Therefore all items offered for sale are covered by the Association’s strict Code of Practice (see page 6). In addition, all items within the Fair have been vetted by experts for authenticity and correct labelling. Authorship can often be a matter of opinion rather than fact in cases of unsigned or undated pieces. No datelines are imposed on articles offered for sale at the Fair, however no reproductions are allowed. It is my great pleasure to welcome you to the fourth LAPADA Art & Antiques Fair Berkeley Square, and my second as Chairman of the LAPADA Association of Art & Antiques Dealers. LAPADA is the largest association of professional dealers in the UK and we have held a flagship fair in the capital every year since 1992. Berkeley Square is perhaps the most enviable location for any fine art fair in the world. Whilst the Fair has happily settled in to its home here, as organisers, LAPADA has continued to develop the event and all it offers to our visitors, and members, who, at the end of the day, it is our purpose to serve and champion. With some 100 exhibitors, our aim is to provide not only quality but breadth of choice in the fine art and antiques on offer for sale. code of practice GENERAL 1. This Code binds all Members in their dealings with Customers who buy for their own use and enjoyment and are therefore in law ‘consumers’ of the goods or services supplied by Members. PRICES 2.1 All goods for sale shall have the full VAT-inclusive price indicated clearly on a label or ticket attached to or immediately adjacent to the article in question; or, where this would be undesirable in any particular case because of the increased risk of theft:
2.2 (a) the full price of the article in question shall be entered on a price list or stock book which is available for inspection at all times during business hours by members of the public on request, and (b) there shall be a prominent Notice placed nearby stating ‘WRITTEN PRICES OF ALL GOODS OFFERED FOR SALE MAY BE EXAMINED ON REQUEST’. 2.3 Any Customer buying goods marked with a price reduced from a previous price may assume that the Member is aware of and complying with the current legislation on false or misleading price indications. DESCRIPTIONS AND ATTRIBUTIONS 3. The Member shall give to the Customer as much clear and accurate information as is reasonably practicable about the article in question, and this shall normally include: - The approximate date or period (e.g. Regency, Art Deco) of manufacture or, if hallmarked/datemarked, the actual year; - The material in which the article is predominantly made (e.g. walnut, bronze, oil on canvas); - The maker or artist’s name, if known, together with any provenance if known; - Any major restoration or later additions. 4. On a sale being agreed, description details as indicated on the label and as elaborated orally (if applicable) shall be written down, in a proper invoice showing the name, address, telephone number and VAT registration of the Member and date of issue. 5. Customers may assume that Members are aware of current legislation against false or misleading trade descriptions of goods or services, misleading price indications and other legislation aimed against the sale of stolen goods, fraud or money-laundering, and the meaning of ‘due diligence’ in each such area, and to have trained all sales staff appropriately. DEPOSITS 6. If a Member accepts a deposit as part payment for specific goods to be collected and fully paid for later, the date and full details of the transaction shall be recorded with a copy for the Customer in writing, including the date
by which full payment must be made and the consequences of default (e.g. possible forfeiture of deposit and right to resell). HOME VISITS 7. Members are prohibited from making unsolicited visits to private domestic premises. SUPPLY OF SERVICES 8. Where a Member’s business is primarily to supply services (such as packing, shipping, valuations or restoration) to Customers, such supply shall conform to ‘best practice’ in the relevant sector and Customers shall be given, in writing, a quotation for the supply in question together with the date and, where possible, time of delivery. AUTHORITY 9. Members have no authority to act on behalf of LAPADA or speak for it unless specifically authorised by the Directors, nor does mem bership of LAPADA imply any guarantee of authenticity. VALUATIONS 10. Valuations carried out professionally (i.e. for a fee) shall be provided in writing, signed and dated, and worded to indicate clearly whether they are for insurance (replacement cost) or for probate (net realisable value). ADVERTISING 11. Members must comply with the British Code of Advertising and Sales Promotion and any other Codes of similar standing. CONCILIATION SERVICES Where a dispute arises between a Customer and a Member which they have been unable to resolve, the LAPADA Conciliation Service is available to either party (under the scrutiny of an independent supervisor) as a prompt conciliation facility. about lapada The golden chandelier symbol displayed in a shop window or at a fair is the sign of membership of LAPADA The Association of Art & Antiques Dealers. Since it was formed in 1974, LAPADA has grown to become the largest association of professional art and antiques dealers in the country. Between them members cover virtually every discipline from antiquities to contemporary fine art. Membership is only open to those who meet the Association’s high standards regarding experience, quality of stock and knowledge of their subject. LAPADA was the first association of its kind to introduce a Code of Practice (see opposite) which all its members must abide by. The purpose of the Code is to maintain the highest standards of professional dealing and to ensure, among other things, that all items for sale are clearly priced and correctly described, thus giving buyers confidence and reassurance when they buy from a LAPADA member. In the unlikely event of a dispute with a LAPADA member, a complaint in writing will ensure a fair and thorough investigation through the Association’s free Conciliation Service. A recent addition to the LAPADA family is LAPADA MODERN, which represents a growing number of our members, all established dealers in contemporary and modern art and 20th century design. www.lapadamodern.org. LAPADA is a member of CINOA (Confédération Internationale des Négociants en Oeuvres d’Art), the international federation of 32 art and antiques dealers’ associations with member associations in 21 countries representing some 5,000 affiliated dealers who all share the principles of quality and integrity founded on a depth of specialist knowledge. If you buy from or sell to a CINOA affiliated dealer you can be confident that the dealer subscribes to strict guidelines on the ethics of dealing and belongs to a recognised and respected national association that vets its members. You can find all CINOA members on their website www.cinoa.org including, as on the LAPADA website, a wide variety of individual paintings and objects for sale on online galleries, a service provided by Online Galleries Ltd. A Mughal Emerald Aigrette by Paul Iribe, 1910. The aigrette is set with a central carved hexagonal Mughal emerald in excess of 100 carats. Surrounded by a border of millegrain diamonds and calibrecut sapphires, it incorporates a series of tapering diamond, pearl and sapphire sprays. The aigrette was the centrepiece of a collection of eleven pieces of jewellery created by Paul Iribe in 1910. For many years Iribe’s aigrette appeared and disappeared from records. It is documented as being in Cartier London’s vaults in 1931 and then vanished again for over 70 years.
