HBA OF KENTUCKY SUMMER BOARD RECAP
T
he State HBA Summer Board of Directors meetings were held June 13th through the 15th at the Galt House Hotel in Louisville. The committee meetings were livelier than during the recession as our members across the state remain engaged in several initiatives and face an ever increasing number of regulatory challenges. One such challenge is endangered species involving Indiana Bats and the threatened Northern Long Eared Bat. A good discussion involved the collaboration between your HBA and the BIA of Louisville as we work together to create a Bat Conservation Bank for the Commonwealth; the goal being to eventually repay our developers for areas of new and existing bat habitat that they do not develop, such as hillsides and other wooded greenspaces. More to come on that initiative in a future issue of NKB. The state HBA is currently accepting nominations for its 2017 Senior and National Officers. For many of our members that have been actively engaged at the state level this is an outstanding opportunity to become further involved in our policies and initiatives at that level of our federation. The meetings were attended by some special guests including Randy Noel, Laplace, LA, NAHB’s Second Vice Chair, Alex Martindale, NAHB Field Representative, Ashley Wucher, new NAHB Field Representative, and Julia Bogue, NAHB Federal Legislative Manager. Updates included progress on KY Division of Water’s new Phase II MS4 Stormwater Permit, revisions to the statewide building code, statewide code enforcement efforts, United States Army Corps of Engineers v. Hawkes Co., Inc. (see p. 8), KYOSHA fall protection standard changes (see p. 8), Young Building Professionals formation across the state. The new Commissioner of the Department of Housing, Buildings and Construction, Steve Milby was in attendance for our codes committee meeting and for a small meeting regarding the use of PVC versus cast iron pipes in commercial high-rise structures. The highlight of the meetings was a visit from Governor Matt Bevin. Governor Bevin was extremely gracious with his time and unlike many elected officials spent over an hour answering questions and engaging in dialogue with the members present on a variety of subjects. The Governor agreed with the members on several issues including the use of PVC pipe in high-rise structures, the need for workforce training programs for our industry and went so far as to tell the crowd on hand that if there are any state regulations that are not business friendly to inform him and his staff as they are looking to pair back state regulations that are harming your business. An engaging discussion was had on tax reform; one of the Governor’s top priorities. Quite an encouraging tone indeed. A few items of note…The Hotel Block for the Kentucky delegation for the International Builders Show is the Embassy Suites, Jamaican Court. Rooms should be reserved prior to October, 14, however, we recommend reserving your room much sooner as the show is growing rapidly with the recovering market nationally and the inclusion of the Kitchen and Bath Show and its attendees. Reservations are open as of August 1st. Construction Career Days will be hosted by HBAK at the Shelby County Fairgrounds September 20th -21st. For those interested in solving our workforce development skills gap please make plans to attend and meet the hundreds of high school students from around the state that will visit with HBA members. Make plans to attend HBAK’s Fall Board of Directors meeting a little closer to home. The meetings will be held October 13th and 14th at Belterra Casino Resort & Spa - Florence, Indiana (777 Belterra Dr, Florence, IN). If you are interested in becoming involved at the state level of our federation or are simply curious about what is going on as the HBA’s work to represent you this is an outstanding opportunity to learn and engage. 4

INDUSTRY NEWS Kenton’s One Stop Shop Program moving to electronic plan reviews

enton County plan reviews handled by PDS staff are about to catch up with the technology that produced them in most cases. Beginning this first quarter of Fiscal Year 2017, the agency that handles zoning, platting, and building plans for the vast majority of the county’s jurisdictions is transitioning to electronic plan review. This capability will eventually cover all plans for zoning permits, subdivision platting and infrastructure construction, and buildings. “This has been a goal of ours for the past three or four years,” said Dennis Gordon, PDS executive director. “It’s just seemed like such a waste of resources for developers and builders to create their plans in CAD systems and then to have to reduce all their electronic work to paper so staff here could review them. The amount of paper we recycle from this process is ridiculous.” “Then there’s the transportation costs and the time necessary to get the plans to our office. It’s such a waste of resources when those plans can be sent instantly via the internet,” Gordon said. PDS’ fiscal year began July 1st. Funding for the hardware and software necessary for electronic plan review was included in its budget that was approved last month. PDS’ budgets are subject to approval by elected representatives of each of the County’s 20 jurisdictions. There was never any debate throughout the budget approval process about moving to electronic plan review according to Gordon. The process of transitioning to digital and away from paper will begin soon. PDS staff will need training on the software and large-screen monitors to be able to read the details produced in CAD systems. The software PDS will use will permit reviewers to make comments right on the electronic plans for transmission back to the creators of those plans. “We plan to take this transition slow and easy so as not to overwhelm those submitting plans and staff here reviewing them,” said Gordon. “Our goal is to have all our infrastructure engineering and building staff online with this process by next spring. We’ll move on to our zoning staff then.” There will be a definite learning curve for staff according to Gordon. But, he suggests staff are looking forward to being able to call up the electronic plans in the field through the iPads they use for the inspection process. INDUSTRY NEWS Kentucky OSHA to Change Fall Protection Standards
U
S OSHA has been pressuring states across the country to change their fall protection standards and Kentucky is the latest state to fall in line. Starting January 1st, 2017 the following changes are being made to the Kentucky Administrative Regulations (803 KAR 2:412). • “Platform” will be defined per 29 CFR 1926.450 - a work surface elevated above lower levels. Platforms can be constructed using individual wood planks, fabricated planks, fabricated decks, and fabricated platforms; • Slide guard systems will no longer be allowed; • Any employee working 6 feet or more above the lower level will require protection including guardrail systems, safety netting or personal fall arrest systems. This includes the exterior of structures, residential floor systems, leading edge floor work, roofs, and attic work. The current regulation allows for ten feet. Again, these changes will go into effect on January 1st, 2017. The HBA will provide safety classes this fall that will include courses on the new fall protection guidelines as well as new confined spaces regulations.

U.S. Army Corps of Engineers v. Hawkes Co., Inc.
I
n an unprecedented 8-0 decision the Supreme Court of the United States (SCOTUS) dealt a resounding gut check to the U.S. Army Corps of Engineers (USACOE) on June 1st. Working with NAHB regulatory and legal staff regarding this decision we are able to bring you some good news in the midst of the overwhelming regulatory world our industry and members find ourselves in. The ruling basically says that you can challenge a wetland determination prior to applying for a permit or going through the jurisdictional determination process. Recent changes to the wetland plants list and soil chromatography scales have resulted in a minimum two-year process of mechanical hydrological soil monitoring on many properties. Prior to this ruling you would have to exhaust a receive a permit, follow a multi-year process and spend money on a case that is heard by a kangaroo-court within the USACOE itself, which as you can imagine is not tilted in your favor. What are the outcomes you can expect? 1. USACOE Field representatives will continue to attempt to over claim wetlands (unlikely but possible) 2. USACOE Field representatives will be far more cautious when claiming wetlands (the most likely) 3. Property owners will become more likely to go through the process of developing their property or preparing the same for sale to developers (also likely) What can you do with this case locally? As an outcome of this case we should make an effort to work with the USACOE District office in Louisville to let them know that due to this case courts are going to be far more involved with wetlands claimed by USACOE. As a result, USACOE is opening itself up to two challenges: 1. “Arbitrary and capricious” field determinations where you can claim damages for loss of revenue; 2. USACOE is simply claiming wetlands that aren’t and therefore are operating out of their scope of jurisdiction.
Both challenges open USACOE up for major hurdles that would further hamper their ability to do what they want to do with the CWA and initiate more litigation than what they are dealing with today. It is in their best interest to work with us to, at a minimum, have total unity with regard to how their field representatives interpret wetlands. Perhaps a good option is one that Shad Sletto has maintained is that USACOE simply use lists created by the Commonwealth for wetlands and stream classifications. It is not but a hop, skip and a jump to apply these legal principles to their stream restoration program as well. We applaud the SCOTUS in its opinion that judicial processes should be made available to those in our industry whom find themselves in the unenviable position of challenging the USACOE in a process that can best be described as regulatory extortion. Penalties for OSHA Fines Will Increase Aug. 1
O
n Aug. 1, monetary penalties issued by the Occupational Safety and Health Administration (OSHA) for regulation infractions are slated to rise by up to 150% depending on the type of violation. Last fall, the president signed a budget bill that allowed the agency to enact a catch-up adjustment and raise fines annually in line with the Consumer Price Index (CPI). This marks the first time in 25 years that OSHA fines have gone up. Previously, OSHA was one of few federal agencies with civil penalties that do not increase with inflation.

OSHA intends to provide guidance on the implementation of the new penalties by Aug. 1. Additionally, to address the impact they may have on small businesses, the agency plans to continue providing penalty reductions based on employer size and other factors. States that operate their own Occupational Safety and Health Plans are required to adopt maximum penalty levels that are at least as effective as federal OSHA’s. 8/2016

Today's consumers are more diligent in their research than ever. Not only do they hop online and do research on their computers (and smart phones), but they also take a sensory approach to making decisions about home buying and remodeling. They want to see, hear and touch before making decisions. As HBANKY members strategize and develop marketing plans for today's consumers, the association encourages them to factor in ways to offer those sensory opportunities for their potential customers. The consumer shows locally organized and presented through HBANKY, such as Homefest, Cavalcade of Homes and Tour of Remodeled Homes, provide such opportunities, and with the marketing outreach that comes along with them, it's an easy path for members to reach an audience that is interested and engaged.

BANKY Director of Shows & Events Melanie Meyer explained, "For some of our members, the consumer shows are the only form of advertising they do. The shows really give them a chance to put their product out there, bring people in to see it and talk one-on-one before they make a buying decision. The reason why these shows are so successful is that they give customers a chance to see, feel and touch the products and get to know the builders and suppliers." Meyer explained that consumers can navigate the events by using apps that are especially created for the shows, and that members benefit from the efforts HBANKY makes to promote the events. "Everyone who has a hand in producing the home benefits. The awareness spreads much farther than just the builder or remodeler who built or renovated the home. Anyone who has a product in the homes benefits as well. Whether that's the bank that financed the project, the Realtor who is selling it or the vendors who provided supplies, products and services for it, everyone benefits from being a part of it," she said. Homefest and Cavalcade of Homes Fuel Enthusiasm for Regional Building Industry Two of the most popular consumer events are Homefest and Cavalcade of Homes. Each draw thousands of regional attendees who have an interest in home design, construction and remodeling. Homefest is a celebration of home building held in a designated location each year in August. This year's event runs from August 13-28 in Crown Point in Crestview Hills. Six homes are featured in the 2016 Homefest sponsored by Florida Tile. HBANKY is working hard to get the word out and partner with regional media to draw attention to the 12 day event, which runs Wednesday through Sunday of each week. Promotional events such as Military Appreciation Day, which offers half-off admission for military service members and their guests, and Family Day are designed to reach out to different segments of the community. Ladies Night, Realtor Day and Date Night are also planned. The long-standing Cavalcade of Homes is a free, scattered site event in Northern Kentucky that spans
different areas and prices ranges and is held the first three weekends in May. The tradition of Cavalcade stems from the 1950's and many NKY residents have it marked on their calendars each year. Both of the events are strategically scheduled and planned to spark interest and build upon momentum of home buying patterns. Tour of Remodeled Homes Planned for 2017 After a couple years off the calendar, the popular Tour of Remodeled Homes event is being planned for the first weekend in October of 2017. HBA staff is jump-starting outreach to its remodeler members in an effort to get commitments sooner than later, so the 2017 event can gain a lot of traction in promotion and awareness within the community. Gauging previous attendance throughout the years, the 2017 event is anticipated to draw approximately 4,000 people. The Tour of Remodeled Homes is an ideal companion event to Homefest and Cavalcade of Homes. Meyer said that many of the attendees of those two events are seeking ideas of how to modernize their current homes, and when they have a chance to see actual transformation of existing homes, it brings them closer to imagining their own projects coming to life. The 2017 event is planned for Noon to 5 p.m. Saturday and Sunday, October 7 and 8, 2017. Anyone interested in participating is asked to contact Melanie Meyer at the HBANKY office at 859-331-9500. Participants Share What Makes Consumer Shows Valuable to Them The consumer shows offer opportunities for companies of all sizes. They are great ways to demonstrate the uniqueness and talents of the Northern Kentucky building community and the strength of members coming together to showcase their products. Events like these demonstrate to the community that the building industry in Northern Kentucky is vibrant, growing and strong in numbers. The intention, of course, is for builders to sell homes and suppliers and vendors to achieve more awareness for their products and services, however, the end result of demonstrating a strong, healthy building industry through these events is of value to every member, large, small or somewhere in between. 8/2016

Jim Cutter, Cutter Construction, said his company has participated in the HBA's consumer shows every year for more than 20 years. "We, as a company, see great value in participating because we are able to market our product and workmanship, and it's good for our vendors and subcontractors as well. It's a great way to expose our company and partners to the general public," he said. Cutter explained that the events are also good for consumers, "From a consumer standpoint, it's a great opportunity. They get to go through these properties at their own leisure with no pressure and get ideas on new construction, decorating, state-of-the-art products and trends." He acknowledged that not every consumer who attends is in the market to buy a home, however, it only takes a small percentage of attendees to act to make it a success for those who participate. "I see these shows mostly as an exposure opportunity for our company and our suppliers to market ourselves and answer a lot of questions. You don't need a high percentage of success to pay for participating. If you get one or two projects a year from it, then the investment is worth it," he added. Cutter said that his company is on board with participating in the next Tour of Remodeled Homes. Adam Miller, Adam Miller Homes, noted that his company participates on a regular basis, "These home shows really give us a chance to create those 'ooh's and aahh's' that will stay in the consumers' minds for years to come. I have been getting business from the home shows for the past four years." Miller said that many clients are familiar faces who look for his homes each year. He's currently working with clients who first toured one of his home sites four years ago. "We love these shows because we can also demonstrate to consumers what can be done creatively to make a home awesome. For example, last year we put an indoor herb garden in the pantry. The reactions from show attendees were priceless! We like to participate in the home shows with the HBA because it gives us great exposure to the public and a chance to market ourselves to potential buyers and meet them face-to-face," he added. "This year’s Cavalcade of Homes was a huge success for the Drees Company," Mike Conklin, Drees Homes, said. "We had several model homes entered in this year’s show and our consumer traffic was tremendous. The HBA staff works extremely hard to organize and market this event for its membership. They do a terrific job, and 16

based upon our show traffic, it was a complete success." Conklin said that the company routinely participates in Homefest and Cavalcade not only to support the efforts of the association, but to showcase the efforts of their suppliers and trade partners. "Involvement in these types of HBAsponsored events is very important to its members," he added. Gus McKinley, Gustin Construction, is participating in the upcoming Homefest and believes these types of consumer events are important for the local industry. "You can tell that these shows are becoming more like what they used to be before the recession. It's important for consumers to realize the recession is in our past and this helps demonstrate that. We want them to continue to grow more and more comfortable about spending the money in home products," he explained. McKinley said that the presence of builders at the shows is an invaluable experience for both the builders and consumers. "When a builder is there, it's obvious they care about their product and take pride in what they're doing. More importantly, it demonstrates that the builder understands the clients' needs and cares about them," he added. McKinley has also participated in a previous Tour of Remodeled homes and is excited about entering a project in the next event. Kevin Krumpelman, Krumpelman Builders, explained why his company participates in the consumer shows. "We've benefited greatly over the years through these shows. With the nature of our business, showing our product is important. Being able to walk into a custom home and see the quality of finishes that goes into building it is very valuable for us. I can track back numerous jobs that have come from a show. We've had people come to us years later after seeing a home and ask for something similar. In one case, it was eight years later and we built a smaller version of the home for the client. We've done both the Homefest and Cavalcade and try to have a house in either show when it's at all possible." SD1’s 2017 Budget and the Need to Draft a Long Range Plan By Brian Miller, HBA Executive Vice President
F
ar too often we find out that many of our members don’t understand the impact of our advocacy services. Ask yourself…"how many windows have I sold in Hebron, Tree Tops, Thornwilde, North Pointe, Around the Richwood exit? In Triple Crown, in Steeplechase? How many office parks have I paved there? Glazed their windows? Moved the dirt for them to build? How many homes have I framed there? How many homes have I wired? Written mortgages for? How many homes have I sold there? How many lawns have I installed?” NOW TAKE ALL OF THAT AWAY!!! THAT…is what HBA’s advocacy services do and have done for you. Advocacy services may not be sexy, they may be technical and land use policy may be an uncomfortable, at times mean-spirited, long range, soul-grinding and difficult to comprehend animal to grapple with but know this…without these services you can find another industry to work in. It is that simple…PERIOD! Is this a long article? Yes. Should it be? I don’t know. But I do know that dozens of your fellow members work tirelessly behind the scenes to keep development and building going in Northern Kentucky. If you know who they are, thank them for your job. The HBA is represented at every SD1 Board of Directors meeting. I attend almost all meetings; many times with your fellow members and many times alone. Sewer availability and stormwater regulations have become such a big impact upon your business that members of our Land Development Council, Commercial Council and all Registered Builders feel that it is integrally important for us to attend these meetings and provide feedback to the Board of Directors and SD1 staff. Most of the time we provide good information and take notes so that your fellow members can review what is going on to provide future feedback. We take that information back to our office, research what is happening, consult with experts, constantly learn and go back to the staff and Board of Directors to help shape land use policy. At times it can get contentious but the majority of the time it is not. The current Board of Directors at SD1 has done the best job in recent history working through their budget, including regional stakeholders, like the HBA, and making cuts and investments that will help the financial position of the agency and spur economic benefits in the future. Throughout this last process the SD1 Board of Directors held five public meetings to review the budget. During that process it became readily apparent that while SD1 has many good staff serving the agency and providing sanitary sewer and stormwater services for our community 20

at large, there are some who have agendas that may harm the economic vibrancy of Northern Kentucky. We hope that changes. The SD1 Board of Directors covered operations and maintenance, stormwater systems, debt service, Capital Programs and Capital Projects throughout their series of meetings. In the past the District has borrowed a significant amount of money to construct the Western and Eastern Regional Treatment Plants, and the tunnel through Boone County. As a result, the agency is paying close to half of its budget into debt service every year. As if that was not enough, the mandates of the consent decree, once to be thought at costs of $850 million; now estimated at over $2 billion in the coming years. The current dictate of the decree mandates completion of consent decree projects by the year 2025; a date unattainable. Due to these two issues and other factors the district is under intense scrutiny for a limited amount of resources. These issues are only confounded by the fact that the agency has taken over the stormwater systems from much of Northern Kentucky’s municipalities. It should be noted that the majority of these municipalities, particularly in Kenton County, have not done their job to maintain the stormwater systems prior to turning them over to SD1, and thus they are in a severe state of disrepair. Ironically enough, many of the elected officials and staff of these municipalities are now blaming SD1 for their flooding and stormwater issues and attempting to pull money from the agency at the cost of most other areas of Northern Kentucky including your industry. Hmmm…I don’t remember them lowering taxes for their residents and businesses as a result of walking away from a failing situation they created. The HBA took a formal position this spring, by a unanimous HBA Board of Directors Resolution, that SD1 should budget $15 million in growth funds each year. While not attainable in the SD1 2017 budget, beginning July 1, 2016, it needs to be a mid-range goal of the utility in the not too distant future. For over three years now the Hebron area North of I-275 has been shut down to new growth other than what sanitary sewer had been reserved previously. Due to the hard work of the HBA and your fellow members we expect Hebron to open very soon thanks to a bailout for SD1 by the Boone County Fiscal Court and potential alternative funding sources on behalf of the development community. These talks are ongoing at press time. We will update you as soon as we can on this matter. Leading up to the SD1 Budget approval by their Board of Directors we believed we were in the best place we could be in regards to reopening Hebron. The SD1 Board of Directors is prioritizing consent decree projects that protect public health but also bring new rate payers into the system to address the ailing budget woes at the agency. For instance, an SD1 staff

How many lawns have I installed?” study stated that within the buildout cycle of the Hebron area the growth occurring there will create a net $70 million back to the agency. A lot of consent decree projects can be done with $70 million; so too maintenance repair and replacement of the existing system. About thirty dedicated members accompanied us to SD1 on July 21st and were pleasantly surprised when the budget summary review went smoothly, taking approximately fifteen minutes to achieve and for the SD1 Board of Directors to take a unanimous vote of approval. After our members left, I stayed behind to continue to monitor the agency. Three agenda items into the regular Board of Directors meeting and the SD1 Board of Directors and the HBA learned at the same time that four capacity reservations were coming to the Board of Directors that would shut down the Richwood Road pump station to any growth; impacting all surrounding neighborhoods such as Triple Crown, Steeplechase and many others, and large commercial and industrial projects, thereby grinding the engine of Northern Kentucky’s growth economy to a halt. This also caught the Judges Executive off guard. My phone call to them was the first they have heard of this possibility. We have a planning and communication problem. If this was known and divulged in a timely fashion to the SD1 Board of Directors and Judges Executive, it could have been well planned and the issue worked through. From January through July it never came up. This is a problem. I cannot begin to express the frustration of the HBA and of the SD1 Board members we have spoken to with regard to this debacle. We have addressed this with the agency, the Judges Executive and other local leaders that NOW is the time to begin a planning process for the agency. The district has been in constant reactive mode and it is not productive. We need to map a future using growth and the net benefits of growth to not only grow more but to be good stewards of the system for all of Northern Kentucky. There will never be enough money to take care of the urban areas and the first ring suburbs if not for growth. Luckily at the eleventh hour the Judges Executive agreed that the specific issue regarding the shuttering of Richwood to growth was an immediate need. The area serviced by the pump station is allowing companies to expand that are literally bringing thousands of jobs in the very near future; jobs that need a home to call their own. During their approval process they pulled $2 plus million out of the SD1 reserves that are overfunded $9 million past their Board of Directors policy to provide an immediate fix. This fix is in two phases. First, two pumps will be upsized to very large variable speed pumps. This will open up a thousand homes. Second, with these two pumps operating another third large pump will be installed coupled with other structures opening up a second
thousand homes in the area. That being said, we are seeing commercial and industrial investment pickup in Northern Kentucky; particularly around the Richwood area; putting potential capacity at a scarcity again. A long term fix for the Richwood area will likely be in the tens of millions. In fact, commercial reinvestment into existing structures is at an all-time high. More on that in coming editions of the NKB. The Judges Executive also agreed that we need to work on a long range plan for the utility. Many things can affect the capacity of sewers including growth, failures, political agendas, and federal regulations. We need a plan NOW to set a course for the agency. At press time, the SD1 Board of Directors is working to find a permanent full-time Executive Director. We wish them well in the endeavor so we can begin to clean up the mess. We often hear that the existing customer is suffering at the hand of growth. In fact, it is the opposite. According to an analysis of the numbers it would cost Covington residents an additional $3 thousand per year if they were to cover their own maintenance, repair and replacement of the systems in their city and that doesn’t cover consent decree projects or handling the long range issues with their combined sewer/stormwater system. Over $22 million has been spent in recent years in sewer repairs alone, not even accounting for the stormwater system repairs and replacement that have gone long overlooked by the city prior to gladly handing their deteriorated system over to SD1. So how do the numbers shake out? The following is a summary of prior year approved capital projects to be spent in 2017, the sanitary capital programs spend for maintenance of the existing sanitary system and newly budgeted capital projects that are receiving first approval in FY 17: Total Sanitary Capital Budgets Maintenance of Existing Systems Consent Decree Projects Expansion for New Customers

Also, portions of the project budgeted approval can land on future years so the actual spending in a given year is not in agreement with the budget. Here’s the actual spend for 2017:

With Hebron alone paying SD1 a new positive $70 million over thirty years according to SD1 staff this is a great funding source to move forward in a balanced approach. The numbers speak for themselves. Even though some of the consent decree funding allows for new structures to be built it is by no means the most desirable investment the industry would like to see but it is the best we have with what is in front of us today. We thank the SD1 Board of Directors, our members who have dedicated years of their lives to your industry, and the Judges Executive who have had to make hard decisions to keep the economic engine of Northern Kentucky going. We wish the SD1 Board well as they continue to negotiate the consent decree and in hopes they find an Executive Director equipped with turning the agency around.
