Priority Release Release One – Registration of Preferences

Terms & Conditions

To be eligible to purchase in the Release One at The Quarry you must agree to the following terms and conditions:

1. These terms and conditions govern the Frasers Property Australia Priority Release for expressing interest in purchasing a property in Release One at The Quarry ("Process”). By participating in the Process, you agree to comply with these terms and conditions.

2. Prequalification

The following persons are eligible to participate in the Process:

(a) Care and Rewards Members;

(b) a person eligible for the Family Share Benefit (as defined in the Care and Rewards Terms and Conditions available at: https://www.frasersproperty.com.au/Care-andRewards/Terms-and-conditions) (“Care and Rewards T&Cs”) who have met the prequalification requirements detailed in paragraph 3 below; and

(c) eligible Gift 2 Get 2 referrals (as set out in the Gift 2 Get 2 T&Cs available at: https://www.frasersproperty.com.au/Care-and-Rewards/Terms-andconditions#TCGiftGet), (each, a Prequalified Participant)

3. For any family members of Care and Rewards Member wishing to gain access to this release under the Family Share Benefit, the family member must:

(a) complete the following referral form by Friday 16 June 2023: https://www.frasersproperty.com.au/Care-and-Rewards/Refer; and

(b) otherwise comply with the requirements to be eligible for the Family Share Benefit as set out in the Care and Rewards T&Cs, including providing supporting documents to the satisfaction of Frasers Property Australia demonstrating that the relevant family member is an Immediate Family Member (as defined under the Care and Rewards T&Cs); and

(c) be notified by Frasers Property Australia in writing prior to 21 June 2023 that they are a Prequalified Participant.

A Prequalified Participant must register their interest in participating in the Process by 12pm (AEST) on 22 June 2023 available at:

https://www.frasersproperty.com.au/SMP/CareAndRewards/QLD/The-Quarry

4. On or before 11am (AEST) on 23 June 2023, each Prequalified Participant will receive a link via their registered email address to submit their preferences of properties available for purchase this release (Registration of Preference). A minimum of three (3) preferences is required to complete the form. The Registration of Preference must completed before 12am (AEST) on 23 June 2023.

5. A maximum of one (1) lot is permitted to be purchased by any Prequalified Participant for each release

6. Prequalified Participants who have properly completed their Registration of Preference will be contacted on 24 June 2023 based on the following order of preferences:

(a) Platinum tier Care and Reward Members;

(b) Silver tier Care and Reward Members;

(c) family members under the Family Share Benefit; and

(d) Gift 2 Get 2 referrals,

with Prequalified Participants in each of the above categories being contacted on a first come first served basis.

7. If Frasers Property Australia is unable to contact you on your nominated telephone number, they will endeavour to leave you a voicemail or SMS, however you will lose your priority and the sales representative will contact the next Prequalified Participant

8. When you are contacted by a sales representative of Frasers Property Australia you may be provided with an opportunity to purchase a property in the release (Property). If you wish to take up this opportunity, you must:

(a) pay a holding deposit of $5,000 to the bank account specified by Frasers Property Australia (“Deposit”); and

(b) return by email to Frasers Property Australia a completed and signed copy of the expression of interest form provided to you by Frasers Property Australia (“EOI Form”) along with a valid receipt showing that transfer of the Deposit has been made (EOI Process).

You must complete the EOI Process within 24 hours of being contacted by a sales representative of Frasers Property Australia.

9. Once Frasers Property Australia confirms receipt of the Deposit and a duly signed EOI Form, a contract for sale and purchase of the Property (“Contract”) will be sent to you or your nominated Queensland solicitor or conveyancer within 10 business days.

10. Payment of the deposit under the Contract and all other conditions of purchase will be governed by the Contract.

11. If you decide not to purchase the Property after payment of the Deposit has been made but before you sign the Contract, your Deposit will be refunded in full.

12. If you fail to complete the EOI Process within 24 hours of being contacted by a sales representative of Frasers Property Australia, you will be deemed to have forfeiting your opportunity to purchase that Property and the Property will be available for purchase by another person.

13. You acknowledge that the Registration of Preference does not give you a legal right or guarantee to purchase a property. There may be more Prequalified Participants undertaking the Process than there are properties available for purchase. You agree not to make a claim against Frasers Property Australia if you are not able to purchase a Property, or you are impaired from purchasing a Property, for any reason, including the negligence or error of Frasers Property Australia.

14. You may be prevented, delayed or impaired from coming the Process, submitting a Registration of Preference or securing an opportunity to purchase a Property during the Process for a number of reasons, including due to infrastructure failures like internet or telecommunication outages, or impairment or failure of the site containing the electronic forms (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree not to make a claim against Frasers Property Australia if you are unable to register your interest or submit a Registration of Preference, or if you are provided a less favourable Registration of Preference priority, due to any of the problems set out in this paragraph, irrespective of who is responsible.

15. By submitting this form, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a property and to promote its products and services. Frasers Property Australia agrees to comply with its privacy policy

in its collection of personal information, which can be viewed here https://www.frasersproperty.com.au/privacy

16. These terms and conditions are governed by the laws in force in Queensland. References to Frasers Property Australia means Frasers Property AHL Pty Ltd ACM 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)), including Frasers Property Keperra Pty Ltd and includes its officers, employees, contractors and agents.

17. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract takes precedence over these terms and conditions.

18. These terms and conditions are to be read in conjunction with the Care & Rewards T&Cs, when understanding who is eligible to become a Member and how rewards can be accessed. To the extent of any inconsistencies between these Terms and Conditions and the Care and Rewards T&Cs, the Care and Rewards T&Cs prevail.
