HOPPER COMMUNITIES LAUNCHES SALES AT SOUTH END TERRACES Residential developer Hopper Communities recently launched sales for South End Terraces, a new townhome community in the South End neighborhood. On the first day of sales, three new homes went under contract, showing there is demand for new residential opportunities in South End. Located at the intersection of Remount Rd. and Norfolk Ave., South End Terraces will consist of three-story townhomes with optional rooftop terraces and bonus rooms. The first phase of 10 units will have private fenced-in backyards and extended driveways, something unique to the infill area of South End. The two-bedroom units will start in the mid $300,000s and will be 1,350 square feet. Each townhome will feature contemporary architectural style, modern interior design, expansive windows, hardwood floors, quartz countertops and stainless steel appliances. The seven-building community will be walkable to the New Bern light rail station and popular breweries, retail and restaurants. Residents can also enjoy easy access to the Rail Trail, a 3.5-mile walking and biking trail that extends into Uptown. COVID-19 IMPACTS APRIL HOME SALES COVID-19 and the economic crisis continued in April, impacting the buying and selling of residential real estate in the Charlotte region. Sales fell 20.8 percent yearover-year, with 3,534 homes sold in April 2020 compared to 4,464 homes sold in April 2019, according to data from Canopy MLS. Closed sales compared to March 2020 were down 16.9 percent. Year-to-date sales show the Charlotte region’s sales up 0.7 percent compared to sales during the first four months of 2019. Pending contract activity, which is usually an indication of buyer demand and future sales, declined 17.6 percent year-over-year as buyers complied with state and county stay-at-home orders, resulting in 4,045 contracts signed in April 2020. Compared to March 2020, contracts declined 15.7 percent. While home sales declined, home prices are still strong. Though the average list price in April 2020 ($336,523) was down 4.1 percent year-over-year, both the median sales price ($275,000) and the average sales price ($325,403) rose 8.1 percent and 7.1 percent, respectively, compared to prices last April. New listings, which are typically a sign of seller confidence, fell 26.6 percent year-over-year with 4,258 new listings posted during the month. Compared to March 2020, overall listing activity was down 28.2 percent as sellers, showings and open houses were put on hold. Inventory was down 24.9 percent year-over-year, and the region continues to experience strong seller’s market conditions. The 16-county Charlotte region currently has 1.8 months of supply, compared to 2.5 months of supply last April. The average number of days a property was on the market from the time it was listed until it closed (list to close) was 89 days. That’s why there’s a trend to buy waterfront with a home or two on it that will be torn down for new construction.” Even with the constraints of COVID-19, the real estate market in Cornelius is hot as ever. “With everything going on in the world today, the Lake Norman market, and especially the Cornelius area, is still thriving,” says Boileau. “Now that real estate is essential and homes can be shown again, showings are almost parallel to those during this time last year. Homes are going under contract at impressive rates.” It comes as no surprise that people from all over want to make Cornelius their home base. The area is full of lakeside fun with all of today’s modern amenities—but above all else, it’s a community that cares. “Cornelius has the Neighborhood Care Center right in town on Smith Circle,” says Rhyne. “It offers a variety of opportunities for the community to give back.” There’s The Bike Shop where kids learn and earn bikes by completing tasks and community service. Learning Zone is for elementary children who don’t have access to WiFi. “iCare Mentors, Spanish Partners, school break activities, ESL workshops, Little Tree of Knowledge and guitar lessons are all housed there too,” she says. “Living in Cornelius is unique in that all of this is available, and yet we’ve been able to maintain that smalltown feel.”

Court upholds HOA’s prohibition on artificial grass by Ben Karb

This column is written by my colleague, Ben Karb. Ben regularly advises boards of directors of homeowners associations and condominium associations about all areas of community association law, and he also works with buyers, sellers and developers with all types of commercial real estate transactions, especially those involving the formation of condominium and homeowners associations. – Mike Hunter

H

omeowners and HOAs appreciate lush grass, but some homeowners got their hands dirty when they put down artificial grass without permission. The North Carolina Court of Appeals in Martin v. The Landfall Council of Associations issued a semi-important (more on this below) opinion regarding the authority of HOAs to enforce architectural requirements and to collect attorney’s fees. Here’s the dirt: The Martins owned a home in Landfall, a golf-course community in Wilmington. The HOA’s architectural guidelines require that before any plants or vegetation can be planted, an owner must first obtain architectural committee approval. The governing documents required all lots be “sodded.” The Martins’ shaded property yielded little grass, despite repeated attempts to grow grass and after pruning the trees. The Martins requested that the architectural committee approve artificial grass, or artificial “sod,” as they put it. The committee denied the request. Undeterred, the Martins laid their artificial sod anyway. The HOA, willing to play in the mud, held a hearing and found the Martins in violation of the guidelines, and it levied fines of $100 per day against the Martins for their failure to obtain architectural

approval. The Martins sued the HOA and the HOA countersued, and so began a scorched-earth, multi-year lawsuit. The Martins argued that a legitimate question existed whether artificial grass meets the definition of “sod,” but the court said it did not matter. The owners’ failure to obtain prior approval was grounds alone to justify the fines. Moreover, the committee’s response followed prior court guidance: that the committee provided concrete suggestions about what was needed to comply, and that a valid reason existed to reject the application. Although the court’s opinion briefly grazed over it, apparently the committee made its determination by “consensus” (apparently it was held without a vote without strict corporate formalities), without a formal vote The worm turned for the Martins when two different judges, at separate hearings, rendered inconsistent decisions about the same legal issues. A first judge sided with the Martins and held that the case must proceed to trial since factual issues existed, whereas a second judge determined there were no factual issues in dispute. A second judge cannot overturn a first judge on the same legal question, and, thus, the Martins could proceed to

trial to determine the amount of damages and whether the HOA could foreclose. The final legal issue was whether the HOA was entitled to recover its attorneys’ fees, which are normally awarded at the discretion of the judge. Enter the Planned Community Act. The Planned Community Act (the condominium statutes have an identical provision) states that the prevailing party “shall be entitled to recover the reasonable attorneys’ fees and costs it incurs in connection with the collection of any sums due.” The use of the word “shall” within the statute mandates that fees be awarded, said the court. This case could have been impactful, but the appellate court got stuck in the mud. For reasons unknown to the general public, the court did not “publish” its decision; in layman’s terms, this case is not binding on later courts (it is persuasive nonetheless). While the court could

have disused the legal effect of rules and regulations, the committee’s “consensus” decision, or other important HOA concepts, it did not. There are still takeaways and lessons learned. First, the decision reiterates the two components to architectural decisions: completion of the architectural change as proposed, but the first, more basic requirement to submit a request. Owners who fail to abide by either requirement do so at their peril. Second, fines of up to $100 per day can be levied and foreclosed if an owner fails to comply with architectural requirements. Third, statutes mandate that attorney’s fees are collectible by the prevailing party in a dispute over sums owed. Finally, committees and boards must supply an owner with sufficient information to help the owner meet the architectural requirements, but if supplied to the owner, architectural decisions are generally upheld by courts.

Adjusting the striker plate is as simple as bending the tab out slightly with a screwdriver.

Small projects, big accomplishments It’s those little house tweaks that can make a world of difference—and now is the time to tackle them by Allen Norwood

A

sheltered-in-place mom with three kids said she had a house problem that was about to drive her to distraction: Every time one of the youngsters slammed the back door, as kids do, the latch of the nearby laundry room door rattled. The laundry room is right off the kitchen. She’s in the kitchen pretty much all the time with everybody stuck at home, and the restless kids are in and out all the time. That adds up to lots of rattling. Is there a fix? Please! Yes, an easy one. But first, a few paragraphs about how rewarding it can be to complete small projects in these uncertain times. There are umpteen reasons not to start a big home project right now. You don’t want to spend a morning in a crowded home center rounding up supplies, or invite a construction crew into your house. You certainly don’t want the house torn

up while kids and parents are jockeying for work space at the dining room table. You might want to take a deep breath and give yourself a break, even after things begin to get back to normal. But you want to keep busy. You want that sense of accomplishment. Which leads us to small projects, those you can complete quickly with tools and materials you already have around the house. Like, say, rattling doors. They’re perfect. You’ll keep busy, and because you can handle them quickly you’ll be able to scratch lots of items off your to-do list. About that door: It’s rattling, even though the door is fully closed, because the bolt from the latch fits loosely in the hole in the strike plate. Tightening it up is a snap. There’s a little tab inside the hole in the strike plate that can be adjusted to stop the rattle. There’s a slot in the tab. Stick a flat-

blade screwdriver in the slot and bend the tab out a bit. That should hold the bolt from the door latch more securely and reduce the rattling. While we’re on doors, here are a couple of other small tweaks that can be completed quickly. If a door refuses to stand open on its own, if it wants to swing closed, you have a couple of options. You can put a brick in front of it—or try this trick with a hinge pin: Tap the middle hinge pin up and out of the hinge. Place the pin on a board to protect the pin and the work surface. (Not directly on a hardwood or tile floor. Bad things will happen.) Tap the middle of the pin with a hammer to put a slight bend in the pin. Then replace the pin. The extra friction ought to hold the door open. If not, use the same tactic on the top pin. The top hinge carries more of the door’s weight than the other two hinges, so there’s more

friction to stop the swing. There are a couple of solutions if the door is sagging, as doors tend to do in homes with kids. The cure might be as simple as tightening all the hinge screws. If not, remove the center screw from the door jamb side of the top hinge. Drill a small hole all the way through the jamb where you removed the screw, and replace the original screw with a longer flathead wood screw that will reach into the 2-by-4 framing behind the jamb. A deck screw will work. Tighten it SLOWLY to eliminate the sag. Be careful—if you over tighten you can damage the door frame.
