eyond saving money, equestrian enthusiasts turn to buying their own piece of land as an investment in their lifestyle and a way to spend more time with their four-hoofed friends. And for those considering the Charlotte area, there are many advantages—namely a rolling topography, beautiful lakes and rivers and proximity to thriving cities, towns and affordable acreage. From Union County to the Foothills, Lake Norman and just across the state line, buyers have plenty of options—and considerations to make—when finding the perfect plot. “Owning horses can be a costly endeavor,” says Cindy Castano-Swannack with Ivester Jackson Distinctive Properties, adding that boarding fees can run upwards of $1,000 per month. “From a financial perspective, however, owning one’s own equestrian property allows that financial investment to flow over into equity growth in real estate,” she says. “And, at the end of the day, the joy of deepening the relationship with the horse on a daily basis is truly priceless.”

Lifelong horse lover Lillie Brown with Town and Country Realtors has helped many find their dream equestrian property in the Foothills area and says there’s much to consider when shopping around. “The buyer needs to think about how they enjoy horses first—do they want to be close to a competition facility or wish to trail ride? Also, the topography is very important,” she says. “Pastures can be rolling but not steep, and buyers must make sure they have enough land for their horses.” The environment in which the horses live is also an integral component. “Both water flow and soil quality is critical when considering land usage,” says Castano-Swannack. “Water in nature is a force to be reckoned with, and poor drainage can wash out valuable soil. So, during due diligence, buyers should consult with the experts to cover all these critical points and have soil tests conducted.” Another important factor is location. According to Castano-Swannack, many buyers want rural but not

necessarily remote. “The proximity to town and resources is a big factor,” she says. “I recently listed a parcel of 68 acres only five minutes south of Waxhaw, and it went under contract in 57 days. It offered the perfect combination of a great location and price.” And there are many more dream properties ready to be scooped up. “We are fortunate to have a large equestrian community with an even larger variety of farms ranging from small to grand,” says Brown. “There are also a few planned communities that cater to horses and have a central barn with many small farms clustered together. This addresses the needs of riders who are looking for that social proximity to other horse people but still want some independence.” As for the market forecast, the outlook is bright and sunny when it comes to purchasing acreage. “Having farmland is a safe investment,” says Brown. “Land is always going to appreciate in value, and, in some cases, there are even tax advantages in North Carolina for owning a farm.”

In Charlotte, people are inclined to decorate their yards during the holiday season, and people tend to be in a happier mood around the holidays anyway. Whether it’s a couple of baskets of mums or the smell of freshbaked cookies, holiday details can invoke a sense of warmth and help potential buyers feel more emotionally attached to your home. Capitalizing off this nostalgia can be helpful, and a few holiday details can help homebuyers imagine themselves establishing their own traditions in your home someday. However, Brown cautions against over-decorating for the holidays, which can be a turn-off and keep people from appreciating all your home’s great features. KEEPING THE YARD LOOKING FRESH Just because it’s cold, doesn’t mean you should abandon your lawn chores (or the company you’re paying

to do it). As Colin Malcolm of Helen Adams Realty attests, most people will know within the first 10 seconds of seeing a home whether or not they like it. If you let lawn care fall to the wayside because of the weather, you might miss out on a lot of potential interest. According to Kyle Rose of the Green Team in Charlotte, fescue grass is better suited for colder months (which is why it can struggle in the summer but turn extra green this time of year). Obviously, planting the right kind of grass for your lawn requires some foresight, which you might not have if you are unexpectedly listing your home. If you need to help your yard perk up at the last minute, Rose recommends a quick spreading of mulch or pine straw to make a world of difference. And if you’re not interested in spending your time out in the cold, you can hire a company like the Green Team to help keep your yard looking as jolly as the inside of your home.

till looking for a last-minute stocking stuffer for the DIYer at your house? There are plenty of tools and gadgets that are affordable, widely available and always welcome on the workbench. Cheap tools aren’t always bargains. Many of them won’t hold up and won’t handle big jobs. If you choose wisely, though, you can find lots of options. For instance, think small. I recently needed a small Phillips head screwdriver. Really tiny—eyeglasses screw size. I scrounged through the catchall drawer in the garage with no luck. I tried the smallest blades on three pocket knives—three!—but not one worked on the minuscule screw. Tiny screwdrivers are now on my wish list. And, for the record, I do not recom-

mend trying to repair eyeglasses with a Buck pocket knife. Stanley makes a 6-piece precision screwdriver set that sells for less than $10. It’s available at a hardware store or home center near you. Irwin makes a 5-piece set with spinning caps on the ends of the handles to make them easier to use with one hand. Another point: Those are both brand names you know and trust, always a plus. Mini tools work fine if you don’t ask them to handle big jobs. They handle tiny jobs—and, as my pocket knife adventure showed, they’re often the only things that will do. I use my mini pliers regularly on everything from door locks to fishing tackle to electronic gear. A few other last-minute ideas for affordable tools: – Look for a telescoping magnetic pickup tool for reaching into tight places to retrieve bolts, screws and other metal parts. The gizmos come in all sizes, including models that will fit in your pocket. At all prices, too, starting at less than $10. A neighbor asked the other day if I had one that he could borrow. The answer was no—but I will add that to the list with the precision screwdrivers. – Every DIYer should own a non-contact voltage detector. Just hold it close to a wire or receptacle to determine whether there’s potentially dangerous electrical power. It’s a quick and easy way to make double sure that you turned off that breaker. You can find models from Klein and Tacklife for $10 or a little more.

H In Defense of HOAs This week’s column was written by my colleague Donna DiMaggio Berger. Donna is a Shareholder in the law firm of Becker & Poliakoff and is the author of the popular Community Association Law blog which can be found at communityassociationlawblog.com. — Mike Hunter

OAs certainly have their share of detractors. Many HOAs operate a community of detached, single-family homes, begging the question: it’s my house; it’s my yard; other than the local building code, why should my HOA be able to restrict what I can do with them? Does it really matter how I maintain my yard? Shouldn’t the choice of exterior paint color be left up to me? Shouldn’t I be able to park whatever vehicle I want wherever I want on my lot? The answer to those questions depends on one’s expectations, and, unfortunately, sometimes people who prefer few or no restrictions find themselves living in communities with extensive rules and regulations. While some people are quick to criticize HOAs and even call for the dismantling of their regulatory framework, there are significant benefits that a mandatory homeowners’ association can provide. In my hometown of Plantation, Fla., an ongoing controversy exists in terms of a holiday light display on a residential cul-de-sac which is not part of a mandatory community association. When I first visited the attraction, I marveled at the grand scale of the display: a large Ferris

wheel in the middle of the lawn with adorable teddy bear passengers, an outdoor movie screen playing holiday classics, thousands of lights and decorations and masses of people milling around and gawking like me. My second thought was, I really would not want to live on this street. This nationally recognized holiday display takes place on an otherwise quiet cul-de-sac with fewer than a dozen homes and only one street that provides access to the residents and their guests and visitors. The push and pull between the owners who host the display and their neighbors has, not surprisingly, played out in the media. Several of the neighbors have been vociferous about the negative impact it’s having on them. They claim the lights, noise, garbage left on their lawns by visitors, weeks of set-up and removal of the display as well as the traffic over the span of many weeks all contribute to the diminution in their quiet enjoyment of their homes and ability to celebrate the holidays on their terms. They also fear the display could hinder the ability of emergency vehicles

to render assistance in their neighborhood while the display’s visitors are clogging the streets. There is little doubt a holiday display of this scale would not be permitted in a mandatory HOA, and this is only one example of activity they could, and arguably should, regulate. Every set of HOA governing documents contains a clause prohibiting activity that interferes with the peaceful possession and enjoyment of the other homes in the community. In this case, the governing documents could be amended to add specific guidelines regarding holiday displays and exterior alterations to a residence. No HOA documents would permit any type of display which could be classified as a nuisance or which would bring a nightly influx of non-residents into the community. A violation of the governing documents such as this holiday display would have resulted in fines, and, if those fines exceeded $1,000, they could have put a lien on the property and possibly foreclosed. Whether you believe that a massive holiday display in a residential

area is a nuisance or a blessing, the tools available to a private residential community enforcing its private restrictions are undeniable, and they can and should work to the benefit of other lot owners. Detractors of mandatory HOAs may argue the local city or county can regulate the use of residential property. That may be true in theory, but in practice the local authority sets minimum standards, whereas your community may want higher standards of aesthetics. The local authority is also often reluctant to become embroiled in these kinds of situations, and, even when they do take action, they may not be as successful as an HOA would. In the case at hand, the City of Plantation sued the display’s owners and lost. The City filed a nuisance lawsuit based on alleged traffic is-

sues and the judge ruled against the City. Curiously, the nuisance impact on the neighbors was not addressed in that lawsuit. In the end, this case illustrates how a private community could more effectively enforce private restrictions as opposed to relying on municipal Code enforcement. What other advantages can an HOA provide? Residents in an HOA benefit from the services and amenities that sharing expenses can provide, such as security services, recreational amenities like pools, exercise rooms, tennis courts and more. Lastly, highly functioning HOAs can foster a strong neighborhood connection. In the case of the besieged cul-de-sac, that neighborly connection arose not because things were going well but because they were going very wrong.

any of us who enjoy gardening this time of year don’t especially like cold weather. But we do like winter, for what it brings. And that is a surprising array of flowering shrubs and trees that stand out through winter. Surprising is probably an understatement as these flowers tend to open suddenly. One day a tree such as Okame cherry is quietly bare. The next, pretty pink blossoms start to open. Fortunately, the Piedmont mostly has mild weather through the winter, allowing us the time to savor these blooms outdoors. The leading lights in this lovely drama are, of course, pansies and the well-known camellias, which are beautiful, dependable and so varied that you could devote your entire landscape to these beauties. Tempting as that may be, it would overlook some fine plants.

Some of the most popular ones advertise their seasonal beauty by having winter in the common name. This includes wintersweet and winter honeysuckle, both of which are good background plants with delicate flowers that are tempting to cut and bring indoors. Winter honeysuckle is not a vine but a big shrub that is best planted in an outof-the way spot, but close enough to notice when the small, white fragrant flowers emerge. Wintersweet grows quite large, possibly to 15 feet over many years, and bears flowers with a sweet to spicy scent from early winter. Witch hazel is another great background plant that produces fragrant, oddly shaped flowers that are typically yellow, orange or reddish orange on a plant that can be called either a large shrub or small tree about 8 feet tall. spring. The early cherry trees, including Okame and Prunus mume, the Japanese flowering apricot, are so worthwhile and lovely for their early bloom. They are mid-sized ornamental trees that stand out, especially at a time when other trees are still leafless. This is a sight that cannot be overstated for beauty and attracting attention.

Among perennials, certainly the best for winter bloom are the Lenten roses. A marvelous array of hybrids are in the marketplace, offering different colors. These are very longlasting flowers, with lovely flowers on low plants with very nice, deep green foliage. They make great edging plants for flowerbeds or walkways in shade.

Ask Nancy Q: What can I do with a Norfolk Island pine that spent the summer outdoors and is now 8 feet tall? It is too big to bring inside? Will it survive in the garage? I am now thinking of giving it away. A: It may survive in the garage provided it gets some light through a window this winter and does not get hit by a cold blast of air. If you have connections with a school or other institution, ask if it could have a home in the large hall with a high ceiling, where it can be seen and enjoyed for a long time.

If you’ve never opened a certificate of deposit before, you might think CDs are a complex option for investing a large sum of money. While they certainly That’s right.
