Not one, but two BIG reasons to join Xpresso Mobile Cafe

The ability to easily get a second Xpresso Mobile Café van on the road, represents a genuine opportunity for new and existing franchisees to now become a mobile coffee magnate in their territory. By Leona Devaz

presso Mobile Café franchisees are making money. Earlier this year, John Kay, a Logan, Queensland based franchisee started his second business. It is the first time for the mobile coffee van franchise (and John!) and is only the start of things to come. Managing Director Jonathan Payne, says it is testament to two factors, the first: “the system works. If you are not making money, you won’t get a second van. We assist franchisees to get into their second van at cost and we have a finance solution to get them onto the road”. The “rent-to-own finance solution” is equivalent to selling 20 extra cups of coffee a day and one of the keys to affording a second van. “It is very competitively priced, at what is effectively 20 x $4.50 cups of coffee per day or $630 per week. This is for our lead-in van - the Hyundai iLoad which includes of course our standard full fitout and signage”. (NB stock and training is extra). The second factor is an entrepreneurial spirit. “This franchisee ( John) looks at the bigger picture and he is robust. We are in a relationship where we support each other – that is what the franchisor\franchisee relationship is all about”. 4

Franchisees within the Xpresso Mobile Café network can operate their second van anywhere within their territory. This premium mobile coffee franchise prides itself on giving large territories – enough for franchise partners to support an additional 2-3 vans, if they choose. “It is all about assisting each other to succeed”, Mr. Payne explains. Everyone has the ability to do it – it is up to them, we don’t push them”. In a competitive coffee landscape, he believes this point of difference is crucial. The ability for franchisees to add more than one van is an important part of the business model so that “franchisees get the best out of their large territory (geographical area). Their first van will only generally cover about 20% of their given territory so if they want scalability and to build a mini empire... the option is certainly there”. Mr Payne adds, “our competitor’s pigeonhole them into small areas, whereas, we genuinely want people to succeed” As franchisees adjust to adding a second van into their territory, Xpresso Mobile’s level of support does not change. “Each new van only attracts our standard stepped weekly fixed franchise fee, there are no upfront franchise fees for the second van!” For franchisee John Kay, Logan is an area of commercial and light industrial businesses, and there is a

need for employees to be served high-end coffee and cold lunch products, “the morning solution and lunch solution”. The food offering is popular, and an area the business is starting to place a focus on. This ethos focuses on supporting communities who are the source of the coffee products as, “sustainability is a huge part of who we are”. The green buying program not only improves the quality of the green beans, but also creates value for franchisees. “We also use biocups, so all our cups are

compostable”. He says 99% of cups have plastic component around them, and are not biodegradable. With the vans fully equipped to deliver the product, Mr. Payne jokes the fit out is worth more than the van itself ! But, it is level of detail that is meeting their client’s expectations for great coffee and service. “We are serious about helping our franchisees achieve their small business dreams rather than just being a franchise fee slave to franchisors. It’s also a great step towards passive income and of course the income tax and GST advantages of renting over standard finance is extraordinary”.

New Franchising Board chair appointed — Billson aims to boost buoyant sector The $144 billion annual turnover franchise sector is set for a new era with the appointment of former Federal Cabinet Minister Bruce Billson to the Board of the Franchise Council of Australia (FCA) as Executive Chair. The FCA’s mission is to support the growth and success of franchising, and the appointment of Mr Billson to lead the FCA Board is aimed at further boosting vitality in the sector. Mr Billson is keen to continue to support entrepreneurial women and men in the Australian economy in his post-political life and believes that the FCA Board role is an excellent fit for his skills, experiences and ambition to continue to “energise enterprise”. He has long been supportive of franchising, including introducing reforms aimed at maintaining a mutually supportive relationship between franchisors and franchisees. “Franchising is a wonderful model for entrepreneurship, where people can be in their own business but not be on their own for this commercial journey,” Mr Billson said. “The experience and knowhow made available by franchise systems and the drive and entrepreneurship of franchisees combined make franchising a very resilient business model during and post-GFC. With improved business conditions, now is the time to take Australia’s leading role in franchising to the next level and grow the number of first-class systems, investors and livelihoods made possible by franchising.” Mr Billson added, “I am excited to be able to work with the FCA Board, executive team and membership to build on the positive momentum in franchising by continuing to nurture confidence in this model of commerce, the capacity of the sector and our commitment to quality to ensure more people see franchising as a pathway to a more prosperous future. There is considerable scope to expand the appeal of franchising, particularly to the increasing number of women and young people looking to ‘have a go’ in their own business, by adding to the 79,000 independently owned and operated franchised outlets. Our export markets are also ripe and ready for successful and proven Australian franchise systems to expand their reach.” In addition to Mr Billson’s Board appointment, the Franchise Council will shortly be appointing a new CEO with the Board keen to reset, renew and reenergise 8

Eagle Boys trials “world’s first” Virtual Drivethru

Eagle Boys Pizza unveiled a Virtual Drivethru, allowing customers to have pizza delivered to their car when they stop by their local store. The technology allows customers to let the store know upon arrival with the simple push of a button, allowing the team members to know exactly when they need to step outside with the customer’s meal. The trial will begin at Eagle Boys Deeragun, Fairfield Waters, Kirwan and Vincent in the Townsville area, with customers invited to request the service when they order their pizzas via the Eagle Boys online ordering sites and apps. The Virtual Drivethru customer option has been in production for 18 months, with Eagle Boys’ Research and Development Team recently working with Australian technology company, Delivery Command. Should the trial be successful, it will be rolled out across the Eagle Boys network nationwide. Read more

Swiss chain opens largest Australasian boutique Swiss ice cream chain, Movenpick, has opened its largest boutique in Australasia with the opening of a franchise in Sydney’s CBD. The new store, opened earlier this month on George Street, adds to the

Domino’s serves up pizza delivery robot

Domino’s Australia has turned a military robot into a pizza delivery droid. DRU (Domino’s Robotic Unit), a prototype of what Domino’s says is the world’s first autonomous pizza delivery vehicle, was unveiled in Brisbane on March 17, 2016. The fast food retailer built the droid with Australian start-up Marathon Robotics using a robot sourced from the military and its own technology, including Domino’s GPS tracking data. DRU, which could spell the beginning of the end of the pizza delivery boy, has a sensory system that uses lasers to move around obstacles in its path to travel unassisted to a customer’s address. The four-wheeled robotic unit travels up to speeds of 20 km/h and is designed to cruise on footpaths, trails and bike paths. When it

Why borrowing money shouldn’t be easy, you need to jump through some hoops.

Fifo Capital has been operating for a decade and has funded in the vicinity of $700 million through their franchisees who specialise in helping SME’s with their cash flow requirements. Managing Director, Neil McMillan says they are sticking to traditional lending principles, unlike companies who are lending money “without fully thinking through the risk of default”. He says it is far too easy right now to get finance. “There are a lot of lenders who have almost forgotten about the traditional tried and tested ways to lend money”. Mr. McMillan says he sees a lot of companies stripping back on their “’normal’ criteria of credit lending risk and chasing market share at what I believe is at higher risk profiles than they previously were”. Lenders are under pressure to compete and this is compromising lending criteria which is “there to protect both lender and borrower. How then can SME’s in a growing environment (growth phase) gain assistance with periodic cash flow solutions? 1. Borrow from a trusted lender that you have confidence

If you are not required to present sound reasoning, data or facts as to your ability to service the loan, then that should give you some indication as to the practices of the lender. 3. Look at credit repayment facilities which allow you to spread payments over an extended period as opposed to having to fund purchases upfront. This reduces cash flow stresses and allows the business owner to get on with growing the business. When asked which sector is receiving a lot of the lending, Mr McMillan says “retail businesses. If there is a recession or dent in consumer confidence, then a number of these businesses lent to could fold and that could result in a lot of losses to the lender”. Does he think this is a continuing trend? “Yes I think so; I see this in perhaps the next 12-18 months”.

Why technology and product innovation are key.

First Class Capital is fundamentally about providing credit in a manner which is transparent, accessible and designed around facilitating future trade says Executive Director, Brad Prout. sources’), he says “there is varying degrees of truth in this. Many business lenders offer seemingly simple products, but the true cost of funding is hidden in what are called ‘factors’ rather than ‘interest’”. What can borrowers and business owners do to navigate this credit landscape? 1. Ensure the business model is fundamentally sound. 2. Focus on cash flow management and don’t be afraid to use credit sensibly within the business if to do so means increasing profitability. 3. Understand the benefits of using credit in your business. To do this, business owners must understand the true cost of funding they are proposing to use. Mr Prout says while increasing access to credit and choice is good, “the borrower must be comfortable with their ability to repay the loan and achieve the intended benefits”. He also believes governments need to closely monitor the use of credit by micro businesses, “to determine what protections (if any) should be afforded to the borrower”. In essence, doing your homework makes good business sense.

We are not going to be reckless, and as a result we don’t suffer losses – in fact we have no provision in our business model to sustain losses. To work out the costs, the place to start is the Disclosure Document and other financial information provided by the franchisor. Once you know the costs, you should calculate the level of sales you need to cover them and make a decent living.

Different franchises have different earning capacities. This means that sometimes there are constraints on the amount you can earn. For instance, if you work on your own, the amount you can earn is limited by the hours you work: for example, as a bookkeeper, cleaner, or handyman. Alternatively, if you employ staff, you may have the potential to earn more income as there are others working with you.

Independent Advice — Financial Due Diligence

No matter how confident you feel about your decision to buy the franchise, it’s important to ask an accountant to look over the numbers. Not only does the Franchising Code recommend it, independent advice is vital because you’re closely involved. There are 2 key factors you need to be aware of: 1. Financial Due Diligence is a specific process that accountants undertake. Bear in mind, however, that not all accountants have expertise in this area. 2. Franchising has unique characteristics that should be considered from a financial perspective. For instance, there may be restrictions on purchasing, pricing, and what you can sell. When you choose your accountant, it’s best to use one who is skilled and experienced in these areas.

Getting First in Line with First Class Capital Low entry franchise fees, low ongoing costs and a booming funding needs market is positioning this finance brand ahead of the game. By Leona Devaz

The Life Cycle of a Business AND its Owner By Len Ferguson

M

any franchise and business owners go on to achieve great success with their businesses. It actually happens more often than we are lead to believe considering that we are mostly hit with horror stories about business owners losing everything when their business fails. Success stories just aren’t as sexy for the mainstream media who are more focused on their ratings than accurate reporting it seems sometimes. Obviously, business success comes at the end of a lot of hard work and your business has evolved and grown over time. But how does a business actually grow, and what stages does a business go through during its life cycle? Below I examine what I call the four phases in a businesses life cycle. a. The Establishment Phase: All business owners go through this. Getting enough sales in the door to

balance out the cash flow of the business so that it becomes positive. Understanding how the business operates, how the businesses finances work and, of course, managing staff. It can take some time to develop the skills to be a Confident, Competent and Compliant within their business. From what I see, it generally takes 12 to 18 months to establish a business and start to move out of the establishment phase to the next stage. b. This next stage I call the Consolidation Phase. In the consolidation phase, business owners generally have the skills needed to run an effective business. In other words, they are Confident and Competent business owners, well from an operational standpoint anyway, although they may not yet be fully compliant with everything required of a business owner to be able to take the next step, and although they are not far away

and this will generally be achieved during this phase. The best way to judge if your business is ready to move to the next stage is that you notice that your cash flow has started to settle down, staff are well trained and work more or less unsupervised and you are generally starting to make a profit and, in some cases, a really good profit. You’re starting to build wealth. c. Now you move into the Investment Phase. In this phase, you start investing into your business so that it can eventually run without you. Building your teams and expanding your business very quickly as the effects of leverage start to kick in. You are becoming true business operators rather than self-employed operators. The true test being when you leave the business for a few weeks and it runs smoothly or better without you. Your business is now truly valuable. Some business owners will never make it to this stage. They will stay within the consolidation phase for various reasons and this is fine. In the end, they are the owners of their business and really do run it as they see fit or within a comfort zone that suits them. But in all cases, eventually everyone moves through to the final stage. d. The Exit Phase. At some stage in the future, everyone will sell their business and move on. It is just the way it is, so there is no use in not thinking about as you move your business through the four phases. It is best

to confront it and plan for it right at the start. Generally speaking, this is when you realize all of your hard work and hopefully make a nice enterprise profit with the sale of your business. Business owners who have taken their business through the Investment Phase and now have a business that can run without them will, in almost all cases, sell their business for a much higher price. Their business is just more attractive to a buyer. The one thing that we all know for sure is that, at some stage, we will look to sell so we should be planning for the exit phase in a deliberate and positive manner. Done and prepared for well, it should be a very rewarding phase to progress through. Have a think about what phase your business sits in at the moment and think about how you can progress through the phase until you ultimately exit. Cannibalisation … What is a Reasonable Distance Between Stores?? By Peter Buckingham CFE

A

prospective Franchisee must look at the competition both from others and from the brand they are joining and ask themselves what is a “reasonable distance between stores”? The effect of competitors is normally not a great problem, and in fact, in the case of homemaker centres and certain types of shopping centres or shopping strips, it can actually be an advantage. This is what we call “clustering”. Name a reasonably sized homemaker centre/precinct, and count the bed stores, furniture stores and electrical stores. Experience has told them that they actually work best together, as the combined drawing power of the homemaker centre far outweighs the advantage of being out on their own. Same reason for DFOs and you should see the size of them overseas. 24

Friend or Foe?

Over the years, we have called this “friend and foe”. In many businesses, including QSRs and DFOs, being with others makes for a precinct and therefore an advantage (“friend”). Being out on your own makes everyone else “foe”. That is great for competitors, but you obviously want minimal competition from your own brand and thus negate any brand advantage you may have over the opposition. In my past life in the oil industry, we had a basic conclusion that 75% of the business a new site would sell came from other sites in a 3 km radius — the balance being the transient volume that moves just because they need fuel at the time.

In businesses such as lottery sales, we had the conclusion it was more like 75% came from sales within 2 km, and when you look at the concentration of lottery agencies, you see that they compete with each other on a very regular basis. Many franchises we see are more like beds, furniture and other homemaker types of business, and our view is that the relevant travel distance is far larger than those mentioned above. So how can we deduce what is fair and reasonable? I remember a great comment from Chris Malcolm FCA Hall of Famer, who once said to me “Peter, we open a (Clark Rubber) site in Alice Springs, and someone in Sydney will still complain!” So the issue is one where a potential Franchisee wants half of Australia as a PMA (preferred marketing area), and the Franchisor is normally trying to rationalise this to make a reasonable PMA, which will allow a reasonable number of stores within each market. So how do we use data and analysis to find an answer?

conclusion as to what is a reasonable PMA in: High-density areas: normally >100,000 persons in a 3-km radius. Bondi, Mosman/Neutral Bay (Sydney), Elwood, South Yarra and Richmond (Vic). Middle suburbia: normally a population density of 60,000– 80,000 persons in a 3-km radius. Middle suburbs of Melbourne and Sydney, anywhere in Adelaide/Perth and most of Brisbane. Outer metro areas: normally a population of <40,000 persons in a 3-km radius; outer metro growth areas: Cranbourne, Doreen, Kellyville, Albion Park, Helensvale, etc. Often, this type of process for many brands may look like:

If we think of two adjoining sites, we normally accept that the two suggested PMAs could overlap somewhat. So if our thinking would be in the Inner area, we would probably be looking at 5–7 km apart, Middle area should be 8–10 km apart and Outer metro somewhere like 12–14 km apart. As you think in terms of a large market such as Sydney (Newcastle to Wollongong), this will probably give around 40 locations, for Melbourne/Geelong around 32 and for

Once we have this mapped, our analysis involves looking at what radius we need to go out from the store to enclose 60% and 80% of the customers. Our view is a reasonable measure of the PMA is somewhere in between. In many cases, we are asked to map the customer database of 10 or 20 stores and come to a realistic

Many franchisors can undertake some analysis (internally or using an external consultancy such as ourselves). If they wish to address this issue with facts and data, our view is the best approaches are: 1. Map a few sets of customer address data from different types of stores, possibly in different markets 2. See what radius do you need to get 60% and 80% of the customers in. 3. Deduce what is a reasonable PMA, and how far approximately should you allow the sites to be apart? The other approach is the cannibalisation approach, where you undertake analysis of what is the real effect of your recently opened stores on other stores in the network? The best way of considering this is: 1. Identify a group of new to industry stores you have opened in the last couple of years. 2. Group like with like — think Inner, Middle and Outer from above 3. Look at each new store in terms of; a. What were the sales of the surrounding stores in the 3 months before opening? b. Leave a few months (3) and then measure the new stores sales over a 3-month period and look at any decrease in sales of the surrounding stores. c. Evaluate this in terms of % sales loss as a factor of distance from the store (commonly known as Huff’s Gravity model).

Reality is most franchisees fear their own branded sites far too much. History has shown me that when another store opens within a few kilometres, this can be the excuse that the sky is falling, and expectations of 50% loss of business comes back to reality, where it may only be 10% (still not great). In fact, we look at sales of clients before and after a new store opens, and sometimes we are amazed that actually the new store opens AND the existing nearby store increases sales as well. Maybe this is that the market presence of two stores — more advertising and action within the brand outweighs the cannibalisation issue? My view is this is really the Franchisor’s responsibility to have some logic to answer the potential Franchisee’s concern.

Summary

Facts and data can answer these common questions, and if you are being told the cannibalisation effect will be zero or very small, ask the logic and do not just accept a “wet finger in the air” opinion.

Base Zero Are Taking Mobile Franchising to New Heights From a coffee franchise to climbing, Base Zero Director Wade Morse is bringing his love of challenges to the urban environment. Getting to the top is now something he helps people – both kids and adults – achieve nearly everyday.

Mr Morse says they have also been very strategic with their marketing approach and because it is a “fun, thrilling,

environment”, jobs are lined up for the next three to six months for franchisees in Sydney. A new Franchisee Development Manager (FDM) has been trained in the US and Mr. Biddle says this will be “the first of many we bring into the Australian network”. Providing a higher level of support is a key focus for the business and the new FDM is “more structured towards coaching, mentoring, goal setting and accountability for franchise partners. They’ll be asked ‘where do you want your business to go?’ Let’s build a plan for that. And where should you start when researching where to find your finance? It’s a perfect fit for your lifestyle, it’s something you are really interested in and the support and training you will receive will make it difficult to fail. But how do you fund your franchise? Cashflow It National Sales Manager Dan Toms says a good place to start when looking for finance is the 30

franchisor. “The brand may already have funding arrangements in place with certain lenders,” he says. “A number of lenders, including Cashflow It have accreditation programs in place for franchise brands, which means that franchisees may already be pre-approved for funding.

“It is also important that franchisees assess what available capital they have to invest in the start up costs of the business. There is no point investing every available cent in the startup costs and having nothing remaining for working capital. “They should consider things like what type of funding solution would suit them, such as lease, rental, chattel mortgage etc. “I would also suggest thinking about their exit strategy, if they are looking to build the business and sell it for a profit then they should investigate if the financier will allow them to pay out the contract early or if there are exit fees and penalties to do so. They may want a more flexible option.” Although franchising has been around for many years, it is still largely misunderstood in the finance industry, according to Dan, who says they are a great option for those looking to fund franchise equipment from someone in the know.

“Cashflow It is very different from a bank or any other finance company in that we only provide funding to the franchise sector and therefore everything to do with our business is specifically tailored for that industry,” he says. “Other lenders classify franchising as small business and lump it together with all the other small business applications such as sole traders operating a gardening business or a couple looking to open a corner store. “The way that we review applications is very different from traditional lenders in that we take into account the strength of the brand and the support that they offer rather than simply looking at the personal asset position of the individual applicant. Our product mix is different and we offer funding solutions to suit different scenarios that franchisees face such as; a new store fit-out, store refurbishment, store re-sale or simply to purchase new equipment. “We also offer a range of terms to align with franchise agreements and individual circumstances. Our approval times are also much faster than traditional lenders.” Cashflow It was established in 2013 out of necessity, according to Dan, who says accessing funding for franchisees could be difficult. “These other lenders didn’t specialise in franchising or even understand the industry so accessing funding could often be very difficult,” he says. “It was clear that a franchise specific lender was required. One with a more competitive offer that could make accessing funding for franchisees a much simpler process. “By financing their equipment with us, business owners are also preserving their precious capital for other uses such as growing their business. “If they select a rental or operating lease then the funding is off balance sheet. This means that it will not affect their ability to borrow in the future. As well as the tax benefits, our clients also benefit from the flexibility of our products. Expanding on Melbourne’s Original Café Culture No cookie cutter stores, but instead, a signature range of baked breads and pastries, professional systems and a flexible approach is the recipe for Degani’s success. By Leona Devaz

T

he European love of food and their passion for coffee is a signature theme of iconic Melbourne brand Degani’s. First established in the late 90s, the founders George Pezaros and George Vasiliadis had an idea to offer a European style bakery\cafe. Espresso had started to take off in Melbourne and people were embracing the concept of roasted coffee. Since then, demand hasn’t waned and customers still travel from Bayside to the Clifton Hill store, relishing the chance to dine on cake and Degani experience. General Manager Darren Lane says the brand is born out of the coffee culture in Melbourne and is “unique and flexible. We have stores that are 500m2 with wine bars and conference rooms, to a 30m2 kiosk in Doncaster. The point of difference for Degani’s is, no two menus are the same, we tailor it to the location and demographics around it”. Items such as wood-fired pizzas, tapas and Mediterranean foods are a staple and the objective for the business is to grow nationally over the next 12 months. At present 70 Degani bakeries operate in Victoria across the Melbourne metro area, including Geelong and Shepparton. Recent additions include Casey (Westfield) and Box Hill. NSW will see its first store open up in the Narellan town centre in August 2016 and WA is also on the map.

Mr. Lane says the CEO and Leasing Manager are “very interested in Perth, and will be coming over to do a roadshow.” The first store opens in Kings Square (Perth CBD) in May and Mr Lane says the leasing team “are looking at the right opportunities for Sorrento Quay, Mandurah, Morley, Northlands Plaza and Bunbury”. Prospective franchisees are already in discussion and can still register their interest in the WA market. As the number one coffee brand in Victoria, Degani’s freshness of product is attributed to sourcing local produce and where possible, “made from scratch. We’re not a simple heat and serve”. Testament to their coffee is an upcoming award in MICE (Melbourne International Coffee Exhibition) during 17-19 March. “We won silver for the ACA chain best coffee beans”. This quality approach also extends to the fitout of the stores – each having a high-level café finish. “it’s not done ostentatiously, we use jars as lights, scaffolds as benches, it has a rustic warmth that it is Melbourne and makes people feel at home – it’s the core of our business. The culture of the business is hospitality and Mr Lane says new franchise partners “don’t need to have had a business before, we can teach you how to manage a team of chefs, cooks and baristas. However, you need to be good with people. Customers might come for the name ‘Degani’ – but they come back for the food, experience and warmth”.

At the time, cafes and chains in Australia were sitting in the middle masses and were not occupied by high-end, bespoke businesses says CIBO General Manager, Merissa Collins. “CIBO started as a family business, all the founders came from hospitality and managed the supply chain. They did all of the food and roasted the coffee”. This attention to detail and craftsmanship has imbibed CIBO stores with a genuine local and community spirit. Franchising Code Avoiding the Traps By Dr Michael Schaper

T

he old adage that “prevention is better than cure” is certainly a good one. If you’re looking to buy a franchise, then some due diligence, sound professional advice and a bit of research can help you avoid the pitfalls and find the right system.

Understand the rules of the game

Before you put your life savings on the line, get familiar with the mandatory Franchising Code of Conduct. The Code is administered by the ACCC and is binding on all franchising participants. It sets out the rights and obligations of both franchisors and franchisees. The Code requires franchisors to disclose specific information to potential and existing franchisees. In addition, it spells out certain major rights of both parties

under a franchise agreement. The Code also provides a way for franchisees and franchisors to resolve disputes. If you’re not sure where to start, then doing a preentry franchise education program is a good idea. Griffith University offers a free online education program for prospective franchisees. The program, funded by the ACCC, educates potential franchisees about their rights under the Code as well as the practical side of running a franchise business. It’s short, simple and to the point. Buying a franchise is a big financial decision and a major lifestyle change. Don’t rely solely on your gut

2. Complete a pre-entry franchise education program. 3. Get advice from an accountant, lawyer or business expert. instinct or you may find the franchise system doesn’t live up to expectations. We think seeking independent perspective from a lawyer, business adviser or an accountant is an important step. In fact, the Code requires you to provide a statement that you have sought this advice. Alternatively, you can sign a statement saying that you are aware that you should seek such help but have decided against it.

4. Make sure you receive an information statement, disclosure document, franchise agreement and a copy of the Code. Read these documents carefully. 5. Take comprehensive notes of your meetings with the franchisor. Insist on the franchisor confirming any claims it makes in writing. 6. Speak to current and previous franchisees.

Do your homework

Take your time to review all the paperwork. These documents not only set out your rights and obligations but they will also give you key information to follow up. You should receive a two-page information statement highlighting some of the risks and rewards of franchising. The franchisor should give you this statement when you apply, or express an interest, in buying a franchise. The franchisor will also provide you with a disclosure document, which contains key financial information and details about the system. Pay close attention to this document, as it covers things such as franchise territory, online sales, site selection, payments and what will happen when the agreement comes to an end. The franchisor must also provide you with the proposed contract (franchise agreement), and a copy of the Code, at least 14 days before you enter into an agreement or make a non-refundable payment. The franchise agreement underpins each party’s rights and responsibilities. When signed, the agreement becomes a legally binding contract between the franchisee and the franchisor.

What do existing and former franchisees say?

As part of your research, you should speak to as many existing and former franchisees as possible. They will provide you with the low down on how the franchise system works and whether they are satisfied with the level of support provided by the franchisor. Franchisors are required to provide you with the contact details of current franchisees as well as franchisees who have left the system in the past 3 years. If possible, see if you can work with an existing franchisee so that you are able to see how the business operates first hand, including turnover and staffing requirements.

7. Research the franchise and try to verify the information provided to you. 8. If you will occupy premises as part of your franchise, make sure you understand your rights and obligations under the lease or occupancy agreement. 9. Check clauses on termination, renewal, end of term and transfer of the franchise, and make sure you are willing to accept them. 10. If the deal is not acceptable, try to negotiate a better offer or look for a better deal. Franchising is a business and, like any business, there is the potential for things to go wrong. Make sure you go in with your eyes wide open.
