GREENWOOD VILLAGE A BILL FOR AN ORDINANCE ORDINANCE NO. 08 SERIES OF 2014 INTRODUCED BY: Mayor pro tem kramer AN ORDINANCE AMENDING THE GREENWOOD VILLAGE LAND DEVELOPMENT CODE REGARDING LENGTH OF STAY IN HOTELS AND MOTELS WHEREAS, the Greenwood Village Land Development Code defines a dwelling unit as a housekeeping unit containing cooking, living, sleeping and sanitary facilities; and WHEREAS, only extended stay hotels and motels in Greenwood Village have full kitchens, including a sink, dishwasher, built in cooking facilities and full-sized refrigerators essential to longer term dwelling by an individual or a family; and WHEREAS, persons staying in hotels for long periods tend to have more electrical appliances than a transient guest and more personal belongings stored in the room; and WHEREAS, Colorado law provides that occupants of hotels, motels, inns, rooming houses, and similar accommodations gain status as tenants and residents after 30 days; and WHEREAS, some proprietors of hotels and motels allow long term stays but avoid conferring tenancy status and rights to guests by having them check out before 30 days and check back in; and WHEREAS, a 30-day occupancy limit for hotels and motels intended for transient stays serves the important public purpose of preventing hotels and motels from becoming substandard apartments without rights of tenancy and in violation of zoning laws; and WHEREAS, for reasons of health, safety and welfare, venues allowing longer term occupancy of hotel and motel rooms must comply with applicable zoning, housing, building, and occupancy codes; and WHEREAS, residential use of commercial property is currently prohibited by the Greenwood Village Land Development Code; and WHEREAS, the Greenwood Village City Council desires to regulate the duration of hotel and motel stays to allow some residential use where it is safe to do so, and prohibit stays longer than 30 days where necessary to ensure safety of the guests and maintain the commercial nature of the property in accordance with its zoning designation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS: Section 1. Section 16-1-100 of the Greenwood Village Municipal Code is hereby amended to read as follows: Sec. 16-1-100. GREENWOOD VILLAGE A BILL FOR AN ORDINANCE ORDINANCE NO. 10 SERIES OF 2014 INTRODUCED BY: COUNCILMEMBER PRESLEY AN ORDINANCE VACATING DEDICATED DRAINAGE EASEMENT ON PROPERTY LOCATED IN THE ORCHARD FARMS FILING NO. ONE WHEREAS, the owner of property located north of East Orchard Road and west of South University Blvd. dedicated a drainage easement to the Village by plat in 1980; and WHEREAS, a request has been submitted by the property owner that the City vacate the drainage easement so that the owner
can construct a swimming pool in that location; and WHEREAS, the owner has agreed to dedicate a new drainage easement to the Village to replace the vacated easement; and WHEREAS, City staff has recommended that the City Council approve the request to vacate the easement and move the drainage easement and the detention pond. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS: Section 1. Vacation of Easement. Based on the recommendation of City staff, the City Council hereby vacates the drainage easement located as more particularly described in Exhibit A. Section 2.
Recordation. Upon the
vacation becoming effective as provided herein, the applicant shall cause a copy of this ordinance to be recorded in the office of the Arapahoe County Clerk and Recorder, at the applicant’s own expense. Section 3. Effective Date. This ordinance shall take effect six (6) days after publication following final passage. AN ORDINANCE ORGANIZING THE GREENWOOD VILLAGE HOSPITALITY BUSINESS IMPROVEMENT DISTRICT AND APPROVING AN INITIAL BOARD OF DIRECTORS THEREFORE
(c) A general description of the types of services or improvements or both to be provided by the proposed District;
WHEREAS, the City Council of the City of Greenwood Village (the “City Council”) received a Petition for the Organization of the Greenwood Village Hospitality Business Improvement District (the “Petition”) within the City of Greenwood Village (the “District”) on June 16, 2014;and
(d) The names of three persons to represent the petitioners, who have the power to enter into agreements relating to the organization of the District; and
WHEREAS, in accordance with Section 31-25-1206, C.R.S., on June 16, 2014 the City Council fixed by order the place and time of a hearing on the Petition, which is not less than twenty (20) days nor more than forty (40) days after the date the Petition was received; and
WHEREAS, the allegations of the Petition appear to be true.
WHEREAS, the City Council, following notice as required by Section 31-25-1206, C.R.S. held and concluded such public hearing at 7:00 p.m. on Monday, July 7, 2014 at the Greenwood Village City Hall, at which proponents and opponents of the District had the opportunity to be heard; and WHEREAS, the City Council has found from the tax rolls of Arapahoe County, in which the proposed District is located, that the total valuation for assessment of the taxable real and personal property in the proposed service area of the District is $1,589,289, all of which is classified for

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GREENWOOD VILLAGE, COLORADO, ORDAINS: Section 1. Pursuant to its authority to organize business improvement districts under Part 12 of Article 25 of Title 31, C.R.S., and specifically Section 31-25-1207, C.R.S. the City Council, as governing body of the City of Greenwood Village, hereby adjudicates all questions of jurisdiction to find that jurisdiction is vested in the City Council to organize the business improvement district described in the Petition. Section 2. The City Council hereby ascertains, based on evidence presented from the tax rolls of Arapahoe County that the total valuation for assessment of the taxable real and personal property in the
proposed service area of the District is $1,589,289, all of which is classified for assessment as commercial and none of which is classified as residential. Section 3. The City Council does not find it to be in the best interests of the District to exclude any property from the District, nor is the City Council required to do so in accordance with Section 31-25-1208, C.R.S. Section 4. In accordance with Section 31-25-1207(5), C.R.S. the City Council hereby finds, based upon the Petition and other evidence presented to the City Council, that: the Petition has been duly signed and presented in conformity with Part 12 of Article 25 of Title 31, C.R.S.; the allegations of the Petition are true; and the types of services or improvements to be provided by the proposed District are those services or improvements which best satisfy the purposes set forth in Part 12 of Article 25 of Title 31, C.R.S.; Section 5. In accordance with Section 31-25-1207(5), C.R.S., the City Council hereby declares the District organized and finds that it shall have the boundaries and service area as set forth in Exhibit A attached hereto and incorporated herein by reference. Section 6. In accordance with Section 31-25-1207(5), C.R.S., the City Council hereby gives the District the corporate name “Greenwood Village Hospitality Business Improvement District” as specified in the Petition, by which, in all subsequent proceedings, it shall be thereafter known. Section 7. In accordance with Section 31-25-1207(5), C.R.S., the District shall be a quasi-municipal corporation and political subdivision of the State of Colorado with all powers and responsibilities thereof, and specifically the powers set forth in Part 12 of Article 25 of Title 31, C.R.S. Section 8. Pursuant to Section 3125-1209(1)(a), C.R.S., the City Council provides by this ordinance for the creation of a board of directors comprised of not fewer than five eligible electors to be appointed by the City Council in accordance with Section 31-25-1209(1)(b), C.R.S. Section 9. The actions of the City Clerk and petitioners in setting and providing public notice of the public hearing on the Petition as set forth in Section 31-25-1206, C.R.S. are hereby ratified and confirmed. Section 10. There shall be no mill levy set by the District. Section 11. Effective Date. This ordinance shall take effect six (6) days after publication following final passage.
