Marin District and Landmark may face bumpy road By Tom Barry During the last two months, it appeared that The Landmark luxury residential towers had finally turned a tumultuous corner, but things change and the light at the end of the tunnel may either be sunshine or an oncoming train. All appeared to be going well at the swank Landmark and Meridian condominium towers in Greenwood Village near I-25 and Belleview Avenue. Neuberger Berman and SVP Global had purchased the note for the property from the German government, which had acquired it through the bankruptcy of Hypo Bank. The East West Partners were placing the property’s trustee, Andy Miller. What’s more, the Kentwood Cherry Creek real estate firm had brought new life and a positive attitude into the sales of the remaining luxury units. But due to some recent developments, The Landmark towers could potentially be headed for another bumpy road over the next year. A sign was posted recently on the door of the towers’ opulent leasing center: “We’re sorry we’re out. The Sales Center is in transition. There are exciting things to come!” The sign included contact information. The Villager had not received a reply from East West Management at press time Developer Zack Davidson constructed the upscale Landmark residential and commercial center and ventured to fund a never-built adjacent European Village. A number of lawsuits involving Marin remain unsettled. Its homeowners association has filed suit against the district contending that its residents were not responsible for repaying Marin’s debts. A district judge concurred, leaving things up in the air for the primary lenders, Colorado BondShares and UMB Bank. In a separate matter, Marin has filed suit against some the district’s original board members and professional consultants in an attempt to recover some of the misappropriated funds. Re/Max agent Rike Palese has settled out of court, claiming no wrongdoing, but paying $100,000. The district’s previous lawyer Paul Cockerel and accountant LeAnn Jones have yet to settle, as the district hopes its professional-liability insurance will replenish the misappropriated funds.

On Dec. 12, the Marin board, the district’s legal adviser and accountant held a meeting attended by more than 15 Landmark residents, some of whom asked hard questions of the board and its advisers. Some residents were dissatisfied and dismayed with the responses. The issues addressed included the judge’s disapproval of the district’s repayment plan to homeowners. The proposed budget and mill levy were also discussed in a sometimes-contentious manner.
