Commissioner’s Regulations Part 154 establishes the legal requirements for the education of English Language Learners in New York State. NYSED’s Board of Regents has approved new requirements of schools and school districts that are to be fully in effect as of the 2015-2016 school year.
Why the need for change? O Over the past 10 years, New York State English

Language Learner (ELL) enrollment has increased by 20%. Currently, throughout NYS, ELLs make up 8.9% of the total school population. Throughout NYS there are over 140 languages spoken. For 61.5%, Spanish is the home language. 41.2% were born in another country.

English as a Second Language

Initial Screening Process: Home Language Questionnaire, initial interview with ESL teacher, NYSITELL screening, proficiency level determination, notification sent to parents/guardians
*Current Regulations do not define the qualifications of staff required to administer the identification process.
New Regulations English as a New Language O No change; however districts are required to retain records indicating parents’ preferred language. Therefore, all notifications sent home will be communicated in stated preferred language. O
*Screening process by qualified personnel: ESL or Bilingual education teacher. (No change for HHH)
Bilingual Education Program Placement Current Regulations O

Each school district with 20 or more ELL students per individual building of the same grade who speak the same home language are to be provided a Bilingual education program. School Districts are not required to provide an annual estimate of ELL enrollment.
New Regulations O
O
Each school district with 20 or more ELL students of the same grade level district-wide (not per individual building) who speak the same home language will be provided a Bilingual Education program. School districts are required to annually estimate ELL enrollment before the end of each school year, and create a sufficient number of BE programs in the district, if applicable.
ESL Program Requirements Current Regulations O Current regulations require school districts to provide ESL instruction through a Stand-Alone model only. O Elementary = pull-out O Secondary = in child’s daily period by period schedule
New Regulations O ENL instruction will be
offered through two settings: O Stand-Alone ENL (ENL instruction with an ESL teacher). O Integrated ENL/ELA (ESL methodologies cotaught or individually taught by a dually certified teacher).
Current ESL program requirements per proficiency level O Proficiency Level Breakdown as a Result of the NYSESLAT
(NYS English as a Second Language Achievement Test) Four Proficiency levels: O Beginner (K-8 = 2 units of study/ 9-12 = 3 units) O Intermediate (K-12 = 2 units O Advanced (K-12 = 1 unit of study) O Proficient = exit program, but entitled to support services up to two years after exiting. (i.e. translation services, extended time on state exams, etc.) *One unit of study = 180 minutes per week
