ESL PROGRAM All English as a Second Language (ESL) teachers are TESOL-trained professionals with many years’ experience in supporting students in their mastery of English, and successful integration into Australian education. At Hillcrest, ESL is offered as a timetabled subject with the same hours of study as mainstream subjects: 5 x 40 minute lessons each week in the Senior Learning Community (Years 7—12), and a total of 300 minutes of lessons for the Junior Learning Community (Prep— Year 6). Our international students are placed into one of the four ESL classes, depending on their needs, to ensure they receive the most appropriate ESL support: • Primary Integration ESL Program • Junior Low Intermediate Program (ESLA) • Intermediate Program (ESLB) • Senior Advanced The aim of our ESL Program is to prepare students to be successful in mainstream classes as soon as possible. Students with more advanced English language skills may move to the mainstream course without ESL support. To do this they will be required to provide proof of achieving a minimum IELTS score of 6 in all areas.


JUMPSTART ACADEMIC SUCCESS PROGRAM We understand the importance of giving our international students the extra support they need to successfully complete assessment tasks in mainstream subjects, so at Hillcrest we offer the Jumpstart Academic Success Program at no additional cost. Jumpstart provides Years 7—12 international students with additional assistance in their homework tasks, assignments and exam preparation, and includes: •

*It is very important for parents to understand that Hillcrest Christian College needs to have full details of any medical or psychological condition that requires medication or medical supervision, and any learning difficulties or special needs a student may have. Hillcrest Christian College will issue a CoE (and CAAW if applicable) on receipt of the signed written agreement and initial fees. Please advise the College of the payment transaction details, including how and when fees will be paid

COMPLIANCE WITH ESOS AND 2018 NATIONAL CODE OF PRACTICE 2018 NATIONAL CODE OF PRACTICE


The National Code of Practice for Providers of Education and Training to Overseas Students 2018 came into effect on 1 January 2018. As an agent engaged by Hillcrest Christian College, you (and your staff or any sub-agents connected to your agency) are expected be familiar with all requirements of the National Code of Practice for Providers of Education and Training to Overseas Students 2018, and to understand the implications of these requirements in your interactions with intending and current students and their parents. STANDARD 4 of the 2018 National Code specifically relates to Education Agents. The requirements of Standard 4 are: 4.1 The registered provider must enter into a written agreement with each education agent it engages to formally represent it, and enter and maintain the education agent’s details in PRISMS. 4.2 The written agreement must outline: 4.2.1 the responsibilities of the registered provider, including that the registered provider is responsible at all times for compliance with the ESOS Act and National Code 2018 4.2.2 the registered provider ’s requirements of the agent in representing the registered provider as outlined in Standard 4.3 4.2.3 the registered provider ’s processes for monitoring the activities of the education agent in representing the provider, and ensuring the education agent is giving students accurate and up-todate information on the registered provider ’s services 4.2.4 the corrective action that may be taken by the registered provider if the education agent does not

comply with its obligations under the written agreement including providing for corrective action outlined in Standard 4.4 4.2.5 the registered provider ’s grounds for termination of the registered provider ’s written agreement with the education agent, including providing for termination in the circumstances outlined in Standard 4.5 4.2.6 the circumstances under which information about the education agent may be disclosed by the registered provider and the Commonwealth or state or territory agencies. 4.3 A registered provider must require its education agent to: 4.3.1 declare in writing and take reasonable steps to avoid conflicts of interests with its duties as an education agent of the registered provider 4.3.2 observe appropriate levels of confidentiality and transparency in their dealings with overseas students or intending overseas students 4.3.3 act honestly and in good faith, and in the best interests of the student 4.3.4 have appropriate knowledge and understanding of the international education system in Australia, including the Australian International education and Training Agent Code of Ethics. 4.4 Where the registered provider becomes aware that, or has reason to believe, the education agent or an employee or subcontractor of that education agent has not complied with the education agent’s responsibilities under

standards 4.2 and 4.3, the registered provider must take immediate corrective action. 4.5 Where the registered provider becomes aware, or has reason to believe, that the education agent or an employee or subcontractor of the education agent is engaging in false or misleading recruitment practices, the registered provider must immediately terminate its relationship with the education agent, or require the education agent to terminate its relationship with the employee or subcontractor who engaged in those practices. 4.6 The registered provider must not accept students from an education agent if it knows or reasonably suspects the education agent to be: 4.6.1 providing migration advice, unless that education agent is authorised to do so under the Migration Act 4.6.2 engaged in, or to have previously engaged in, dishonest recruitment practices, including the deliberate attempt to recruit a student where this clearly conflicts with the obligations of registered providers under Standard 7 (Overseas student transfers) 4.6.3 facilitating the enrolment of a student who the education agent believes will not comply with the conditions of his or her visa 4.6.4 using PRISMS to create CoEs for other than bona fide students. Under the Education Services for Overseas Students Act 2000 (the ESOS Act) providers of education to overseas students are required to meet certain standards as are any education agents with whom the provider has entered into an agency agreement.

Promote Hillcrest Christian College and its courses in the countries/ regions specified in 1.c.

ii.

Recruit and assist in the recruitment of prospective students to undertake courses at Hillcrest Christian College in accordance with the policies of Hillcrest Christian College

iii. Provide prospective students with any necessary information required under the ESOS Act including information about the courses, facilities and services of Hillcrest Christian College

2.

ENGAGEMENT OF THE AGENT

a)

Hillcrest Christian College engages the Agent to recruit suitable prospective students in the countries specified in 1.C for the term of the agreement.

b)

This is a non-exclusive agreement. Hillcrest Christian College may appoint other agents in the countries/regions specified in 1.c.

c)

This agreement is only for the countries/ regions as listed above. If the Agent wishes to expand its services to other countries/ regions, this can only be done with the consent of Hillcrest Christian College and amending the agency agreement.

In performing these services, the Agent must: i.

Promote Hillcrest Christian College with integrity and accuracy and recruit prospective students in an honest and ethical manner

Observe appropriate levels of confidentiality and transparency in dealings with overseas students or intending overseas students

iii. Act honestly and in good faith, and in the best interests of the student


iv.

Inform prospective students accurately about the requirements of Hillcrest Christian College using only up-to-date material provided or approved by the College

v.

Take reasonable steps to confirm the accuracy of information provided by prospective students in the application

vi.

Ensure that only signed and fully completed applications are submitted to Hillcrest Christian College

vii. Ensure that relevant supporting documentation accompany each application and acceptance of offer documents

i.

Engage in false or misleading advertising or recruitment practices including misleading comparisons with any other education provider or their courses or inaccurate claims regarding any association between Hillcrest Christian College and any other education provider

ii.

Facilitate applications by students who do not meet the visa criteria or make any guarantees about the likelihood of obtaining a student visa

iii. Give false or misleading information relating to course fees payable or acceptance into a course iv.

Deduct any fees from the amount payable by the student to Hillcrest Christian College

v.

Commit Hillcrest Christian College to accept any prospective student into a course

vi.

Use or access PRISMS without the prior written consent of Hillcrest Christian College

E L P M SA viii. Provide any offer documents received from Hillcrest Christian College to the prospective student within 24 hours of receiving the offer documents ix.

c)

Only undertake promotional and marketing activities involving Hillcrest Christian College that have been approved by Hillcrest Christian College

As per the requirements of the ESOS Act, the Agent must not engage in dishonest practices, including: i.

Recruiting or attempting to recruit a student currently studying with another Australian education provider

ii.

Suggesting that a student come to Australia on a student visa for any reason other than for full time study

iii. Facilitate the enrolment of students who the Agent believes will not comply with the conditions of their student visa

d)

iv.

Use PRISMS to create a CoE for other than bona fide students, or

v.

Provide prospective students with immigration advice unless the agent is a separately registered migration agent (Migration Act 1958).

In addition to 3.c the Agent must not:

vii. Recruit or attempt to recruit a prospective student who the agent knows to have engaged the services of another representative of Hillcrest Christian College

viii. Sign or encourage others to sign official documents, such as the application form, on behalf of the prospective student unless the student is under 18 years of age and that person is the prospective students parent(s)/ legal guardian ix.

Submit an application to Hillcrest Christian College on behalf of a student if the Agent is aware the prospective student has applied to other education providers, without also advising Hillcrest Christian College of this circumstance.

Submit an application to Hillcrest Christian College on behalf of a student if the Agent is aware the prospective student has been rejected by an education provider for a similar course, without also advising Hillcrest Christian College of this circumstance.

The Agent must ensure that all staff of the Agent and any subcontractors of the Agent have appropriate knowledge and understanding of the international education system in Australia, including the Australian International Education Agent Code of Ethics (ACE).

AGENT’S FEES

Student Visa Enrolments a)

Unless Hillcrest Christian College agrees otherwise in writing, the cost of advertising and promotional activities undertaken by the Agent will be borne by the Agent.

The College will pay to Education Agents a commission payment of 15% of tuition fees for a student’s first year of enrolment and 10% of tuition fees for the second and each consecutive year that the student is enrolled at the College as a full fee paying 500 visa subclass student. Commission is only paid on monies received.

RESPONSIBILITIES OF HILLCREST CHRISTIAN COLLEGE

a)

Hillcrest Christian College is responsible at all times for compliance with the ESOS act and National Code 2018.

5. CONFIDENTIALITY a)

Hillcrest Christian College is not required to accept any prospective student referred by the Agent.

iii. Assess completed applications from prospective students within a reasonable time of receipt iv.

Subject to the provisions of this clause, Hillcrest Christian College must pay the Agent’s fee for each student who:

Ensuring Hillcrest Christian College is made aware of any extra fees the agent requires from the parents relating to the continued support of the parents and students during their time at Hillcrest.

For the purpose of this Agreement, the Agent is regarded as having recruited the student under this Agreement if the Agent submits the student’s application for enrolment, and that application also bears the Agent’s name.


e)

An Agent’s fee is not paid where a prospective student applies directly to Hillcrest Christian College.

An Agent’s fee is not paid where a prospective student applies directly to Hillcrest Christian College.

The Agent will receive the commission fee only after the Agent has submitted an invoice for each study period of one semester. Invoices must be emailed, to the Hillcrest International Learning Community: international@hillcrest.qld.edu.au.

Invoices will be paid by Hillcrest Christian College no later than 30 days after student has commenced the study period.

No Agent’s fee is payable unless the Agent has submitted an invoice for the short term enrolment. Invoices must be emailed after the completion of the short term study period, to the Hillcrest International Learning Community: international@ hillcrest.qld.edu.au.

Agent fees will not be paid for invoices presented more than six months after the completion of a study period.

Agents can apply to negotiate a special fee structure, which includes not receiving commission from Hillcrest Christian College.

Agent’s fees will cease if a student’s visa status changes from the 500 visa and they no longer pay international student fees.

ASSIGNMENT AND SUB-CONTRACTING

a)

The Agent must not assign this Agreement or any right under this Agreement without the prior consent of Hillcrest Christian College.

b)

Apart from sub-contractors listed in this Agreement, the Agent must not subcontract to any person the performance of any of its obligations under this Agreement without the prior consent of Hillcrest Christian College.

c)

Despite any sub-contract, the Agent remains liable for performing its obligations under this Agreement.

8.

MONITORING OF AGENT’S ACTIVITIES

a)

The Agent must participate in a range of activities to review the performance of the Agent. These activities may include but are not limited to:

Agent’s fees will cease if the student/parent advises the College, in writing, that the Agent is no longer representing them.

Short Term Tourist Visa Enrolments a)

The College will pay Education Agents a commission payment of 15% of tuition fees for a students's short term enrolment at the College. Commission is only paid on monies received.

b)

Subject to the provisions of this clause, Hillcrest Christian College must pay the Agent’s fee for each student who: i.

Is recruited by the Agent; and

ii.

Is enrolled in a course; and

iii. Has paid the course fee to Hillcrest Christian College; and iv.

c)

7.

Has completed the short study course.

For the purpose of this Agreement, the Agent is regarded as having recruited the student under this Agreement if the Agent submits the student’s application for enrolment and that application also bears the Agent’s name.

i.

A regular review of the Agent’s performance, to be undertaken at least every six months at the discretion of Hillcrest Christian College including a record of inquiries and outcomes as set out in Schedule 2,

ii.

Spot checks to be undertaken by representatives of Hillcrest Christian College both at the Agent’s premises and at promotional events


iii. A yearly survey of parents of students and students recruited by the Agent. b)

The Australian Government Department of Education and Training’s review and publication of PRISMS data on student outcomes associated with international Education Agents in Agent Performance Reports. For Hillcrest Christian College to access Agent Performance Reports in PRISMS for 8.b, the Agent agrees to his/her personal information being: i.

Recorded in PRISMS. This may include the Agent’s name, business email address, phone number and address;

ii.

Accessed by the Australian Government Department of Education and Training, Department of Home Affairs (formerly Department of Immigration and Border Protection) and other Commonwealth agencies that access PRISMS;

or is engaged in false misleading or unethical advertising or recruitment practices, the Agreement may be terminated under the terms set out below in clause 10. b)

Alternatively, Hillcrest Christian College may decide at its discretion to engage in corrective action with the Agent.

These activities may include but are not limited to: i.

Onshore or online training for the Agent

ii.

Requiring the Agent to complete an online Agent Training Course.

10. TERMINATING THIS AGREEMENT

E L P M SA iii. Used to administer or monitor compliance with the Commonwealth legislation e.g. Education Services for Overseas Students Act 2000, Migration Act 1958; and iv.

Disclosed by the Australian Government Department of Education and Training to other Australian Government entities (including, but not limited to ASQA and TEQSA), education institutions and publicly. The Australian Government Department of Education and Training will share individual agents’ performance publicly as aggregated data (but will not identify agent – provider relationships). Agent-provider relationships will only be identified when data is shared with education providers and other Australian Government entities.

9.

CORRECTIVE ACTION

a)

If at any point during the term of this Agreement, Hillcrest Christian College believes or reasonably suspects that the Agent is negligent, careless or incompetent

a)

Either party may terminate this Agreement at any time by giving the other party 30 days’ notice in writing.

b)

If the Agent breaches any part of this Agreement, Hillcrest Christian College may terminate the Agreement at any time and with immediate effect by giving written notice to the Agent.

c)

If the Agent breaches any part of 3.c, Hillcrest Christian College will immediately terminate the Agreement with immediate effect by giving written notice to the agent except where the breach of 3.c. was on the part of an individual employee or subcontractor of the Agent and the Agent has terminated that relationship.

d)

On termination of this agreement, the Agent must:

i.

Submit all applications and fees from prospective students received up to the termination date; and

ii.

Immediately cease using any advertising, promotional or other material supplied by Hillcrest Christian College and return all materials to Hillcrest Christian College within 30 days.

The termination of this agreement by either party does not affect any accrued rights or remedies of either party.


11. DISPUTE RESOLUTION/MEDIATION a)

In the event of any grievance or disputed, the Agent may access Hillcrest Christian College’s Complaints and Appeals Policy.

b)

If the matter cannot be resolved through use of Hillcrest Christian College’s Complaints and Appeals Policy [see 14.b].

12. ENTIRE AGREEMENT a)

This Agreement and its schedules: i.

Constitutes the full Agreement between the parties as to its subject matter; and

ii.

In relation to the subject matter replaces and supersedes any prior arrangement or agreement between the parties.

This Agreement may only be varied in writing, signed by both parties.

14. GOVERNING LAW a)

This Agreement is governed by and construed in accordance with the law in force in the State/Territory of Queensland, Australia.

b)

The parties submit to the non-exclusive jurisdiction of the courts of the State/ Territory of Queensland, Australia.

15. AGENT DECLARATION

I confirm and declare that I, and any staff or subcontractor of the above mentioned agency: i.

Have knowledge and understanding of the international education system in Australia, the Australian International Education Agent Code of Ethics (ACE), and my/our obligations related to recruiting, counselling and enrolling overseas students, as evidenced in information provided in Schedule 1, and

ii.

I/we have no conflicts of interest and will take reasonable steps to avoid conflicts of interest with duties and obligations, including under clause 3, of this Agreement with Hillcrest Christian College.

REFUND POLICY 1.

This policy outlines refunds applicable to course fees paid to the College, including any course fees paid to an Education Agent to be remitted to the College.

2.

Any service fees a student (or parent(s)/ legal guardian if the student is under 18) pays directly to a third party are not within the scope of this refund policy.

3.

The application fee is non-refundable.

4.

Payment of course fees and refunds:

a)

Fees are payable according to the invoice/ statement of fees supplied by the College. Fees must be paid six months in advance.

b)

An itemised list of College fees is provided in the College’s written Agreement and available on the College website www.hillcrest.qld.edu.au/our-college/ international and is subject to change without prior notice [as per NC Standard 3.3.4]

c)

All fees must be paid in Australian dollars, unless requested otherwise. Refunds will be reimbursed in the same currency as fees

Refunds will be paid to the person who enters into the written Agreement, unless the College receives written advice from the person who enters the written agreement, to pay the refund to someone else.

All notification of withdrawal from a course, or applications for refunds, must be made in writing and submitted to the Director of International Learning Community – international@hillcrest.qld. edu.au

6.

Student default because of visa refusal:

a)

If a student produces evidence of visa refusal (or provides permission for the College to verify visa refusal with the Department of Home Affairs) and fails to start a course on, or withdraws from the course on or before the agreed starting date, the College will refund within four weeks of receiving a written claim from the student (or parent/guardian if the student is under 18 years of age) the total amount of course fees received by the College before the student’s default day minus the lesser of AUD$500.

b)

If a student whose visa has been refused withdraws from the course after it has commenced, the College will retain the amount of tuition fees proportionate to the amount of the course the student has undertaken and will refund of any unused tuition fees* received by the College with respect to the student within the period of four weeks after the day of student default. *Calculation of the refund due in this case is prescribed by a legislative instrument (s.10 of Education Services for Overseas Students (Calculation of Refund) Specification 2014).

Non-tuition fees Non-tuition fees will be refunded on a pro rata basis proportional to the amount of time the student was studying in the course, except where a non-refundable payment on behalf of the student has been made. Refund amount = weekly non-tuition fee × weeks in default period. In this specification, the number of weeks in default period in relation to a course: i.

during which a registered provider or a student defaulted; and

ii.

for which the provider received payment of non-tuition fees in respect of the student; means the number of weeks calculated as follows: Weeks in default period = [number of days from the default day to the end of the period to which the payment relates] divided by 7

Non-commencement with NO notification of withdrawal If the student does not provide written notice of withdrawal and does not start the course on the agreed starting date, one term’s (or ten weeks) tuition fees will be retained from tuition fees received by the College. New enrolment - If tuition fees for up to one study period have been received in advance where the student (or parent/legal guardian if the student is under 18) notifies the College in writing of withdrawal before completing the relevant study period, no tuition fees will be refunded.

Continuing enrolment - If tuition fees for more than 1 study period have been received in advance and the College receives written notification of withdrawal by the student (or parent/legal guardian if the student is under 18) the College will refund the amount of unused tuition fees less one term’s fees, provided that at least one term’s (10 weeks) written notice of withdrawal has been received. NB: Where less than 10 weeks’ notice of withdrawal is received, the College will refund the amount of unused tuition fees less 10 weeks tuition fees in lieu of notice.

e)

Refunds in the event of a provider-initiated cancellation of enrolment i.

No refund of tuition fees will be made where a student’s enrolment is cancelled for any of the following reasons: •

Any behaviour identified as resulting in enrolment cancellation in accordance with the College’s Behaviour Management Policy/Student Code of Conduct.

Failure to pay course fees.

Any refund in the case of cancellation of a student’s enrolment for failure to maintain Hillcrest Christian College’s agreed conditions of enrolment as outlined in the student’s written agreement, including failure to disclose a pre-existing condition requiring a high degree of specialised support or care, will be at the discretion of the College.

Provider Default Any default by the College will be compliant with the current provisions of the ESOS Act 2000 and the ESOS Regulations 2001 (as amended) If, for any reason, the College is unable to offer a course on an agreed starting day for the course, and the student for some reason cannot be placed or refuses placement in an alternative course arranged by the College, a full refund of any unspent pre-paid tuition fees paid to the College will be made within 14 days of the agreed course starting day. If, for any reason, the College is unable to continue offering a course after the student commences a course, and the student for some reason cannot be placed or refuses placement in an alternative course arranged by the College, a full refund of any unspent pre-paid tuition fees paid to the College will be made within 14 days of the College’s course default day. In the event that the College is unable to fulfil its obligations of providing an agreeable alternative course for the student, or a refund, the student will receive from the Australian government’s Tuition Protection Service. This written agreement, and the right to make complaints and seek appeals of decisions and action under various processes, does not affect the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.

10. If the student changes visa status (e.g. becomes a temporary or permanent resident) he/she will continue to pay full overseas student’s fees for the duration of that calendar year.

DEFINITIONS OF WORDS AND PHRASES USED IN THIS POLICY Tuition fees – fees directly related to the provision of the student’s course, including textbook hire and bond, P&F and Capital Levies. Non-tuition fees – fees not directly related to provision of the student’s course, including camp fees, bus travel, QCAA fees and OSHC Course fees – the sum of: (a) The tuition fees received by the provider in respect of the student; and (b) The non-tuition fees (if any) received by the provider in respect of the student. Study period is equal to one semester (two terms)


COMPLAINTS AND APPEALS POLICY

A copy of this policy will be provided to the student (or parent(s)/legal guardian if the student is under 18) at a reasonable time prior to a written Agreement being signed and again within seven days of the commencement of student attendance of the enrolled course.

FORMAL COMPLAINTS HANDLING PROCEDURE

a)

The process of this grievance procedure is confidential and any complaints or appeals are a matter between the parties concerned and those directly involved in the complaints handling process.

b)

The student must notify the College in writing of the nature and details of the complaint or appeal.

c)

Written complaints or appeals are to be lodged with the Director of International Learning Community.

d)

Where the internal complaints and appeals process is being accessed because the student has received notice by the College that the College intends to report him/ her for unsatisfactory course attendance, unsatisfactory course progress or suspension or cancellation of enrolment, the student has 20 working days from the date of receipt of notification in which to lodge a written appeal.

e)

Complaints and appeals processes are available to students at no cost.

f)

If the matter cannot be resolved through mediation, the matter will be referred to the Executive Head of College and Hillcrest Christian College’s internal formal complaints and appeals handling procedure will be followed.

Each complainant has the opportunity to present his/her case to the Executive Head of College or Director of International Learning Community.

g)

The student and/or the College may be accompanied and assisted by a support person at all relevant meetings.

The formal grievance process will commence within 10 working days of the lodgement of the complaint or appeal with the Executive Head of College or Director of International Learning Community and will be finalised within 10 days, or a soon as practicable.

The purpose of Hillcrest Christian College’s Complaints and Appeals Policy is to provide a student or parent(s)/legal guardian with the opportunity to access procedures to facilitate the resolution of a dispute or complaint.

INFORMAL COMPLAINTS RESOLUTION

a)

In the first instance, Hillcrest Christian College requests there is an attempt to informally resolve the issue through mediation/informal resolution of the complaint.

b)

Students should contact the Director of International Learning Community in the first instance to attempt mediation/ informal resolution of the complaint.

c)

For personal or social concerns in Primary, contact the Director of International Learning Community or the Deputy Head of JLC; in Secondary contact the Director of International Learning Community or the Deputy Head of SLC – Pastoral.

For academic, subject or procedural concerns in Primary contact the Director of International Learning Community or the Head of Junior Learning Community; in Secondary, contact the Director of International Learning Community or the Head of Senior Learning Community.

For the duration of the internal complaints and appeals process, the student’s enrolment will be maintained, as required under the National Code of Practice for Providers of Education and Training to Overseas Students 2018 and the student must continue to attend classes. However, if the Executive Head of College deems that the student’s health or wellbeing, or the wellbeing of others is at risk, he/she may decide to suspend or cancel the student’s enrolment before the complaints and appeals process has been accessed or fully completed. In such cases, the student may still lodge a complaint or appeal, even if the student is offshore.

If the student wishes to appeal a decision made by Hillcrest Christian College that relates to being reported for a breach of course progress or attendance requirement (under Standard 8), the student must lodge this appeal with the Overseas Student Ombudsman’s office within 10 working days of being notified of the outcome of his/her internal appeal.

Once the Executive Head of College or Director of International Learning Community has come to a decision regarding the complaint or appeal, the student will be informed in writing of the outcome and the reasons for the outcome, and a copy will be retained on the student’s file. If the grievance procedure finds in favour of the student, Hillcrest Christian College will immediately implement the decision and any corrective and preventative action required, and advise the student of the outcome. Where the outcome of a complaint or appeal is not in the student’s favour, the College will advise the student within 10 working days of concluding the internal review of the student’s right to access the external appeals process. However, the College is only obliged to await the outcome of an external appeal if the matter relates to a breach of course progress or attendance requirements. For all other issues, the College may take action (including making changes to the student’s enrolment status in PRISMS) in accordance with the outcome of the internal appeal.

EXTERNAL APPEALS PROCESSES

a)

If the student is dissatisfied with the conduct or result of the internal complaints and appeals procedure, he/she may contact and/or seek redress through the Overseas Students Ombudsman at no cost.

i)

refusal to approve a transfer application (under Standard 7); or

ii)

suspension or cancellation of the student’s enrolment (under Standard 9)

Any choice to lodge an external appeal with the Overseas Student Ombudsman is at the student’s discretion. The College need not await the outcome of any external appeal lodged, before implementing the outcome of the internal appeal. 6.

OTHER LEGAL REDRESS

a)

Nothing in the College’s Complaints and Appeals Policy negates the right of an overseas student to pursue other legal remedies.

Hillcrest Christian College will consider applications for enrolment from students wishing to apply for a student visa, subject to compliance with the legislative requirements of the State of Queensland and the Commonwealth of Australia and the conditions of enrolment set by the Hillcrest International Learning Community (HILC), including any requirements to undertake extra tuition to learn English to meet the English language proficiency standard needed to enter mainstream classes. Applications for enrolment must be made on the International Student Enrolment Form. This must be correctly completed, and must be accompanied by the following documents to support the application. Please note: Certified translations are required for any documents not in English, with any costs to be met by the applicant:

a.

Certified copies of Academic Reports for the past two years, together with explanation of the reporting standards and what is indicative of a ‘passing grade’ in the reporting system.

b.

A reference from the student’s current or most recent school Principal is also required if student Report Cards do not record student behaviour or commitment to studies;

c.

Appropriate proof of identity and age;

d.

A copy of their current passport with name, photo identification, passport number and expiry date.

e.

Official results from any recently completed English Proficiency Test. Students applying for Years 11 and 12 must provide official results from a recent English Proficiency Test (e.g. IELTS, AEAS).

f.

Any medical reports; specialist reports or Individualised Education Plans (IEP) that are relevant to the application.

g.

A Letter of Offer from another registered provider, if applicable.

h.

Application to the Queensland Curriculum and Assessment Authority (QCAA) for relaxation of completed core requirements, if applicable.

An application for enrolment can only be processed when all the above documents have been received by HILC (international@ hillcrest.qld.edu.au).

Applications from international students are processed according to established policy and procedures, and are dealt with on their merits.

Assessment procedures include an evaluation of reports from previous schools and of English language proficiency. In cases where report cards are not available or are inconclusive for any reason, the College may require relevant testing of the applicant to assess the application.

Assessment procedures require students to undergo a video, or interview in person with the Director of International Learning Community if the applicant is applying for Years 7 - 12. It is a requirement of HILC that during an interview, the student is not allowed any assistance. If students are found to be receiving assistance from another person, written clues or translation devices then their application will be automatically considered unsuccessful.

Onshore applications for Years 11-12, where the student is transferring from another CRICOS registered provider, will only be considered where the transfer, if accepted, allows the student to achieve a successful study outcome at the end of the enrolment.

Enrolment at Hillcrest Christian College is conditional upon the acceptance and adherence to the International Student Code of Conduct found in the Application Form and Student Handbook, and the College guidelines and rules found on the College website and student diary.

As a condition of enrolment, the student/ parent/legal guardian agrees to disclose any essential information relating to additional support or care that the student


might require because of an existing medical condition, including the need for prescribed medication; or disability, including learning disorder, or other need for specialised support. Failure to do this may result in cancellation of enrolment.
