Early Auction Company, LLC Terms And Conditions Of Sale At Auction Early Auction Company, LLC Terms and Conditions of Sale at Auction The Early Auction Company and its auctioneers are licensed by the Ohio Department of Agriculture and an aggrieved person may initiate a claim against the auction recovery fund created in section 4707.25 of the Ohio Revised Code. Bidding on any item constitutes acceptance of the following Terms and Conditions. The property listed for sale by auction in either a catalog or on the website of Early Auction Company LLC will be offered for sale and sold subject to the following terms and conditions: 1. All property is sold “as is.” Neither the auctioneer nor any consignor makes any warranties or representations of any kind or nature with respect to the property. In no event shall the auctioneer or any consignor be responsible for the correctness, nor be deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, culture, source, origin or condition, of the property. Early Auction Company strives to be accurate in all information regarding each lot but it is at the bidder’s sole discretion to determine for his or herself all information regarding condition, manufacturer, origin and provenance. No statement by the auctioneer or consignor at the sale, or in the bill of sale or invoice, or elsewhere shall be deemed such a warranty or representation or an assumption of liability. In addition, this auction will be a “reserve auction” meaning an auction in which the seller or an agent of the seller reserves the right to establish a stated minimum bid if agreed upon between the seller and auctioneer. Early Auction Co. will mail payments to consignors within 30 days of the auction. Early Auction Co. will assume responsibility for bad checks, debts, and unpaid auction items. 2. The highest bidder for each lot shall be the buyer. If any dispute arises as to any bidding or between two or more bidders, the lot so disputed shall be put up immediately again at the last undisputed bid and resold. 3. Any bid not commensurate with the value of the article offered or which is merely a nominal advance over the previous bid may be rejected by the auctioneer at his discretion, if in his judgment such bid is likely to effect the sale injuriously. 4. Each lot shall be the buyer’s risk from the fall of the hammer and shall be paid for and taken away by the buyer at the end of each day. All shipping will be through a third party shipper. Early Auction Co. is in no way responsible for items in the care of a third party shipper. 5. Acceptable forms of payment are cash, check or credit card. Checks are accepted from established customers. New buyers must provide a current letter of reference from their financial institution or other references suitable to Early Auction Company LLC at least five business days prior to the date of auction. A sales tax of 6.5% will be applied to the total purchase and buyer’s premium unless a valid exemption form is on file with the company or can be submitted. 6. A buyer’s premium of 15% will be applied to the total of all purchases made buy buyers at the auction or bidding over the telephone. However, that percentage will be raised to 18% if payment is made by credit card. All bidders participating in the auction using online bidding will be charged a 21% buyers premium on all purchases. 7. Early Auction Company LLC also will handle absentee written bids and telephone bids. A member of our staff will execute written and faxed bids in a timely manner. Within a day or two after the auction, bills will be sent to all successful bidders. Telephone bidders will be billed within a day or two after the auction Absentee bids must be arranged prior to the day of the preview. We cannot be responsible for failing to execute absentee bids that are received on the day of or during the auction. There is a form at the back of our catalog for written and phone bids. Please fill out the form completely and indicate clearly how you wish to bid. Write all phone contact numbers legibly. Early Auction Company LLC is not responsible for being unable to contact a bidder. Please see the front of this catalog for more information regarding Online bidding and shipping. 8. All disputes arising from an auction or sale shall be resolved in Cincinnati, Ohio under Ohio law by mediation or, failing that, binding arbitration under the commercial arbitration rules of the American Arbitration Association. Bidding on any item constitutes agreement to be subject to jurisdiction in Ohio for purposes of resolving disputes. Bidding on any item constitutes acceptance of the foregoing Terms and Conditions.

Early Auction Company, LLC Terms And Conditions Of Sale At Auction Early Auction Company, LLC Terms and Conditions of Sale at Auction The Early Auction Company and its auctioneers are licensed by the Ohio Department of Agriculture and an aggrieved person may initiate a claim against the auction recovery fund created in section 4707.25 of the Ohio Revised Code. Bidding on any item constitutes acceptance of the following Terms and Conditions. The property listed for sale by auction in either a catalog or on the website of Early Auction Company LLC will be offered for sale and sold subject to the following terms and conditions: 1. All property is sold “as is.” Neither the auctioneer nor any consignor makes any warranties or representations of any kind or nature with respect to the property. In no event shall the auctioneer or any consignor be responsible for the correctness, nor be deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, culture, source, origin or condition, of the property. Early Auction Company strives to be accurate in all information regarding each lot but it is at the bidder’s sole discretion to determine for his or herself all information regarding condition, manufacturer, origin and provenance. No statement by the auctioneer or consignor at the sale, or in the bill of sale or invoice, or elsewhere shall be deemed such a warranty or representation or an assumption of liability. In addition, this auction will be a “reserve auction” meaning an auction in which the seller or an agent of the seller reserves the right to establish a stated minimum bid if agreed upon between the seller and auctioneer. Early Auction Co. will mail payments to consignors within 30 days of the auction. Early Auction Co. will assume responsibility for bad checks, debts, and unpaid auction items. 2. The highest bidder for each lot shall be the buyer. If any dispute arises as to any bidding or between two or more bidders, the lot so disputed shall be put up immediately again at the last undisputed bid and resold. 3. Any bid not commensurate with the value of the article offered or which is merely a nominal advance over the previous bid may be rejected by the auctioneer at his discretion, if in his judgment such bid is likely to effect the sale injuriously. 4. Each lot shall be the buyer’s risk from the fall of the hammer and shall be paid for and taken away by the buyer at the end of each day. All shipping will be through a third party shipper. Early Auction Co. is in no way responsible for items in the care of a third party shipper. 5. Acceptable forms of payment are cash, check or credit card. Checks are accepted from established customers. New buyers must provide a current letter of reference from their financial institution or other references suitable to Early Auction Company LLC at least five business days prior to the date of auction. A sales tax of 6.5% will be applied to the total purchase and buyer’s premium unless a valid exemption form is on file with the company or can be submitted. 6. A buyer’s premium of 15% will be applied to the total of all purchases made buy buyers at the auction or bidding over the telephone. However, that percentage will be raised to 18% if payment is made by credit card. All bidders participating in the auction using online bidding will be charged a 21% buyers premium on all purchases. 7. Early Auction Company LLC also will handle absentee written bids and telephone bids. A member of our staff will execute written and faxed bids in a timely manner. Within a day or two after the auction, bills will be sent to all successful bidders. Telephone bidders will be billed within a day or two after the auction Absentee bids must be arranged prior to the day of the preview. We cannot be responsible for failing to execute absentee bids that are received on the day of or during the auction. There is a form at the back of our catalog for written and phone bids.
