How does AML/CFT affect me?

New Legislation in the Real Estate Industry The Anti-Money Laundering and Countering Financing of Terrorism Act 2009 – or “AML”, as it is more commonly known, is part of a worldwide initiative to crack down on illegal activities, including money laundering and terrorism. New Zealand is held in high regard internationally as one of the least corrupt countries and as a great place to do business. The new rules have been introduced to safeguard that reputation and to play our part in combating global crime. Criminals have been known to use banks, lawyers, accountants and real estate agents to help hold and move assets. The new legislation is aimed at detecting and ultimately deterring this activity.

How am I affected by the new legislation? From the 1st of January 2019, all Real Estate companies under the Act must request specific information from our clients before we may advertise the property or business to sell. This information will also be required from clients who have commercial property they wish to lease. If your property or business is held in the name of a company, trust, or has overseas ownership, we will need specific information about the entity including the people associated with it - such as directors, shareholders, trustees and beneficiaries. The Act also requires us to ask you to confirm source of funds for these entities. Under the new rules, we will require documents such as a birth certificate, passport or driver’s licence, to prove your identity. We may also request a copy of your rates bill, electricity account or bank statement to confirm your usual residential address. If you have any questions, please do not hesitate to contact your salesperson or their Manager.

A year in review

When I was a child the year used to drag itself slowly through its 12-month cycle, but now, so many decades later, it’s practically breaking speed records! 2019 has been a strong year for highlights and the challenges have felt ever-so-slightly easier – or maybe I’m just finally learning to adapt and modify my response to continued stress. So, with another fast and furious year on the cusp of ending, now is the perfect time to consider its colorful tapestry and think about what I have achieved. It’s true, sometimes you’re so busy with the mechanics of your occupation that the opportunity to reflect on the bigger picture doesn’t present itself, but it’s so worthwhile when you do. So, where did I get it right? In the interests of simplicity, I said ‘yes’ more than ‘no’. ‘Yes’ to requests for help, especially if they delivered on our desire to give back or lift up those members of our community who are vulnerable or in great need. ‘Yes’ was also the answer when asked if I’d speak or present on personal or professional

topics including business culture, resilience, consistent high performance and mentoring. And some of the biggest ‘yeses’ went to incredible people who approached us about the possibility of joining our company in the search for a business that provided inspiration in addition to a rewarding career path. I firmly believe this commitment to getting good people on board, people that embrace our culture and our values, is why we hold the awards for No. 1 Residential Office nationally and internationally for Harcourts and No. 1 Franchise in New Zealand for earnings per consultant. A firm ‘no’ (or two) also made an appearance, however, when I met people considering a real estate career while wanting to avoid accountability, hosting open homes or training – the list went on, unlike my tolerance! I may be old-fashioned, but it will always be a ‘no’ if you front up to an interview in jeans or arrive late, underprepared and over-entitled. So, what else has stood out this year? An active, even marketplace with interest rates at very low levels making first-home owners feel more optimistic than they have for a long time. More and more legislation and an acceptance that the AML (anti-

money laundering) requirements which began last year, whilst inconvenient at times, are here to stay. Landlords have also had to continue incorporating changes in the way their rental properties are presented, maintained and tenanted, and this looks unlikely to abate. Professionally, we have also had the incredible benefit of Chris Kennedy (formerly the CEO for Harcourts NZ) joining us as General Manager. To say this has done a lot to relieve some of the workload and stress that occurs when you are running a dynamic, successful company whilst driving ever-forward is an understatement! As for Christmas, personally, I’ve always loved this time of year. The mother in me will miss our beautiful eldest son and his partner who will spend the season working in the Japanese mountains, but I will have the company and joy that other family and friends have always provided. To those of you that read my monthly column, I wish you a Christmas that makes you feel happy rather than stretched and stressed, and a 2020 full of promise.

Conduct of Auction This is an extract from the contract so please refer to complete terms as supplied and available on display.

• The property is offered for sale subject to a reserve price being met, the highest bidder whose bid is accepted by the auctioneer shall be the purchaser. • The auctioneer may nominate the sum by which the bidding can be raised. • The auctioneer may refuse any bid. • The auctioneer or the licensed real estate agent acting for the vendor in respect of the sale may submit a bid on behalf of any person. • The auctioneer shall identify a person so acting before the commencement of bidding. • The vendor reserves the right to bid personally, by a representative, or through the auctioneer and to withdraw the property at any time before it has been sold and without declaring the reserve price. • If a dispute arises concerning any bid, the auctioneer will determine the dispute or re-offer the property at the last undisputed bid.

THE PURCHASER SHALL IMMEDIATELY ON THE COMPLETION OF THE AUCTION: a) Sign the Memorandum of Contract failing which the auctioneer may sign on behalf of the purchaser. b) Pay to the vendor’s licensed real estate agent the deposit being 10% of the purchase price unless otherwise agreed; and c) Complete its GST information in Schedule 1.
