TERMS & CONDITIONS
1. The Frasers Property Australia, Port Coogee, Stamp Duty Credit (Transfer Duty) Promotion ("Offer") is available to buyers of the following selected residential lots situated within Octavia Mews and Omeo Edge releases at Port Coogee:
• Octavia Mews (Stage 7C): Lot 205; and
• Omeo Edge (Stage 8): Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13, 14, 16, 17.
(each an “Eligible Lot”) who enter into a contract of sale of an Eligible Lot (“Contract of Sale”) at the list price ("Purchase Price") after 10am WST on Saturday 24 June 2023 (“Start Date”) which settles on or before 5pm WST on Friday 29 September 2023 (“End Date”). A buyer who satisfies this criteria is an eligible buyer for the purposes of these Terms and Conditions (“Eligible Buyer”).
2. The Offer starts on the Start Date and will end on the End Date
3. The Offer entitles an Eligible Buyer to receive a credit equivalent to the amount payable as stamp duty on the Contract of Sale (“Duty Credit"), being ‘Transfer Duty’ payable under the Duties Act 2008 (WA) calculated as the lesser of the duty assessed on the duty assessment notice and the standard rate of duty for residential property, but excluding any:
• foreign persons surcharge (i.e. “foreign transfer duty”) under the Duties Act 2008 (WA) and any other government fees such as transfer fees;
• additional amounts payable for fines or penalties for late lodgement; and
• additional duty arising where the Eligible Lot is group assessed for duty in conjunction with other lots.
4. Frasers Property Australia will provide the Duty Credit to Eligible Buyers at settlement of the Contract of Sale as an adjustment to the Purchase Price.
5. Frasers Property Australia reserves the right at any time to:
• cancel, suspend or extend the Offer to buyers that have not entered into a Contract of Sale;
• include additional properties in the Offer or withdraw an Eligible Lot from this Offer.
6. The Eligible Buyer acknowledges that the Offer is non-transferable and the Duty Credit cannot be claimed as a discount off or reduction in the Purchase Price, in cash or in any other transferrable value.
7. If the Eligible Buyer does not complete the purchase of the Eligible Lot in accordance with the Contract of Sale or if settlement of the Contract of Sale is extended by request or default of the Eligible Buyer beyond the settlement date stated in the Contract of Sale, or beyond the End Date, the Eligible Buyer will not be entitled to receive the Duty Credit
8. This Offer is not available with extended settlement dates.
9. The Eligible Buyer forfeits all rights to receiving or participating in the Offer if the Eligible Buyer does not comply with any of these terms and conditions or any term or condition under the Contract of Sale.
10. All other terms and conditions in the Contract of Sale apply. To the extent of any inconsistency between these Terms and Conditions and the Contract of Sale, the Contract of Sale will prevail.
11. An Eligible Buyer must rely on their own enquiries in relation to the Offer
12. This Offer can be taken in conjunction with the “2023 Gift 2 Get 2” offer running from 4:00pm AEST on Thursday 11 May 2023; and ending on 5:00pm AEST on Monday 31 July 2023 (unless that date is extended, or the Gift 2 Get 2 Offer is cancelled earlier, by Frasers Property Australia). 13. Prices and availability of Eligible Lots are subject to change without notice.
14. The Offer is not an offer of finance. Frasers Property Australia takes no responsibility and is not liable for an Eligible Buyer’s stamp duty or other tax liabilities or government charges.
15. The Eligible Buyer must disclose the contents of this Offer to any lending institution providing finance to the Buyer to assist with the purchase of the Eligible Lot
