvils with an early verge escapement. Strikes and animates on command. Original hands and movements are in working condition; the paint is good quality and in excellent condition with no touch ups, has some very minor flaking to the paint. In an oversized gold frame. A black marble and gilt bronze “Quarter Deck” case with a sailor below and the captain at the stern, steering the ship. The railings, compass and lanterns at the top deck are intact. A ladder leads to the lower deck. The captain figure is connected to an “X” suspension with a compound pendulum bob below, he rocks back and forth steering the ship as the pendulum swings. The 8 day brass movement is signed GLT (Guilmet) Paris - numbered 1191 and strikes a coiled anvil on the hour. X suspension needs repair, otherwise in very good condition. 11”W x 9”H x 12”D. The clock has black hour, minute and sweep second hands, 11 ½” enamel dial with bold black Roman hour numerals, typical pinwheel movement with dead beat escapement and maintaining power. The movement is very clean with no signs of corrosion. Massive heavy gridiron pendulum and massive brass pendulum bob, brass weight and fancy etched brass bezel, sits on a wood mount. Mahogany figure 8 case, veneered on the door, has good upper and lower glasses, throat glass has 2 cracks in the corners. Original finish. This clock has black spade hands, new 8.5” dial, new lower calendar dial and the calendar hand is missing. The calendar drums appear original but have ink staining on the days of the week on some of the months of the year. The clock has a Seth Thomas brass eight day time and strike movement, typical calendar mechanism, a new brass bell and a new pendulum bob. The case has a good inside door label and an inside case label. The case has been cleaned. FRENCH BRONZE ANNULAR MANTLE CLOCK W/ SERPENTS.

The large gilt bronze urn has 2 handles draped with garland and a flame finial. A pair of serpents wrapped around with their tongues as hands for the annular dial. The dial is comprised of 2 chapter rings, one with porcelain Roman numerals for the hour and the other with porcelain numbers for every 5 minutes. The lower pedestal is heavily fluted and draped with a robe. The front of the urn is inscribed “Lepaute Ber du Roy”. The time and bell-strike 8 day movement features a levered platform escapement; the balance swings freely with a brisk motion. In very good clean condition. 8”W x 22”H x 8”D. MASSIVE ENGLISH TRIPLE FUSEE BRACKET CLOCK.

The clock has fancy pierced black hands, engraved brass dial, silvered chapter ring with bold Roman numerals. Black five minute markers and black minute marker chapter ring. The dial has some loss of silver from the 10 minute marker to the 32 minute marker. The dial has three sub dials, one for chime, silent, one for regulating the clock fast or slow and one for striking on eight bells or for anvils. The clock will strike Westminster chime or eight bells. The entire case is decorated with multiple fancy brass trimmings, pineapple finials, two large brass handles and two pierced brass side panels. The clock has a massive top quality oversized brass time, strike and chime English clock movement that strikes on 8 bells or 4 heavy cathedral anvils with the hour strike on the cathedral anvil. 14”W x 28”H x 10”D. 21” High satinwood grandfather style mantle clock applied filigree mounts and painted with flowers on 3 sides and a scenic panel on the front. The top finial is a full standing rooster. FRENCH INDUSTRIAL ROLLING BALL CLOCK W/ FIGURAL LION.

The movement is driven from large steel balls feeding into the paddle wheel in the back driving the 7 wheel train. Complete with an exposed silvered lever platform escapement. The heavy bronze movement and case have a gold dore finish. The 3 1/4” enameled porcelain dial has a rhinestone bezel around both the timepiece and the barometer. A mercury stick thermometer stands to the left of the movement. The case is embellished with applied champleve and beveled glass on 4 sides with a large figural lion at the top. As the paddle wheel rotates it drops the balls into the tray below; which then are placed into a container at the top, hidden under

the lion figure. Circa 1890. 44

This clock has a wood case in old finish with bronze hour numerals. The top of the clock is signed faintly “Hickory Dickory Dock”. The mouse has paint touch up and a replaced tail. The back of the clock has a label signed Dungan & Klump Philadelphia PA. A round French bronze time and bell-strike movement, signed Vincenti & Co 1855, with an exposed Brocot jeweled pallet escapement. The dial features a porcelain chapter ring with applied numerals and the butterfly pendulum. The case is bronze with beveled glass on 3 sides. The bird sings on the hour and on command; animated from a lower movement, attributed to Botem, the bird whistles and its head, beak and tail feathers move. The blued hands are original to the clock. These hands have lost most of the bluing and have slight staining with very minor surface rust. The 8 day time only brass movement is original to the case and is not signed. The cast lead weight is typical and original to the clock. The case has a gilt eagle finial, solid brass bezel, brass side arms, mahogany case with gilt presentation throat and lower bracket. The lower bracket presentation balls have some gesso loss. The brass side arms are dull and stained. The throat glass is original to the clock and in good condition. The lower door glass is also original to the clock and in nice condition with an American and English ship engaged in battle. The case is numbered 011. The case never had a pendulum tie down. The case is a tall windmill tower, both silvered and dore on a marble base. On the front of the tower is a barometer over a clock, both with silvered dials. The movement is time only with a platform cylinder escapement, the balance swings freely with a brisk motion. Mounted on the left side of the case is a Centigrade thermometer and on the right is Fahrenheit. FRENCH INDUSTRIAL STEAM CLOCK AND BAROMETER.

A large center cylinder and piston, with a vertical connecting rod, powers the fly wheel with centrifugal governor assembly. On either side of the cylinder are fireboxes mounted with broilers, all with attendant pressure lines and tubing leading to the cylinder. There is also a barometer over the right firebox, a thermometer behind the cylinder and a timepiece above the left box. The automation is driven by a movement built into the base, separate from the timepiece. All on a rouge marble base with 4 platform gilded feet. Large original key. 2 Chips to the glass on the timepiece, thermometer is cracked. 13.5”W x 19.5”H x 7.5”D. Estimate $12,000 - 15,000.

LOT: 90 GEORGE BLACKIE ENGLISH BOXED CHRONOMETER. George Blackie English fusee detent boxed chronometer with helical hairspring and maintaining power. The chronometer has gold spade and poker hands, slivered 100 MM dial signed “Prize Medal George Blackie Maker to the Admiralty, 24 Amwell Street London 1862 & 789”. The silvered 3.5” dial has a large 37 MM seconds dial and a 29 MM up/down indicator dial. The dial has black Roman hour numerals and is in very nice condition. The chronometer has a good gimbaled brass tub, good bezel with glass crystal and all hardware. Original key included. The 4 columns and the dome top are fitted with bronze mounts. Signed with the Royal Vienna “beehive” mark. The time only 8 day movement has a platform cylinder escapement and is encased in a sphere hanging from the upper platform. It is numbered 124510. A very finely detailed gilt bronze case of the “Notre Dame de Paris” cathedral. Tall gothic style towers at the top over a level of columns, a row of 3 dimentional figures above the main entrance with 3 cathedral doors at the top of the steps. The midsection shows a balcony centered with the clock tower having a bronze 2 1/2” dial and enameled roman numerals. The round bronze time and bell-strike silk thread movement, signed Gasche - D’ Jroi - of Paris, is numbered 1092. It strikes on the half hour with a count wheel striking mechanism and runs on a brocot escapement. This clock is in very good clean condition, springs are good, and the finish is crisp and original. The silvered 5 ½ inch dial is signed “Chelsea Clock Co. Boston U.S.A.” The dial has slight streaking from the strike winding arbor to the 3:00 hour numeral and has whale oil staining on the edges. The dial retaining ring has silver loss from the 20 minute mark to the 40 minute mark. The Clock has good blued “Moon” style hands. The clock has an 8 day time and ships strike brass clock movement with platform escapement that is running with a good motion. The movement number is 70905. The balance regulator is short but is still reachable from the dial. The solid brass case has a 7 ½ inch bezel, 8 ½ inch brass case and is 3 ½ inches deep. The brass case is dull and shows prior attempts to polish with creases having dried polish in them. The solid brass case has a hinged bezel and is mounted to a mahogany base. E. HOWARD & CO. #61 ASTRONOMICAL FLOOR STANDING REGULATOR CLOCK.

This clock has an original silvered 14” dial signed “E. Howard & Co. Boston Mass.” The astronomical dial has the typical outside chapter ring for the minutes with Arabic 5 minute markers and a black minute marker chapter ring, small subsidiary hour dial with bold black Roman hour numerals and a subsidiary seconds bit with 10 second Arabic second markers with black second chapter ring. The original dial has minor surface stains and fingerprints. The clock has the “No. 3” brass movement with dead beat escapement, “Jeweled Pallets” and isochronous beat adjustment on the top of the verge. The clock has solid brass pulleys, top quality brass weight with oversized hook and four jar “Mercurial pendulum”. The pendulum is numbered “286 - 3450”. The case has a nice silver beat indicator applied to wood supports. The clock has a fantastic carved Walnut case with burled panels, nice soft patina and a lightly cleaned original finish. The case has a hole about half way down the back board for securing the clock to the wall. The original owner of this clock, A. F. Robertson, was a life long craftsman in the art of watch making. In 1861 (at the age of 16) he began to study watch making and engraving under Louis Spaulding (formally with Waltham Watch Factory) in San Francisco, CA. He left California for St. Cloud, Minnesota 6 years later and founded his first jewelry business, A. F. Robertson - St. Cloud. The clock was purchased for this store, in the late 1860’s, and the front glass pane at the time read A. F. Robertson. In 1907 he moved to Harlowton, Montana where he commenced the Robertson Jewelry Firm, settling down there until is death. Of his 4 sons, 2 took on the task to run the store, William A. with the help of Ralph L (former mayor at Three Forks, MT). William changed the initials on the front glass from A. F. to W. A., which is how the clock reads today. The family took meticulous care of the clock as it sat protected on a custom pedestal made to safeguard the clock in the store and kept a log of the maintenance. This maintenance was continued and logged by William’s niece Betti when he passed in 1971, and then by Betti’s daughter (the current owner) up to the present day. FRENCH FIGURAL SILK THREAD “ATALA & CHACTAS” CLOCK CIRCA 1810.

This clock depicts the story of a book by Rene Viconte de Chateaubriand, published in 1801 titled “Atala, or the Love of Two Savages in the Desert”. The main group on top is derived from a painting “The Liberation of Chactas” by Pierre Jarome Lordon, which shows Atala to the left, wearing traditional clothing, giving her an exotic look and tagging her as the daughter of a Spaniard, with a feathered crown resembling her Indian status. She is untying her love Chactas, who is a Netchez Indian taken captive for sacrifice by another Indian tribe. On the right side of the clock is an Indian guard, shown sleeping against a wood pile on which the clock sits. The front of the cases platform is mounted with a relief plaque, related to a painting by Anne-Louis Girodet de Roussy Trioson titled “The Funeral of Atala”. It shows Chactas carrying Atala, followed by a hermit priest and led by a dog. The case has a very good gold dore finish and shows the finest detail. Complete with a round French bronze time and bell strike silk thread movement. The book takes place in “New Eden”, which is now called Louisiana. The two main characters are Atala and Chactas. Atala is the daughter of a Spaniard man and an Indian woman of strong Christian beliefs, she has ties to the chief of an Indian tribe. She has sworn to her mother that she will forever remain a virgin. Chactas is an Indian of a different tribe, the two tribes go to battle and Chactas is taken captive for a ceremonial sacrifice. Atala meets him while he is tied up, and falls in love with him; she comes by at night and frees him and they run away together. In the midst of the North American wilderness, they get caught in a terrible storm and they are rescued by a missionary and a hermit (who also is a village priest). They are brought to the village and begin life together; Chactas is greatly influenced by Christianity in the town and considers converting, which pleases Atala. Atala is torn between the promise she made to her mother to be a virgin and her feelings for Chactas, She decides to commit suicide with poison. When the priest’s grant Atala freedom from her promise, because it is unchristian like, it is too late. The remedies for the poison does not work and she dies. The clock has a good original wood base with ball feet. The movement is signed Seth Thomas & Sons, is a brass eight day time and strike movement with a count wheel strike system. LOT: 217 RARE OAK GUSTAV BECKER CLOCK W/ PHONOGRAPH. A simple oak case with incising, has a tin dial with a brass finish and a 4 1/2” chapter ring with black numerals. The dial is etched at the top “D.R.P. and “Made In Germany”. Has a signed Gustav Becker spring driven movement. The balance wheel and escapement are encased in brass. The balance wheel spring is broken. The movement engages a phonograph mechanism playing a celluloid ribbon 2 3/4” wide composed of heavy steel bracket plates with large gears. The musical mechanism has an oversized spring, wound from the side and plays in an internal wood horn, 5” in diameter. Buyer’s Premium, Purchase Price, Taxes-Buyer’s Premium: All bidding at auction and all purchases will be in U.S. Dollars. A buyer’s premium in the amount of 15% of the successful high bid will be added to the amount of the successful bid price for all lots purchased at auction. Purchase Price: Upon the announcement by the auctioneer, the successful bidder becomes the purchaser and is responsible for the amount of the successful bid, the buyer’s premium, applicable taxes, and other charges provided for in the Terms of Sale. Taxes: Applicable taxes shall include Massachusetts sales tax (5%), use tax, excise tax, and other taxes or levies. Only valid resale certificates are accepted as proof of exemption from Massachusetts’s sales tax by U.S. dealers. No Massachusetts sales tax is charged for purchases shipped out of state. 3. Methods of Payment and Fees-Acceptable methods of payment: Cash, Check, Visa, MasterCard and Wire Transfers. Payment from absentee and phone bidders is due within 72 hours of notification of successful bids. All other payments are due upon receipt of invoice. We reserve the right to hold all goods paid for by check until payment has cleared. Late Payment Charge: If payment is not received within thirty (30) days of sale, Fontaine’s Auction Gallery, reserves the right to impose from the date of sale a late charge of 1 1/2% a month of the total purchase price and deny all future credit. The purchaser will pay for and remove the purchased Property from the premises of Fontaine’s Auction Gallery within (30) thirty days of the sale. If the purchased Property is not removed in this time, the purchaser will thereafter be assessed a $10 per lot storage charge per day. If any of the Terms of Sales are not fully complied with by the purchaser, the purchaser will be in default without need of notice by Fontaine Auction Gallery. The purchaser shall be liable to Fontaine Auction Gallery and the consigner for the total purchase price, including all premiums, charges, and expenses specified in the Term of Sales. Interest shall accure at the rate of 18% per annum commencing with the date of the auction. 4. Qualifying to Bid-New Buyers: If you are not known to us, you may be asked to furnish identification, a valid credit card number, and, possibly, credit references. If you are acting as another’s agent or principal, we may request a letter of authorization. If paying by check, you must establish credit at least three (3) business days prior to the auction. A letter from your bank, presented before the sale, may also be accepted, at our discretion, although we may retain your purchase(s) until the check clears. If you are successful and do not remit payment within thirty (30) days, the balance will be charged to your credit card together with such charges set forth in these terms of sale. 5. Payment, Collection, and Shipping Responsibilities of Purchaser: On the fall of the auctioneer’s hammer, title to the Property immediately transfers to the successful bidder who, in turn, becomes the purchaser of the Property. The purchaser assumes full risk and responsibility for the purchased Property, including all costs and expenses of handling, shipping, insurance, taxes, export, and otherwise, and is liable for the full purchase price, plus the buyer’s premium, applicable taxes, and any other associated expenses. Collection of Property and Storage Charges: The purchaser will pay for and remove the purchased Property from the premises of Fontaine’s Auction Gallery within thirty (30) days of the sale. If the purchased Property is not removed in this time, the purchaser will thereafter be assessed a $10 per lot storage charge per day. Fontaine’s Auction Gallery may, at its discretion, remove the purchased Property to public storage at the purchaser’s risk and expense. All associated charges will be added to the total invoice and must be paid in full before the Property will be released. 6. Bidding Increments: 0 – 100 = 10 100 – 500 =25 500 – 1000 =50 1000 – 2500 = 100 2500 – 5000 = 250 5000 – 10000=500 10000 – 25000= 1000 25000 – 50000=2500 50000 – 100000=5000 The auctioneer has the sole and exclusive power, discretion, and authority to regulate the bidding and its increments. 7. Absentee Bids: We accept absentee bids by phone, by mail, in person, or by fax. Absentee bids are requested no later than 6:00 p.m. on the day before the auction. If you fax your absentee bids, please call us to confirm receipt. All absentee bidding is handled as though you are in attendance. We will buy all designated lots for you at the bidding increment just above where competition stops. Please check and comply with these increments. All unreserved bidding starts at 50% of the low estimate unless there are two or more competing absentee bids at a price higher than that. (For example, a lot estimated at $500–$750, with no reserve, will normally open at $250. If there are two absentee bids for $400 and $600, the lot must sell for $425, even if there is no further bidding from the phone, later absentee ballots, or from the live audience. In such a case, we will open the bidding at close to the low estimate.) “Plus” bids: Because of our structured bidding increments, it is more likely that several people will leave identical bids. Since an earlier bid wins in the event of a tie, a later bid with an added “plus” bid to the next increment would win the piece. All absentee bidder names and bids are held in strictest confidence, disclosed only in the event of a question after the sale. Absentee bidding is a convenience offered to our customers and, while we will make every effort to execute your instructions, Fontaine’s Auction Gallery is not liable or responsible for any errors or failure to do so. 8. Telephone Bids: Lines are available on a first-come, first-served basis – please reserve as soon as you are able. We must hear from you no later than 12 noon on the day before the auction. Determine the lots on which you most want to bid before reserving the lines. If you need condition reports, please request and review them prior to reserving phone lines. We will call you at one phone number ONLY during the auction. If you are unsure of where you or your agent will be during the sale, we

you leave absentee bids. All requests for overseas telephone lines must be accompanied by absentee bids, which will be executed on the buyer’s behalf, should there be any problems with telephone connections. Your phone number and lots will be confirmed the day before the auction. Please do not change your phone number after your phone lines have been confirmed; if you do, Fontaine’s Auction Gallery will not be responsible for any breakdown in communications. We strongly recommend land lines, as, to date, they are more reliable than cellular phones. One of the reasons people bid by phone is to monitor how much they’re spending. However, if you bid by phone, you must be willing to bid to the low estimate should the bidding go that far. There is no exception to this rule. You may, however, leave absentee bids for any amount. Bids are placed on the telephone at the discretion of Fontaine’s Auction Gallery, and at the caller’s risk. Telephone bidding is a convenience offered to our customers and, while we will make every effort to execute your instructions, Fontaine’s Auction Gallery is not liable or responsible for any errors or failure to do so. All telephone bidders hereby consent to their telephone conversations with Fontaine’s Auction Gallery being monitored and recorded. 9. Auctioneer’s Determination Final: A lot will be sold to the highest bidder as determined in the sole and exclusive judgment of the auctioneer. The auctioneer will also have the sole and exclusive power and authority to a) resolve any disputes between bidders, b) determine whether to pass or re-offer a lot for sale c) reject or challenge any bid or advance in the bidding, and d) otherwise regulate the bidding and its increments. 10. Estimates: The estimates provided in this Catalogue are our opinion of the price that a willing buyer would pay for the Property at auction, based, where possible, on prices paid for comparable items sold in the past. They are neither a representation nor a prediction of the actual selling price that will be realized at auction, post-auction sale, or upon resale, which may be substantially different from these estimates. We shall not be liable in any way for such a difference. 11. Withdrawal of Property from Sale: Fontaine’s Auction Gallery reserves the right to withdraw property from the sale for any reason and with no liability whatsoever for such withdrawal. 12. Warranties and Guarantees: This is a guaranteed auction as expressly stated in this paragraph. General: All information in the Catalogue concerning: age, authenticity, genuineness, quantity, period, culture, source, or origin is warranted for a period of thirty (30) days from the date of sale by Fontaine’s Auction Gallery, inclusive of shipping and handling time periods, except as excluded below. All items are available for pick up at our gallery once cleared payment has been made & it is the responsibility of the buyer to acquire purchases before the guarantee expires. After 30 days, all sales are as is and there are absolutely no refunds for any reason. This warranty extends to only the original buyer of record (that is, the registered bidder). Size is approximate. If keys are present, they will be provided with the clock. The terms “perfect,” “mint,” and “pristine” indicate that the lot is in the same condition that it was at time of manufacture. Exclusions and Limitations: This Warranty does not cover: a) Wear, wear to movements or bushings, minor imperfections or factory flaws b) Any description which states (or is bracketed in a section described as) “as-is” or “not guaranteed”; c) Subsequent owners or assigns of the Property. This disclaimer of liability on our part applies whether the information is included in the Catalogue, advertisements, announcements, or communicated through our representatives, bills of sale, or elsewhere, and whether written or oral. 13. Condition Reports: Condition reports are statements of opinion by the staff of Fontaine’s Auction Gallery, and/or independent consultants. It is not a warrantee. If you would like condition reports for items in the sale, please call (413) 448-8922 on Monday through Wednesday during preview week to allow ample time for completion of the request and arrangement of subsequent phone/ absentee bids. Otherwise, please fax (413) 442-1550 or mail the condition report form and you will be called prior to 5:30 pm on the Friday before the auction. Please be patient. We get many requests and we make every effort to respond to all of them in a timely fashion. Fontaine’s Auction Gallery is not liable or responsible for any errors in the condition report or failure to deliver the same. 14. Purchaser Default Remedies: If any of the Terms of Sale are not fully complied with by the purchaser, the purchaser will be in default without need of notice by Fontaine’s Auction Gallery. The purchaser shall be liable to Fontaine’s Auction Gallery and the consignor for the total purchase price, including all premiums, charges, and expenses specified in the Terms of Sale. Interest shall accrue at the rate of 18% per annum commencing with the date of the auction. In addition to other remedies available to Fontaine’s Auction Gallery by law, Fontaine’s Auction Gallery may, at its option, a) cancel the sale of the lot(s) on which the purchaser defaulted and of any other lots sold to the defaulting purchaser at the same or any other auction(s) and retain as liquidated damages all payments made by the purchaser, b) resell the purchased Property, whether at public auction or private sale, or c) pursue any combination of a) and b) above. Purchaser hereby waives any rights it may have regarding Fontaine’s Auction Gallery’s legal obligation to mitigate damages. In event of default, the purchaser will be responsible to Fontaine’s Auction Gallery and the consignor for any deficiency, any and all costs and expenses, including reasonable attorneys’ fees, collection fees and expenses, late charges, and other damages. Fontaine’s Auction Gallery may, at its discretion, apply any proceeds of sale otherwise due to the purchaser or monies of the purchaser in Fontaine’s Auction Gallery’s possession to reduce or satisfy the purchaser’s obligations. Security Interest: As security for full payment to Fontaine’s Auction Gallery. and the consignor of all amounts due, the purchaser grants and Fontaine’s Auction Gallery retains a security interest in the Property purchased at auction and in any other property or money of purchaser in Fontaine’s Auction Gallery possession or coming into Fontaine’s Auction Gallery’s possession (collectively, “collateral”). Fontaine’s Auction Gallery shall have the rights of a secured creditor as provided by the Uniform Commercial Code and other applicable law. Such security interest in the Property or other collateral will cease when the Property is physically delivered to the purchaser or the purchaser’s agent. 15. Legal Disputes: In the event of any legal disputes, the bidder/buyer agrees that the laws of the Commonwealth Of Massachusetts shall govern. Additionally, bidder/buyer agrees to jurisdiction and venue for any legal dispute to be exclusively in the courts located in Pittsfield, Massachusetts. BIDDER/BUYER HEREBY AGREES TO WAIVE TRIAL BY JURY IN ANY LITIGATION IN ANY COURT, WITH RESPECT TO, IN CONNECTION WITH, OR ARISING OUT OF THESE TERMS OF SALE. Finally, bidder/buyer agrees to be liable for any and all attorney’s fees of Fontaine Auction Gallery in the event of any legal dispute.
