DEFINITIONS The terms in these rules shall have the meanings respectively assigned to them as stated in the list of terms and definitions. NAME These regulations bear the following name: Rules for the use of logo’s and trademarks applicable for ADR Register, EMCI Register, IHR Register and WCEI Registers. GENERAL OBJECTIVE These regulations are set up to protect the logos and word trade marks registered by GNG with the Benelux Office for Intellectual Property, among other things by describing the user rights and basic principles of enforcement and also to protect the none with the Benelux Office for Intellectual Property registered logos and trade marks. CHARACTERISTICS Certificate holders all share the following characteristics: all certificate holders are certified by GNG; all certificate holders possess a certificate of competence and/or a certificate of approval from GNG; all certificate holders are registered with the public GNG inventory. LOGOS AND TRADE MARKS GNG lists all logos and trade marks for each existing certificate scheme. GNG owns all logos and trade marks that are listed in this article. Ownership of one or more of these logos and trade marks, either separate or collectively, may not be transferred or encumbered.

DEFINITIES De in dit reglement gebruikte begrippen hebben de betekenis zoals genoemd in de lijst van begrippen en definities. NAAM Dit reglement draagt de naam: Rules for the use of logo’s and trademarks applicable for ADR Register, EMCI Register, IHR Register and WCEI Registers. ALGEMENE DOELSTELLING Het reglement heeft tot doel de door GNG bij het Benelux Merkenregister geregistreerde beeld- en woordmerken te beschermen, ondermeer door het beschrijven van de gebruiksrechten en de uitgangspunten tot handhaving alsmede alle niet bij het Benelux Merkenregister gedeponeerde te beschermen. KENMERKEN Het gemeenschappelijke kenmerk van de certificaathouders is dat: alle certificaathouders zijn gecertificeerd door GNG; alle certificaathouders een GNG certificaat van vakbekwaamheid en/of een certificaat van goedkeuring hebben; alle certificaathouders zijn ingeschreven in het openbare GNG register. LOGOS, BEELD- & WOORDMERKEN GNG registreert de beeld- en woordmerken voor alle ingestelde certificatieschema’s. De in dit artikel genoemde beeld- en woordmerken zijn eigendom van GNG. De eigendom van één of meer van deze beeld- en woordmerken, zowel afzonderlijk als collectief, kan niet worden vervreemd of bezwaard. Het beeldmerk bevat het logo van het specifieke GNG register en de internationale benaming van het beroep, de bedrijfsgroep, de dienst of het product zoals genoemd in het certificatieschema.

7. 7.1 7.2

CERTIFICATES All certificate holders receive a certificate of competence and/or certificate of approval, hereafter named: certificate. The certificate will be drawn up and supplied by GNG.

7.3

The certificate will remain the property of GNG and can be withdrawn, declared non-valid or (re)claimed under all conditions.

RIGHT OF USE

8.1

Only certificate holders are allowed to use the collective logos and word trade marks.

8.2

The certificate holder is entitled to use the logos and/or word trade names only when the certificate holder has received the rights of use from GNG.

8.3

When the rights of use have not been received (yet) the certificate holder is not allowed to use the logos and/or word trade names unless GNG decides otherwise.

8.4

The certificate holder obtains the rights of use by producing a written statement to GNG in which the certificate holder clearly states that he/she knows and accepts the conditions for use established by GNG.

8.5

When the certificate holder has obtained the rights of use, the certificate holder has to buy the logo and/or word trade name from an organization appointed by GNG. This organization is entitled to charge a fee from the certificate holder. Only when the fee charged by the organization is paid in full by the certificate holder the organization has the duty to provide the logo and/or word trade name.

CERTIFICATEN Iedere certificaathouder verkrijgt een certificaat van vakbekwaamheid of goedkeuring, hierna genoemd: certificaat. Het certificaat wordt opgesteld en afgegeven door GNG. Het certificaat blijft eigendom van GNG en kan onder alle omstandigheden worden ingenomen, ongeldig worden verklaard of worden (in)gevorderd. RECHT OP GEBRUIK Het gebruik van de collectieve logos en merken is exclusief voorbehouden aan de certificaathouders. De certificaathouder heeft het recht op het gebruik van de beeld- en/of woordmerken voor zover GNG dit gebruiksrecht aan de certificaathouder heeft toegekend. Indien het recht op het gebruik (nog) niet is toegekend heeft de certificaathouder geen recht op het gebruik van de beeld- en/of woordmerken behoudens een afwijkend besluit van GNG. De certificaathouder verkrijgt het recht op het gebruik door het afgeven van een schriftelijke verklaring aan GNG waaruit blijkt dat de certificaathouder bekend en akkoord is met de GNG aan het gebruik gestelde voorwaarden. Indien de certificaathouder het gebruiksrecht heeft verkregen dient de certificaathouder bij de door GNG aan te stellen organisatie het beeldmerk en/of het woordmerk af te nemen. Hiervoor is de bedoelde organisatie gerechtigd een vergoeding aan de certificaathouder door te belasten. Indien de bedoelde organisatie een vergoeding in rekening brengt is de certificaathouder gehouden eerst de vergoeding aan de bedoelde organisatie tegen finale kwijting te voldoen alvorens de bedoelde organisatie de plicht tot levering heeft.

8.6

The certificate holder may incorporate into or reproduce the collective word trade names on: their own corporate identity; their own stationary; their own website; advertisements; any materials used for promotional activities regarding trade fairs, sales, promotion and sponsoring; any other use after consultation with and obtained permission from GNG.

USER DUTIES

9.1

The certificate holder is obliged to use the logos and word trade names permanently, unabridged and unconditionally in keeping with the stipulations in these regulations as well as according to other regulations, instructions and conditions that are connected with or follow from the certification of the certificate holder or due to a measure or directive from GNG.

9.2

GNG has the authority to impose conditions on the rights of use as mentioned in the regulations. This authority applies to collective as well as individual conditions.

9.3

GNG has the authority to impose and prescribe further rules to the rights of use as mentioned in the regulations.

9.4

The certificate holder is obliged to use the collective signs in a recognizable and legible way.

9.5

The certificate holder is not allowed to alter a collective sign or make changes to the original text or shape, either entirely or partially. The certificate holder, however, is free in his/her choice of colour and size.

9.6

With regards to logo size the certificate holder should observe the following: the original proportions of the collective sign should be preserved; the diameter of the sign should at least measure 1.5 centimetres (0.6 inches).

De certificaathouder kan de collectieve merken gebruiken voor: de opneming in de eigen huisstijl; de vermelding op het eigen briefpapier; de vermelding op de eigen website; de vermelding in advertenties; de vermelding in materiaal ten behoeve van activiteiten op het gebied van beursuitingen, verkoop, promotie en sponsoring; ieder ander gebruik in overleg met en na verkregen toestemming van GNG. VERPLICHTINGEN VOOR GEBRUIKERS De certificaathouder is gehouden het gebruik van de beeld- en/of woordmerken permanent, onverkort en onvoorwaardelijk in overeenstemming te houden met dit reglement alsmede alle andere reglementen, instructies, voorwaarden of anderszins gestelde instructies welke verband houden met of voortkomen uit de certificatie van de certificaathouder of vanwege een door GNG ingestelde maatregel of verordening. GNG is bevoegd aan het gebruiksrecht zoals bedoeld in het reglement voorwaarden te verbinden. Deze bevoegdheid geldt voor zowel collectieve als individuele voorwaarden. GNG is bevoegd met betrekking tot het gebruiksrecht zoals bedoeld in het reglement nadere regelgeving vast te stellen en te verordenen. De certificaathouder is gehouden de collectieve merken herkenbaar en leesbaar te gebruiken. Het is de certificaathouder niet toegestaan een collectief merk geheel of gedeeltelijk aan te passen, te veranderen of anderszins van de oorspronkelijke tekst en vorm te laten afwijken. De uitzondering wordt gevormd door de vrije keuze van de kleur en het formaat. De certificaathouder is verplicht met betrekking tot het formaat: de oorspronkelijke verhoudingen van het collectieve merk in stand te laten; een minimale doorsnede van het beeldmerk van 1.5 centimeter aan te houden.

10.

ENFORCEMENT AND SANCTIONS

10.1

If requested, the certificate holder is obliged to inform GNG directly in writing if he/she intends to use any of the collective sings signs.

10.2

GNG is always entitled to ask for information about the certificate holder's use of the collective signs. In order to do so, GNG may use external sources or consult experts.

10.3

Anonymous sources or consultants are not valid. GNG is not obliged to disclose the identity of the external sources or experts to the certificate holder or to third parties.

10.4

GNG is entitled to refuse the right of use with immediate effect or at any other moment in time determined by GNG. GNG is entitled to add further conditions to this refusal, for instance with regard to the termination or period of the refusal. The refusal can be declared temporarily or permanently.

HANDHAVING EN SANCTIES De certificaathouder is desgevraagd verplicht GNG per ommegaande schriftelijk te informeren over het door hem / haar toegepaste of voorgenomen gebruik van de collectieve merken. GNG is altijd bevoegd om zich te doen laten informeren over het gebruik van de collectieve merken door een certificaathouder. Hiertoe kan GNG ondermeer gebruik maken van externe bronnen of deskundigheid. Anonieme bronnen of deskundigheid kwalificeert niet. GNG is niet verplicht externe bronnen of deskundigheid bekend te stellen aan de certificaathouder of derden. GNG is bevoegd het gebruiksrechmet onmiddellijke ingang of op enig ander door GNG te bepalen tijdstip te ontzeggen. GNG is bevoegd aan de ontzegging nadere voorwaarden te koppelen, ondermeer met betrekking tot de intrekking en de duur van de ontzegging. De ontzegging kan worden aangezegd tegen bepaalde of onbepaalde tijd. Een ontzegging dient te zijn gebaseerd op het gestelde in dit reglement of op een handelen, doen of nalaten door de certificaathouder in strijd met de naam en faam van het beroep of de beroepsgroep voor zover dit blijkt uit of is gebaseerd op de certificatie van de certificaathouder. Een ontzegging geschiedt altijd schriftelijk per aangetekend schrijven. Een verbod op het gebruiksrecht ontstaat als en indien de inschrijving van de certificaathouder in register eindigt alsmede als en indien het certificaat van vakbekwaamheid is vervallen, vervalt, wordt ingevorderd of is ingevorderd. Indien de certificaathouder wordt geschorst wordt het gebruiksrecht eveneens geschorst behoudens een afwijkend besluit van GNG.

A refusal should be based on the stipulations in these regulations or on an act or failure to act on the part of the certificate holder contrary to the good name and reputation of the profession or occupational group as understood in or following from the certification of the certificate holder. All refusals shall be in writing by registered post.

10.7

The right to use will be prohibited if and when the certificate holder's registration ends, the certificate of professional skill expires or will expire and is or will be reclaimed.

10.8

The right to use will be suspended if the certificate holder is suspended, unless GNG decides otherwise.

FINAL CLAUSES CONFIDENTIALITY GNG, the management, the committees as well as the individual committee members are bound by a duty of confidentiality towards the certificate holders and/or third parties with regard to knowledge and/or information concerning companies, certificate holders, authorities, organizations and/or people whose knowledge and/or information has come to them on the basis of their position within GNG. Violation of the duty of confidentiality is ground for removal from the position and in case of a certificate holder ground for testing the rules of conduct based on the regulations, right of complaint and disciplinary rules. DISPUTES If in the certification statute something has not been or has not completely been regulated and/or has given rise to a dispute, GNG is authorized, without prejudice to the provisions in the articles of association of GNG. If GNG does not take a decision with regard to the dispute, the dispute will become subject to mediation. If mediation is not successful the dispute will be brought to a competent Dutch court. MULTILINGUALISM In case of multilingualism, the Dutch language is preferred over any other language. ADOPTION

14.1

This statute is adopted by the GNG management. Earlier versions of the statute no longer apply and are replaced by the present statute with the date and version number as stated in the header.

LAW

15.1

Only Dutch law applies to this statute.

SLOTBEPALINGEN GEHEIMHOUDING GNG, de directie, de commissies alsmede de individuele commissieleden zijn gehouden aan de geheimhoudingsplicht jegens de certificaathouders en/of derden met betrekking tot de kennis en/of de informatie omtrent bedrijven, certificaathouders, instanties, organisaties en/of personen welke kennis en/of informatie tot hen is gekomen op grond van hun functie binnen GNG. Het schenden van de geheimhoudingsplicht is grond voor ontzetting uit de functie en ingeval van het zijn van certificaathouder grond voor toetsing aan de gedragsregels op basis van het reglement klacht- en tuchtrecht. GESCHILLEN Voor zover en indien het certificatie statuut iets niet of onvolledig regelt en/of leidt tot een geschil is GNG bevoegd, onverlet het bepaalde in de statuten van GNG. Indien GNG geen besluit neemt ten aanzien van het geschil, wordt het geschil onderworpen aan mediation. Indien de mediation niet slaagt wordt het geschil aan de bevoegde Nederlandse rechter voorgelegd. MEERTALIGHEID Bij meertaligheid prefereert de Nederlandse taal boven elke andere taal. VASTSTELLING Dit statuut is vastgesteld door de GNG directie. Hiermee zijn eerdere versies van het statuut vervallen, niet meer van toepassing en vervangen door het voorliggende statuut met de dagtekening en nummering zoals genoemd in de ‘ header’. WET Uitsluitend de Nederlandse wetgeving is van toepassing.
