SALE TERMS AND CONDITIONS Please READ and FAMILIARIZE yourself with the 2 pages of our HUTCHINGS PERFORMANCE HORSE SALE GUIDELINES. Hutchings Performance Horses, its associates and the auctioneers’ function is to bring the buyer and seller together. All responsibilities and guarantees lie between the buyer and seller. ALL BUYERS MUST PRE-REGISTER IN THE SALE OFFICE Bank name, Address, Drivers License and Social Security Number will be required to obtain a Buyer’s Number. 1) PERSONS PLANNING TO PURCHASE HORSES IN THIS SALE FOR THE FIRST TIME SHOULD PRESENT LETTERS OF CREDIT FROM THEIR BANKS IF PERSONAL CHECKS ARE USED IN PAYMENT. Anyone with account problems with Hutchings Performance Horses in the past will be required to pay for their horses with cash. EXAMINE HORSES PRIOR TO PURCHASING (be sure to attend the preview, look your choices over, and ask any questions you may have) 2) THERE IS NO IMPLIED WARRANTY MADE BY AUCTIONEER AS TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF ANY ANIMAL FOR SALE. 3) The highest bidder is to be the buyer. If any dispute arises between or among two or more bidders, sole authority to settle the dispute as he sees fit is reserved by the auctioneer and the decisions shall be final. Seller reserves the right to waive the sale of his horse BEFORE it leaves the ring. The auctioneer reserves the right to reject any or all bids. 4) The Sales Management is not responsible for the integrity of any specific bid and the seller understands and assumes all responsibility for any bid that is made and not thereafter honored. In the event any bid is not honored, the seller agrees not to hold the Sales Management responsible and agrees not to sue the Sales Management therefore. 5) All horses are offered for sale according to the laws of the State of Nevada and the right to bid is reserved for all sellers in the sale unless otherwise announced. 6) Effort has been made to insure correctness of this catalog and, in most cases, information quoted concerning the horses is taken from the official AQHA records. However, employees and auctioneers will not assume responsibility for errors or omissions, but appreciate having them called to their attention. Announcements in the ring take precedence over printed information. PAY CLOSE ATTENTION TO THE ANNOUNCEMENTS. 7) The seller is the responsible party for all representations or warranties, expressed or implied concerning the condition of any horse and buyers should satisfy themselves concerning the condition of any horse they purchase. Except as otherwise announced by the auctioneer at the time of sale, the consignor of each animal represents and warrants to the buyer and Hutchings Performance Horse Sales the following: 1. Title of the animal, free from all adverse claims to ownership, use or possession. 2. The animal is sound of eyes and wind. 3. The animal is not a cribber or wind sucker. 4. The animal is or has not been nerved, have navicular disease, have ringbone, been foundered or any other pre-existing condition. 5. The sex or condition as a gelding or ridgeling is as described in the sale catalog or announced at the time of sale. 6. Any animal which, at the time of sale is described as a stud or colt and does not at such time have two testes descended to the scrotum must be announced. Warranty with respect to descended testes does not apply to any horse sold prior to Jan. 1 of his yearling year. 7. The horse does not possess the defect commonly known as parrot mouth. If any of these conditions are announced, the consignor is held harmless for the condition. 8) All GUARANTEES ARE MADE BY THE OWNER. Right of recourse must be directly to the owner of the horse. Make sure to pre-inspect horses prior to purchasing. 9) Horses have been Coggins tested and found NEGATIVE within six months of the sale date, but foals on the mares will not have had coggins by sale day. Coggins papers given when horses are paid for. The HYPP status of all Impressive bred horses will be announced. Hyperkalemic Periodic Paralysis Disease (HYPP) is a muscular disease. The results of horses that have been tested for this disease will be noted in the catalog as follows: N/N -Negative for HYPP, H/N or N/H - Positive (Heterozygous) for HYPP. All horses descended from the stallion IMPRESSIVE that do not declare an HYPP test should be purchased as is. Consignors are required to disclose all test results or treatment of suspect horses for this condition. 10) In the event a dispute should arise as to a particular defect which should have been, but was not announced as described above, the buyer has the right to have a veterinarian examine the horse he has purchased to determine if the horse suffers from the defect. THIS EXAMINATION IS TO BE MADE AND HUTCHINGS PERFORMANCE HORSES IS TO BE NOTIFIED BEFORE THE CHECKS ARE MAILED.If the purchaser’s veterinarian determines the horse to have alleged defect, the Sales Management, as agent, shall appoint a veterinarian of its choice to determine if the horse has the defect(s) and if the defect was present at the time of sale. His or her decision will be final. If the veterinarian determines that the defect was present at the time of the sale and it was not announced, the sale of said horse shall be null and void and the consignor must pay entry fee and commission. If the horse is determined by the Sales Management veterinarian not to have the alleged defect, the sale of said horse is valid and enforceable and purchaser assumes all costs of examination and treatment. 11) If the buyer rightfully rejects the animal in the manner stated in #10, the animal will be returned by the buyer to the consignor and the full purchase price of the animal will be refunded. 12) The seller guarantees all mares were bred to stallions as indicated in the catalog. We believe them to be in foal, but are selling them as they are and without return privileges, unless otherwise specified. Broodmares owned by Hutchings Cattle Co. and sold as in foal are sold with a live foal guarantee and a right to rebreed. Any purchaser of a broodmare sold in this sale as IN FOAL to a stallion may have her examined by a veterinarian acceptable to the undersigned, within 24 hours after the sale and prior to removal from the sale premises. Any broodmare so examined whose pregnancy status is found not to be as represented at the time of sale may be returned to the consignor as unsold and the consignor shall pay the veterinarian’s fee for examination and is liable for the commission as if sold. If the broodmare is found to be as certified, the purchaser shall pay the examination fee. 13) When a horse is sold, the buyer shall sign the Acknowledgment of Purchase which will be brought to him. Title passes when the buyer signs this Acknowledgment. Name and address MUST BE LEGIBLE and complete and MUST BE FILLED IN EACH TIME A HORSE IS BOUGHT. This acknowledgment is to be filled out exactly as the purchaser wants it registered. We will not be responsible for errors on transfer, if the acknowledgment is not properly and clearly filled out.

14) Title to and risk of loss passes to the buyer when the animal is knocked off as sold by the auctioneer. Immediately after the horse is sold, it will be the sole risk and responsibility of the buyer. Effective from the time of purchase, the buyer assumes responsibility for the maintenance and care of the animal. The buyer further agrees to indemnity and hold the consignor and Hutchings Cattle Co. harmless from all loss, cost and expense arising from illness, injury or death of such animal, or loss or damage to property, and injury or death of persons, caused by the buyer, the buyer’s agents or employees, or by the animal, subsequent to the time of purchase.NO HORSE WILL LEAVE UNTIL FINAL SETTLEMENT HAS BEEN MADE. 15) Upon receiving payment for a horse, the cashier will issue an order to obtain delivery. Buyers are cautioned not to lose their receipts. Buyers must make arrangements for care of stock until it can be removed. Buyer will need to use the “pink slip” to be released to load. Do not remove hip numbers from horses once they are applied. Buyer releases will be checked against hip numbers and no horse will be released without a legible hip number. 16) Driver’s license and Social Security Number will be required to obtain a buyer’s number. Payment terms for this sale are cash. Payment in full must be made to the cashier immediately after the sale. All payments shall be U.S. Currency. Method of payment shall be Cash, Cashier’s Check, Traveler’s Checks, or approved bank check which has been verified and approved in advance by cashier and/or officers of Hutchings Performance Horses. All payments must be made to Hutchings Performance Horses. Any payment made by the buyer to the consignor or any other party will not be regarded as valid or entitle the buyer to delivery of the animal. All “returned” or insufficient fund checks will be immediately turned over to the District Attorney and charges will be filed. NO RE-DEPOSITS: Anyone issuing us an insufficient fund check for a horse will run the risk of having their name printed in our mailing of 115,000 catalogs and flyers. The size of a NSF horse payment check classifies as a felony and it will be turned over to the District Attorney for immediate prosecution. All past buyers who have passed a “returned check” to the Hutchings Performance Horses will be required to pre-pay for their purchases or pay in cash. 17) All registration papers will be withheld until checks clear the bank. At 30 days from the date of the sale, the registration papers, along with transfer certificates, will be mailed directly to AQHA for transfer of ownership to the new buyer. Checks for payment will be mailed to the sellers on that same date. 18) Buyers will pay the AQHA $15.00 transfer fee. ALL BUYERS WILL BE CHARGED THE CURRENT RATE OF SALES TAX ON ANY PURCHASE, UNLESS A TAX NUMBER iS GIVEN AND THE PROPER FORM IS FILLED OUT AT THE OFFICE. You will be asked for your current AQHAmembership number. Persons not having a current membership can either purchase one directly from AQHA or buy one at the time of payment forpurchases. 19) Buyers and spectators are cautioned to be careful while on the grounds, particularly while horses are being shown or sold in the sale ring. All persons attending the sale do so at their own risk. According to the laws of the State of Nevada, neither the owners nor any other person connected with this sale assume any liability, legal or otherwise, for accidents to persons or property, before, during, or after the sale. 20) Any horse not consigned to the sale and found on the grounds will be assessed a $150 fee and will go through the auction at the end of the sale. A release for this horse will not be issued until these terms are met. No horse will be let out the gate without a hip number and release issued through the office. 21) Any buyer who purchases a horse from the sale and leaves the animal for more than 24 hours, will be subject to a feeding cost of $5.00 per day and $2.50 for foals left on mares that are not taken at time of the sale. If feed arrangements are not made by the buyer, the said horse will be sold to cover feed costs. 22) We allow the use of all major credit cards for the purchase of horses at the Silver Buckle Sale There will be an additional 4% charge.

Dear friends,

It has been a year of miracles. The Lahontan Reservoir is as low as I have ever seen it in my lifetime. We’ve had an allocation of 17% of our irrigation allotment, yet we have managed to run our band of mares out on feed in the fields all summer. The mares and foals look good considering the feed conditions. The Lord has blessed this community with rainfall that has been both timely and in amounts that are way above average. This has provided unexpected feed and farmers have been able to harvest a decent crop. In March another miracle occurred: our son Scotty returned home from Scotland and Ireland. He had been serving a two-year mission for The Church of Jesus Christ of Latter-day Saints that blessed our family and the lives of many others in those countries. Since last year’s sale we have had a new grand daughter, little “Ella” Segura. This makes two fillies in the herd of eight little miracle grand children. They bring us all kinds of joy. Grandma CC loves to gather them like a mother hen and nurture them and play with them and spoil them. We have FINALLY moved into our house that we started building eight years ago. Miraculous! With all the kids gone and all the space this house affords, we have asked ourselves, “What in the world were we thinking?”

Oh, I forgot, we are talking about a horse sale! Well, what can I say? The foals are amazing. Major Red Buck’s foals are impressive, Pearhandled Shooter’s foals will catch your eye and we can’t say enough good about them. The Pepto Hot Sox foals will make you want to swing a leg over them and take a ride in the arena. We want to send out our thoughts and prayers to the Toolson family as John Toolson passed away this past year. We wish he could have witnessed the quality of the foals of his great stallion crossed on our mares.

Cash Talks Baby Doll comes right off the top of our broodmares. She was started as a two-year old by Clint Weaver and had 60-90 days riding as a two-year old. We put her under saddle again a few of weeks ago and found that she rides extremely well. She has the potential to be a rope horse, cow horse or whatever you want to do with her. Baby Doll had a very nice colt two years ago, Cash Talks Cassidy, Lot 5 in the sale. Last year she had a gray Ki Two Eyed stud colt that was a hot item in last year’s sale.
