Whitebred Shorthorn Cattle CONDITIONS OF SALE The Sale is conducted under the General Conditions of Sale normally applicable to this mart, and under the following Special Conditions; in any case in which they conflict the following special conditions shall prevail. MALE WARRANTY All bulls 12 months old and over at the date of the sale are warranted capable of getting stock by natural service. All bulls under 12 months old at the date of sale are warranted capable of getting stock by natural service as from the date reaching the age of 12 months. In the event of any bull proving incapable of getting stock by natural service, a purchaser shall intimate such incapacity to the Auctioneers, and if such incapacity is proved by the Certificate of Veterinary Surgeon mutually chosen by the Purchaser and the Vendor (or, in default of agreement), appointed by the Auctioneers, the Vendor shall be bound to accept the return of the bull and to refund to the Purchaser the price received. The Veterinary Surgeon shall also certify that the infertility is not the result of injury, accident or illness happening after the date of the sale. To establish a claim under this Condition the Purchaser must give notice of his claim to the Auctioneers in writing within 12 weeks of the date of the sale or of the bull attaining the age of 12 months as the case may be. The Vendor shall only be liable to the Purchaser for the price of the bull and not for any other loss, except keep, sustained by the Purchaser. FEMALE WARRANTY Heifers, 18 months old and over on the day of sale are warranted breeders. Complaints regarding heifers which prove non-breeders must be reported within six months of date of purchase, any such complaint to be supported by a VS certificate. EAR MARKS Vendors should ensure that all ear marks are clearly legible and that they agree with those as printed in the catalogue. Bulls will be inspected for ear marks prior to going to the sale ring. Any infringement may mean disqualification. Government subsidy By Alistair Driver FARMING Minister Jim Paice has challenged British farmers to ‘set the industry on fire’by leaving the past behind and embracing the opportunities on offer in today’s marketplace. Speaking at the Oxford Farming Conference, Mr Paice laid out his vision for British farming based on seeking out new global markets, innovating using all available technologies and ultimately thriving without the support of direct subsidies. He also revealed Defra would be hosting an ‘innovation summit’ in London in March followed by a series of ‘practical’regional events. He dismissed the view of farming ‘as a quaint old industry’ and urged farmers to look to the future. “We can keep the cosy image of Buttercup in the field producing a few litres a day and the bucolic farmer leaning on his gate We can sentimentalise farmers as small players in a market dominated by supermarkets at home and multinational conglomerates abroad,”he said. “Or we can set this industry on fire and take the opportunities and face the reality they provide.”

He insisted his comments were not about advocating ‘big, corporate’ farms over ‘small, family’ businesses: “It is about attitude: whether to pine for the old days of government intervention and protection, or to face the challenges.” At the heart of his speech was the need for the industry to use ‘the best research, technology and knowledge transfer we can get’ to help boost production, while protecting resources and biodiversity.

Driving ambition Mr Paice identified the Agriculture and Horticulture Development Board (AHDB) as the ‘professional body’ to drive the industry forward in this area and had asked AHDB chairman John Godfrey to address how this could be achieved. He stressed the industry needed to accept it was competing in a global food marketplace and to seek out export opportunities ‘where we are most competitive’. Shadow Defra Secretary Mary Creagh said food was ‘one of the defining political issues of this century’, but criticised the Government for failing to address all the issues surrounding it. Highlighting the role farming and food can play in stimulating economic recovery, she warned of increasing food poverty in the UK against a backdrop of rising food prices, exacerbated, she claimed, by commodity speculation. NFU president Peter Kendall said he was heartened by Mr Paice’s message.

GALLOWAY CATALOGUE SPECIAL NOTICES Buyers and Sellers of Non-Pedigree Cattle are firmly requested to note the following: The Regulations of the Galloway Cattle Society Do Not Apply but we are requested by the Galloway Cattle Society to say, that in respect of pedigree animals sold in the Non-Pedigree Classes; Sellers are required to pay transfer fees direct to the society Secretary and complete the Transfer of the animals to the Purchaser. This is to safeguard the position of the purchaser in respect of future progeny.

NOTICE TO VENDORS We are asked by the Ministry staff to obtain, prior to the sale, details of All Ear Marks. Enclosed you will find an entry form equal in number to those entries which do not give this information. Please be good enough to complete this form before coming to the sale, noting very carefully the catalogue lot number applicable to each animal. Vendors are reminded that they must give correct ear numbers

CONDITIONS OF SALE A copy of both the Pedigree and Non-Pedigree Conditions of Sale are available for inspection in the office.

TIBIAL HEMIMELIA At a meeting of the Council of the Society in February 1993 the regulations governing Tibial Hemimelia were reviewed and are now published as follows: 1. The birth of a calf with the genetic condition known as Tibial Hemimelia is to be reported to the Secretary immediately thereafter giving details of both the Sire and the Dam. A Veterinary Certificate which is to include the blood grouping of the calf, the dam and if possible the sire or an AI Certificate if appropriate is then to be forwarded to the Secretary. The Society will pay the sum of ÂŁ50 to cover these Veterinary costs. (This payment is restricted to one payment per sire notified.) 2. Bulls born after 1st September 1979 will not be accepted for registration if they have notified Tibial Hemimelia carriers in the first or second generations of their pedigrees. 3. Females will not be accepted for registration by sires known to be carrier animals except those conceived before the time the sire was notified as a carrier. 4. No Export Certificate will be issued for Bulls which have a Tibial Hemimelia carrier in the first two generations effective at time of export. 5. No Export Certificate will be issued for Heifers, the Sire or Dam of which is a Tibial Hemimelia carrier, effective at time of export. 6. Purchasers of In-calf Heifers will be refunded 15% of the purchase price by the vendors in the case of these Heifers giving birth to calves born with Tibial Hemimelia from this service provided that the Heifers are purchased at Pedigree Sales held under the auspices of the Galloway Cattle Society. This regulation applies only to Heifers kept in Great Britain and does not apply to animals purchased for Export. 7. Pedigree Galloway Bulls, if mated with a Galloway Cow and siring a calf with the condition of Tibial Hemimelia, when advised to the Society, will result in the Society making an offer to purchase the said Bull for the sum of ÂŁ1000 sterling. The Bull will then be slaughtered under arrangements made by the Society. This regulation applies only to Bulls kept in Great Britain and does not apply to animals purchased for Export. 8. The Society will continue to accept the registration of Females out of the Dams notified as carriers.

HEALTH AND SAFETY RULES HARRISON & HETHERINGTON LIMITED NOTICE TO ALL VISITORS AND TRADERS PLEASE READ AND OBSERVE THE FOLLOWING All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc.

AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions as recommended by the NBA) 1.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

4.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

5.

All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

7.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

8.

No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

9.

Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington. Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/or Regulations. Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling. When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals. Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/ sale of livestock in the ring and reserves the right to intervene at any point if, in the company’s opinion, the person showing the livestock is at risk in undertaking that activity. Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES. The auction ring man escapes and refuges must be kept clear at all times. All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.

10. If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter. 11.
