Letter from the editor

To be given the opportunity to edit a real estate magazine for Hansa Realty is not just a privilege, but it also gives me the chance to communicate my love of the Costa del Sol to its readers. Marbella in particular, and the Coast in general, have seen a great improvement in recent years, optimism has returned to the tourist sector hand in hand with the local businessmen. The fact that the Costa del Sol is considered a top quality luxury destination sets it from the crisis we are experiencing in the rest of Spain. The expansion of Malaga Airport, the underpass of San Pedro de Alcántara, high speed trains due to connect with Marbella and other neighbouring towns, the best galas and biggest events take place here, and with the 137 nationalities that live together in the area, all this makes this Coast the most cosmopolitan in the world; international schools, all types of sport, idyllic infrastructure in the largest towns, culture, art, music, beach and climate, all make this place absolutely the best to live in. I would also like to mention the that regularisation of the illegal properties, which was of such concern to investors in previous years, now has become reality. The Mayoress of Marbella is one of the most respected politicians, and I have asked her to send a message to future investors and owners who may be worried about the steps the Town Council may be taking in the near future. We cannot consider real estate investment without meticulous advice from a legal firm, so we talk to Miguel Angel Marin, specialist in commercial and real estate law. The architecture of the Costa del Sol has its own stamp of identity, so we have talked to the German architect Benno Bühler, who has a lot of experience in what is called “Marbella Style” and where he also advises on the new laws regarding Energy Consumption.

The interview with the great empresario Bruno Filipone, whose life has been dedicated to the restaurant sector, sends a message about the importance of family values and gives us a tremendously positive angle to those wishing to settle here and succeed with their business ventures. The Costa del Sol is not only party and beach, but also sport, and to talk about this we have two of the greats in the world of Spanish sport: Manolo Santana, one of the top world tennis players, and Mr. Luis Estrada, Vice President of the Santa Maria Polo Club and an organiser of elite sporting events. Dani Garcia, our chef with two Michelin stars, born in the Costa del Sol, talks to us about the latest trends in gastronomy. For those who know me, also know that I am a fan of Marbella’s social life and therefore I have wanted to show you some of the most important fiestas and parties that are taking place in this city, and my suggestions for food and drink. A real estate magazine would not make sense if we had not chosen the best properties and the best opportunities in the Costa del Sol that are available in our four offices. It has been a difficult job, since our portfolio consists of 1,200 properties listed by our offices, and many more have been left out. Ángeles Muñoz By María Elena Paganini Andalucia (Regional Government) and it is their job to explain to us how the project is progressing. From the Town Hall’s part, we are doing everything we can to ensure that the project goes ahead, and that the solution announced by the Andalusian Government does not condemn it to another fifteen years in the bottom drawer. This project is fundamental for the city and I hope that the Junta does not turn its back on Marbella once again. We are celebrating the third year of Marbella Luxury Weekend. How did it begin and who is this luxury weekend aimed at? It is an initiative created by the Town Hall and this third year confirms its status as an international event for the elite. For four days Puerto Banús, in particular, and the town in general, will be the centre of attention for the world’s principle exclusive brands and their prospective customers. Do you believe that the word Marbella is inexorably connected to luxury? Absolutely, and Marbella Luxury Weekend, without doubt, is an excellent way to ensure that our brand is linked to exclusivity and excellence. Don’t forget that we in Marbella have highly exclusive brands which do not appear in other parts of Spain.

After the uncertain times that we have experienced in this city, what message would the Mayoress give to new investors? Without doubt a message of optimism. After a tumultuous period our city has seen the return of normality and legal certainty. Marbella’s business community has been encouraged by the drive initiated by the Town Hall to attract investors from countries such as Russia or the Persian Gulf. Furthermore, with the new PGOU (General Plan of Marbella) and a Town Council that is back to normal, Marbella is an area which has great potential and still a long way to go. With the present real estate crisis, do you believe that buying properties in the Costa del Sol is still good business? Of course, Marbella in particular is still a very attractive city in which to invest in real estate property. Our climate, infrastructure and the services offered make the municipality a wonderful place to live or to come on holiday. Three years after the approval of the PGOU (General Plan of Marbella), and the present legalisation of some thousand properties, what is left to do in the near future in this respect? We must continue the standardisation process of all the properties that were found to be in breach of regulations, some 16,500 in total. Hence the Town Hall has initiated the procedures to begin the obligatory compensation payments required for the standardisation according to the PGOU, and is demanding that the promoters pay the charges, as well as the urbanizations’ debts. What is the real situation regarding the expansion of Puerto la Bajadilla? As you know, this project is under the jurisdiction of the Junta de

As Angeles Muñoz and not Mayoress, what do you like most, and least, about Marbella? Marbella is a city that should be known and lived in. I fell in love with it from the beginning, and ever since then I have been working to improve it even more. I love its climate, the hospitality of our people, the mountains and sky line…I could go on. What I like least is the lack of infrastructure, particularly with regard to education and sanitisation, which is the responsibility of the Junta de Andalucia. It is incredible that with more than 140,000 inhabitants on the register, we only have three Public Health Centres. You have the responsibility to take decisions on behalf of all those who have voted for you. What is the most difficult decision you have made since you became Mayoress? When you are Mayoress of a city as important as ours, there are no easy decisions because we are talking about many diverse interests. At the moment I do not remember which was the most complicated but I do remember the duty I have with the city and that every decision that I make must be done taking into account the general interest of all our citizens. Hansa Realty, like many international companies, has decided to bet on Marbella. What words of support could you give to the businessmen who invests in the your city? I can assure them that at present Marbella offers all the guarantees for companies, such as Hansa Realty, who have decided to bet on the city. The standardisation process initiated by the local government and the approval of the PGOU has returned legality and legal certainty to the town, which is now a perfect place to develop any business project. Furthermore, we must emphasise that the Town Hall has an Investor Help Department which offers all sorts of information and personalised advice to the companies that are interested in investing in our city. For me, talking about Da Bruno is not just talking about great Italian food in the Costa del Sol, but also the family. How important is this for Bruno and Giussepina? Family means hospitality, love and the best gastronomic tradition. Da Bruno in Italian means At Bruno’s House, and it is the name of the seven establishments that form our restaurant group: Da Bruno Sul Mare (Bruno’s on the Beach), Da Bruno Cabopino, Da Bruno a Casa (at home with Da Bruno), Da Bruno Pasta, Da Bruno San Pedro and Da Bruno Mijas Costa. All of them offer our clients that extra special attention that makes them feel at home, and we take care of all details so that they can enjoy a unique experience around a cosy table with friends and family. Another of the restaurant’s successes stems from the ingredients and classic Italian recipes. Do you find many differences between shopping here in Andalusia and Italy? At Da Bruno’s we take advantage of all that Andalusia can offer us, so that we can offer Italian cuisine with a Mediterranean flavour. There is a great variety of quality fresh produce, whether fruit and vegetables or meat and fish. All have their special place in Da Bruno’s kitchen where they provide dishes that combine the tradition of Italian cuisine with the latest in today’s modern and innovative cooking. Andalusia and Italy share many products that are known for their top quality. In general there is not a lot of difference between the two places, but each does have its own particular products, which, in the case of Italy, we import in order to offer our clientele the best of that country’s gastronomic delights. Although it is a long time since you started your first restaurant, those who know Bruno and Giussepina get the impression that you enjoy it as much as ever. Do you think that your passion for your work is the key to your success? Our finest treasure is our clients and their pleasure is our duty. Every day we open our restaurants with the intention of offering a unique gastronomic experience in a cosy and pleasant environment. We look after all their needs with the same hospitality and care, we offer top quality dishes made with the best ingredients, for all tastes. Given the great choice of restaurants that Marbella has to offer, we are honoured that you choose our restaurant to enjoy a family meal, a dinner with friends or an important event. They appreciate the friendly and intimate service that we offer, from our waiting staff to the management, and myself. The proof is that oncwe they have visited us, they always come back. They also appreciate our surroundings and décor, which create a welcoming atmosphere suitable for the whole family and for all sorts of events for large groups.

You are considered to be one of the most serious businessmen in the city with your 20 years’ career here. What do you think about Marbella today? The city of Marbella opened its doors to us nearly 20 years ago and we have been watching its development ever since. Many things have changed, but the people still offer the same hospitality and friendliness as ever. Its position as one of the prime tourist spots of Spain is proof of the hardworking character of its people and their increasingly strong business sense. The present economic situation forces us to work along with each other, more than ever, in order to develop a joint effort to help those who need it. The Da Bruno Group of Restaurants has signed cooperation agreements with a large number of businesses in the area and has participated in forums in the tourist sector. We also participate in charitable social activities such as the Lions Club of Marbella, Ciudad de los Niños (Children’ Charity) and the CRECE Foundation (Disabled Childrens’ Foundation). And to finish off, what message would Bruno Filipone give to today’s youth who have so few hopes? Send a message of hope and support wishing them success in their academic and professional ventures. I consider myself an entrepreneur from the day I started in the restaurant world and my recipe for achieving my goal is lots of work, dedication and to create one’s own way of doing things. We have to fight to get ahead with any business idea and not to stop until we succeed.

This requires careful initial study which must also take into account the tax regime of the investor’s country of origin. In the past has the legal advisor been legally liable for real estate advice to individuals and companies in Marbella? Of course. A legal or tax adviser is obliged to provide the best possible advice to his clients over and above any interests or relationships with promoters, estate agents, etc. ….something that some have not respected in the past and which, combined with the crisis caused many lawyers, tax advisers and estate agents to close down. From now on we encourage those who have been affected by this situation to take legal action and demand compensation, it is their right.

Lexland is a cross-disciplinary practice with multilingual lawyers in the Costa del Sol. What is it that your foreign clients particularly worry about? Legal certainty, both regarding investment in real estate and commercial or business operations. To receive suitable advice which guarantees that they will make the correct decisions and reduce the risk of problems in the future as much as possible. You have to remember that many of our clients find themselves in a foreign country; they have to make decisions that are very important to them and they have to be confident that their decision is correct, with all possible guarantees. You are a specialist in commercial and real estate law, how much have the relevant laws changed in the last few years? As a result of the crisis, there are constant changes and new laws, nearly every week we are faced with new regulations. Some recent laws do indeed help new businesses and real estate operations, but it is true that often they add new complications to certain operations, particularly real estate, with regard to tax implications, money laundering, etc. which now more than ever often require specialist advice. What are the principle tax implications that affect a company nowadays? The tax system has become more complex, new IVA (VAT) regulations, company taxation, increase in tax inspections, and so on. This forces the businessman to spend more time with these matters. Of course it is also true that new laws bring new tax advantages, reduction or delay in the payment of certain taxes. Many of these are unfamiliar to the businessman, or difficult to understand. In our tax department we discover tax advantages for clients who are unaware of them, and provided there is suitable tax planning, these advantages could make the difference between closing down, or carrying on the business. When we talk about foreign investors, whether individual or corporate, what is the biggest worry when investing in the Costa del Sol? Legal certainty and tax treatment of your investment; having the most efficient legal and tax instruments by which you can make your

What does the constitutional law for personal data protection consist of and what is its scope? The law 15/1999 controls the treatment of personal data in order to guarantee its protection so that third parties can only receive such data with the consent of the individual. Therefore it is essential to know whom we give our personal details to, and then to know when we give our consent for our details to be given to others. This is the only way to avoid surprises and if necessary, to take legal action. Many entities must comply with this law, including real estate agents, banks, lawyers, hospitals, advisors, etc. and they must keep a record of all personal data recorded which must be filed with the Data Protection Agency, with a data protection manager in each company. When did the rentals law change? The law 6 June, 4/2013 introduces several changes, the most important being in my opinion: eviction due to lack of payment can commence after failure to pay one month’s rent, giving the tenant just 10 days to pay. Time scales are reduced, both regarding Eviction Judgements and mandatory rental contracts to only 3 years and tacit extension of only one year. The tenant can rescind the contract after six months giving 30 days notice, regardless of the initial duration of the contract. Now it is more necessary than ever to register rental contracts in the land registry office, since if you do not, a new owner can demand the cancellation of the contract. Rent increases no longer need to be according to the rate of inflation (RPI) but as agreed by the parties concerned. A register has been created to recognise tenants who have been convicted for not paying their rent. Juan Miguel, to finish off, what good news message can you give to future investors in the Costa del Sol after these tumultuous times? My message is absolutely positive, apart from the town planning problems that we all know about. Today we can offer complete legal certainty to investments, which, together with excellent investment opportunities, make this an ideal moment to invest. Proof of this can be seen by the large number of foreign investors who are acquiring real estate at prices that were impossible to imagine some time ago. Contrary to other parts of Spain, there is a clear increase in real estate purchases in the Costa del Sol, an increase which many Town Halls are noticing thanks to the increase in revenue from Capital Gains Tax which applies to the sale of real estate property. All this helps us believe that we are experiencing a unique investment opportunity given the constant increase in demand that we are seeing every day.

“Always look ahead no matter how old you are or what your circumstances are.” By María Elena Paganini

Manolo, you have been amongst the elite in the world of tennis, and for some years now you have been organising the Mutua Madrid Open with top players. Do you think that one day we could have a similar tournament here in Marbella? At the moment it would seem unlikely to have a Mutua Madrid Open (Masters 1000) in Marbella for various reasons, both money-wise and the need to obtain the ATP’s permission for a further world Masters 1000.

How important is sport for the people of Marbella? Very important, for all types of sport. You must have enthusiasm and the determination to win. Which one of today’s tennis professionals do you particularly admire, either for his style or maybe for his technique? Rafael Nadal, no question. He is a perfect example thanks to his behaviour both on and off the tennis court. Of course there are

the other greats, such as David Ferrer or Roger Federer. What sort of personality does an elite sportsman have? A resolute character… perseverance, determination and discipline. Once you told me in an interview that it is a “leap in the dark”, never look back? Perhaps this has something to do with the winner’s personality? Always look ahead no matter how old you are or what your circumstances are. There is no choice if you want to be happy. Seeing your vitality, your passion and energy, it looks as though there is no age when a man is no longer young, what is your secret? Love life as long as you have it. You only live once. And it is a privilege as long as you enjoy mental and physical health. How did you celebrate your 75th birthday? As usual – with the people I love and who love me in the world of tennis. You run a Racquets Club with various activities, you are a businessman who has invested many years in Marbella, do you think it is the best place to live and work? Marbella is a town to live in and to visit and to settle down for ever….. its people, its weather and lots more. And I have a club called Manolo Santana Racquets Club, with a great family and sports atmosphere which attracts people of all ages to come and have fun. They say that behind every great man there is a great woman, and all who know Claudia will agree. I am with the woman I love most, and whom I will love all my life. You are an architect with a great deal of experience in the Costa del Sol. Is there what can be considered a typical style of architecture in this area? Thanks to the diversity of the owners who live here, they have created an interesting microcosm of architectural styles…..which I would call “Marbella Style”: a mixture of Andalusian, American, Arab, Latin American…….with certain central European details. The Costa del Sol has a wide range of constructions, from the most ugly (no style whatsoever) to dream mansions, which are the most spectacular that one can imagine. These are, however, hidden behind gardens and high walls. This rich diversity mixed with the unique gardens in our Costa has always attracted me. Also, since not only am I an architect, but also a valuer, I visit all sorts of places, and know what I am talking about. Given the real estate crisis which has affected Spain in general and the Coast in particular, what type of customer are you working with at the moment? We have noted a strong revival this year 2013, I cannot even remember when I have had so many clients in just half a year. Our clientele is Central European (English and particularly German) but also from the Arab Emirates. And the eastern countries, Russia and Poland, are also showing great interest. Is there an architectural style that can be called “timeless”, classic, which can work anywhere in the world? Timeless refers to anything that is well made... the same as watches, yes? Now real estate agents must show the Energy Rating of the properties that they sell or rent, but which residential properties or buildings are required to have this Certificate?

The Certificate is obligatory for all buildings, but only if the owner wishes to sell or rent. What services will an architect offer when the Energy Rating is made? The client will know his property better, particularly what has to be done to save energy. And this is precisely what is intended, more awareness on the part of the owners, and as a result, less energy costs. If we do not do this, what penalties do we risk? In Spain all this is still very new, I do not think that even the administration knows yet what consequences all this might have. In other countries like Germany, the Courts are full of petitions by tenants or buyers caused by non-existent or false energy certificates. Do you believe that the foreign owners are sufficiently informed about this new regulation which has just become applicable? There will be owners who have not found out yet, but normally those who have real estate property in Spain will have representatives/ friends/lawyers/agents who can keep them informed. You are a chartered architect both in Germany as well as Spain. What differences do you find at the time of planning and building in each country? I left Germany due to the excess bureaucracy in 1995 and now we find that there is more bureaucracy in Spain than in Germany. So much so that I find absurd the amount of documents we have to provide the various administrations. I hope that this will ease in due course.

When we say that Dani Garcia’s cuisine is based on contrasts, what do we mean? What is melon with Parma or Serrano ham, for example? It is a contrast of tastes: the freshness and sweetness of the fruit with the savoury taste of the ham. This contrast is what excites the palate and makes your taste buds soar to another dimension, and this is what we want: the contrast between savoury, smoked, spicy, sweet, all these tastes blended together in harmony. What is the difference between a chef with or without a Michelin star? What makes a Michelin chef? It’s all very subjective, there are chefs without Michelin stars who produce great food, but we do things differently – that is what makes food such a wonderful art. Creating a superb paella is as important as making a dish with liquid nitrogen (????Please clarify the text – it doesn’t make sense!!) A Michelin star involves not only creativity, but also other factors such as the décor, the service and the crockery and cutlery. When we talk about luxury regarding food, we normally think of caviar, for example, but we can also include country-made cheese or eggs with cured salami. What does luxury mean for Dani Garcia? In the old days, a luxury restaurant would serve caviar, foie gras, truffles, that is, very exclusive dishes, but today things have changed a lot. Now luxury means doing something new, being creative, the “je ne sais quoi”, and most of all, knowing today’s new cooking techniques, that is what decides whether we are dealing with luxury or not. My luxury? I am happy with a couple of clams and fried fresh anchovies. What dish would you have liked to invent. I would have liked to invest Pizzas, for example (laughter). I think that gazpacho or tortilla was invented at the time with great

imagination, the day someone decided to crush a tomato, add some garlic, onions, peppers, olive oil and Sherry vinegar – well what a wonderful moment that was! I wish I did it myself! (laughter). Is there competition amongst the great Chefs? Or just mutual admiration? Tell me the truth, eh? Of course there is competition, it is necessary, but what we really need is to learn from each other, and of course there is enormous respect amongst us. All the avant-garde in world gastronomy looks to Spain, everything is shared, everyone works together, nothing is kept secret. In the old days Hotel Chefs did not publish their recipes, they hid them so no-one else could see them. Nowadays this no longer happens in the world of haute cuisine, the chefs of my generation with 2 or 3 stars send recipes to each other, and then you adapt them. Even El Bulli called me once for one of my recipes. That’s why Spain has become so well respected for its cuisine. We are all going through a big economic crisis at the moment. Does that affect a great Chef’s creativity? Creativity needs investment, and that is very difficult at the moment. I would really love to have two people with me all the time in the kitchen, just creating ideas….but this is not economically viable. The plus side? It makes your ideas more radical, more substantial, more pure. You are a Chef amongst the elite and will remain in the history of Spanish cuisine. What would you say to young chefs in these difficult times? You have to create a dream, you have to identify your goals and of course be very determined, particularly as regards food, but we professionals can make other people happy. There is nothing better in life than making others happy, so you have to fight, and if you believe in yourself, you will succeed.

“Polo is our passion” By María Elena Paganini

How did it all begin? When did the Santa Maria Polo Club open? Polo started at the same time as Sotogrande, an urbanisation created by two people of great importance, Mac Micking and Enrique Zobel in the 1960’s, who wanted to make a very special and unique urbanization, similar to the American style. The first thing they did was to buy the land and before building even one house, they built polo fields and a superb golf course. Polo already existed in the Gibraltar area, mostly played by the military. The first Gold Cup was held in 1973, 74, and now we are holding the 42nd event. Polo in Sotogrande not only brings together the best players but also the greatest sponsors. What is your work as Vice President? The world of polo is virtually unknown in Spain, but in Sotogrande we hold the third most important tournament in the world after the Palermo Open and the English Open. This year it is the 42nd tournament. We will have 30 teams and it will be a particularly attractive event, with players such as Cambiaso, the Pieres brothers, McDonogh, Novillo Estrada, and teams such as “Dos Lunas” or “Ayala”, so during a whole month we will offer the very essence of world class polo. We Polo fans love this incredible sport and the elegance of the game, but surely there is a lot of work involved in the organisation of a tournament? Apart from being the Vice President of the Santa Maria Polo Club, I am also Managing Director of OM Premium where we organise elite sport events mainly in the world of polo and golf. To organise what involves 30 teams, more than 1,000 horses, 150 matches. In other words a whole month of organisation and logistics. This is very important, and a lot of experience is involved. We get calls from countries such as China, Qatar or the Arab Emirates to organise polo tournaments for them, we also have considerable experience in the commercial aspects, sponsorships, media, etc. we have the fundamental “know how”.

As in all sports there are fans and players, you are a fan of this sport, but have you ever tried to actually hit a ball? It is a very difficult sport which requires great control over the horse, you have to have a lot of skill; of course I have tried it. As a spectator I find it quite spectacular, but if you have control over your horse and you want to move on to polo, this sport unites skill, team play, risk, grace……. no other equestrian sport has so much appeal. The inauguration of Los Pinos with its 2,500 metre marquee and luxury brands was a success, but maybe the classic old fashioned fans miss el Rio? We created Los Pinos out of need for space, el Rio was a classic area, but it became too small for the polo fields and particularly for the commercial area and hospitality zone. To begin with people found this change from the traditional difficult, but now they are thrilled by it. The Medium Handicap with 16 teams is still played in el Rio. Investment in Sotogrande thanks to the summer tournaments must be enormous! Has it declined in recent years due to the crisis? Not particularly as regards international level polo. There are problems in Europe and the entire world, but we have not particularly noted the crisis on the sporting side, although the sponsorship situation is more complicated since we depend principally on national sponsors, and here we do notice that there are less financial means in this country. You have to find new ways of selling your product. We have increased offers for products, gastronomy, hospitality and we have also managed to maintain good sponsors of top quality brands. How does one become a member of Santa Maria Club? Is it only for polo players? And what advantages are there? Yes, of course. You can become a playing member, a non-playing member or corporate member. There are big advantages from the

point of view of hospitality, protocol, parking areas, exclusive terraces, polo classes, polo clinics and we have a large amount of offers and perks for members wishing to enjoy watching good polo, or playing good polo. Santa Maria Club has a foundation which promotes Equine Therapy. What is it and who benefits from it? It is an effort by the Club to help children, particularly children with problems with mental illnesses. Horses and the contact with horses provide a very useful therapy for such conditions. The results are fascinating and the best results are incredible and benefit the whole of the Campo de Gibraltar, including Marbella. Sotogrande is probably the urbanisation with the most sporting activities in the world, sailing, golf, tennis, paddle tennis, polo. How important is sport for you, and what sports do you practice? I play golf, and truth be told, Sotogrande is a golfer’s paradise, and even if you do not play golf, you will end up doing so with all the facilities on offer, courses such as La Reserva, Valderrama or el Real Golf Club.

Finally, what goals does a Polo Club official pursue? Where do you want to go with Santa Maria Polo Club? That is an easy one to answer since we have a project for the future. In Los Pinos in particular, we have a residential project, including luxury hotel and tourist services, which we hope will become the best polo club in the world. We already have some of the best polo fields, very experienced organisation, a very special atmosphere, and surroundings that are very suitable for polo. All this will be complemented with the most exclusive residential zone in the world with polo and leisure harbour. This will make it a unique complex, which we want to achieve without forgetting the essential factors, that is good polo and well organised tournaments. At the moment we are growing, we have increased the handicap to 22 goals, we have brought the best players in the world. I must stress that few shows of this type are free, but here people can go without paying anything except for the finals, and the proceeds go to the Equine Therapy Foundation. A very attractive offer which is becoming better known day by day. The Club’s doors are open and you can enjoy a great show.
