A Holmesian mystery set in a Goochland subdivison earlier this month made for one of the more interesting Board of Zoning Appeals meetings in recent memory. On July 16, four members of the five-member board met to hear an appeal by a local development group, Courthouse Associates LLC, that had been slapped with a Notice of Violation from the county for failing to deliver on one of the proffered conditions they agreed to in conjunction with a rezoning case nearly 18 years ago. As one condition of that rezoning, which paved the way for the creation of the Mill Forest subdivision in January of 2000, the county insisted that a “minimum of one water impoundment structure” — essentially a

Zoning appeal continued from >1 pond — “ and one dry hydrant would be constructed within the development.” A dry hydrant is defined as a non-pressurized pipe system installed in existing lakes, ponds and streams, used by firefighters to draw water in the event of an emergency. According to testimony given by assistant County Attorney Whit Marshall, after investigating a complaint from a Mill Forest resident about a mysterious water pipe that had reportedly appeared in the neighborhood, county staff found that there was “no water impoundment structure” in place either. Also missing, Marshall said, was any record of the county approving a dry hydrant in that location, a step that was also required as a condition of the rezoning. Not only was the hydrant not functioning, Marshall said, but the fact that the developers said that it was could have lead to confusion and dangerous delays in the event that fire crews went to use it during an emergency. It would seem, to anyone listening, like a slam-dunk: the structure that was supposed to be there was not functioning, if it ever existed in the first place. Case closed. Not so fast. Representing the developers, attorney Darvin Satterwhite noted that the board members were not there that day to decide if a functioning water impoundment structure and dry hydrant were currently in place—only that both had been there and operational when the subdivision plat was approved 17 years ago. The fact that the plat was approved by the county was proof that the structures had been there, Satterwhite said. If they weren’t, he asked, why would the county have signed off?
Appellant Lee Gordon, a contractor and a member of Courthouse Associates who was involved in the rezoning and claimed he oversaw the construction of both the water impoundment structure and the dry hydrant — and that both were built to the codes in effect at that time — presented the board with photos of both. They had been taken, he said, just three hours before. Gordon admitted that neither was in working order, but both he and Satterwhite attributed that to a lack of diligence by the residents of Mill Forest. “Why isn’t it working? Because in 15 years nobody in that subdivison has bothered to do anything to maintain it or to improve that pond.” After so many years, he explained, silt buildup and other symptoms of neglect had rendered the structure useless. Gordon told the board that Courthouse Associates still legally owns the property and has not yet turned it over to the Mill Forest Home Owners Association, but explained that there were covenants in place designating who is responsible for maintenance. After deliberating for around 20 minutes, the board
NEWS: What’s Going on in Goochland County returned with its verdict. Both sides had been convincing and presented strong cases, they said. But while BZA member Paul Springman acknowledge that the structures had almost certainly been built on the site years ago, he sided with the county that the violation notice was valid. His fellow board members, however, did not agree. “There was something there,” insisted member Carol Coe, throwing her support behind Courthouse Asscoiates. “What’s there now, that’s not our decision.” It was an opinion echoed by fellow board member Amanda Kowlaski. “I’m not saying it’s a good water structure, but there was something there,” Kowlaski said. “The proffer was met.” To BZA chairman Rob Parker, the decision ultimately hinged on the fact that the county had given developers the go-ahead so many years ago. “I do believe that the structure was there,” Parker said. “And lacking any more official county approval for any other dry hydrants, this would be the only approval avenue that I would be aware of — so it appears to have been approved.”

Obituaries KARL H. BOGGS JR. Karl Hardman Boggs Jr., 81, died peacefully on July 26, 2018, after a courageous twomonth fight against complications from Myasthenia Gravis Disease. He was predeceased by his parents, Louise F. Boggs and Karl H. Boggs Sr., and BOGGS his youngest brother, Ralph Boggs. He is survived by his loving wife of 59 years, Betty Farley Boggs; their three daughters, Claudia Bridges (Robbie) of Maidens, Karla Otten (Eric) of Palm Desert, California, and Tammy Hands (Thom) of Boca Raton, Florida; six grandchildren: Bobby Bridges (Jerikah), Tyler Hunt (Watkins), Megan DuLong, Mathew Otten, Elle Otten, and Sam Hands; one great-granddaughter, Ellie Bridges; two brothers, John
Boggs (Louise) of ManakinSabot, and Chuck Boggs of Virginia Beach; numerous nieces and nephews; and many friends who loved him deeply. Karl retired as an executive from Home Beneficial Life Insurance Co., where he worked for 38 years and was greatly admired and respected for his incredible work ethic and outstanding leadership. He continued working as an entrepreneur, owning and operating the Boggs Christmas Tree Farm with his wife for more than 20 years and managing investment properties (even from his hospital bed). He was a determined, self-motivated, hard-working man with great integrity and appreciation for the value of a hard-earned dollar. He served in the National Guard, and was a member of the Staunton Masonic Lodge and Shriners and the Staunton Elks. He was a great, honest, kind-hearted, fun-loving family man who was a country boy at heart. He had a competitive spirit and passion for golf and
loved hunting, fishing, riding his tractor, and loving on his dogs. Most of all, he was devoted to his family, cherished his grandchildren, and valued his friendships. We will never forget his sense of humor, that grin on his face, his silent chuckle, and a glass of wine in one hand and a cigar (not lit) in the other. Karl was one of a kind and will be deeply missed by so many. In keeping with his wishes, in lieu of flowers or any services, he would want you to have a drink and raise your glass to a life well-lived, play a round of golf, laugh at a good joke with a friend, spend time with the ones you love, pay it forward with kindness and generosity to others and he’ll meet ya where the grass is always greener - at the 19th hole in heaven. Throughout her life, Jane pursued her love of equestrian events, riding, fox hunting and carriage driving her beloved standard bred horse, “Two.” She was a lifetime member of Deep Run Hunt Club. She was also a member of James River Driving Club and Hermitage Country Club. Jane’s second love was her river cottage in Middlesex County, near Urbanna, where she gathered with family and friends. If there was a celebration, holiday, or just a gettogether, it was held at Jane’s home or river cottage. A
s Christopher Cantwell left a Charlottesville courthouse on July 20, he did so with a suspended jail sentence, a $250 fine for violating his previous bond, and a court order to leave the state of Virginia within eight hours. Cantwell, who gained a measure of notoriety last August as a featured speaker for the violenceplagued Unite the Right rally in Charlottesville, used the short walk from the courthouse to his car to both sputter anti-Semitic abuse at media members and plug his own website. If that last part surprised you, it probably shouldn’t have. In fact, if it caught anyone off guard that Cantwell decided — given only the scantest of openings — to go into marketing mode at the conclusion of a saga that left
one person dead and a community deeply scarred, they simply haven’t been paying attention. Because more than he is a racist, a bigot, a criminal or a monster, Christopher Cantwell is a salesman. (A word of caution: reaching this conclusion yourself could bring with it the same sick, sinking feeling that crept in last year, when a couple that sought to stage a protest near a controversial monument in Richmond turned out to own a company that specialized in Confederate-flag emblazoned t-shirts and other Southern heritage clothing items and knickknacks.) Cantwell, for his part, likely won’t be hurt too badly by his banishment from the state. Anyone who wants to may still go to his website to purchase the very same t-shirt he wore for the Charlottesville rally, during which he seemed to find himself preening and proselytizing in front of a TV camera so often that it is a wonder he managed to

Sugar rush: Locals go nuts over doughnuts By Jim Ridolphi Contributing Columnist
Last Friday, hours before the sun made its first appearance in a week, cars began lining up on Broad Street near Willow Lawn. Now, the smell of hot doughnuts at Staples Mill and Broad Streets is not an unusual occurrence. It’s something that’s permeated the air and issued a tantalizing invitation to anyone within smelling distance of that corner for decades. For the life of me, I could not understand why an increasingly long line formed on Broad Street waiting to enter Krispy Kreme Doughnuts. There’s always a brisk business at the location every morning, but this seemed unusual and out of the norm even by Krispy Kreme standards. Now, I was still trying to figure out what I was doing up at this early hour. I had an excuse and was headed out to perform everyone’s favorite errand, servicing your automobile. I was grabbing an egg biscuit for the long trip to the dealership for what is never a pleasant couple of hours sitting in a lobby that reminds me that my car is not new. And now the line of cars was as far as the eye could see looking like a caravan of chariots lined up for battle. As evening approached, I was again in that area and noticed the line of cars still extended a fair distance down the street and the lobby was packed. I had since discovered what was causing the chaos. Krispy Kreme was celebrating its 81st birthday and celebrating by giving customers a deal on their specialty, glazed doughnuts. Doughnuts continued from >6 chased one dozen at regular price received the second dozen for a dollar. Honestly, the recent Build a Bear stampede didn’t interest me, but the crowd of folks that jammed the lobby at Krispy Kreme did get my attention. I’m sure that I am not the only Richmonder who has a long relationship with the outlet on Broad Street. When I had my first morning paper route as a preteen, my final stop was always Krispy Kreme. The doughnuts were always hot, served by little ladies with starched white aprons. I suppose a year hasn’t passed without me making at least one visit to that location, so I finally decided to park and head for the end of the line. What a naive fool of a thought? Every adjoining lot was jammed with the vehicles of dedicated, discount doughnut seekers. I ended up finding
a spot in the Holiday Inn lot a block away. I was getting out of my car when a woman approached the lot, carrying the two dozen hard-earned snacks like a stuffed animal won at the local fair. She told me that rumors were rampant in the long line waiting for doughnuts, the worst coming in the form of a report that the small outlet was running out of doughnuts. “Someone in the line said they made like 18,000 doughnuts so far today,� she said. Now, I can’t verify those figures, but I can tell you the promotion did achieve, to my observation, Build a Bear like results, and I could tell by the look at this mother’s face who waited patiently in line for doughnuts for her kids that I didn’t want to enter that fray. The lady must have seen me walk back to my car, and, as I prepared to leave, she pulled her car beside mine. “Sir, do you want one of these doughnuts?� she asked
with a smile. I politely declined, but left the scene of the confusion with a good feeling, a belief in the goodness and generosity of my fellow man or woman, and a confirmed and affirmed belief that discounted doughnuts will always draw a crowd. But, it wasn’t all unicorns and rainbows. The company’s Facebook page was alive with angry customers sharing their own horror stories. One poster wrote: “Just made a trip up thinking I would miss the crowd and not only did I miss the crowd I missed the donuts they are out! How does that happen lol?!?� Another wrote, “Drove 45 minutes just to get there and be told there were no donuts, but “if you come back in a couple hours, we may have a few� . Thanks for nothing.� Oh, my! The whole episode left me with a yearning for something sweet and sticky. I think I’ll go and have a full-priced doughnut.

Goochland YMCA tops in Division 5 at CHAMPS By Billy Fellin Sports Editor
The Goochland YMCA swim team competed against the best that the Greater Richmond Aquatic League had to offer on July 28-29 at SwimRVA for the CHAMPS meet. Goochland was the top scoring team in Division 5 at the CHAMPS meet with 215 points.
Nathaniel Harris and Andrea Rogerson each scored two wins for the Manta Rays at the meet. Harris won his division the eight-and-under 25 free with an 18.67. He also won his division in the 50 free with a 43.34. Harris was second in his division in the 100 IM with a time of 1:56.10. Rogerson won her division in the 9-10 100 IM with a
1:27.89, as well as the 100 free with a 1:16.58. “Nathaniel and Andrea have both natural swimming talent and enjoy the sport,” coach Helen Brown wrote in an email. “I am looking forward to following their swimming journey and am honored to be a part of it.” She was second in the 50 back with a 39.26, as well as second in the 50 free with a 34.75 in the senior varsity
division. Annika Rogerson finished sixth in her division of the 11-12 50 back with a 38.11. She was seventh in the 100 IM with a 1:24.45, ninth in the 100 free with a 1:14.94 and was 10th in the 50 butterfly with a 37.84. Avetis Saakian was second in the boys 9-10 50 free with a 36.38. He was second in the 100 free with a 1:23.25, fifth
in both the 100 IM with a 1:36.55 and the 50 breast with a 50.00. Eleanor Martin finished fifth in her division in the 11-12 50 free with a 34.56. Mia Valdez came home fourth in both the 9-10 50 breast and 50 butterfly with times of 49.82 and 43.03, respectively. She was sixth in the 50 free. Sasha Babic was third in the 50 breast with a 45.55.

District 11 tournament decision ends Post 201’s season

one that was worthy of deciding who would advance or not in the district tournament, had it continued on as scheduled. Thanks to a four-run fifth inning, Post 201 defeated Post 125 5-1. In the top of the fifth inning, Post 125 scored on an error to make it 1-0. Post 201 came to bat in the fifth and worked three straight walks to load the bases with no outs. Nicholas knocked in Cody Willis after Post 125 changed pitchers to make it 1-1. Then, Carter Minnick grounded into a fielder’s choice, which allowed Sam Reid to score and made it 2-1. TJ Jordan then flew out to right field and Johnson scored for a 3-1 lead. Minnick scored on an error later in the inning and Post 201 took a 4-1 lead and eventually won 5-1. After that, Tommy Preston took the mound in the sixth and allowed just one runner and struck out two batters to close out the win for 201. “Toward the end of the season, we were struggling with our bats,” Mead said. “It held true tonight. We finally had some stuff happen and put things together in the fifth inning. Our pitchers pitched

When the District 11 tournament was originally scheduled, the win would have propelled Post 201 forward in the tournament and would have played Post 284 in the second game of the elimination bracket. However, due to the weather forecast as well as the condition of the fields around the area, the District 11 commissioner ruled that the double-elimination tournament would become a single-elimination. The decision eliminated all the teams in the tournament except for Post 175 and Post 137 and rendered the game between Post 201 and Post 125 meaningless outside of development of the players. “Those decisions are made much higher than me,” Post 201 coach Eric Mead said. “However, I always tend to make decisions that are best for the baseball players. We’re very upset about this decision because there are a whole lot of baseball players, on multiple teams, who didn’t get to play the baseball games they should have gotten to play this year.” Mead continued by saying that not only did the deci-

Hunter Montgomery still has a year of eligibility, but will be entering a school program in Norfolk that will prevent him from returning. “We had a tremendous amount of talent on this team,” Mead said. “It’s probably the most talented team that 201 has had in a few years. It was a lot of fun to coach this team. I really enjoyed it. Every one of them represented the American Legion Post the way we asked them to. They were respectful baseball players and they carried themselves well.” Mead said he’s looking at the loss of nine players from this year’s roster as an opportunity for next season as the team looks to rebuild for 2019. “We’ll be younger next year,” he said. “You don’t know what you’ve got until you see who comes out to play.” Anneliese Rogerson, Caul, Pillion and Hardman were with eighth in the mixed 13-14 200 medley relay. Caul, Hardman, Laura Brown and Anneliese Rogerson finished ninth in the 13-14 200 free relay, while Armandas Patinas, Harrigal, Summitt and Garrett Kemmerly were 10th in the 15-18 division.

He was the last surviving child of George Henry White and Genevieve Frances Raabe White; he was predeceased by his sisters, Annette White Behnke, Dorothy White Malquist, Carol White Hood, and Patricia White Jambour, and brother George Henry White Jr. A native of Fredericksburg, he grew up in Highland Park and was a graduate of John Marshall High School. He joined the United States Army in 1952 and served in the Army Signal Corps in Germany. He enrolled in Richmond Professional Institute of the College of William and Mary
(now VCU) on the GI Bill and graduated in 1959 with a Certificate in Commercial Art. He was a multi-talented artist, craftsman, and sculptor whose skills were employed in collaboration with his wife in countless arts shows and exhibitions. In 1979 they were among the co-founders of the annual Arts Around The Lake festival at the University of Richmond, and in 1992 they helped launch the UpTown Gallery at 1305 West Main Street, the premier Artists’ Co-Op in Richmond’s fan district. Although he and his wife were both deeply

involved in the Richmond art scene they moved to Goochland County in 1966 and for the next half century were generous contributors to the county’s cultural life, donating art, illustrations, and graphic design services to local non-profits, and, in the 1970s, were among the co-founders of the Snooty Fox Society. In 1987 they were both “co-conspirators” in the publication of an April Fool’s Day lampoon edition of the local weekly newspaper, “Not The Gazette” which was described by one contemporary as “a love letter to the county.” The following year he was a co-founder
of The Goochland Free Press when the county was threatened by proposed urban development. His artistic talents were honed at Reynolds Metals Style & Design Department, General Medical, and the Sorg Advertising Group. In 1984 he cofounded Lind & White Advertising. A Memorial Service will be held on Saturday August 4, at 2 pm, at the Bliley Staple Mills Funeral Home, 8510 Staples Mill Road, Richmond, Va. In lieu of flowers the family suggests donations to every worthwhile Democratic candidate to ensure a Blue Wave in November!

Volunteers help get new school year off to a great start
F
or the 26th consecutive year, the YMCA is making sure local children in need have the necessary clothes and supplies for a successful school year. Last week, a small army of over 100 local volunteers took an estimated 90 children shopping as part of the YMCA Bright Beginnings program. On July 25 and 26, volunteers known as Shopping Buddies paired up with YMCA Bright Beginnings participants from Goochland at a local Target and helped them shop for two new outfits, shoes, socks, underwear and a new jacket. The children also received a backpack filled with school supplies. Organizations that came out in support of the program included Capital One, Wells Fargo, Goochland Rotary Club, Goochland Fire Department, Goochland County Schools, Goochland County, and Goochland YMCA Board members, members and staff. Across the YMCA of Greater Richmond association, 2,000 children were expected to participate in the program.
