Midtown | MAC Residences - Request to Purchase Terms and Conditions To be eligible to purchase at the VIP pre-release launch of MAC Residences at Midtown, Macquarie Park, you must agree to the terms and conditions of the Request to Purchase Tool. 1. These terms and conditions govern your use of the Frasers Property Australia Request to Purchase Tool for registration of your interest in purchasing a property at Midtown during the initial sales release of MAC Residences (“Request to Purchase Tool”). By using the Request to Purchase Tool, you agree to comply with these terms and conditions. 2. You may register your interest in the initial sales release of MAC properties at Midtown only after you have attended an appointment and during the period from Saturday 22 August, 2020 to 5pm (AEST) on Wednesday 16 September 2020 (“Registration Period”). During the Registration Period, you must complete the Request to Purchase Form to register your interest to purchase a property within MAC Residences (each, a “Property”) in accordance with these terms and conditions (“Registration”). 3. If you complete the Request to Purchase Form, you will receive a confirmation email from Frasers Property Australia confirming your Registration and you will become a “Registered Purchaser”. 4. Following Registration, you will receive a subsequent email with a link to access the Request to Purchase Tool. 5. Request to Purchase for MAC Residences at Midtown, Macquarie Park opens at 12pm (AEST) on Saturday 19 September 2020 and close at 1pm (AEST) on Saturday 19 September 2020 (Request to

Purchase Period). During the Request to Purchase Period, you may use the Request to Purchase Tool to request to purchase a property within MAC Residences release at Midtown, Macquarie Park (“Request to Purchase”). 6. If you are successful in requesting to purchase a property within MAC Residences apartment release at Midtown, Macquarie Park, you will receive an email from Frasers Property Australia confirming your Request and reference number. 7. Following the Request to Purchase Period, you will be contacted by the Midtown Sales Team via telephone within 48 hours of the Request to Purchase Period closing. You will be contacted in order of priority, based on the time of receipt of your Registration by the Request to Purchase Tool server. Please note that all Prosperity members who registered to purchase will be contacted first. 8. When you are contacted by the Midtown Sales Team, you may be provided with an opportunity to purchase a property in the MAC Residences release at Midtown, Macquarie Park (Property). If you wish to secure that opportunity, you must: a. pay a non-refundable administration fee of $500 to the bank account specified by the Midtown Sales Team (“Administration Fee”) within 2 hours of being contacted by the Midtown Sales Team; and b. return by email to Frasers Property Australia a completed and signed sales advice for the Property and a valid receipt showing that transfer of the Administration Fee has been made. 9. Once Frasers Property Australia confirms receipt of the Administration Fee and a duly signed sales advice, a contract for sale and purchase of the Property (“Contract”) will be sent to the Registered Purchaser’s nominated solicitor or conveyancer. 10. To purchase a Property, the Registered Purchaser must exchange the Contract between Monday 21 September 2019 and Monday 28 September 2020 by returning the Contract to Bugden Allen Lawyers, Level 13, 111 Elizabeth Street, Sydney, NSW 2001 Attn: Natalee Forster, by 5pm (AEST) on Monday 28 September 2020. 11. Payment of the deposit under the Contract and other conditions of purchase are governed by the Contract. 12. If you decide not to purchase the property between reserving the property on the 19 September 2020 and signing and returning the contract and paying the remainder of the 10% deposit on the 28 September 2020, you will lose the $500 administration fee. 13. If following the Request to Purchase Period, the Midtown Sales Team is unable to contact you on your nominated telephone number, we will endeavour to leave you a voicemail or SMS, however you will lose your Registration priority and the Midtown Sales Team will contact the next Registered Purchaser. The Midtown Sales Team will endeavour to contact on your nominate telephone number a second time. Once you return a call to the Midtown Sales Team, you will resume priority ahead of the remaining Registered Purchasers who have not yet been contacted. If the Midtown Sales Team is unable to contact you by telephone after the second attempt and you do not contact the Midtown Sales team before we finish contacting all Registered Purchasers, Frasers Property Australia reserve the right to forfeit your Registration and any opportunity to purchase a Property during the initial sales release at Midtown, Macquarie Park. 14. You acknowledge that Registration does not give you a legal right or guarantee to purchase a Property, including during the initial sales release at Midtown. There may be more people registering using the Registration Tool than there are Properties available for purchase. You agree not to make a claim against Frasers Property Australia if you are not able to purchase a Property, or you are

impaired from purchasing a Property, for any reason, including the negligence or error of Frasers Property Australia. 15. You may be prevented, delayed or impaired from using the Request to Purchase Tool for a number of reasons, including due to infrastructure failures like internet or telecommunication outages, or impairment or failure of the Request to Purchase Tool (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree not to make a claim against Frasers Property Australia if you are unable to use the Request to Purchase Tool, or if you are provided a less favourable Registration preference, due to any of the problems set out in this paragraph, irrespective of who is responsible. 16. By submitting this form, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a Property and to promote its products and services. Frasers Property Australia agrees to comply with its privacy policy in its collection of personal information, which can be viewed here [ https://www.frasersproperty.com.au/privacy ]. 17. These terms and conditions are governed by the laws in force in New South Wales. Reference to Frasers Property Australia means Frasers Property AHL Pty Ltd ACN 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)) and includes its officers, employees, contractors or agents. 18. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract takes precedence over these terms and conditions.
