The Government of Indonesia has requested to buy eight (8) MV-22 Block C Osprey aircraft. Also included are twenty-four (24) AE 1107C Rolls Royce Engines; twenty (20) AN/AAQ-27 Forward Looking InfraRed Radars; twenty (20) AN/AAR-47 Missile Warning Systems; twenty (20) AN/APR-39 Radar Warning Receivers; twenty (20) AN/ALE-47 Countermeasure Dispenser Systems; twenty (20) AN/APX-117 Identification Friend or Foe Systems (IFF); twenty (20) AN/APN-194 Radar Altimeters; twenty (20) AN/ARN-147 VHF OmniDirectional Range (VOR) Instrument Landing System (ILS) Beacon Navigation Systems; forty (40) ARC-210 629F-23 Multi-Band Radios (Non-COMSEC); twenty (20) AN/ASN-163 Miniature Airborne Global Positioning System (GPS) Receivers (MAGR); twenty (20) AN/ARN-153 Tactical Airborne Navigation Systems; twenty (20) Traffic Collision Avoidance Systems (TCAS II); twenty (20) M-240-D 7.64mm Machine Guns; twenty (20) GAU-21 Machine Guns; Joint Mission Planning Systems (JMPS) with unique planning components; publications and technical documentation; aircraft spares and repair parts; repair and return; aircraft ferry services; tanker support; support and test equipment; personnel training and training equipment; software; U.S. Government and contractor engineering, logistics, and technical support services; and other elements of technical and program support. The estimated total cost is $2.0 billion. This proposed sale will support the foreign policy goals and national security objectives of the United States by improving the security of an important regional partner that is a force for political stability, and economic progress in the Asia-Pacific region. It is vital to U.S. national interest to assist Indonesia in developing and maintaining a strong and effective self-defense capability. The proposed sale of aircraft and support will enhance Indonesia’s humanitarian and disaster relief capabilities and support amphibious operations. This sale will promote burden sharing and interoperability with U.S. Forces. Indonesia is not expected to have any difficulties absorbing these aircraft into its armed forces. The proposed sale of this equipment and support will not alter the basic military balance in the region. The prime contractors will be Bell Textron Inc., Amarillo, Texas and The Boeing Company, Ridley Park, Pennsylvania. There are no known offset agreements proposed in connection with this potential sale. Implementation of this proposed sale will require travel by the U.S. Government personnel and contractor representatives to Indonesia on a temporary basis to provide program technical support and program management oversight. There will be no adverse impact on U.S. defense readiness as a result of this proposed sale. This notice of a potential sale is required by law and does not mean the sale has been concluded. The Government of France requests to buy three (3) E-2D Advanced Hawkeye Aircraft, ten (10) T-56-427A engines (6 installed and 4 spares), three (3) AN/APY-9 radar assemblies, four (4) AN/ALQ-217 electronic support measure systems (3 installed and 1 spare), three (3) AN/AYK-27 Integrated Navigation Channels and Display Systems, five (5) Link-16 (MIDS-JTRS) Communications Systems (3 installed and 2 spares), ten (10) Embedded GPS/INS (EGI) Devices (6 installed and 4 spares), four (4) AN/APX122(A) and AN/APX-123(A) Identification, Friend or Foe systems (3 installed and 1 spare) and one (1) Joint Mission Planning System. Also included are Common Systems Integration Laboratories with/Test Equipment, one in Melbourne, FL, and the other in France; air and ground crew equipment; support equipment; spare and repair parts; publications and technical documentation; transportation; training and training equipment; U.S. Government and contractor logistics, engineering, and technical support services; and other related elements of logistics and program support. The total estimated program cost is $2 billion. This proposed sale will support the foreign policy and national security of the United States by helping to improve security of a NATO ally which is an important force for political stability and economic progress in Europe. The proposed sale will improve France’s capability to meet current and future threats by providing its Naval Air Forces with a sustainable follow on capability to their current, legacy E-2C Hawkeye aircraft. The E-2D aircraft will continue and expand French naval aviation capabilities and maintain interoperability with U.S. naval forces. As a current E-2C operator, France will have no difficulty absorbing this equipment and support into its armed forces. The proposed sale of this equipment and support will not alter the basic military balance in the region. The principal contractor will be Northrop Grumman Systems Corp, Aerospace Systems, Melbourne, FL. There are no known offset agreements proposed in connection with this potential sale. The proposed sale of these UH-60 helicopters to Lithuania will significantly increase its capability to provide troop lift, border security, anti-terrorist, medical evacuation, search and rescue, re-supply/external lift, combat support in all weather. These UH60 helicopters will allow for interoperability with U.S. and NATO forces in rapid response to a variety of missions and quick positioning of troops with minimal helicopter assets. Lithuania intends to use these defense articles and services to modernize and expand its armed forces to provide multi-mission support in its region and combat terrorism threats. Lithuania will have no difficulty absorbing these helicopters into its armed forces. The proposed sale of this equipment will not alter the basic military balance in the region. The principal contractors will be Sikorsky Aircraft Company, Stratford, CT; and General Electric Aircraft Company (GEAC) in Lynn, MA. There are no known offset agreements in connection with this potential sale. Also included are AN/VAS-5 Driver’s Vision Enhancers; AN/VIC-3 Vehicle Intercom Systems; AN/VRC-91E Single Channel Ground and Airborne Radio System (SINCGARS); Basic Issue Items (BIi); Components of End Items (COEI); Additional Authorized List (AAL); Special Tools and Test Equipment (STTE); M6 Smoke Grenade launchers and associated spares; Outside Continental United States (OCONUS) Deprocessing Service; OCONUS Contractor-provided training; Field Service Representatives (FSR); technical manuals; spare parts; U.S. Government and contractor engineering, technical, and logistics support services; and other related elements of logistical and program support. The total estimated program cost is $100 million. This proposed sale will support the foreign policy goals and national security objectives of the United States by improving the security of a Major Non-NATO Ally that is a strategic partner in South America. The proposed sale will improve Argentina’s capability to meet current and future threats by increasing operational capabilities and force availability. Argentina will use the Stryker vehicles to conduct stability operations in support of disaster relief and international peace keeping obligations. Argentina will have no difficulty absorbing these vehicles into its armed forces. The proposed sale of this equipment will not alter the basic military balance in the region. The State Department has made a determination approving a possible Foreign Military Sale to the Government of Israel of approximately 990 million gallons of Petroleumbased products for an estimated cost of $3 billion. The Defense Security Cooperation Agency delivered the required certification notifying Congress of this possible sale today. The Government of Israel has requested to buy approximately 990 million gallons of Petroleum-based products, to include JP-8 Aviation Fuel, Diesel Fuel, and Unleaded Gasoline. The total estimated cost is $3 billion. The United States is committed to the security of Israel, and it is vital to U.S. national interests to assist Israel to develop and maintain a strong and ready self-defense capability. This proposed sale is consistent with those objectives. The proposed sale of the JP-8 aviation fuel will enable Israel to maintain operational aircraft. Diesel fuel and unleaded gasoline will be used for ground vehicles. The proposed sale will improve Israel’s ability to meet current and future threats in order to defend its borders. The proposed sale of this equipment and support will not alter the basic military balance in the region. U.S. vendors will be selected using a competitive bid process through Defense Logistics Agency Energy for supply source(s). The use of Walter grades WJ30EL and WJ30ER specifically for micro drills ensures that the drills exhibit superior wear resistance. In addition, new cutting-edge geometry increases process reliability and optimized dimensions allow for maximum stability, even with the smallest drills. The uniform finish on the drill cutting edges and tight tolerances ensure excellent surface finish of drilled holes. With the special flute geometry, the chips (swarf) are evacuated effectively. Hole depths of up to 12 x Dc can be easily achieved. Oil or emulsion can both be used as a coolant with these drills. EUROPA The transfer directive Directive 2009/43/EC on intra-EU transfers of defence-related products aims at simplifying the terms and conditions for transfers of defence-related products within the EU. The European defence market being fragmented and differing on national approaches has caused many problems for the European defence industry in general, and for small and medium-sized enterprises (SMEs) in particular. For example, national systems to control the transfer of defence equipment did not distinguish between exports to nonEU countries and transfers between EU countries. Different national licensing regimes also imposed burdensome administrative procedures, while hampering the security of supply between EU countries. The Transfer Directive 2009/43/EC diminishes these obstacles, progressing towards a genuine European market for defence equipment, without sacrificing EU countries' control over their essential defence and security interests. It introduced a partially new licensing system differentiating between and rationalising the use of general, global, and individual licenses. • Furthermore, it encourages EU countries to replace, as far as possible, the use of individual licenses with general licenses for unproblematic intra-EU transfers; additionally, general licences are applied where the unauthorised risk of reexportation to non-EU countries is strictly controlled. This includes purchases by armed forces from other EU countries and transfers of components in the context of industrial cooperation to companies certified in accordance with Article 9 of the directive. • The remaining intra-EU transfers group multiple transfers to several recipients by one supplier. The established licensing system aims at rendering individual licenses the exception. EU countries remain free to determine the products eligible for the different types of licenses and to fix the terms and conditions of such licenses. To help harmonise the licences, the Commission in cooperation with EU countries developed recommendations. Page 32 of 47


Article 9 on certification and the register of the certified defence-related enterprises CERTIDER Article 9 of the transfer directive lays down the general principles for the certification of defence undertakings in the EU. The certification granted at the national level is designed to testify to the special ability of defence undertakings to receive defencerelated products and, where appropriate, to respect all the conditions attached to those products, such as end-use and end-user conditions. The European Commission provides information about the certified recipients of defence-related products and makes them publicly available through CERTIDER, the central EU register of certified undertakings. As certificates have to be mutually recognised by EU countries, the European Commission also supplied the national authorities with common certification guidelines in January 2011. La data de 02 iulie 2020 Președintele României a promulgat propunerea legislativă pentru modificarea Legii 31/1990 privind societățile care prevede, printre altele, eliminarea restricțiilor cu privire la asociatul unic. Modificările vor intra în vigoare începând cu data de 5 iulie 2020. Eliminarea restricțiilor cu privire la asociatul unic Este una dintre cele mai importante prevederi. Astfel, a fost abrogat art. 14 din Legea 31/1990 care prevedea că o persoană fizica sau juridică nu poate fi asociat unic decât într-o singura societate cu răspundere limitata (SRL), respectiv că un SRL nu poate avea ca asociat unic un alt SRL, alcătuit dintr-o singură persoană. Această modificare va intra in vigoare la data 05 iulie 2020. Inițiatorii acestui proiect de act normativ (devenit Legea 102/2020) au urmărit – astfel cum rezultă din expunerea de motive – accelerarea procesului de înmatriculare a noilor societăți și implicit stimularea inițiativelor antreprenoriale. Remarcăm de asemenea că aceste modificări aduc o serie de alte beneficii așteptate de mediul de afaceri cum sunt: • Simplificarea structurilor grupurilor de societăți: este instituită indirect posibilitatea grupurilor de societăți de a asigura controlul printr-o singura societate – de tip holding. Astfel, începând cu data de 05 iulie 2020, societățile de tip holding vor putea deține calitatea de asociat unic in toate societățile din grup, fără a mai fi necesară asigurarea unor dețineri minoritare de către societăți din același grup (în prezent, cel puțin o parte socială a societăților din grup trebuie să fie deținută de către altă persoană, pentru a se asigura respectarea restricțiilor cu privire la asociatul unic). Cu titlu exemplificativ, redam mai jos o structură de tip holding care va putea fi implementată începând cu 05 iulie 2020:

Indonesia has been touted as the most attractive defence market in Southeast Asia as it deals with terrorism, illegal fishing, piracy, drug smuggling and other crimes. Indonesia is aiming to meet its own defence needs and not be reliant on other countries for military equipment by 2029. The biggest economy in Southeast Asia set up a coordinating committee in 2010 to create a master plan to develop its defence industry. In 2012, the government also issued a supporting law. However, in the defense industry, the work has typically marched on at home or payments continued to be made thanks to the CARES Act. Within the DoD, employees are returning to workplaces for 40-60% of their time, finishing the remainder of work from home. LAYOFFS IMPACTING THE DEFENSE INDUSTRY Sumaria Systems By August 31, Sumaria Systems plans to layoff 72 employees who are based at Wright-Patterson AFB. Sumaria Systems is a Danvers, MA-based organization, which is a female-owned information technology, engineering and professional services company. On May 1, Sumaria Systems won seats on the team of firms that received a five-year $75 million-plus contract to support the Air Force ISR Sensors and FMS division at Wright-Patterson AFB, as well as Langley, Gunter, and Eglin AFBs. Without an authorization of emergency funding from Congress, the agency will need to furlough 70% of its workforce, beginning August 3. Am avut o intrevedere cu E.S. Michèle Ramis ambasadorul Republicii Franceze la București. Temele abordate au vizat direcțiile cele mai importante ale cooperării bilaterale, în special investițiile franceze în domeniul industriei de apărare. Partea franceză a apreciat măsurile întreprinse de guvernul român pentru atenuarea efectelor crizei generate de pandemie, precum și deschiderea arătată pentru susținerea investițiilor franceze în țara noastră.
