How does AML/CFT affect me?
New Legislation in the Real Estate Industry The Anti-Money Laundering and Countering Financing of Terrorism Act 2009 – or “AML”, as it is more commonly known, is part of a worldwide initiative to crack down on illegal activities, including money laundering and terrorism. New Zealand is held in high regard internationally as one of the least corrupt countries and as a great place to do business. The new rules have been introduced to safeguard that reputation and to play our part in combating global crime. Criminals have been known to use banks, lawyers, accountants and real estate agents to help hold and move assets. The new legislation is aimed at detecting and ultimately deterring this activity.
How am I affected by the new legislation? From the 1st of January 2019, all Real Estate companies under the Act must request specific information from our clients before we may advertise the property or business to sell. This information will also be required from clients who have commercial property they wish to lease. If your property or business is held in the name of a company, trust, or has overseas ownership, we will need specific information about the entity including the people associated with it - such as directors, shareholders, trustees and beneficiaries. The Act also requires us to ask you to confirm source of funds for these entities. Under the new rules, we will require documents such as a birth certificate, passport or driver’s licence, to prove your identity. We may also request a copy of your rates bill, electricity account or bank statement to confirm your usual residential address. If you have any questions, please do not hesitate to contact your salesperson or their Manager.

Got Any Time? Time. Have you got any? It’s the elephant in everybody’s room. “I haven’t got enough time.” How often do we hear that and, even more, how often do we say it to ourselves? I’ve been a party to that personal conversation even though I try to be meticulous about punctuality and prioritizing, and I find it’s a massive issue with some of the people I meet. Having started into a new year – a new decade, in fact – it’s a great opportunity to look at how we can utilize that precious 24 hours a day to get the best out of ourselves and our lives. Here’s what provides me with both comfort and sanity.
1.
Be organized/structured/ prepared. It’s very easy to spot someone who hasn’t done the preparation. Someone who made it harder for themselves by not investing time in setting up their diary, confirming appointments, checking in on personal or family commitments,
basically doing everything they could to provide a gentle entry into a task or a week without the stress of having to overcompensate and then waste time. Every Sunday, I prepare for the week, month and year ahead. I’ve done this for decades and it creates a steady flow of activity and creativity, while minimizing time wasted. I feel calm, no matter the gravity or magnitude of what lies ahead, and that is a godsend!
2.
Delegate. Something that’s easier said than done, but some tasks are simply better performed by others (anything to do with the car or filling in questionnaires for me!). Work out what those tasks are and you’ll have time left over for the things that truly matter.
3.
Say ‘no’. It sounds easy, but just as some people can’t say ‘yes’ to anything, others can’t say ‘no’. You can tie yourself up in knots trying to do for others what they might never do for you. Why? Because we feel bad? Well, time to start practicing the ‘no’. Many of us have children who made an art form of this simple response. Learn from them. Give your time to the people and causes that matter.

Limit distractions. Sometimes it feels like so many things are calling for our attention. Coupled with this is the online world, which can dominate so much of the lives people lead. Everyone wants to know something immediately or be helped instantly – of course, this could just be part of the business world or the life you live, however be aware of digital distractions that have little merit and consume lots of time. This includes digital games or endless online shopping which can easily go from a distraction to an addiction. After using some of these strategies for yourself, I’d love to wish you the time to focus on things that resonate with you at a deep and meaningful level. I’d also like to thank you for taking the time to read this and to wish you well as we pass from February into March. No matter how many techniques I utilize, this particular month is always madness, and anyone working to a March 31st end of financial year will know why!

Conduct of Auction This is an extract from the contract so please refer to complete terms as supplied and available on display.
• The property is offered for sale subject to a reserve price being met, the highest bidder whose bid is accepted by the auctioneer shall be the purchaser. • The auctioneer may nominate the sum by which the bidding can be raised. • The auctioneer may refuse any bid. • The auctioneer or the licensed real estate agent acting for the vendor in respect of the sale may submit a bid on behalf of any person. • The auctioneer shall identify a person so acting before the commencement of bidding. • The vendor reserves the right to bid personally, by a representative, or through the auctioneer and to withdraw the property at any time before it has been sold and without declaring the reserve price. • If a dispute arises concerning any bid, the auctioneer will determine the dispute or re-offer the property at the last undisputed bid.
THE PURCHASER SHALL IMMEDIATELY ON THE COMPLETION OF THE AUCTION: a) Sign the Memorandum of Contract failing which the auctioneer may sign on behalf of the purchaser. b) Pay to the vendor’s licensed real estate agent the deposit being 10% of the purchase price unless otherwise agreed; and c) Complete its GST information in Schedule 1.
