How to avoid getting stuck with

For years we have been lamenting the poor productivity of the New Zealand building industry in comparison to other developed countries, and it’s a documented fact backed up by solid evidence. It’s not that kiwi tradesmen are lazy or incompetent – the causes relate more to geographic and population factors – but it does mean we pay more for building materials and services than we should do. The preferred solutions are greater competition in the building materials sector, greater reliance on prefabrication, and greater standardisation of buildings, but they are tough obstacles to overcome. MBIE are trying to free up prefabrication from red tape and improve the product certifi cation system, but at the same time they are making life tougher for builders, joinery manufacturers and building materials merchants through increased liability.

Then add to that mix the impact of the covid-19 pandemic, and we have building prices going through the roof. It’s all due to basic economics – demand exceeding supply. Demand has increased due to the Government pumping borrowed money into the economy and consumers not being able to spend it on overseas holidays. Supply has decreased due to a reduction in domestic timber milling capacity, domestic and overseas manufacturers mistakenly reducing their production in anticipation of a pandemic-induced recession, and the global freight industry doing the same thing. Given that joiners are sometimes signing up projects that won’t be able to start for six months or more and accepting orders that won’t be able to be delivered for a similar period - when substantial price rises over that period are inevitable - there will be an increased focus on the joinery supplier’s ability to pass on cost increases in the months to come. And that will create tension not only with clients who can’t cope with the inevitable budget blowout, but also with their banks who are increasingly insisting on genuine “fi xed price” projects and are seemingly blind to the realities of variations, provisional sums, and cost fluctuations. Because those are the three main reasons why so-called fixed prices are never fi xed.

How are joiners going to protect themselves against their profitability being eroded by these unprecedented price rises in the aftermath of the pandemic? The best way is by charging on a cost reimbursement basis so that property owners pay the true cost of materials and labour at any given time. However that leaves property owners uncertain about their ability to fund their project, so they naturally want their suppliers to assume the risk of price rises. The suppliers can do that if they build in large contingencies into their fi xed prices (at the expense of the property owner) and if they get their own suppliers and subcontractors to commit to fixed prices. But in these days of high demand coupled with material shortages and long leadtimes, they aren’t going to do that. Alternatively, joiners can stockpile building materials in anticipation of using them on some project later on, but they bear the cost of procurement and storage and they run the risk that many of those materials will turn out to be superfl uous.

That leaves us with the three standard ways to vary prices in a fi xed price contract – variations, provisional sums, and cost fl uctuations. You can only charge for a variation if you are required to do something diff erent from what you originally agreed to do, so that won’t help you if the project hasn’t changed, but the cost of it has. Provisional sums are appropriate if there are certain components of a project that simply can’t be priced accurately in advance, but if that applies to the whole of the project and you make the whole of the contract price provisional, then all you are doing is effectively converting a fi xed price contract into a cost reimbursement one, and the customers won’t wear it. That leaves you with cost fl uctuations, and you will only be able to pass those on if your contract allows you to do so.

Cost fluctuation clauses in contracts vary widely, so what you can do depends on the particular wording in your contract – assuming you have an entitlement to adjust your price for cost fl uctuations in the fi rst place. For example that entitlement may

be restricted to the cost of labour, or subcontractors, or materials, or any combination of them. And assuming you are allowed to make the adjustment, then what you are entitled to adjust for, is the diff erence between the rates and prices that applied when you originally accepted the order, and the rates and prices that apply when it comes time to invoice for your goods and services. So you will have to have some way of proving what the diff erence is. That means having written records of what you based your original price on – wages and salaries, and quotes or estimates from subcontractors and suppliers – and then similar records of what those inputs cost you now.

Sometimes an ability to pass on cost increases is subject to those cost increases not being reasonably foreseeable at the time the Contract is signed. If your cost fl uctuation clause is qualifi ed in that way, then whether you are caught out by the no-foreseeability requirement will depend on how widely-known the current supply shortage was when you signed your contract. If it was widely known, then your customer is likely to argue that you took the risk of price increases that you knew were likely to eventuate. You would have to argue in response that although you knew there was a global pandemic, you were no better equipped to foresee what the Government response would be or how global supply chains would be affected, than anyone else. Finally, you might be obliged to do what you can to resist any price increases and procure subcontracts and materials on the basis of fi xed prices that cannot be increased during the course of the your work. In that case you would argue that it simply isn’t feasible to obtain fi xed supplier and subcontractor pricing in the current market. You would need to get statements verifying that from your suppliers and subcontractors, if you are put to the test.

STATE OF THE INDUSTRY

Reports from Branch Presidents November 2021

AUCKLAND / NORTHLAND

Since our last update in August, Auckland joiners have been restricted by Covid. With 5 weeks of level 4 lock down and now operating in level 3 for the past 7 weeks, with looking like we will be in level 3 at least until 29th November when the government reviews the settings depending on the vaccination rates.

Operating at Level 3 and having Covid in the community is causing all sorts of headaches for our businesses, from difficulties in doing business in general, supply of materials and lose of production hours as staff must isolate for 14 days being a close contact. Also we have companies where the workers are not permitted to cross the border daily, so currently not working and no subsidy is available from the government. Vaccination is all the talk of the town, with some building site and suppliers indicating that they will only allow people double vaccinated on their site. Thus, causing a lot of decision in Joinery companies if you can force your employees to get vaccinated or not, knowing joiners are hard to come by and no one wants to terminate employees. Shortages of timber supplies is still a bit of a mixed bag with finger jointed pine products coming back online along with pre profi led timber sections. On the other hand Cedar supply is still under pressure with some sizes required for double glazing now not available till March 2022.

All in all, the industry is looking positive with plenty of activity being reported in the near future. - Rob Pickup

CANTERBURY

The Canterbury region is continuing as the rest of the year has gone, with extremely high workloads and staffi ng pressures. Most of our members are fully booked for this year and well into next year. Some supplies are still diffi cult to get for some of our members, organisation and planning ahead is a must when ordering. Our members are busy getting photos and boards ready for our 2nd local Canterbury Master Joiner awards in April next year. This will be another great social occasion for our members and associates.

We had a very strong response to our Canterbury pay rate survey. With a good mixture of small, medium and large business completing the survey. Ian Featherstone of Glass Half Full compiled this for us and it was great to have him present the results on zoom to all the members who participated in the survey. Members commented that this information would help them in their future planning. The recent Master Joiners survey about retirement age of our members is a big concern looking forward to the future. Of the 120 members that completed this survey, a quarter were due to retire in the next 10 years. This is very scary. We need to come up with ideas about how to address these issues and start thinking about succession plans. On the farm, cool and wet spring weather has meant that grass and crops have been slow. But it has fi nally warming up and things are starting to grow. Wishing everyone a very merry Christmas and hope that you all are able to take a well deserved break over this time before heading into another crazy year. - Nathan Busch

CENTRAL

There hasn’t been a whole lot of change since my last report. The Central Region is still facing high demands for new builds and also renovations. Top of the list for most people at the moment is to upgrade their kitchen. This is causing most of our members to use a waiting list system or just turning people away. Some of our specialist joiners are managing to plug the holes with little jobs that have been on the back burner for months – so this is positive. The fall-out from Auckland staying in Level Four for longer than the rest of the country is really showing now. Most new builds are now behind schedule. This has caused holes in production for our members, that they are not able to fi ll at the drop of the hat due to the lead time on materials. This along with trying to keep stock levels higher than normal is hurting cash fl ow. A lot of us are facing battles with trying to get colour selections from clients a lot earlier than usual – months out from production, to secure the product for them. It would also be great if suppliers in Auckland were able to explore back-up plans/options for getting stock to customers outside of Auckland should there be another lockdown.

News from Immigration on Visa holders being able to apply for Residency with less obstacles in their way was amazing. Staffi ng continues to be an issue in the Region. Qualifi ed staff are hard to come by. Training is the way to go. We continue to have a steady stream of apprentices signing up which is fantastic.

It is going to be a busy a run into Christmas this year. We all need to keep an eye on each other and offer support where we can. I know everyone will be looking forward to the annual close down and some quality time with our families. - Kristine Holmes

HAWKES BAY / POVERTY BAY

Covid Xmas around the corner and Summer is knocking on the door, things are warming up in ‘the Bay’. The Magpies are on fi re at the top of the NPC. Property prices are also on fire in ‘the Bay’, soon to be dampened by the Government ... time will tell.

Most if not all HB/PB Master Joiners are cranking along, provided the short comings of supply aren’t holding jobs up with materials. This has been an ongoing trend over the last year or more making it hard to understand when we will get to the other side of it. My Spidey senses say it’s going to be like this for some time. Gone are the days of ordering just in time per job, carrying stock seems to be the way forward. Staffi ng numbers seem to be a go to topic of discussion. Training seems to hit a note with leading us out of this. The Government Apprenticeship Boost has helped getting the initial numbers, further support will be needed. Relying on the pool of Tradesmen already in our industry is not sustainable for our future.

We enjoyed a good turn out at our combined Mid-Winter Xmas Dinner and AGM during the winter where we acknowledged Murry McIndoe past president and strong supporter of MJ. Murray input was and will always be appreciated at our meetings. Let’s hope he calls in when he’s not Camper vanning around. Our next meeting, we are off land yachting. - Greg Rabbitte

TARANAKI

Well, with the warm weather and these longer days, it is great to spend sunny evenings with the family. Now it’s November and only 8 weeks to Christmas, so where has the year gone? I suppose we were all a little shocked going into lockdown in the middle of August, as this gave us no time to organize anything, barely enough time to get ourselves home if we were away.When we did return to work, trying to remember what orders were due, and where things were at, was hard enough, but also having Auckland closed made things really diffi cult. Most suppliers were distributing things evenly, to ensure they was enough product to supply everyone, and keep them in production. Once Auckland did open under Level three, it took time to get the freight moving so the supply chain was moving but slowly. This did cause freight problems, which meant goods that would usually arrive in a couple of days, were now taking up to 10 days to arrive at Taranaki Joinery company’s. Now with the run into Christmas most members have reported being busy. I think the key to success at this time of year and to be prepared for the New Year, we need to be really organised, making sure materials and goods are ordered early enough, to be available when they are needed. Sometimes other trades have held us up with deadlines not being met, which means our timeframes are put out. The other trades are also aff ected by material shortages and freight delays. They are in the same boat as us, so patience and understanding are required, although this can be a challenge. Most of us have full factory’s of kitchen and other joinery product waiting to be installed, any delays cause problems and then rescheduling can prove to be diffi cult.

Finding staff is an on-going headache that our sector faces. There are very few qualified tradespeople around, even fi nding a young person ready to give the joinery trade a go, is tough.We now need to think outside the square and try to attract people to the industry, succession planning. Most Taranaki building trade companies report being busy, with some even being booked out up to a year in advance. So lets hope we get to level 1 before Christmas and we can enjoy a good Christmas with family and friends, and have a good break to recharge the batteries for a busy year in 2022 - Bryan Frank

WAIKATO / BOP

Overall, the Waikato/BOP region is experiencing a boom of activity. Residential construction at all levels continues to grow and the renovation market is also strong on the back of consumers not travelling and low interest rates. Plenty of activity in infrastructure and civil works projects in most areas also. Members are reporting confirmed workloads well into the 2nd quarter of 2022 and some into 2023.

The usual mid year peak around May-July came later this year as a result of supply chain and COVID restrictions disrupting project timelines. Some Members noted a short spell of ‘consumer jitters’ with the arrival of the Delta variant. Despite this, enquiry remains strong going into 2022. Navigating changing COVID restrictions and borders to get materials delivered and our people to and from work sites has been hugely challenging of late. Scheduling production and managing workloads remains a time consuming and demanding process. Members are preordering and holding higher than normal inventory in an attempt to mitigate this as much as possible. In general, most consumers are understanding of delays where there is good communication. Skilled staff shortages remains one of the most challenging aspects of managing the demands on our businesses going forward. Sadly, we had to cancel our Apprentice Awards event for the 2nd year in a row. Fingers crossed that things settle down soon so we can have our annual Ken Monk Fishing Trip in February. This is always a popular event for the Members and a great way to remember the legacy of Ken. Despite all the challenges the world has been throwing at us in the past 2 years, our Members are still feeling lucky and optimistic. - David Higgins

WAITAKI

The Waitaki area has been in constantly busy over the last few months with most members having full work books stretching into the new year. Despite the obvious issues that are being endured nationally and globally it would appear that the construction industries requirement for joinery has only grown both residentially and commercially in the Waitaki. There are many opportunities for pricing which is putting many estimators in a very busy position with a lot of members pushing work out into the 2022 working year and having to miss opportunities by declining tenders. With a number of Workshops working on Ministry of Education contracts and Ministry of Health contracts the requirements regarding vaccinations have had several members discussing how best to manage their staff around this work moving forward, several main contractors have sent out information to this aff ect and will require confi rmation that the staff we send to site comply with this mandatory requirement. Finding good staff is still an issue with experienced tradesman and installers extremely difficult to fi nd many members are working hard to source suitably motivated people to fi ll apprenticeship roles in their factories.

Material and Supply chain issues are very much becoming a cause for serious concern with subcontractors shutting down supply earlier than usual and suppliers constantly sending out increased pricing notifications, it’s been interesting to hear from some main contractors that they have been told that their timber framing for future contracts will not be available until June 2022 due to a lack of timber available for pre nail framing companies. Potentially having a negative fl ow on eff ect of pushing programmed joinery supply out further than anticipated or planned. Pricing for many contracts need reviewing frequently as price increases for products can change monthly requiring deposits in advance or materials held off site agreements, to secure products early enough and at the price used at tender time.

Quote validity periods are constantly being reviewed, all of the members indicate that clients are generally paying on time with few outstanding debts held, however many members are fi elding calls from potential clients who are asking for joinery to be priced and supplied this year, time frames that are un-achievable.

In conclusion the Waitaki area seems to be coping well with the end of the year looming up very fast, once again most members are looking forward to mid 2022 for new work with a number looking out further than that .
