Are you ready for apartment living?
Apartment living is booming in our major cities - at least judging by real estate statistics - as more New Zealanders respond to the housing squeeze by opting for going up in the world. As a country with a limited history of apartment living, we are frequently faced with would-be buyers who are unaware of some of the most fundamental aspects of apartment ownership. Last year apartments were being snapped up as quickly as they came to market in Wellington and Christchurch, and 2014 ended with new record highs in selling price expectations, according to data from Trade Me’s property price index.The capital city saw an increase of 1.1 per cent, taking the average to $403,000, and Christchurch had a rise of 13.6 per cent, an average selling price expectation of $466,400. There are a few things you need to think about when it comes to buying the right apartment for you.
• A sense of community in the complex:
The downside of leasehold is that as you don’t own the land, you don’t benefit from rising land values. Whilst leasehold properties are significantly cheaper than freehold, there are positive and negative aspects of both leasehold and freehold, and it is up to the individual to work out what is best for them. Understanding the difference between the two options is the first step to understanding the apartment market.
Has it got one? Is there a café/gym/pool where residents meet? A café is invaluable. Gyms and pools aren’t always used.
• What is a body corporate and why do I have to pay?
• The ratio of owner-occupiers to renters. A higher ratio is a sign the complex is well-run and stable.
• Leasehold or freehold? This is a big one, perhaps the most important thing to understand before embarking on an apartment hunt. Leasehold apartments are not common in Christchurch more so in Auckland. With a freehold title you own the apartment and a share of the land of which the building sits, and this is usually represented as a unit title. Each owner owns their own ‘unit’, and may have a shared ownership in the ‘common property’ areas such as entrance ways, gardens and lifts. With a leasehold title, you own the apartment, but lease a share of the land from the land owner, the difference between the two seems straightforward enough, and is usually reflected in the price.
The body corporate is an entity made up of all the unit owners in a building that administers and looks after the apartment complex on your behalf, so if you are an owner, then you are also a member of the body corporate. All owners, have to pay a body corporate fee and that goes into a budget that is spent on maintenance, upgrades and any other operating costs. The body corporate is then administered by a separate company with money held in an independent trust. This means there is a transparent view of the budget and allocation of body corporate funds. The body corp minutes: before purchase, you lawyer will check the rules and also the minutes for peoples concerns, repairs and maintenance. Look for overdue levies. If everything is up-to-date, generally people are happy in the complex.
Before buying an apartment it is also imperative to understand what plans the body corporate has for the building, as well as other rules that will have an impact on how you live in your home and any changes you want to make. Check whether you can hang washing on your balcony or whether you can put in an air conditioning unit. Ask about maintenance and any planned developments. Check what the rules are around noisy neighbours. Also make sure you ask about pets or whether you can store items in your car park space. Get a building report to check if it’s a leaky building! • How does insurance work? Insurance for the building is included in the annual body corporate charge, but it doesn’t cover contents, so this is something you will need to organise yourself. The type of insurance, and the rates, will vary from building to building, so understanding what the cover does and doesn’t include is vital. Ask what would happen if your neighbour had a fire and it impacted on your apartment, or if you accidentally flooded your bathroom and repairs had to be carried out. It used to be that preparing to sell a property required a relatively systematic but simple number of steps. All of the parties involved worked to a prescribed formula and we all knew what was needed. For the owners this often focused on ensuring scrupulous presentation and, for realtors, the determination of marketing methods dominated.Today it’s an entirely more complex matter. Not only have the Christchurch earthquakes created a whole new level of requirement for compliance and documentation for anyone selling, but the Real Estate Agents Act 2008 also demands an obligation from the realtor for an in-depth knowledge of any and all matters relating to the property. As you can see below, it truly is no easy matter and a huge part of my role as a business owner and manager is to ensure this level of preparation is undertaken in a timely and professional way. Sometimes preparation can take weeks rather than days, but at least it means purchasers are well informed, owners are being transparent and consultants are making a difference and that means the world to me. PREPARATION CAN INVOLVE THE FOLLOWING REQUIREMENTS OF A GENERAL NATURE:

When listing a property, get a copy of the certificate of title.
Review the title and check the information on tenure, ownership, legal description property description in the listing document matches the information on the title.
• Establish if there are interests
registered on the title such as covenants, caveats, easements, etc. that should be brought to the attention of prospective purchasers (and the vendor).
• Find out the zoning and town
planning regulations or council requirements so you are able to point out what restrictions might apply to that property.
If necessary, have a lawyer help you to interpret what any restrictions mean.

• The property is offered for sale subject to a reserve price being met, the highest bidder whose bid is accepted by the auctioneer shall be the purchaser. • The auctioneer may nominate the sum by which the bidding can be raised. • The auctioneer may refuse any bid. • The auctioneer or the licensed real estate agent acting for the vendor in respect of the sale may submit a bid on behalf of any person. • The auctioneer shall identify a person so acting before the commencement of bidding. •
The vendor reserves the right to bid personally, by a representative, or through the auctioneer and to withdraw the property at any time before it has been sold and with out declaring the reserve price.
• If a dispute arises concerning any bid, the auctioneer will determine the dispute or re-offer the property at the last undisputed bid.
THE PURCHASER SHALL IMMEDIATELY ON THE COMPLETION OF THE AUCTION: a) Sign the Memorandum of Contract failing which the auctioneer may sign on behalf of the purchaser. b) Pay to the vendor’s licensed real estate agent the deposit being 10% of the purchase price unless otherwise agreed; and c) Complete its GST information in Schedule 1.
