All Sheep to be sold in guineas. All sheep will be sold under the Conditions of Sale of the LAA - see pge 8 and 9 Commission will be deducted at the rate of 5% on all pedigree sheep sold. No dressing, clipping or the use of bloom dips on the fleeces of the sheep will be permitted. Any sheep noted to be misrepresenting the Texel Breed Society Rules will be reported. 5. All sheep to be sold singly. 6. All sheep will be identified with tags hung around their necks. 7. All sheep to be from Maedi Accredited Flocks only. 8. Sheep will only be accepted into the Market and penned for Sale if they are accompanied by a Movement Declaration Form and an official SAC MV Accredited Certificate which has been correctly completed. These certificates must be handed in when animals arrive at the market. Please note: A SAC Representative to be on duty to inspect all Maedi Visna Certificates. 9. All sheep will be subject to a Inspection. Any animal which does not reach the Inspection Standard will not be eligible for sale. 10. All In-lamb entries will be scanned to confirm in lamb. 11. Vendor to be responsible for the correctness of tattoos and any other faults. Buyers have one hour following the end of sale to lodge any faults or misrepresentations to the Auctioneers. 12. Conditions of Sale All sheep are sold under the Conditions of Sale as displayed in the mart recommended by the Livestock Auctioneers Market Committee for England and Wales. The following is an extraction taken from the above: PART VIII - Sheep Female sheep not described as in Lamb 76 A female sheep which is not described in the catalogue or at the time of sale as in lamb is warranted as not being in lamb. 77 If within 14 weeks after the day of sale a female sheep warranted as aforesaid proves to be in lamb, and within 14 weeks and 5 days after the day of sale, the purchaser gives to the auctioneer written notice supported by a certificate signed by a Slaughterhouse manager or a Veterinary surgeon or other competent person, that such female sheep has proved to be in lamb then, if the sheep lambs at a date which proves it to have been in lamb at the date of the sale, either the purchaser may return the sheep and her lamb, if any, to the vendor or, at the sole option of the purchaser, the vendor shall pay to the purchaser as and for ascertained and agreed liquidated damages, to cover all expenses, depreciation in value and other damages whatsoever, a sum equal to 25per cent of the purchase price of the sheep. Female Sheep described as Correct 78 All female sheep described in the catalogue or at the time of sale as correct are warranted to be sound in mouth and udder. 79 If any such sheep is proved to be unsound in mouth or udder, that is to say is lacking any of the 8 broad teeth or has damaged or worn teeth or defective udder, and notice of such unsoundness is given by the auctioneers in writing within 5 clear days after the day of sale, supported by a certificate signed by a veterinary surgeon, then either the purchaser may return the sheep to the vendor, or, at the sole option of the purchaser, the vendor shall pay to the purchaser as and for ascertained and agreed liquidated damages, to cover all expenses, depreciation in value and other damages whatsoever, compensation at the rates set out in Appendix 1 (i) to these Conditions. Female Sheep proving Barren 80 If any female sheep, which was described in the catalogue or at the time of sale as being in-lamb, proves not to have been in lamb at the time of sale and within 21 days after the day of sale the purchaser gives written notice to the auctioneers of his intention to return the animal, supported by a veterinary surgeon’s certificate that such sheep has proved not to have been in lamb, then the purchaser may return such sheep to the vendor. [A] RAMS AND RAM LAMBS

[i]

All rams and ram lambs are warranted by the seller capable of natural and effective service WITHIN FOUR CALENDAR MONTHS from the date of the sale (subject to Condition [B] [i] [ii]. If at the expiry of this period (the Male Fertility Guarantee Period) the ram or ram lamb has failed to prove himself capable of natural and effective service and a veterinary surgeon’s certificate that a semen test has been carried out by the artificial vagina method is lodged within the Male Guarantee Period with the auctioneers specifying that ram or ram lamb is so incapable and further that the veterinary surgeon has inspected the buyer’s breeding ewes and found them to be in normal breeding condition and not responsible for the aforementioned incapacity then the buyer may return the animal to the seller.

[ii]

The animal shall be deemed incapable of natural and effective service if it fails to make at least one ewe pregnant during the Male Guarantee Period under natural breeding condition and is so certified as being incapable by veterinary surgeon’s certificate aforementioned.

[iii] The buyer shall throughout the Male Guarantee Period give the animal full and sufficient opportunity to prove that he is capable of natural and effective service.

[iv] The seller will be entitled to take the animal back during the last two months of the Guarantee Period in order to test the animal during that period.

[v]

The Guarantee Period may be extended by the buyer with the consent of the seller where there is reasonable veterinary opinion that the animal may be capable of proving itself capable of getting stock in the second service season in such case any claim hereunder will be deferred until the expiry of sixteen months from date of sale or four months from commencement of the second service season whichever be the earlier.

[B] IT IS HEREBY AGREED THAT

[i]

[ii] death within the respective Guarantee Period voids any liability under this Guarantee unless such infertility has been proven.

[iii] in cases where the seller insures his liability under the Fertility Guarantee, the Insurer shall assume the rights and remedies of the seller under the Guarantee and procedure rules.

incapacity due to injury from whatever cause illness suffered or contracted after the date of sale is not covered by the Guarantee.

EXCEPT THAT Infertility owing to or associated with small or soft testicles will only be accepted as an insurance responsibility where the seller is in possession of a veterinary surgeon’s certificate certifying the normality for age of the animal’s testicle size and consistency at time of sale.

[C] CLAIMS

[i]

All claims for breach of warranty must be made in writing not later than two months from the expiry of the respective Guarantee Period stated above and be forwarded to the auctioneers with a veterinary surgeon’s report containing the information required in Condition (A) (i) above if appropriate.

[ii] All animals not conforming to the Guarantee shall be returnable to the seller who shall refund the purchase price, pay the cost of transport to and from the buyers premises and veterinary fees but is not liable for any other loss sustained by the buyer.

HEALTH AND SAFETY RULES HARRISON & HETHERINGTON LIMITED NOTICE TO ALL VISITORS AND TRADERS PLEASE READ AND OBSERVE THE FOLLOWING All visitors and traders on site will be responsible for ensuring that they and their employees or sub-contractors engaged by them comply with all legal requirements, including the Health and Safety At Work etc., Act 1974, The Management of Health and Safety At Work Regulations, The Provision And Use of Work Equipment Regulations, etc. All visitors and traders will be responsible for ensuring that their operations in no way affect the integrity of the company or its fire, safety or security arrangements and in no way compromise the health and safety and welfare of other visitors to and or employees of Harrison & Hetherington. Although it is the visitors and traders responsibility to ensure that plant, equipment and systems in work are safe, Harrison & Hetherington Limited reserve the right to ask any visitor or trader to leave the market for any breaches in the Health and Safety Rules and/ or Regulations. Vendors must inform Harrison & Hetherington Limited of any livestock due to attend the market whose temperament, behaviour or condition may call for additional precautions for its safe handling. When loading or unloading livestock handlers must ensure that the dock and vehicle gates are securely fixed so as to prevent the escape of animals. Traders are responsible for providing and maintaining suitable livestock handling equipment. They should ensure that livestock handlers are fit, experienced in livestock handling and familiar with the livestock in their charge. Children must not be permitted in any area where they may be at risk from livestock or machinery. In the case of bulls, during the period when the show/sale is open to visitors, bulls in stalls or pens should not be left unattended. If the handler is temporarily absent, arrangements should be made with another vendor, steward or member of Harrison & Hetherington staff to oversee the bull until the handler returns. Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommend that an adult person should accompany any junior person during the showing/sale of livestock in the ring and reserves the right to intervene at any point if, in the companyâ&#x20AC;&#x2122;s opinion, the person showing the livestock is at risk in undertaking that activity. Passageways must be kept clear at all times during the auction sale. PLEASE DO NOT STAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES. The auction ring man escapes and refuges must be kept clear at all times. All portable electrical equipment supplied and/or used by visitors and traders must be safe and fit for the purpose and should have a valid portable appliance test certificate.

AUCTIONEER’S TERMS & CONDITIONS OF SALE (Incorporating the Auctioneer’s Terms and Conditions as recommended by the National Beef Association) 1.

The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’s reserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arise between two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneers may determine the dispute at their own discretion and their decision shall be final. The Auctioneers reserve the right to refuse the bid of any person without being called upon to give reason for such action.

The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediately at the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and a pass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk and expense of the respective purchaser or purchasers thereof and shall be removed from the sale premises at the purchaser’s expense. The right of property shall not pass until the full purchase price is paid.

Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. As a result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cash payments in excess of nine thousand pounds sterling for any any single or linked purchase transaction.

All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correct identification of the animals, are the entire responsibility of the Vendors. The Auctioneers take no personal responsibility for the correctness of such statements or identities.

All statements in the catalogue, or any made by the Auctioneers at the time of sale relating to any veterinary or other tests are to be taken as statements of fact only. No such statements shall guarantee the purchaser of any animal against loss arising from the subsequent reaction of such animal to any test administered after the sale and the Vendors shall not be liable in any way should this occur.

All stock is sold subject to the Conditions of Sale recommended for use at markets by the Livestock Auctioneers’ Markets Committee for England and Wales except in so far as these conflict with any Special Conditions applicable to the sale of pedigree stock, when the latter Conditions shall prevail.

Neither the Vendors nor the Auctioneers will be responsible for any accident or injury to persons or property, through fire or any other cause whatsoever, nor for any damage by animals prior to, during or after the sale.

No undertaking by the Auctioneers or their servants to take charge of any Lot or Lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of these Conditions.

Inasmuch as the Auctioneers act as agents for a disclosed principal they shall not be considered personally responsible for any default on the part of either purchasers or Vendors and the remedy shall be against them only and not against the Auctioneers.

If these conditions are unfulfilled, the Vendors or Auctioneers shall have the power to resell the Lots, retaining any surplus and charging any deficiency and expense to the defaulter.
