Fine stringed Musical Instrument collection from the Estate of Peter Voigt (1943-2024)

To be sold by auction on Friday 28th March 2025

Peter Voigt was the ninth generation in the famous Voigt family business of violin making and restoration, begun in 1699 by Adam Voigt in Markneukirchen, Saxony, Germany.

Peter’s grandfather, Paul Arno Voigt arrived in England in the early 1900s and set up a violin business in Manchester. Peter was born there in 1943, to one of Paul’s sons, Ernst Reinhardt.

In 1947 and by now trained in the craft, Ernst and his brother (also called Paul) left the Manchester business and opened a violin shop in central London. Each later opened a business of his own

Peter joined his father in Monmouth Street, Soho, at the age of 17, and quickly honed his skills. Father and son moved the business to Sussex in 1970, and when Ernst retired in 1981, Peter relocated to the Sussex village of Lindfield. It was then that he began to use his discernment to build his extremely fine collection of violins, ‘cellos and bows, a collection he cherished.

Peter had a passion for restoring and repairing instruments and over a sixty-seven year career became a consummate luthier. Those skills, along with his impressive knowledge of the violin trade, brought customers from far and wide to his highly regarded workshop. He also contributed to the development of young musicians via his work for the ‘Benslow Instrument Loan Scheme’.

Outside work, Peter indulged another passion, motor racing, in which he used his technical skills and become an excellent engineer. He re-built and restored cars, and enjoyed much racing success. A sportsman, music-lover and motor cyclist, Peter was also known for his wit, kindness, mild manner and talent for friendship.

The Granary Collection - Lots 2201-2228

Granary Guitars is a collection of fine antique, classical and flamenco instruments, acquired over 30 years by enthusiast Alun Morgan. The journey began, when he took delivery of his new Romanillos guitar which he’d ordered many years before. This was the first concert guitar he’d played and it awakened a deep interest in the history and sound of the instrument that he loved and played as an amateur. Aware of all the famous makers by reputation only, Alun decided that the best way to get to know them better was to try and own one of their guitars. This started the guitar collecting bug that many guitarists seem to possess - an interest that’s given him years of enjoyment. He also decided that he would not hide the guitars away but make them available for inspection and playing by other guitarists and luthiers - many of whom would never have had the opportunity to play or examine some of the guitars of the great makers. In choosing guitars for his collection, he tried wherever possible to focus on the sound and playability of the instruments, not their looks, and decided to undertake only those restorations that were necessary to keep the guitars in good heart, and not necessarily in perfect cosmetic condition. No guitar was ever bought as a financial investment. At its peak, Granary Guitars became one of the largest private museums of its type in the UK, holding around 60 instruments. “Many hundreds of people have seen, played or examined these guitars (always under my beady eye!) and some of the instruments have been borrowed by well-known professionals for concerts and recordings, and even helped win an international competition or two. But, time has caught up with me and the best thing for the guitars is to find them new owners who will be as excited as I was when I bought them and who will get the same pleasure they’ve given me over these years. Collecting guitars has given me great enjoyment during which I’ve met many luthiers and guitarists, and some have become very good friends. It’s only right to acknowledge the help and support Granary Guitars had over the years from David Merrin and Liam Romanillos. And although I’m sad to be selling my guitars, the friendships I made collecting them are even more important and will remain”.

The Sound of Spain is a series of nineteen tracks, collated as a small homage to the music of Spain and to exhibit the many fine guitars in the Granary collection. Alun’s choice of music was relatively easy, selecting pieces that drew him into the guitar many years ago. Once the track listing was decided, guitars were then selected based on which would do the piece most justice. The guitars were recorded as accurately as possible under identical recording set-ups and with minimal post recording technical interference so as to capture their raw qualities. All pieces were played by professional guitarist David Merrin and were recorded by world class engineer / producer John Taylor who selected Holy Trinity Church, Weston, Hertfordshire as the perfect venue to exhibit the guitars’ acoustics. David Merrin

David Merrin is a fine luthier, initially self-taught by studying guitars by master makers, before training with Jose and Liam Romanillos. As a player himself, he is able to view and approach the challenges of guitar making from the inside and making beautiful guitars. David has been responsible for restoring and maintaining the Granary collection, getting to know the instruments first hand and therefore became the perfect choice to perform on ‘The Sound of Spain’ Recording.

The Derazey name is more commonly associated with violins made in the Mirecourt region in france. Like many luthiers, makers put their hand to other stringed instruments, particularly guitars.

*From the Granary Collection - This rare instrument, lined with parchment is of great age and historical interest. It is difficult to estimate the age but it may date from the late 17th or early 18th century. Many of the pieces, including the rose, are still with the instrument. The intention was to further explore its origins and find a suitable restorer but the sale of the collection precluded this.

Antonio de Lorca Garcia (1798-1870) was the son of the carpenter Asensio. He took his examination to become a master guitar maker in Malaga on 28th December 1828.

David Merrin says “the little guitar played very well…is clear sounding, has a fast response and still offers all the subtleties of the Spanish sound.” Condition notes: this guitar has repaired cracks to back, sides and to the top. The bridge has had changes with dowelled holes just below the current bridge. The guitar features Baker tuners to the bass hand side and a different tuning plate to the treble side with replacement buttons. The neck has been previously reset and refretting also carried out.

This particular guitar has a spruce table with seven fan struts and is unusual in that it has a solid Brazilian rosewood back and sides - many guitars of this era were made entirely of spruce with a rosewood veneer on the back and sides as Brazilian rosewood was expensive to import. He also joined a typically English style maple head with an inward curve to a mahogany neck and fitted what were at the time state of the art Baker tuner machines. This guitar moves away from the ornate French style and looks more towards the Torres pattern of the modern classical guitar

Condition notes: this guitar was restored by renowned luthier David Merrin. The back and sides have many repaired hairline cracks including to the shoulders. The top has repaired cracks including some sliver in-fills and refinishing carried out. Mild wear can be seen to the rosewood board particularly in the first position and the bar frets are also worn. One of the tuner buttons has been replaced. £3500-4500

Altimira worked in Barcelona between 1840 and 1880 and died in 1884. The design seems to be a transitional one between the more ornate French instruments and the Torres Spanish style. This guitar, made in 1879, has a fan strutted spruce top, Brazilian rosewood back and sides and a typical Torres style head. A very fine sounding guitar and worthy of the concert hall. There is a very ornate Altimira in the V&A Museum in London.

David Merrin States: ’A clear, balanced voice… a delight to play”

Condition notes: various repaired cracks to sides. Small hairlines to top. Various play wear evident to top. Mild wear to fretboard and wear to frets. In very good condition.

Eduardo Zerega AKA Edgar E. Hill was a mandolin and guitar player with Zerega's Spanish Troubadours. He was also an instructor, seller and distributor or musical instrument and sheet music. This guitar features on track five of Granary Guitars' 'The Sound of Spain' album, played by David Merrin. ‘..a beautiful gentle tone’. This guitar dates from around 1908 and is smaller than his normal concert instruments. Despite its smallish size, it sounds very sweet and is very playable. Condition notes:restored by luthier Peter Barton in 1999. Luthier notes state: ‘Repaired and reinforced crack to side of centre join in front of bridge. Cleaned and filled gaps around bindings and heel/rib join. Remove and clean machine heads. Clean and re-polish finish. Fit new golpeador plate.’

Sold with an image of Celestina Arlotti holding the guitar and thought to be from the time she was presented with the guitar. Condition notes: various hairline cracks present to body, although appears free of anything major. Two hairline cracks visible to lower bout back and another to the upper bout across from the centre. The sides appear crack-free. The top has a hairline crack between the bridge and sound hole just off from the centre seam and also has hairline cracks either side and the length of the fingerboard. The fretboard showing signs of use and the frets are in good condition although appear to be a later refret. Scratches and other marks are present as to be expected for the age

Condition notes: top showing signs of wear with nail marks, along with a repaired crack between the bridge and body end. Repaired cracks are also visible to the back. The current frets appear in good shape as well as the neck and board. Interestingly, these guitars are made of highest quality with very few corners cut in their making. They are almost perfect miniatures of the makers full size instruments and it is perhaps surprising that so much care was taken for a child’s guitar. If you have small hands, the are very playable and sound great!

This is a rare Garcia being a highly decorated 'Luxury' model and is rather unusual, having its original metal tornavoz still in situ. David Merrin comments ….”The guitar is very forgiving in nature which is probably due to a lowering of the resonance caused by the tornavoz and ..loses no clarity.” Condition notes: hairline crack to centre back and further smaller hairlines visible. Repaired cracks to centre table and some refinishing work evident. General surface marks around. Wear to fingerboard and frets evident. The tuners have been replaced with the barrels repositioned. Listen to The Sound of Spain track here: https:// tinyurl.com/FranciscoSimplicio. Francisco Simplicio (1874-1932) was a pupil of Enrique Garcia, a fact that he proudly states on his label. This guitar, number 249, was built in 1929, the year that Francisco himself won a gold medal at the 1929 Barcelona World Fair. It is one of his 'luxury' instruments as shown by the exquisite detailing throughout. It has had a new fingerboard, new tuning rollers and the bridge has been replaced, but the inlay of the original bridge has been retained. In the 'Sound of Spain' album notes, David Merrin states "Simplicio in my opinion has produced a masterpiece here. The craftsmanship is outstanding and the guitar has a sound to match, with its very rich tone inviting the player to explore its farreaching range from solid wooden sounded basses to glossy trebles. This is an important guitar that has always interested me." Condition notes: long repaired cracks to either side of top. Replacement bridge. Replacement fingerboard. Later tuners. Repaired fine hairlines to lower bout back. Refinishing.

Listen to The Sound of Music track here: https://tinyurl.com/ HermannHauser. This guitar of European spruce and Brazilian rosewood has a distinctive but simple 'wheatsheaf' rosette and a zero fret. It was previously owned by Walter Gotze whose arrangements of classical guitar pieces will be familiar to many classical guitarists. Condition notes: repaired fine hairline cracks to back. Two repaired cracks to the top at lower bout running from the body end through to the sound hole rosette. Repair to upper bout to the bass side of fretboard. Further repair to bass hand side of upper bout. Two restored cracks to the treble side of upper bout. Refinishing. Mild wear to fingerboard and frets appear in good shape. Otherwise the guitar is in good condition in terms of appearance with a few minor marks. David Merrin comments: “ a fine sounding instrument ….different qualities to most other instruments seemingly having higher frequencies surrounding the notes..a refined quality”

*From The Granary Collection, acquired from a prominent dealer, 1998. This guitar can be heard on track nine of Granary Guitars' 'The Sound of Spain' album, played by David Merrin. Listen to The Sound of Spain track here: https:// tinyurl.com/1934SantosHernandez. This Flamenco guitar from 1934 is hand signed on both the label and on the underside of the table and has the makers official Madrid luthier stamp on the inside foot of the neck. It is not clear whether it was originally made as a peg head or the machine heads are a later addition as either would have been an option at the time. The guitar is currently fitted with later Rogers machine heads. Constructed of cypress, the guitar is light and has an underlying woody tonal quality. Condition notes: considering its age, appears to be in fine condition and is free of any open cracks. There is a repaired hairline crack visible to the body end and a repaired hairline crack to the bass side of the ebony fretboard. The fingerboard appears to be in good condition along with the frets, which appear later. There has been a repaired crack to the head and obvious tuner barrel adjustments. Refinishing is evident and various minor dings and marks present, all to be expected for a working guitar of this age. This 1934 guitar has a wonderful sound and David comments that it was one of the easiest play. Condition notes: this guitar has been restored with a repaired crack to the back, repaired cracks to the body end and repaired hairlines to the sides. There is also an opening hairline to the bass side rib at the lower bout, repaired cracks to the top and refinishing is evident. The frets are in good condition, the guitar has been refretted. The guitar is currently fitted with Rogers tuners although there are an earlier set included.

David Merrin states "This guitar has a mellow depth and elegance of tone that is difficult to find in modern instruments. The balance is superb and the instrument is full of character. Built using the Torres model, Viudes has left much more wood in the instrument, knowing as violin makers know, it is not wise to make an instrument graduated too thinly. Better to let the character develop over time as the instrument breaks in than to risk the short career of a firecracker guitar".Condition notes: although obviously played, this guitar appears to be free of any significant restorations. There is checking to the finish, light play wear to the top and buckle markings to the back as well as expected wear to the back of the neck and frets. Otherwise, in very good condition.

The workshop of the famous guitar maker Domingo Esteso was carried on by his widow and nephews after he died in 1937. They proclaimed this continuation on the label and worked out of the same workshop and this a fine early example of a classical guitar. Condition notes: minor rippling to the top behind bridge. Small hairlines to either side of the fretboard would suggest a possible neck reset at some stage. Evidence of refinishing. Some light marks and dings around, as expected for a used guitar of this age. Otherwise, appearing in good condition.

David Merrin states: "This cedar top concert guitar dating from 1976 has a very powerful sound and features his characteristic 'spearhead' motif on the headstock. It does, however, require a good technique to unlock its rich resources. The double sides have added stiffness and weight to the guitar and the string tension feels looser - perhaps because of this, it has a refined and mature sound with fast attack."

Condition notes: overall, appears in used but good condition and although free of any major or structural defaults, the guitar may have been refinished at some stage, possibly to freshen its look. Any work of this nature was carried out before it became part of The Granary Guitar Collection.

He was self-taught and began to build professionally in 1967. John Williams occasionally uses a Fleeson on his recordings (the latest being on his Magic Box CD, 2001) when he needs a contrast to his Smallman. Condition notes: this guitar generally appears to be in good condition and free of any major repairs although there are surface marks around. There is some tarnishing/ oxidisation to the frets which will need cleaning.

The back and sides are a heavy triple laminate of cocobolo and the table is supported by a honeycomb lattice of balsa wood and carbon fibre which enables Smallman to make his tops very thin (less than 1mm in places), whilst withstanding the 64lb pressure of the strings without tearing. This guitar is an outstanding example of Greg Smallman's work having an exceptionally attractive back and is in very fine condition. Condition notes: back and sides in good condition with minor marks. The top shows signs of play wear. The frets are tarnished and oxidised in places and will need cleaning. Otherwise a good example.

Michael Turner qualified in medicine in 1973 and worked as a consultant pathologist in the NHS for over 30 years. As an amateur pianist with a love of the eighteenth century, he developed an interest in period keyboard instruments. He bought his first square piano in 1989. He was inspired by visits to Finchcocks to expand the collection. He bought mainly from auction, often with advice from Lucy Coad, who also expertly restored many of the pianos. The collection slowly grew to encompass the development of the piano from the mid eighteenth century in both England and Vienna. There is an eclectic mix of fine period keyboards in the collection including rare English spinets by Joseph Harris & Thomas Barton, a Harpsichord by Shudi and Broadwood; also, several other fine Grand and Square Pianos by well know makers. Now the time has come to consider moving to a smaller home Michael has made the decision to instruct Gardiner Houlgate to sell a large part of this collection.

Lots 3240-3276 were part of the collection of bows belonging to the late Dorothy Fellows

Growing up in Australia in the 1940s and 50s, Dorothy Fellows discovered there there were very few opportunities for developing and presenting her rare musical talent. She took the decision to move to the UK to study and perform, and she and her husband Clive emigrated to London in the late 1950's, where Dorothy completed her advanced studies in music. She was made a Fellow of the Trinity College of Music London, in Harpsichord and Pianoforte, in the early 60s.

Already a qualified teacher in Australia, Dorothy further pursued her teaching career. The UK became her permanent home and the cello her favoured instrument. Dorothy was a passionate collector of instruments and bows, many of which she commissioned from contemporary makers in the 1970s and 80s. By the time of her death in 2013 she had acquired a substantial collection of close to 100 instruments and bows.

CONDITIONS OF SALE

The Auctioneer acts only as agent for the Seller (unless otherwise specifically declared). Lots sold are likely to have been subject to wear and tear caused by user or the effects of age and may therefore have faults and imperfections. Buyers are given ample opportunity at viewing times to examine lots to be sold and will be assumed to have done so. They must rely solely on their own skill or judgement as to whether lots are fit for any particular purpose.

1. Bids

All bids made shall be treated as offers made upon these Conditions of Sale and all persons present and approved to bid are admitted to a sale on the basis that they have notice of these Conditions.

1A. Internet Bidding

There are no additional surcharges when bidding via our own bidding platform 'GH Live'

We also use two other online bidding platforms via the-saleroom.com and Easylive which will be subject to additional fees. Please see their respective websites for further details and terms.

‘Pre-Bidding Autobids’

'Pre-Bidding' is a new feature to our own platform and allows bidders to bid against each other prior to the start of a live auction. During the live auction the bidding will start at the current bid reached during the 'Pre-Bidding' and continues until your maximum bid is reached. All bids are anonymous, and your maximum bids are confidential. If you have been outbid, during the ‘Pre-Bidding’ then you will receive an email notifying you that you are no longer the leading bidder, however once the sale is live you will not receive any further notifications. Once bids are placed, they cannot be removed, but can be reduced, if above the current bid.

2. Ascertainment of the Buyer

The Buyer shall be the person making the highest bid which is acceptable to the Auctioneer as signified by the fall of the hammer. No bid may be retracted. In the case of a dispute the Auctioneer may either declare the purchaser or put the lot up again.

3. Auctioneer’s discretion

The Auctioneer has sole discretion, (a) to refuse any bid, (b) to advance the bidding as he may decide, (c) to withdraw or divide any lot or combine one lot with another or others, (d) to exclude any person from the auction rooms, and (e) to require pre-payment in full.

4. Reserves and Seller’s right to bid

Lots put up for sale are subject, (a) to any reserve price imposed by the Seller, (b) the right of the Auctioneer to bid on behalf of the Seller, and (c) where no reserve has been imposed (but in no other case) for the Seller to bid personally or through any one agent. It is the responsibility of the Seller to ensure any reserves are received by the Auctioneer.

5. Buyer’s Duties

The Buyer shall forthwith or as soon as possible after the sale, (a) supply his name and address, (b) supply, if so required, bank or other suitable references, (c) pay the full purchase price in a way acceptable to the Auctioneer, notwithstanding any prior arrangement for advance payment required by the Auctioneer, and (d) on proof of payment clear the lots purchased by the times specified. Lots may not be cleared during the sale except by permission of the Auctioneer.

6. Payments ALL LOTS ARE TO BE PAID & CLEARED WITHIN 7 DAYS OF THE AUCTION

Methods of payment include direct bank transfer, debit card, credit card, cash to a maximum of £8,500, Cheque payments are no longer accepted. For fraud protection we no longer accept payments by credit or debit cards for ‘Customer not Present’ transactions. Card payments at the saleroom will be accepted but must be supported by Chip and PIN. Card payments for live internet bidding will only be accepted if they have been AVS and 3D Secure authorised via our online platform with a maximum transaction limit of £1000 for Watch & Jewellery auctions; £2000 limit for all other auctions unless previous authorisation has been agreed. Deposit payments made direct at the bank or via telephone banking will need to be confirmed as 'cleared funds' before any goods are released.

6A. Anti-Money Laundering Policy

New clients spending over £5000 on an individual transaction must be verified, by supplying a current form of ID confirming their name and address to match the invoice. This must be supplied to complete the transaction before the release of goods

7. Liability of the Auctioneer and Sellers

Subject to Condition 8: (a) faults and imperfections (if any) are not stated in the catalogue and neither the Seller nor the Auctioneer is responsible for any defects whatsoever, (b) no warranty is given or authorised to be given by the Seller or the Auctioneer with regard to any lot other than the Seller’s right to sell it, (c) any express or implied conditions or warranties relating to description or quality, are hereby excluded.

8. Catalogue Descriptions

Descriptive statements contained in the advertisements or catalogues or made up by the Auctioneer or any member of his staff should be taken as matters of opinion only and shall not be taken as statement of fact.

i) Items in the catalogue are sold as seen. Where possible significant damage is mentioned, but this does not include all faults and imperfections. The absence of such reference does not imply that the lot is in good condition or free from restoration or repair. Condition reports are available upon request

ii) ’Inscribed’ or ‘Signed’ does not imply that the lot is wholly or partly by that maker

9. Forgeries

Notwithstanding Conditions 6 and 7, if the Auctioneer receives notice in writing from the Buyer WITHIN 7 DAYS OF THE SALE that in his opinion a lot is a forgery (as defined in Condition 12) and on giving such notification the lot in question is returned to the Auctioneer at his working premises in the same condition as when bought, then if on considering such evidence as the Buyer supplies to prove his assertion, the Auctioneer decides that the lot is a forgery the sale of the lot will be rescinded and the purchase price repaid to the Buyer.

10. Property in lots and risk

The Buyer shall not become the owner of any lot, and the Auctioneer shall have a lien thereon, until the Buyer has discharged the purchase price in full together with any other charges due, but after the fall of the hammer the risk of damage or loss shall nevertheless be the Buyer’s.

11. The Premium

The Buyer shall pay to the Auctioneer a premium of 22% of the hammer price together with VAT. (26.4% inclusive of VAT)

12. Default by Buyer If the Buyer fails to make payment in a way acceptable to the Auctioneer or to remove any lot or lots bought by him within 7 days of the auction or in any other material respect fail to comply with these conditions, the Auctioneer shall have the right, (a) to resell the lot or lots by public auction or otherwise without notice to the Buyer, and if any deficiency arises on such resale, after deducting the Auctioneer’s full costs and expenses, the Buyer shall be responsible to the Auctioneer therefore (but any net surplus to be the Seller’s) or, alternatively, (b) to store the lot at the Auctioneer’s premises or elsewhere and to release the lot to the Buyer only after payment in full of the purchase price together with any other charges due. The Auctioneer reserves the right to charge storage of 50p per lot per day on any lot or lots uncleared by the time specified together with any removal expenses. In addition, interest will be charged at 2.5% per month or part thereof (34.4% APR) on any accounts that remain unpaid in part or full 1 week after the sale. Interest and storage will be charged from the date of sale. In addition, the Buyer shall be liable for all legal and court costs incurred by the Auctioneers in pursuit of payment from the Buyer. The Auctioneer reserves the right to refuse any cheques and will not release lots purchased until evidence has been received that any cheque accepted has been cleared.

13. Release of Goods

Payment and clearance should be made within seven days after the sale. Goods will not be released until full payment has been cleared and a paid invoice produced. For clients arranging courier or third-party collection: written instruction must be received by the purchaser; identification will be requested from the courier and their vehicle’s registration number taken. For security purposes our premises are monitored by 24-hour CCTV

14. Definitions and interpretation

In these conditions: (a) Reference to the ‘the Auctioneer’ shall be taken to mean the firm of Gardiner Houlgate or any director, partner or employee thereof at the time of sale; (b) Buyers shall be deemed to be the principals unless to the prior knowledge of the Auctioneer they are acting as agent on behalf of a named principal; (c) ‘Forgery’ means a lot (i) which is so constituted as deliberately to deceive when considered in the light of its catalogue description, and (ii) whose value as such is materially less that if it had complied with the catalogue description; (d) The Interpretation Act 1978 shall apply to the general construction of terms and expressions used in these Conditions as if contained in a statute.

15. Law and Jurisdiction

These Conditions of sale are subject to English law, which shall apply to their construction as well as their effect. The Seller and Buyer agree to submit to the exclusive jurisdiction of the English courts.

16. What is Temporary Importation?

Temporary Importation is a system that applies to lots which have been imported for sale from outside the EU. It allows the point of importation to be delayed until after the sale at auction. These lots are indicated in catalogues by the use of the following symbol * Only the Hammer Price will be treated as the import price and the Buyer’s Premium will be subject to UK domestic VAT at 20%. So whilst the Hammer Price will continue to be charged with Import VAT at 5% or 20” as appropriate, the Buyer’s Premium will always be charged with domestic VAT at 20% Lots subject to Temporary Importation will be offered under the Auctioneer’s Margin Scheme and will be subject to import VAT of either 5% or 20% on the buyer’s Premium. Anyone who wishes to buy outside the Margin Scheme should notify us immediately. An invoice under the normal VAT rules and charging VAT at 20% on both Hammer and Premium will then be issued

Temporary Importation should affect only private individual buyers who are resident within the EU. Anyone who is registered for VAT in the EU should be able to recover the VAT on the Buyer’s Premium either on their VAT returns or through the 8th Directive Refund Scheme. Any non-EU buyer who exports the lots from the EU will be able to have the VAT refunded provided the appropriate export regulations are complied with

17. Property sold with a * Symbol These items have been imported from outside the EU to be sold at auction under temporary importation. When Gardiner Houlgate releases such property to buyers in the UK, the buyer will become the importer and must pay Gardiner Houlgate import VAT at 5% on the Hammer Price These lots will be invoiced under the Auctioneer’s Margin Scheme. Gardiner Houlgate must bear VAT on the Buyer’s Premium and hence charge an amount in lieu of VAT at 20% on this Premium. This amount will form part of the Buyer’s Premium on our invoice and will not be separately identified VAT registered buyers from the EU should note that the import VAT charged on property released in the UK cannot be cancelled or refunded by Gardiner Houlgate VAT registered buyers from the UK should note that the invoice issued by Gardiner Houlgate for these items is not suitable evidence in respect of import VAT VAT registered buyers from the EU countries may be able to seek repayment of the import VAT paid by applying to HM Revenue and Customs. On request, immediately after the sale, the office can either ask HM Revenue and Customs to generate a C79 certificate (for UK buyers), or obtain a copy of the import C88 (for other EU VAT registered buyers), which may be used to claim recovery of the VAT. Otherwise Gardiner Houlgate may re-invoice the lot and charge VAT at 20% on both the Hammer Price and the Premium and provide a tax invoice to the buyer

18. CITES Restrictions

Any lots containing any amount of Brazilian rosewood and endangered species may be subject to restrictions when exporting outside of the EU. It will be the buyer’s responsibility to make sure that the relevant paperwork is in place before shipping. Some lots are sold with CITES article 10 certificates, allowing the commercial use of an item containing an endangered species. Lots subject to this are marked in the catalogue

Import/Export

It is the buyer’s responsibility to obtain the correct import/export licenses and CITES licenses for items which they have purchased. Gardiner Houlgate take no responsibility for the export of goods.

19. Gemstones

Many gemstones have been treated in various ways to enhance their appearance. For example, sapphires and rubies are routinely heat treated and emerald treated with oils and resins. Some stones may require re-treating or oiling periodically. Enhancement affects market value, and all Gardiner Houlgate estimates assume that gemstones may have been enhanced.

20.Artists Resale Rights (or Droit de Suite)

On certain lots marked in the catalogues and which are sold for a hammer price of £1000 or greater (converted into the currency of the sale using The Design and Artists Copyright Society threshold calculator on the date of the Sale) the Additional Premium will be the percentage of the amount of the Hammer Price calculated as follows:

£0-£50,000 4%

£50,000.01 to £200,000 3%

£200,000.01 to £350,000 1%

£350,000.01 to £500,000 0.5%

Exceeding £500,000 0.25%
