Climb aboard one of the world’s most famous train journeys linking the city of Christchurch and the historic west coast town of Greymouth. The TranzAlpine will take you on a coast to coast rail journey through the mighty Southern Alps, where spectacular views of the chiselled alpine landscape will take your breath away at every turn. Highlights include the 73 metre high Staircase viaduct, Arthur’s Pass National Park and the Otira tunnel. You will experience a total of 19 tunnels and 4 viaducts. The outdoor viewing carriage will get you close to the fresh alpine air and awesome scenery. Regularly touted as one of the top ten train journeys in the world - it is the experience of a lifetime.

The Coastal Pacific train travels along the north-east coast of the South Island linking the delightful port of Picton with the vibrant city of Christchurch. This world renowned rail journey is a literal scenic feast, with the Kaikoura mountain ranges to the west and the rugged Pacific Ocean coastline to the east. Travel through some of New Zealand’s finest farmland and horticultural regions and see amazing wildlife from the comfort of your train carriage. Seals and penguins can often be seen basking on the rocks below before crossing the idyllic Canterbury Plains to the Garden City of Christchurch. Available on the 11 Day Classic Southern Discovery tour only.

Departing from Dunedin’s historic railway station, begin your journey into some of New Zealand’s most spectacular and iconic scenery. Marvel at the variety of landscapes as the train negotiates this narrow and deep gorge, carved out over aeons by the ancient Taieri River. The natural wonders combined with the challenge of man-made engineering will leave you amazed, as somehow the railway blends into the natural environment perfectly. It is a wonderful example of the sheer determination of early railway pioneers. If you wish, stand on the open air platforms and enjoy the informative live commentary. Available as an optional activity on the 18 Day Platinum New Zealand Grandeur and 10 Day Platinum Southern Encounter.

Explore some of New Zealand’s magical wonders by water. Discover the powerful solitude of Doubtful Sound, the grandeur of mighty Milford Sound or sail the pristine waters of Lake Rotoiti onboard some of New Zealand's most spectacular cruises.

Milford Sound Described as the eighth Wonder of the World, Milford Sound is acclaimed as New Zealand’s most famous tourist destination. Carved out by glaciers during the ice ages, it is truly breathtaking in any weather. The fiord’s cliffs rise vertically from still dark waters, mountain peaks scrape the sky and dense rainforests cling to sheer rock faces. Waterfalls cascade downwards, some as high as 1000 metres and when it rains in Milford Sound, those waterfalls multiply with magnificent effect. Enjoy expert commentary while cruising the length of this spectacular fiord.

Doubtful Sound Doubtful Sound is a remote wilderness area three times longer and ten times larger than Milford. With its rugged peaks, verdant rainforest and twisting hidden inlets, this stunning fiord will take your breath away. Home to abundant wildlife, you may see bottlenose dolphins and fur seals at play or catch a glimpse of a rare Fiordland Crested Penguin. Cruise across Lake Manapouri, then travel by coach over Wilmot Pass to access Doubtful Sound. The isolation makes this pristine fiord a very special place, a place only those in the know get to see.

Lake Rotoiti Encounter the best Lake Rotoiti has to offer aboard the luxury yacht ‘Tiua’, a stylish and luxury 53-foot catamaran. This exclusive eco-sailing experience across the lakes is serene. Clear waters will allow you to discover the native bays and coves under sail before visiting Manupira Pools, Lake Rotoiti’s mineral rich, outdoor thermal hot spas accessible only by boat. On certain trips, Kirra Tours also offer you the opportunity to experience an overnight cruise in either Milford or Doubtful Sounds. Designed along the lines of a traditional scow, these vessels blend old world charm with modern comforts that include spacious viewing decks, a dining saloon, fully licensed bar and an observation lounge. After dropping anchor in a sheltered cove, you can choose to explore the shoreline by kayak or tender boat, or simply relax onboard. In the evening, enjoy a delicious three course buffet dinner prepared by the onboard chefs and served in the dining saloon. Mingle with fellow travellers, savour some fine wines and if the skies are clear in the evening, spend some time on the upper deck gazing at the stars before retiring to your cabin with your own private ensuite bathroom. Day 2 Auckland, Paihia (B,D) Leaving the city behind, we travel across the Auckland Harbour Bridge and drive north to Paihia in the Bay of Islands, a seaside town nestled on the foreshore of a National Maritime Park. On arrival, meet your local Maori guide who will provide an insight into the local history before visiting Waitangi, the location of the signing of the treaty between the Maori people and the British. Enjoy a self-guided tour through the Treaty House, the Maori Meeting House and War Canoe. Later this afternoon, board your launch for the scenic cruise to the Cape Brett Lighthouse and the famous ‘Hole in the Rock’.

Day 3 Explore the Bay of Islands (B) Today is a free day to explore and enjoy the beauty of the Bay of Islands. Your Guide will happily assist with arranging optional activities for you. Alternatively, explore the township of Russell, New Zealand’s first settlement and visit its historic Church, Mission House and Museum.

Day 4 Auckland, Rotorua (B,D) Leaving Paihia, travel south through Whangarei to Warkworth and on to Auckland. Cross the Bombay Hills to the lush farmlands of the Waikato before arriving at the geothermal wonderland of Rotorua, the centre of Maori culture and famous for its geysers, boiling mud pools and steaming craters.

Today begins with a visit to the Agrodome to see a unique New Zealand farm show. Visit Rainbow Springs to learn about native flora and fauna, including the famous Kiwi bird. This is followed by the spectacular Skyline Gondola which offers superb views over the city, lake and mountains and for those wanting a little excitement, why not try a Luge ride with our compliments. Enjoy some free time this afternoon before visiting Tamaki Village for an evening of fun and culture. You will experience a traditionally prepared Maori Hangi (feast) followed by a cultural performance featuring Maori songs, chants and dance including the stirring haka.

Day 6 Taupo, Art Deco Napier (B,D) View the mighty Huka Falls and the Wairakei Geothermal project before stopping at Lake Taupo, the largest in New Zealand. Continue on to Napier, often regarded as the world’s Art Deco capital. On arrival, enjoy a locally guided walking tour of the city.

Day 7 Wairarapa, Wellington (B,D) Orchards and vineyards give way to farmland as you travel into the rural heartland of the Wairarapa region. Day 8 Wellington, Hanmer Springs (B,D) This morning, we board the Interislander Ferry for the scenic cruise across Cook Strait to the South Island. Continue our journey south to the alpine resort town of Hanmer Springs, renowned for its therapeutic natural thermal waters.

Queenstown boasts an incredible array of adventure and leisure activities and your Guide can assist with any optional activities you would like to do. Take a ride on the world famous Shotover Jet Boat, travel to the top of Bob’s Peak by gondola for spectacular views, take a tour to the gold mining area of Skippers Canyon or for the adventurous, try white water rafting. Day 16 Wanaka, Franz Josef (B,D) Pass picturesque Lake Hayes on the way to Arrowtown, an area steeped in fascinating history relating to early settlement and the gold mining era. Day 2 Christchurch, Lake Tekapo (B,D) Today begins with a unique experience combining history and sightseeing. Enjoy a journey in style through the changing face of Christchurch’s city centre on-board a beautifully restored heritage tram. We then visit the International Antarctic Centre before crossing the Canterbury Plains, New Zealand’s largest area of flat land that lies between the mighty Southern Alps and the Pacific Ocean. Its patchwork of agricultural activity ranges from grazing grass and wheat to herbs and sunflowers. On arrival at Tekapo, we stop to view the tiny Church of the Good Shepherd and the Collie Dog Memorial overlooking the lake. Day 13 Hobbiton, Pauanui (B,D) Cross the Mamaku Ranges into the Waikato region, well known for its dairy farming, world famous horse studs and champion Rugby team! At Matamata experience a guided tour of Hobbiton, the movie set used in the block-busting ‘Lord of the Rings’ and ‘Hobbit’ films. Learn how this beautiful piece of farmland was transformed into The Shire from Middle-Earth and be sure to take a photo at the gate to Bilbo Baggins house, “Bag End”, looking out over the whole set to the hills in the distance. At Hokitika, we stop to visit to a Pounamu (also known as Greenstone or Jade) factory. Pounamu is considered a treasure in Maori culture and is seen as a sign of status and power. Travel south across the Canterbury Plains and stop at beautiful Lake Tekapo to view the tiny, historic Church of the Good Shepherd. Then travel up the western side of Lake Pukaki to the Mt Cook National Park, a World Heritage listed site. The park covers over 70,000 hectares of breathtaking alpine scenery.

Set beneath the rugged Crown Range is Arrowtown, a historic village located beside the Arrow River which was once a haven for the gold prospectors of the 1860’s. It features a fascinating collection of mining cottages with an atmosphere straight out of last century. Enjoy time to stroll through this historic village, before enjoying a relaxing, sumptuous lunch at Walnut Cottage, the show piece of Akarua Wines and back dropped by the Remarkables mountain range.

Day 13 Tasman Glacier Expedition (B,D) Today we experience the Tasman Glacier in the most unique way possible. An experienced guide will whisk you away in a stable MAC Boat to explore the melting ice-face of the Tasman Glacier. Get up close to touch and taste 400-year old icebergs that have been carved into the murky waters of the lake. Later today, there is time to enjoy one of the many bush walks and optional ski-plane and helicopter flights are available (subject to weather conditions).

Day 14 Cromwell, Lake Te Anau (B,D) Begin the assent over the Lindis Pass to the township of Cromwell, then continue on to the historic village of Clyde, nestled in a sheltered basin at the foot of an immense and crooked gorge. Day 2 Picton & the Marlborough Sounds (B,D) This morning, board the Interislander ferry for the cruise across Cook Strait. On to Manapouri, where you enjoy a leisurely cruise across this picturesque lake to West Arm. This is followed by a short coach trip on New Zealand's most expensive road, travelling over Wilmot Pass and pausing along the way to experience the dense Fiordland rainforest and view Doubtful Sound glistening far below. After a leisurely start to the day, a brief ferry ride brings us to Waiheke Island, a haven for vineyards, olive groves, art galleries and sandy beaches. Travel south this morning to Matamata. On arrival at Shire’s Rest you embark on a guided walking tour of the Hobbiton Movie Set used in ‘The Lord of the Rings’ and ‘Hobbit’ films. Day 5 to 7 At Sea

Milford Sound is a fjord in the south west of New Zealand's South Island. Part of the Fiordland National Park and the Te Wahipounamu World Heritage Site, it has been judged one of the world's top travel destinations in an international survey. Frequently visited by rain, the mountain peaks rising from the waters of Milford Sound are often softened by mist and an air of almost flawless awnd overpowering mystic calm. After Milford Sound, we continue cruising the Fiordland National Park. This stunning park encompasses mountains, lakes, fjords and rainforests. The natural wonders continue offshore with seals, dolphins and whales frequently spotted in the waters.

Day 9 Oban (Halfmoon Bay) Arrive: 8:00am | Depart: 5.00pm (tender boat required) You might not realise that New Zealand has a third island. It hangs beneath the South Island and is just about the last inhabited place before Antarctica. The island itself is only about four percent inhabited and that is its attraction. It is an unspoiled piece of primeval New Zealand.

Day 10 Timaru Arrive: 10:00am | Depart: 8.00pm Timaru is built on the rolling volcanic hills surrounding Mt. Horrible. Visit the South Canterbury Museum, filled with artefacts and information about the history of the region from the Maori arrival to the present day and the Aigantighe Art Gallery, housed in a homestead dating from 1908.

Day 12 Kaikoura Arrive: 8:00am | Depart: 5.00pm (tender boat required) Kaikoura draws visitors from all over the world for the prolific marine life in the surrounding waters. Whale, dolphin and seal watching tours operate year-round. There is a scenic walkway from the town centre out to Point Kean and there are colonies of fur seals on the rocky shores.

Day 20 Hobbiton, Rotorua (B,D) Travel south this morning to Matamata. On arrival at Shire’s Rest you embark on a guided walking tour of the Hobbiton Movie Set used in ‘The Lord of the Rings’ and ‘Hobbit’ films. This location is the largest “green set” in the world and the only part of the set remaining in New Zealand. You will see hobbit holes, the Mill and Double Arch Bridge and the Party Tree. Be sure to take a photo at the gate to Bilbo Baggins house, “Bag End”, looking out over the whole set to the hills in the distance. Later we continue our journey to the geothermal city of Rotorua.

When is the best time to come to New Zealand? We have designed our tours around the most popular time to visit New Zealand during the spring and summer months. However, being an all-year round destination, autumn and winter offer something different.

Are you able to cater for special dietary requirements? More often than not, special dietary requirements can easily be catered for. However, it is important that you let us know at the time of booking so that your request can be passed on to the relevant hotels and suppliers.

What is the smoking policy in New Zealand? Smoking is prohibited by law in coaches, bars, restaurants, cafes, casinos and other public buildings. Most hotels and resorts are now entirely smoke-free so if you do smoke, we would respectfully request that you remember to do so outside.

Are there laundries at the hotels we stay in? Many properties have guest laundries equipped with washing machines and dryers. These are available at a nominal charge. Hotel dry-cleaning and laundry services are available throughout New Zealand.

What sort of clothing should I bring with me? Whilst on tour, dress is informal and relaxed on most occasions. Smart casual clothes are acceptable at most restaurants. New Zealand weather can be a little unpredictable at times so we recommend layering as a good option. Each traveller is entitled to take one suitcase and one carry-on bag. The maximum weight allowed for each suitcase is 23kg. Any excess luggage must be requested at time of booking. Ask your consultant for more information.

Can I use my mobile phone in New Zealand?

Your Coach Captain will maintain a daily seat rotation plan that not only provides an equal touring experience for all our passengers, but also allows you the opportunity to get to know your fellow travellers.

Most service providers offer an international roaming facility that will allow you to receive and make phone calls using your existing phone number while travelling in New Zealand. Higher call rates usually apply when using this facility though, so we recommend checking with your service provider before activating roaming. Alternatively, you can purchase a prepaid SIM card when you arrive in New Zealand. These are available through the following mobile service operators: 2 Degrees, Spark and Vodafone.

Is tipping expected?

Are transfers included if I arrive early?

Tipping in New Zealand is neither mandatory nor expected, however should you choose to reward a job well done, it is always greatly appreciated.

Yes, your arrival and departure transfers are included whether you are starting the tour at the airport, cruise terminal, train station or ferry terminal. However, transfers are not included when travelling between hotels or travelling to and from a private residence. Please ask your consultant for more information.

Can I choose my own seat?

Can I pre-book additional sightseeing before I leave home? You’re very welcome to discuss and pre-book extra activities with your travel agent for those leisure days when nothing has been planned. Alternatively, your Coach Captain will be happy to offer recommendations and make bookings for you throughout your journey.

When do I receive my tour documents? We normally provide your travel agent with a copy of your final itinerary approximately three weeks prior to your tour departure date. All your vouchers, detailed itinerary and holiday information will be provided in a welcome pack that will be given to you on arrival in New Zealand by your transfer driver or upon check-in at your hotel.

Do I need to be physically fit to travel on your tours? You need only be in good health and of average fitness to enjoy our tours. The activities and sightseeing included has been specifically selected with our typical age group in mind. If you have any concerns at all, please ask your travel agent to contact us and we will be pleased to offer advice.

Are your tours suitable for children? Children under the age of 5 are not permitted on our Classic collection tours. Children under the age of 16 are not permitted on our Platinum Collection small group tours. Children prices are available on application.

Do I need a passport or visa to enter New Zealand? All visitors to New Zealand must carry a passport that is valid for at least three months beyond the date you intend to leave the country. Brochure Validity This brochure is valid for travel from 01 September 2019 until 31 August 2020 unless replaced by a subsequent edition. Tour and Holiday Prices All prices quoted in this brochure are in Australian Dollars, are inclusive of GST and supersede all prices previously advertised. Pricing is subject to currency exchange fluctuations and Kirra Tours reserves the right to amend without notice any prices in this brochure. Pricing will be guaranteed only after Kirra Tours has received full payment. Current valid prices will be advised on request and confirmation by way of invoice to your travel agent when your booking is made. Reservations and Payments A non-refundable deposit of $200 per person is required to confirm your booking. Failure to pay the deposit within 10 days of booking may result in the cancellation of your reservation by Kirra Tours. Full and final payment of all tours and holidays must be received by Kirra Tours no later than 60 days prior to departure date. If full payment is not received by this date, we reserve the right to cancel the booking. Bookings made within 60 days of travel date must be paid in full upon confirmation. Amendments and Late Bookings Any amendments requested by you, once your reservation has been confirmed, may incur a minimum charge of $25 per file to cover administration and communication costs. Bookings made within 15 days of departure date may be subject to a $50 per person late booking fee. Cancellations made by you Having accepted your booking, should it become necessary for you to cancel your reservation 60 days or more prior to departure date, your deposit only shall be forfeited. Cancellations made within 60 days of departure date will incur the following charges: (Expressed as a percentage of the confirmed tour & holiday price). • 59-30 days prior to departure - 50% • 29-15 days prior to departure - 75% • 14 days or less prior to departure - 100% Should you wish to cancel your existing booking and transfer to a new departure date within 60 days of departure, normal cancellation fees will still apply unless you are rebooking onto an earlier tour date of the same or greater value. Please note that you will also be responsible for all additional costs associated with any flight changes and air ticket reissues imposed by the airline plus a $50 per person amendment fee. You are also responsible for and must pay all costs and expenses incurred by you as a result of any change made by you to your itinerary after your tour departure date. This includes changes due to illness or personal reasons. Variations and Changes made by Kirra Tours It is unlikely that we will have to make any changes to your tour after you book but as we plan these arrangements many months in advance, we may occasionally have to make minor alterations. You will be notified at the time of booking of any known changes in itinerary, hotels or tour price and you are under no obligation to continue with your booking should these prove unsuitable. We reserve the right to cancel or amend travel arrangements once a reservation has been confirmed due to safety, adverse weather or any operational reason whatsoever and will notify you or your travel agent as soon as it is reasonably possible to do so. In the highly unlikely event that minimum numbers of bookings are not achieved to operate the tour and ensure an enjoyable group atmosphere, the responsibility to Kirra Tours is to only refund all monies received by them. Any such decision will be made 65 days or more prior to departure date and Kirra Tours will use all best endeavours to find an alternative tour of similar quality and inclusions or offer the closest available date of the same tour. Force Majeure Force Majeure refers to events that are beyond the reasonable control of Kirra Tours and which could not have been prevented by Kirra Tours. Accordingly, please note that compensation will not be payable if Kirra Tours is forced to cancel or in any way change your holiday as a result of war, or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical problems affecting transport or any similar events beyond our control nor will we be liable for flight delays or changes to your holiday for health or safety reasons. Refunds No refunds will be made once travel has commenced nor will any refund be available in respect of any tours, accommodation, hires, services or inclusions not utilised. Product and service providers are unable to authorise any refund on Kirra Tours’ behalf. Inclusions and Exclusions Without limitation, unless specified otherwise by Kirra Tours in writing, the price of your booking shall not cover airport arrival/departure taxes or any other airline fees or charges, travel agent fees and charges, charges for excess luggage, personal services, gratuities, laundry, drinks, meals (unless stated in the itinerary), pre-travel documentation, personal accident and medical expenses and incidental expenses including all communication charges, all of which are your sole responsibility. Holland America Line and Seabourn Holland America Line and Seabourn reserves the right to unilaterally withdraw any sailing from public sale, with or without prior notice. In these circumstances agents will be provided with reasonable alternatives. Taxes, fees and port expenses are subject to change at any time. Passport and Visas Please check with your travel agent or airline at time of booking as to the precise requirements and procedures for obtaining passports or visas. It is the responsibility of the traveller to hold the correct travel documents. Health and Fitness All passengers must warrant that they are reasonably fit and healthy to participate in the tours and holidays. Passengers requiring medical and physical assistance must be accompanied by a companion as Kirra Tours, their touring staff or agents cannot provide this service. Travelling with a collapsible wheelchair is subject to availability at the time of booking as each tour can only accommodate one wheelchair traveller. Kirra Tours reserves the right to remove a traveller from a tour if their health or fitness interferes with the enjoyment of the tour by other passengers; renders them unable to cope with the requirements of coach travel; or results in illegal or undesirable behaviour thereby jeopardising the safety and well-being of other travellers. In the event that you are requested to leave the tour, no refunds will be made and any subsequent costs from that time are at your own expense. Delays to Travel (a) Kirra Tours does not incur any liability for airfares purchased by travel agents or clients online via the internet. (b) In the unlikely event that a tour is cancelled Kirra Tours will not be held responsible for fees applicable to reissuing or changing flights. Pre & Post Accommodation Any additional night’s accommodation required pre or post tour are subject to availability and the prevailing rate at the time of booking. Solo Travellers If you are travelling alone you have the option of purchasing your holiday as a single room traveller or alternatively, as a share twin. To qualify for the share twin option, you must agree not to smoke in your room and accept that compatibility with your room mate cannot be guaranteed. In the event that we are unable to match you with another solo traveller of the same gender, you will be provided with a single room at no additional cost. Please note that the share twin option is available on Classic Tours only. Triple Rooms Discounts are available for triple share rooms. They are subject to availability and prices are based on using existing bedding. If a third bed is needed, this may be a ‘foldaway’, 'sofa bed' or ‘rollaway’. Please note that the triple share option is available on Classic Tours only. Vehicles, Seat Rotation & Touring Staff Kirra Tours operates a seat rotation system which allows for all passengers to enjoy forward and window facing seats and this policy cannot be adjusted to suit individual needs. Please be advised that smoking on board coaches in New Zealand is prohibited by government regulations. Kirra Tours reserves the right to substitute vehicles due to operational or mechanical necessity or any unforeseen circumstances. Kirra Tours will provide the services of an on-board tour concierge on their Classic Plus tours subject to a minimum of 35 travelling guests and reserves the right to operate any departures with fewer than this number of passengers with a driver guide or coach captain only. Luggage Allowance Each passenger is entitled to 1 piece of luggage weighing no more than 23kgs with them plus one item of hand luggage. Coaches must adhere to strict weight limits imposed upon them by Government regulations so we ask all travellers to take this into account. Airlines may also impose weight and size limits for checked baggage and we recommend you check with your airline before your travel date. All luggage and personal effects are at all times carried at the risk of the tour participant. Holiday Duration The first and last day of your holiday itinerary are travelling days and therefore depending on flight arrival and departure times, may not necessarily be a whole day. Wi-Fi Complimentary Wi-Fi is available on your tour coach however it has limited bandwidth and may not be as fast as normal broadband and might not be available in all areas. Complimentary Wi-Fi is available in many hotels however charges may apply at some properties. These charges are determined by the individual property and Kirra Tours have no influence over the cost of internet usage charged by them. Travel Insurance Travel insurance is not included in your tour cost. It is strongly recommended that insurance be taken out to protect you against cancellation charges, loss or damage of personal effects, ill health and medical expenses and any other unforeseen insurable events. Independent Arrangements & Excursions Any air and land arrangements you make independently which do not form part of the tour are entirely done so at your own risk. Should you book any excursions or additional travel arrangements while on your holiday with us, please note we act only as your booking agent and should anything go wrong with any such arrangements, your rights will lie solely against the organisation’s supplying such arrangements. Complaints In the unlikely event that a problem occurs during your holiday, it is important that you immediately inform your Coach Captain or the provider of the service. If that is not sufficient to resolve the matter, then contact the New Zealand office of Kirra Tours. If your complaint cannot be resolved satisfactorily at that time, you must write to our office within 30 days of your return to your home country supplying all the relevant details. Special Requests We will endeavour to fulfil any special requests (e.g. special room or dietary requirements) and will pass on your request to our suppliers. You must

advise us of any such requirement at the time of booking in writing no later than 45 days prior to departure. Kirra Tours has limitations on the number of wheelchair travellers it can cater for. Please contact us for availability. Minors & Children Passengers under the age of 16 must be accompanied by a parent or guardian at all times during any tour. Children fares are available on application. Unfortunately, children under 5 are not permitted on our touring programs and children under the age of 16 are not permitted on our Platinum Collection small group touring program. Liability 1 Responsibility: You acknowledge and agree that Kirra Tours accepts no responsibility and will not be liable to you or any third party for any loss, cost or damage (including loss of enjoyment) suffered directly or indirectly in connection with: a) any risks or other aspects of any tour or other travel arrangement notified to you by or on behalf of Kirra Tours (in these Terms or otherwise); b) any change to your itinerary or delays in departure or arrival times of aircraft or otherwise during the conduct of any tour or other travel arrangement; c) any loss or damage to your baggage; d) any personal injury or death resulting from the acts or omissions or negligence of any third parties providing goods or services to you during your tour or other travel arrangements including, without limitation, air carriers, hotels, restaurateurs, transportation providers and/or medical personnel; or e) any loss of enjoyment by you due to circumstances outlined in these Terms or otherwise beyond Kirra Tours control. Passengers will not be permitted to embark or continue on tour while their mental or physical condition is, in the opinion of any representative of Kirra Tours, such as to render them incapable of caring for themselves, they become objectionable to other passengers, or they become a hazard to themselves or other passengers. 2 Total liability: Notwithstanding any other provision of these Terms, and to the maximum extent permitted by law, Kirra Tours maximum liability to you or any third party (including any claims of negligence on the part of Kirra Tours) is limited to the amounts actually paid by you with respect to your booking (excluding insurance premiums, variation fees and additional fees (as applicable). 3 Consequential loss: Kirra Tours will not be liable for any loss of enjoyment, opportunity, profit, savings, revenue or interest or any other consequential or indirect, incidental, special or punitive loss, damage or expenses even if Kirra Tours has been advised of their possible existence and even if such loss, damage or expense is caused by Kirra Tours negligence. 4 Indemnity: You agree to indemnify Kirra Tours for any loss or damage suffered by Kirra Tours as a result of, or in connection with, any breach of these Terms or any negligence or willful default, by you (or any other person covered by your booking). 5 Force Majeure: Kirra Tours shall not be liable for any delay or for any failure to fulfil its obligations under these Terms (or any service obligations to you) if the failure or delay arises directly or indirectly from or as a consequence of any Force Majeure Event (as defined in the Terms). Accident Compensation Scheme You acknowledge that New Zealand has a no-fault law and claims are handled by the Accident Compensation Commission (“ACC”) pursuant to governing legislation, including the Accident Compensation Act 2001. Because of the wide range of help available from ACC after an injury, you can’t sue for personal injury in New Zealand, except for exemplary damages. General 1 The Terms may be subject to amendment by Kirra Tours from time to time. 2 Additional terms and conditions (over and above those specified in the Terms) may apply to your booking and will be advised by your Kirra Tours representative at the time of booking (or variation thereof). 3 The Terms are governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the New Zealand courts. 4 This summary together with the Terms constitute the entire agreement between the parties about its subject matter and any previous agreements, understandings and negotiations on that subject matter have no effect. Responsibility This brochure is the sole responsibility of Kirra Tours who will exercise all possible diligence in matters within their control relating to travel arrangements, accommodation and all the other services featured in any of the tours. Scenes depicted within this brochure are not necessarily included in the tours or holidays. No part of this brochure may be reproduced without Kirra Tours's prior written permission.
