LOWER MORTGAGE RATES COULD ASSIST WITH AFFORDABILITY AND INCREASE COMPETITION AMONG AREA BUYERS The Charlotte-area housing market continued its run of steady gains in both home sales and prices in February. According to data from Canopy MLS, year-over-year home sales rose 3.6 percent with 3,144 homes sold in February 2020. Compared to sales in January 2020, sales were up 10.9 percent with 309 more properties sold in February than January. Pending contract activity was up 24.8 percent with 4,888 contracts written in February, while pending sales or contract activity was up 6.8 percent compared to January. Both increases point to strong future sales within the region. Prices rose in February with the average list price for the month increasing 2.2 percent to $354,533. Both the average sales price ($304,569) and median sales price ($262,640) saw gains of 9 percent and 11.9 percent, respectively. Compared to the previous month, the average sales price was up 2.3 percent while the median sales price rose 4.2 percent. Sellers are still getting most of their original asking price as the original list price to sales price ratio increased 0.9 percent to 96.8 percent in February. Days on market, the metric that accrues for “Active” and “Under ContractShow” statuses, averaged 50 days in February compared to 54 days in February 2019. The average number of days a property was on the market from the time it was listed until it closed was 99 days. T
he Queen City offers a stunning mix of old and new. New residences, shops, restaurants and more are constantly erected as Charlotte draws more and more newcomers to its bustling, economically thriving epicenter. At the same time, the new is being built amongst the old. Charlotte was born at the intersection of Trade and Tryon in 1768. Myers Park was a 1,200-acre farm before it transformed into a nationally acclaimed streetcar suburb in 1938, beloved for its looping, tree-lined streets. Likewise, Eastover was once two dairy farms before transforming into the affluent neighborhood it is today. It’s long been a favorite with Charlotte’s most elite, drawing them with its premier urban design. It’s even been said that Eastover is Charlotte’s most beautiful neighborhood. While that’s up for debate, there is no denying these two prominent Charlotte neighborhoods have extraordinary staying power. “History and elegant charm close to an urban core will always have gravity,” says Scott Russo with The McDevitt Agency. “Myers Park and Eastover continue to draw in newcomers and move-up buyers looking for convenient access to Uptown. In Myers Park alone, there are 600 historic buildings and private residences nestled along its iconic, willow-oak lined streets. It’s easy to see why this neighborhood has maintained its long-standing desirability.”
The architectural variety in these two neighborhoods is also a draw. Buyers won’t find cookie-cutter anything here. “The Myers Park neighborhood is home to some of the Queen City’s most stunning residences—many of which date back to the early 1900s,” Russo says. “Styles range from Tudor and Georgian to California contemporary and modern farmhouse. They’re also sitting on larger lots than what you’d find in other ‘urban burb’ neighborhoods.” “Part of the charm of Eastover and Myers Park is that no two homes are alike,” adds Joan Goode with Dickens Mitchener & Associates. “You’re just as likely to see a Cape Cod-style home that looks like it was plucked straight out of a neighborhood in the northwest next to a modern home. neighborhoods, has local shopping and dining and has several parks throughout its tree-lined streets.” The areas’ beauty begs to be enjoyed outside on wide, welcoming sidewalks that wrap gently along the curving streets. Like an old Hollywood film, these streets beckon those to take a walk down memory lane. “The tree canopy covers so many backstreets and neighborhood cut-throughs. It’s almost magical to walk beneath them,” Goode says. “Neighbors are incredibly active. There are constant activities and festivals going on, like the 24-hour booty loop ride and Festival in the Park, which showcases local artists in Freedom Park.” Eastover is, of course, just as charming. While this sought-after community has seen generations of original families prosper and grow, they also welcome newcomers with open arms. Its rolling hills and large shady lots close to great schools, beautiful parks and local churches, shops and restaurants make it feel like it’s a world away from a city. Yet, the hustle, bustle and nightlife of Charlotte is just minutes away. And the airport is just 10 miles down the road. As two of the Queen City’s most desirable neighborhoods, the real estate market is hot. “My business has never been stronger,” says Goode. “The Charlotte market is growing daily. Coronavirus and Community Associations by Mike Hunter and Ben Karb

nderstandably, Offit Kurman attorneys have been getting a lot of inquiries from our community association clients and management companies on what to do about the coronavirus and how they should respond and communicate to homeowners. The Community Association Institute (CAI) has published some guidance on its website, along with a sample letter that can be adapted for use to your community associations. You can find it at caionline.org/pages/ coronavirus.aspx.
HOAs with annual meetings scheduled in the near future have asked about the possibility of holding “virtual meetings” of members. That’s generally not allowed under North Carolina law unless there is very specific language in the bylaws addressing the format and protocol for such meetings. so urgent as to justify holding a virtual meeting, understanding the risk that someone may later challenge the validity of any action taken at such a meeting. For North Carolina HOAs, there is a specific statute in the North Carolina Nonprofit Corporations Act that allows boards of directors to conduct meetings via teleconference. Still, there is no corresponding statute for meetings of members. § 55A-8-20. Regular and special meetings. (a) The board of directors may hold regular or special meetings in or out of this State. (b) Unless the articles of incorporation or bylaws provide otherwise, the board of directors may permit any or all directors to participate in a regular or special meeting by, or conduct the meeting through the use of, any means of communication by which all directors participating may simultaneously hear each other during the meeting. A director participating in a meeting by this means is deemed to be present in person at the meeting.
Can a board disclose the identity of a person exposed to Covid-19? Another topic of concern is what type of information can and should a board disclose to its members when it learns of a possible Covid-19 infection within the community. This may be less of a concern in single-family HOAs than in condominiums or townhomes where proximity to other people is a genuine concern. We believe if a board learns that one of its community’s members is infected, the board should let owners know there is a possibility of exposure to the virus; however, we do not advise that the board disclose the identity of the person or that the board attempts to impose different requirements on an infected person (such as limiting access to community mailboxes). While we recognize the pressures boards face from members who want to protect themselves and their families, we cannot treat people with a virus differently than other people. These are people’s homes, and there is no less of a right to be sick at one’s home than there is a right to be free from the virus.

Stay safe Tips for cleaning your home without damaging your surfaces by Allen Norwood
I
n your drive to super-clean your house, don’t forget some basic rules: Don’t grab the most convenient spray bottle and start spritzing every surface. Don’t assume a homemade formula that you discovered online really is a good substitute for the commercial cleaner you just ran out of. And, for goodness’ sake, don’t mix household cleaners. You know all that, but, well, all of us can use reminders during these scary times. Let’s start with some general information and then go to specifics, including a website that will help you clean properly to protect your family from coronavirus. You’ll want to visit the site regularly in the weeks ahead. Using the incorrect cleaner, or using a cleaner incorrectly, can damage your home and its furnishings—and, more importantly, endanger your family. Hard surfaces might sometimes seem indestructible, but they aren’t. Craig Madans of HOCOA, the Charlotte-based home service network, says network contractors have repaired or even replaced things like countertops and hardwood
floors because of damage from cleaners. That was before coronavirus came along to tempt us to clean with stronger stuff. “You can’t use caustic cleaners on marble,” he says. “We’ve had to replace countertops because of that.” Even Lysol and bleach can damage marble. Workers have had to refinish hardwood floors because countertop cleaners spilled or splashed, Madans says. As I was writing this, I came across online advice that says a mild solution of Oxiclean and water could be used on pretty much every surface in your house. Well, no. It says right on the container that it’s not to be used on latex paint— and that’s pretty much every painted surface in your house. Windex on everything? Well, no. It says on the GE website that stainless steel refrigerators shouldn’t be cleaned with window sprays. GE says you shouldn’t use ammonia, any vinegar-based cleaners or any product containing bleach. In other words, GE advises you to avoid most of the homemade formulas you’ll find on Pinterest.
Madans says his best advice would be to use soap and water and follow package directions. I couldn’t have said it better. Especially “follow directions.” For advice on cleaning your appliances, visit your manufacturer’s online site. For stone care, visit naturalstoneinstitute. org. For general cleaning tips, visit the American Cleaning Institute at cleaninginstitute.org. I wrote a couple of things a while back, before any of us could have imagined anything like what we’re going through, that are timely now: – Be careful with hand sanitizer around leather furniture. Your kids are diligently using sanitizer—maybe some you whipped up because store shelves are empty—and they’re sheltering in place in front of the TV. But alcohol, the main ingredient in hand sanitizer, will break down any top coat on leather. – If you mix up homemade cleaning solutions, be sure to keep them out of reach of kids. Children, especially toddlers, are at most risk for accidental poisoning. Use clean containers and, as
I’ve written, CLEARLY LABEL REUSED CONTAINERS. (The emphasis was a reminder to myself in an earlier column.) On the American Cleaning Institute site you’ll find clear warnings about cleaning chemicals that never should be mixed. That includes bleach and ammonia, of course, but there are others. Finally, the institute site—again, it’s cleaninginstitute.org—offers specific guidance for cleaning to protect your family from coronavirus. Go to the site and click on “Understanding Products” and then “Cleaning for Coronavirus.” You’ll find a list of disinfectants that meet EPA guidelines for use against coronavirus and links to helpful sources and stories. Brian Sansoni, senior vice president of the institute, says the site will be updated regularly with the latest information. Wash your hands, and be safe.
