ADJUSTMENTS TO THE GUARANTEE SUM Lessor can demand that the guarantee sum is adjusted according to adjustments to the tenants payments per the agreement. This demand has to be delivered in writing. 4. WHAT THE GUARANTEE COVERS The guarantee per this agreement, covers all of the tenants commitments, hereby- but not restricted to – payment of the rental sum, damages to the dwelling and costs incurred due to eviction/enforced termination. 5. DUE DATE IF CLAIM IS FORWARDED Claim on the basis of this guarantee is due within two weeks of the guarantor receiving written notice at the address noted in section 1 above in this guarantee contract. It must also be documented that the claim has been delivered and demanded from the tenant and the aforementioned has not paid. Besides these apply:

A. Claims for rental payments and other possible contracted addendums can be claimed when the tenants due date has been surpassed by ten days. It is not required that the Landlord requests the unpaid rent before the claim has been forwarded to the guarantor. B. For other claims, the landlord has to first document that the claim has been delivered to the tenant with referals to the necessary provision(s) in the Tenants contract or the Landlord & Tenants Act that applies to the claim. The tenant has the right for a due date of at least two weeks, and the due date has to have been surpassed before the claim is forwarded to the guarantor. C. If the rental property is in worse condition at the termination of the agreement than stipulated in the tenancy agreement or as stated in the Landlord & Tenants Act, the lessor has to forward their claim to the tenant within a reasonable amount of time after discovering the fault(s), per Landlord & Tenant Act § 10-3. If this is not done, the obligation to the tenant and guarantor does not have to be kept. D. Claims against the tenant on the basis of this guarantee contract can not be forwarded for claims that pre-dated the granting of this guarantee. E. Claims covered by this guarantee can not be forwarded later than two years after the claim against the tenant has past the due date, per garantiforskriften § 3 last paragraph. 6. NATURE AND LENGTH OF GUARANTEE This guarantee is irrevocable and non-transferable. It applies throough the course of the rental agreement and an added three months. The guarantee is not valid for longer than........../.........../............ (date). If the rental agreement is extended the guarantee is also automatically extended for the same period, with an added three months. If a specific claim is not put forward before the expiration date of the guarantee, the guarantor’s responsibility as per the guarantee contract as lapsed. 7. SALE/EXCHANGE OF OWNERSHIP OF PROPERTY/RENTAL PROPERTY At the event of a sale or other transference of the property or rental property, the guarantor is to be notified at the address provided in section 1 of this guarantee . The guarantee will apply to the new landlord as regards to claims that occur after the exchange of ownership. 8.
