Dear Client, When I started our Firm with Supreme Court Associate Justice Emilio A. Gancayco, and my co-partner, Atty. C. Fortunato R. Balasbas, our goal was clear: we wanted to be in the service of our countrymen. In fact, through our corporate social responsibility arm, the Justice Emilio A. Gancayco Foundation, Inc., we pushed for improvements in the justice system and funded scholarships for deserving students who can contribute to the betterment of the Philippines in the future.
Time and again, people have been hurt, taken advantage of, treated unfairly. My heart goes out to those who merely forgive and forget. And I admire those who fight for what was right, seek the help of a law practitioner and ultimately receive what is deserved. I have always believed that people, especially my fellow Filipinos, should disengage themselves from the helpless, simplistic and unconfident mindset and always seek and pursue justice.
The Philippine business setting grows fairly rapidly, and we can still expect a boost in newly registered businesses and job openings inside and outside Metro Manila. It must always be remembered that when we start and run companies, abiding with the rules is an investment and will definitely give a business more returns in the future. Alcon, Inc. vs. Elken SDN. BHD.

IPC No. 14-2005-00130
This was an opposition case instituted by Swiss multinational corporation Alcon, Inc., owner of the registered trademark ALCON, directed against the application for registration under International Class 5 of the trademark ELKEN & DEVICE, Serial No. 2-2002-002929, owned by our client Elken SDN BHD, a Malaysian company. The former claimed that, with both marks covering the same class of goods, approval of the registration of the trademark ELKEN & DEVICE will not only cause confusion among buyers but would also diminish and dilute the distinctiveness and identity of the trademark ALCON. The Director of the Bureau of Legal Affairs, Intellectual Property Office [IPO], denied the opposition of Alcon, Inc., and gave due course to the application for registration of the trademark ELKEN & DEVICE by applicant Elken SDB. BHD., on the following legal bases: • •
There is no confusing similarity between the two marks. While goods using either mark fall under the same Class 5, what is controlling is the similarity, if any, of the goods offered for sale and not "the arbitrary classification or general description of their properties or characteristics.“
Alcon, Inc., did not pursue its appeal to the Office of the Director General, IPO.

Gancayco Inducted IPAP Head Lawyer Pablo Gancayco, senior partner of the Gancayco, Balasbas & Associates Law Offices, has recently been elected president of Intellectual property Association of the Philippines (IPAP). He will head the Philippine group in at least three international IP organizations, namely the Asian Patent Attorneys Association (APAA), the Association Internationale Pour La Protection de la Propriete Intelletualle (AIPPI) and the ASEAN Intellectual Property Association (AIPA). He and other newly-elected officers were inducted into office by director-general Ric Blancaflor. IPAP is the lead organization responsible for handling, among others, the registration and conflict resolution of intellectual property rights locally. It is the only organization of lawyers engaged in the practice of Intellectual Property Law in the Philippines which covers, among others, trademarks and brand names, invention patents, and copyrights of musical compositions, movies, and other artistic and literary works.
