December saw a brief lockdown for SA which really triggered some strong growth in property prices, namely due to people wanting space to live in and slowing the supply of properties coming to market. TIPS FOR Form 1's
What is a Form 1 A Form 1 is the vendors representation of the property. The document along with all the information has to be supplied to the purchaser before the “cooling off period” can commence. The cooling off period is legislated to be 2 working days once served – this does not include weekends or public holidays. Serving the Form 1 The Form 1 can be served after the contract is signed, usually via email. Purchaser does not have to sign. During the cooling off period, the purchaser is required to do their due diligence and checkup any council approvals for additions to the original dwelling and getting a building inspection to check for white ants, termites, salt damp, cracks etc. Cooling Off If you decide to have a building inspection completed during your cooling off period and you don’t like what has been reported or for some reason you need to cool off, ask your conveyancer what to do. Otherwise follow the steps in the Form 1 on page 2. Strata and Community If the purchaser is buying a Strata or Community Title, the Form 1 will contain minutes of the meeting of the group of units. There are well worth reading especially if there are any ongoing repairs to the units generally. If the purchaser is buying a Community Title, there will always be a set of By Laws attached to the Form 1. The By Laws are unique to the group of units and it will detail guidelines such as the allowance of pets and any restrictions of the unites such as noise levels, hanging out washing or balconies etc. If a purchaser is buying a Strata unit then there are no By Laws however, there is legislation that all Strata units are governed by.
