Family Share Extended Offer
1. This offer is made by Frasers Property Australia on the Terms and Conditions set out below (Family Share Extended Offer).
2. This Family Share Extended Offer is available to:
a. a natural person who is a member of Frasers Property Australia’s Care & Rewards program (Care & Rewards), being either:
i. an existing member at the start of the Promotion Period; or
ii. a person who is entitled to be a Care & Rewards member and has chosen to be a member during the Promotion Period (Referrer); and
b. a new purchaser (being either a natural person or a company) introduced by the Referrer to Frasers Property Australia, who enters into their first contract to purchase a residential property at the following Participating Development (Referred Extended Family Member):
i. Land lots in the Frasers Property Australia development Mambourin Green, in Mambourin VIC.
(Promotion Eligible Contract).
3. This Family Share Extended Offer:
a. starts on 4pm AEST on Thursday 6 June 2024; and
b. ends on 5:00pm AEST on Saturday 1 February 2025 (unless that date is extended, or the Family Share Extended Offer is cancelled earlier, by Frasers Property),
(Promotion Period)
4. These Terms and Conditions:
a. apply in addition to, and unless specifically stated otherwise, must be read with, the terms and conditions of the Care & Rewards program, which are available to view click here (Care & Rewards Terms and Conditions); and
b. continue to apply after the end of the Promotion Period, to each Referred Extended Family Member and the Referrer who referred that Referred Extended Family Member during the Promotion Period, so that those Referrers and Referred Extended Family Members are entitled to receive their rewards where their Promotion Eligible Contracts settle after the end of the Promotion Period (but the Family Share Extended Offer otherwise ends at the end of the Promotion Period).
5. Under this Family Share Extended Offer and subject to clause 8 below:
a. a Referrer is entitled to receive a referral reward of $2,000 (Family Share Referral Reward) if the following have been satisfied:
i. the Referrer has submitted a valid ’Refer Family & Friends’ introduction form (Referral Form) during the Promotion Period and before their Referred Extended Family Member has
entered into a Promotion Eligible Contract. You can access the Referral Form here: careandrewards.com/refer or in the myFrasersProperty app and portal;
ii. the Referred Extended Family Member is not an existing Care & Rewards member;
iii. the Referred Extended Family Member is not already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia or appearing on a Frasers Property Australia sales database;
iv. Frasers Property Australia has acknowledged receipt of the Referral Form before the Referred Extended Family Member has entered into a Promotion Eligible Contract;
v. for a Referrer who is entitled to be a Care & Rewards member and has chosen to be a member during the Promotion Period, Frasers Property Australia has confirmed that the Referrer has been accepted as a Care & Rewards member before the end of the Promotion Period;
vi. the Referred Extended Family Member has entered into their first Promotion Eligible Contract during the Promotion Period;
vii. if the Referrer has entered into an Eligible Contract that has not yet settled: 1. the Referrer has satisfied all Purchaser Conditions in their Eligible Contract; and 2. the Referrer has not defaulted on settlement of the Eligible Contract on the required settlement date;
viii. the Referred Extended Family Member has not defaulted on settlement of their Promotion Eligible Contract on the required settlement date;
ix. if the Referrer has entered into an Eligible Contract that has not yet settled, the Referrer has not nominated, assigned or otherwise transferred their Eligible Contract to a third party, except that the Referrer may nominate, assign or otherwise transfer their Eligible Contract to a company provided the Referrer is and remains at settlement of the Eligible Contract a director of the company the Eligible Contract is nominated, assigned or otherwise transferred to;
x. the Referred Extended Family Member has qualified for the Family Share Purchase Reward; and
xi. the Referrer has otherwise complied with the Care & Rewards Terms and Conditions and, if applicable, the terms of their Eligible Contract;
b. a Referred Extended Family Member is entitled to receive a purchase reward on their first Promotion Eligible Contract equivalent to the Referring Member’s tier at the time of referral (Silver 2% or Platinum 3%) of the net purchase price payable on the Promotion Eligible Contract (Family Share Purchase Reward) if the following have been satisfied:
i. either:
1. the Referred Extended Family Member is not already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred
to Frasers Property Australia or appearing on a Frasers Property Australia sales database; or
2. if the Referred Extended Family Member has previously been introduced or referred to Frasers Property Australia or appears on a Frasers Property Australia sales database, as a result of a previous friend referral promotion or scheme, the Referred Friend must meet all of the conditions in clauses 5(b)(ii) to 5(b)(ix);
ii. if the Referred Extended Family Member is a natural person, the Referred Extended Family Member is not an existing Care & Rewards member;
iii. if the Referred Extended Family Member is a company, the company’s authorised representative has notified Frasers Property Australia of up to 2 individuals to be Care & Rewards members who are either shareholders or directors of the company and has confirmed that none of them are existing Care & Rewards members;
iv. on or before entering into the Eligible Contract, the Referred Extended Family Member has confirmed and warranted to Frasers Property Australia that the Referrer was their referrer (in the sales advice form provided to Frasers Property Australia);
v. the Referred Extended Family Member has entered into their first Promotion Eligible Contract during the Promotion Period;
vi. the Referred Extended Family Member has satisfied all Purchaser Conditions under their Eligible Contract;
vii. if the Referrer has entered into an Eligible Contract that has not yet settled, the Referrer has not defaulted on settlement of their Eligible Contract on the required settlement date;
viii. the Referred Extended Family Member has not defaulted on settlement of their Eligible Contract on the required settlement date;
ix. the Referred Extended Family Member has not nominated, assigned or otherwise transferred their Promotion Eligible Contract to a third party, except that the Referred Extended Family Member may nominate, assign or otherwise transfer their Promotional Eligible Contract to a Company provided the Referred Extended Family Member is and remains at settlement of the Promotion Eligible Contract a director of the Company the Promotion Eligible Contract is nominated, assigned or otherwise transferred to; and
x. the Referrer has qualified for the Family Share Referral Reward and has otherwise complied with the terms of their Eligible Contract and the Care & Rewards Terms and Conditions.
6. Subject to compliance with these Terms and Conditions:
a. the Family Share Referral Reward will be paid to the Referrer after the later of: i. the date the Referred Extended Family Member’s Promotion Eligible Contract reaches Unconditional Exchange; and ii. 10 Business Days from the date Frasers Property Australia receives a completed Care & Rewards Bank form from the Referrer via DocuSign
If the Referrer is a company, the Family Share Referral Reward will be paid to one person whom the authorised representative of the company confirms in writing to Frasers Property Australia
b. the Family Share Purchase Reward will be paid to the Referred Extended Family Member:
i. if the Referrer’s Eligible Contract has settled before the Referred Extended Family Member’s Promotion Eligible Contract settles, on the date of settlement of the Referred Extended Family Member’s Promotional Eligible Contract. The Family Share Purchase Reward will be paid in the manner determined at Frasers Property Australia’s discretion, including as an adjustment to the purchase price of the Referred Extended Family Member’s Promotion Eligible Contract; or
ii. if the Referrer’s Eligible Contract has not settled before the Referred Extended Family Member’s Promotion Eligible Contract settles, the date which is 10 Business Days after the later of:
i. the date the Referrer’s Eligible Contract settles; and ii. the date Frasers Property Australia receives a completed Care & Rewards Bank form from the Referred Extended Family Member via Docusign
The Family Share Purchase Reward will be paid in the manner determined at Frasers Property Australia’s discretion.
7. If:
a. the Referred Extended Family Member or the Referrer defaults under their Promotion Eligible Contract or Eligible Contract, respectively; or
b. the relevant Promotion Eligible Contract or Eligible Contract is otherwise brought to an end before settlement for any reason; or
c. the Referred Extended Family Member or the Referrer nominates, assigns or otherwise transfers their Promotion Eligible Contract or Eligible Contract not in accordance with paragraph 5.a.ix or 5.b.ix, respectively,
then the Referred Extended Family Member will not be entitled to receive the Family Share Purchase Reward and the Referrer will not be entitled to receive the Family Share Referral Reward under this Family Share Extended Offer.
8. A Referrer can make any number of referrals under these Terms and Conditions. However, if a Referred Extended Family Member enters into more than one Promotion Eligible Contract, the Referrer is only entitled to receive a Family Share Referral Reward in respect of the Referred Extended Family Member’s first Promotion Eligible Contract.
9. For every additional Promotion Eligible Contract or every Eligible Contract entered into by the Referred Extended Family Member, the Care & Rewards Terms and Conditions will apply to the Referred Extended Family Member (including eligibility for the Repeat Purchase Reward on the second and each subsequent Promotion Eligible Contract or every Eligible Contract that the Referred Extended Family Member enters into).
For example, a Referred Extended Family Member that is entitled to receive the Family Share Purchase Reward for their first Promotion Eligible Contract under these Terms and Conditions at a silver tier, is still entitled 2% Repeat Purchase Reward for their second Promotion Eligible Contract or first Eligible Contract under the Care & Rewards Terms and Conditions.
10. These Terms and Conditions will prevail to the extent of any inconsistency between these Terms and Conditions and the Care & Rewards Terms and Conditions. All other terms and conditions in the contract for sale and the Care & Rewards Terms and Conditions apply.
11. Frasers Property Australia reserves the right to cancel or extend the Family Share Extended Offer at any time.
12. This Family Share Extended Offer cannot be taken in conjunction with any other Frasers Property Australia offer including, but not limited to, the Family Share Benefit under Care & Rewards Terms and Conditions. That means that if a Referrer refers a Referred Extended Family Member (and makes a claim) under this Family Share Extended Offer, that Referrer cannot also claim for a referral reward under the Care & Rewards Terms and Conditions (for referring that Referred Extended Family Member).
13. The Family Share Referral Reward and the Family Share Purchase Reward under this Family Share Extended Offer cannot be claimed as (and do not constitute) a discount or rebate on, or reduction of, the purchase price under a Promotion Eligible Contract or an Eligible Contract
14. The price and availability of any Promotion Eligible Property is subject to change without notice. Frasers Property Australia reserves the right to withdraw from sale any Promotion Eligible Property or participating Development at any time.
15. All parties must rely on their own enquiries and the terms of their Promotion Eligible Contract and Eligible Contract
16. This Family Share Extended Offer is not an offer of finance. Frasers Property Australia takes no responsibility and is not liable for a purchaser’s stamp duty, strata levies or other tax liabilities or government charges.
17. In the event of any dispute or disagreement, the decision of any member of Frasers Property Australia is final.
18. Capitalised terms which are used but not defined in these Terms and Conditions have the meaning given in the Care & Rewards Terms and Conditions.
19. In these Terms and Conditions, “Frasers Property Australia” means Frasers Property AHL Limited and where relevant includes all related entities, including the vendor for each Eligible Property.
20. These Terms and Conditions are governed by the laws in force in Victoria
21. Privacy collection notice:
a. Frasers Property Australia agrees to use any Personal Information collected in accordance with the Frasers Property Australia Privacy Policy.
b. The types of personal information we may collect and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website. c. A Member agrees to provide Frasers Property Australia with Personal Information in order to participate in the Care and Rewards program, and to keep that information up to date.
d. If a Member does not provide or update the Personal Information required by Frasers Property Australia, the Member acknowledges that it may not be entitled to receive certain Benefits under
the Care and Rewards program.
e. Frasers Property Australia may send electronic communications to the Member regarding third party offers, products and services available as part of the Care and Rewards program. Members can unsubscribe from such electronic communications by using the unsubscribe function in these communications.
f. Members acknowledge that the myFrasersProperty app & portal provides information on each Member’s individual Tier and Benefit which is personal to each Member. To maintain the privacy of such information, each Member must ensure that the email address the Member provides to Frasers Property Australia for the purposes of accessing the myFrasersProperty app is sufficiently unique in its nature. Members acknowledge that it is the responsibility of each Member to only use their own email address and ensure that no other person uses their email address to avoid any unauthorised access to each Members personal information.
