ENG EDITORIAL It is a great satisfaction and privilege for me to present the II International Conference “Juvenile Justice in Europe: a framework for integration”, organised by the International Juvenile Justice Observatory which is being held on the 24th and 25th of October in Brussels, capital of the European Community and main headquarters of the European institutions, including the European Parliament which I am honoured to belong to. The mission of the International Juvenile Justice Observatory is to provide an international and multidisciplinary view of juvenile justice through which it can promote awareness, knowledge and the development of policies, legislations and appropriate methods of intervention on an international scale. These are the reasons which inspire me to support and present these conferences, since juvenile delinquency and juvenile justice are issues which go beyond the borders of the member states and cause great concern among the European institutions and citizens. Owing to the central location of Brussels and its status as the capital, the papers and workshops being presented these days promise to be productive in results. I hope that these conferences enable us to draw conclusions which will have a more or less immediate effect on the policies of the Community and the member states. A clear example of the interest shown by the European institutions in this important issue and the accessibility of European citizens and their organisations to voice their concerns to the European Union authorities is the Opinion “Preventing juvenile delinquency and the role of juvenile justice in the European Union”, recently approved by the European Economic and Social Committee. It was read by José María Zufiaur Narvaiza from Spain with the president of Fundación Diagrama collaborating as an expert. This document correctly synthesises the main aspects of the problem of juvenile delinquency and juvenile justice in Europe, proposing specific actions to be adopted through the Community’s decisionmaking institutions (the European Council, Commission and Parliament), in order to achieve common directives and orientations for the member states. The criteria should lead to greater effectiveness in the fight against juvenile delinquency and in the reintegration and re-socialisation of these youngsters and juveniles. To conclude, the debates, reflection and analysis carried out by juvenile justice experts and professionals who have come from all over Europe and from other countries in the world to participate in this Conference will help us make progress in achieving the objectives marked by the UN’s Convention on the Rights of the Child and by other international regulations of the UN and the European Council, thus building a Europe of greater justice and solidarity, especially towards the most disadvantaged sectors of its population, including young offenders.

ENG PRESENTATION BRUSSELS 2006 Since its beginning, the goal of The International Juvenile Justice Observatory has been the promotion of developing a public opinion conscious of the rights of children and, especially, juveniles in conflict with the law. Every two years, the IJJO organizes an International Conference with the aim to make possible the meeting of professionals, public organizations, institutions and universities under a common interest: the development of a GLOBAL AND WITHOUT FRONTIERS JUVENILE JUSTICE. The First International Conference took place in Salamanca (Spain) in October, 2004, under the title "Juvenile Justice and the Prevention of Juvenile Delinquency in a Globalized World", with the participation of more than 300 persons from 30 countries from all over the world. This meeting opened the debate and the analysis concerning the different strategies of juvenile crime prevention, as well as the recent evolution of juvenile justice systems in the world. To continue on the advances achieved in Salamanca 2004, the International Juvenile Justice Observatory, which belongs to Foundation Diagrama, has collaborated in the elaboration of a European Opinion on "Prevention of the juvenile delinquency. The models of Treatment of the Juvenile delinquency and the role of the Juvenile Justice in the European Union", submitted to the European Economic and Social Committee (EESC), by Mr. JosĂŠ Maria Zufiaur, President of the Latin American Follow-up Committee and Adviser of the EESC. For this reason, The Second International Conference of The International Juvenile Justice Observatory will be held in Brussels (Belgium) on 24th, 25th October 2006.
The subject matter of this conference is based on the challenge of promoting a reflection about a major harmonization of legislation and common ways of action in prevention, treatment and integration policies, regarding juveniles and young people in conflict with the law. The analysis will focus on the following main subjects: F Juvenile delinquency prevention strategies.
F Juvenile Justice Systems and possible improvements: Implementation of measures and the development of organizations.
F New ways of dealing with offenders in institutions. F Integration and aftercare.

It is an international metropolis - a mosaic of languages, cultures, and traditions. ENG PRESENTATION IJJO The main aim of the International Juvenile Justice Observatory – IJJO – created in 2003, is to promote a juvenile justice without frontiers. This aim is invariably guided by the Convention on the Rights of the Child, adopted by the United Nations in 1989 and more specifically by the Beijing Rules on the administration of juvenile justice, approved in 1985. The IJJO offers a permanent and international service which promotes the study and the analysis of juvenile justice in the world and allows the encounter of professionals in Law, Criminology, Police, Psychology, Sociology and Education, etc. Through its meetings, the IJJO generates an international forum to analyse and exchange knowledge about legislations, intervention models and researches related to the problematic of juvenile delinquency. By encouraging the creation and follow-up of international groups specialised in juvenile justice, the IJJO aims to contribute to the projections and improvements of national laws as well as the development of educational intervention programmes and research related to minors at risk of social exclusion. The Observatory also offers its users and collaborators an extended data base that is being updated each day and which contains over 10.000 documents of all kind (press, events, reports, legislation, training, …) related to juvenile delinquency and juvenile justice. European Opinion "The prevention of juvenile delinquency. Ways of dealing with juvenile delinquency and the role of the juvenile justice system in the European Union". The International Juvenile Justice Observatory has collaborated to in Opinion about the Prevention of the Juvenile Delinquency presented before the European Economic and Social Committee by Mr. José Maria Zufiaur, President of the Latin American Follow-up Committee and Advisor of the European Economic and Social Committee. According to the Recommendation of the Committee of Ministers for the Council of Europe on September 24th, 2003, juvenile delinquency has become a subject of great concern in the majority of European countries. This Recommendation also evokes the need to set up new answers on a European scale, giving more importance to multidisciplinary coordination. Considering the principles of the Recommendation, the main aims of this proposal of Opinion are: to develop a common policy of prevention of juvenile delinquency and to work out guidelines of good practices facilitating a uniform implementation in Europe. The final voting took place during the EESC plenary session on the 15th March 2006 and The European Opinion was approved with 98 votes in its favour. Please see annexe: page 171

C’est pour moi une satisfaction de présenter la II Conférence internationale intitulée “La Justice juvénile en Europe : un cadre pour l’intégration” organisée par l’Observatoire international de Justice juvénile les 24 et 25 octobre prochains à Bruxelles, capitale communautaire et siège principal des institutions européennes, parmi lesquelles se trouve celle à laquelle j’ai l’honneur d’appartenir, le Parlement européen. La mission de l’Observatoire international de Justice juvénile est d’apporter une vision internationale et interdisciplinaire de la justice juvénile et de stimuler, à travers celle-ci, la connaissance ainsi que le développement international de politiques, de législations et de méthodes d’intervention adéquates. Ce sont toutes ces raisons qui me poussent à soutenir et présenter ces conférences, car je considère que la délinquance juvénile et la justice du mineur sont des questions qui vont au-delà du domaine de compétence des Etats et qu’elles suscitent une grande préoccupation au sein des institutions et des citoyens européens. La position centrale de Bruxelles, doublée de son statut de capitale, laissent présager des interventions et des ateliers de travail qui porteront leurs fruits tout au long de ces journées. J’espère que ces journées de travail nous permettront d’aboutir à des conclusions efficaces, à effet plus ou moins immédiat, sur les politiques communautaires et celles des Etats membres. Un exemple de l’intérêt témoigné par les institutions européennes sur ce sujet ainsi que les préoccupations et questions que les citoyens européens et leurs organisations ont face aux instances de l’Union européenne réside dans l’Avis d’Initiative “La prévention de la délinquance juvénile, les moyens de traitement de la délinquance juvénile et le rôle de la justice du mineur au sein de l’Union européenne” approuvé récemment par le Comité économique et social européen, au cours duquel est intervenu l’Espagnol José María Zufiaur Narvaiza et auquel Fundación Diagrama a collaboré par le biais de son Président, présent en qualité d’expert. Ce document synthétise avec une grande exactitude les principaux aspects que revêtent les questions de la délinquance juvénile et de la justice du mineur en Europe, proposant des actions concrètes soumises à adoption auprès des institutions communautaires dotées d’une capacité de décision (Conseil, Commission et Parlement européen), afin d’aboutir à des directives ou à des orientations communes pour tous les Etats membres. Ces critères devraient nous permettre de gagner en efficacité dans la lutte contre la délinquance juvénile et dans la réinsertion et la re-socialisation de ces jeunes et mineurs. En conclusion, à travers le débat, la réflexion et l’analyse des experts et des professionnels de la justice juvénile venus de toute l’Europe et du reste du monde pour assister à cette conférence, nul doute que nous ferons des progrès dans l’atteinte des objectifs établis par la Convention des Droits de l’Enfant de l’ONU et par d’autres normes internationales établies par les Nations Unies et le Conseil de l’Europe, construisant ainsi une Europe plus juste et solidaire, en particulier pour les segments les plus défavorisés de sa population, parmi lesquels se trouvent les jeunes délinquants.

Tous les deux ans, l'OIJJ organise une Conférence Internationale afin de permettre la rencontre de professionnels, de membres d'organismes publiques et d'institutions ainsi que des universitaires, poursuivant le même objectif : développer une JUSTICE JUVENILE GLOBALE ET SANS FRONTIERE. La première Conférence Internationale qui s'est déroulé à Salamanque (Espagne) en octobre 2004, ayant pour thème "La Justice Juvénile et la Prévention de la Délinquance dans un monde globalisé", a rendu possible la participation de plus de 300 personnes provenant de 30 pays différents. Cet événement a favorisé la création de débats et a permis l'analyse de distinctes stratégies de prévention de la délinquance juvénile, ainsi que de récentes évolutions des systèmes de justice du mineur dans le monde entier. Afin de poursuivre les avancées obtenues à Salamanque 2004, l'Observatoire International de Justice Juvénile, organisme appartenant à la Fondation Diagrama, a collaboré à l'élaboration d'un Avis sur "La prévention de la délinquance juvénile, les modes de traitement de la délinquance juvénile et le rôle de la justice des mineurs dans l'Union Européenne", présenté au Comité Economique et Social Européen (CESE), par Mr. José Maria Zufiaur, Président du Comité de Suivi d'Amérique Latine et Conseiller du CESE. Dans ces conditions, la II Conférence Internationale de l'Observatoire International de Justice Juvénile aura lieu à Bruxelles (Belgique) le 24 et 25 octobre 2006. Le thème de cette nouvelle édition est né de la volonté de promouvoir une réflexion sur
l'harmonisation des législations, ainsi que sur la création de lignes d'action communes en terme de politique de prévention, d'insertion et d'approche de la délinquance juvénile. L'analyse se focalisera sur quatre axes principaux.

L’Observatoire International de Justice Juvénile - OIJJ-, créé en 2003, a pour objectif principal de promouvoir une justice juvénile sans frontière, ayant pour référence la Convention des Droits de l’Enfant adoptée en 1989 par les Nations Unies et plus précisément les Règles de Beijing concernant l’administration de la justice pour les Mineurs, approuvées en 1985. Pour cela, l’OIJJ offre un service international et permanent destiné à promouvoir l’étude et l’analyse de la justice juvénile dans le monde et permettant la rencontre de professionnels du Droit, de la Criminologie, de la Police, de la Psychologie, de la Sociologie, de l'Education, etc. A travers ses rencontres, l’OIJJ génère un forum d’envergure mondiale d'analyse et d’échange de connaissances et d’expériences sur les législations, les modèles d'intervention et les recherches liés à la problématique de la délinquance juvénile. En encourageant la création et le suivi de regroupements internationaux dans le domaine de la justice juvénile, l’OIJJ a pour but de contribuer à l’avancée et l’amélioration des législations nationales ainsi que de favoriser le développement de nouveaux programmes d’intervention éducative et de recherches relatives aux mineurs à risque d'exclusion sociale. L’Observatoire offre aussi à ses usagers et collaborateurs une large base de données quotidiennement actualisée comprenant plus de 10000 documents en tout genre (presse, événements, rapports, législations, formation, …) en relation avec la délinquance juvénile et la justice du mineur. Avis Européen "La prévention de la délinquance juvénile, les modes de traitement de la délinquance juvénile et le rôle de la justice des mineurs dans l'Union Européenne". L’Observatoire International de Justice Juvénile a collaboré à l’élaboration d’un Avis sur la Prévention de la Délinquance Juvénile, présenté au Comité Economique et Social Européen par Mr. José Maria Zufiaur, Président du Comité de Suivi d’Amérique Latine et Conseiller du Comité Economique et Social Européen. Selon la recommandation du Comité des Ministres du Conseil de l’Europe, du 24 septembre 2003, la délinquance juvénile est devenue un sujet de grande préoccupation dans la plupart des pays européens. Ce texte évoque aussi la nécessité de mettre en place de nouvelles réponses à l’échelle européenne, tout en privilégiant une coordination inter-institutionnelle. Considérant les principes mis en exergue dans la recommandation sus visée, l’objet de cette proposition d’avis est double: développer une politique commune de prévention de la délinquance juvénile et élaborer un guide de bonnes pratiques facilitant une actuation uniforme en Europe. Es para mi una satisfacción presentar la II Conferencia Internacional “La Justicia Juvenil en Europa: un marco para la integración” organizada por el Observatorio Internacional de Justicia Juvenil que se celebra los días 24 y 25 de octubre en Bruselas, capital comunitaria y sede principal de las instituciones europeas, entre las cuales se encuentra la que me honro en pertenecer, el Parlamento Europeo. La misión que realiza el Observatorio Internacional de Justicia Juvenil es la de aportar una visión internacional e interdisciplinar de la justicia juvenil y, a través de ésta, fomentar el conocimiento y el desarrollo internacional de políticas, legislaciones y métodos de intervención adecuados. Son estas las razones que me inspiran a apoyar y presentar estas conferencias, ya que la delincuencia juvenil y la justicia del menor son cuestiones que superan el ámbito de los estados y que suscitan gran preocupación entre las instituciones y los ciudadanos europeos. La ubicación central de Bruselas, así como su carácter capitolino, hacen presagiar que las ponencias y mesas de trabajo que se desarrollen a lo largo de estos días serán pródigas en resultados. Espero que, estos días de trabajo, nos conduzcan al planteamiento de conclusiones que puedan producir efectos, más o menos inmediatos, en las políticas comunitarias y de los estados miembros. Un ejemplo del interés de las instituciones europeas por el tema que nos ocupa así como del acceso que las preocupaciones e inquietudes de los ciudadanos europeos y de sus organizaciones tienen ante las instancias de la Unión Europea es el Dictamen de iniciativa “La prevención de la delincuencia juvenil, los modos de tratamiento de la delincuencia juvenil y el papel de la justicia del menor en la Unión Europea” aprobado recientemente por el Comité Económico y Social Europeo, en el que ha sido ponente el español José María Zufiaur Narvaiza y en el que la Fundación Diagrama ha colaborado a través de su presidente, en condición de experto. Dicho documento sintetiza muy acertadamente los principales aspectos que abarcan el problema de la delincuencia juvenil y de la justicia del menor en Europa, llegando a plantear actuaciones concretas que, desde las instituciones comunitarias con capacidad de decisión (Consejo, Comisión y Parlamento europeos) se pueden adoptar, a fin de conseguir directrices u orientaciones comunes para los estados miembros. Estos criterios deberían conducir a lograr una mayor eficacia en la lucha contra la delincuencia juvenil y en la reinserción y resocialización de estos jóvenes y menores. En conclusión, a través del debate, la reflexión y el análisis de los expertos y profesionales en justicia juvenil de toda Europa y de otros países del mundo, participantes en esta Conferencia, se conseguirá sin duda avanzar en el logro de los objetivos marcados por la Convención de Derechos del Niño de la ONU y por otras normas internacionales tanto de Naciones Unidas como del Consejo de Europa, logrando así una Europa más justa y solidaria, especialmente con los sectores más desprotegidos de su población entre los que se encuentran los menores y jóvenes infractores.

PRESENTACIÓN BRUSELAS 2006
Con carácter bianual, el OIJJ organiza una Conferencia Internacional con el objetivo de hacer posible el encuentro de profesionales, organismos públicos, instituciones y universidades bajo un interés común: el desarrollo de una JUSTICIA JUVENIL GLOBAL Y SIN FRONTERAS. La Primera Conferencia Internacional se celebró en Salamanca (España) en octubre de 2004, bajo el titulo “Justicia Juvenil y Prevención de la Delincuencia en un mundo globalizado”, contándose con la participación de más de 300 asistentes procedentes de 30 países de distintas regiones del mundo. Dicho encuentro permitió el debate y el análisis en torno a las distintas estrategias de prevención de la delincuencia juvenil, así como la evolución reciente de los sistemas de justicia del menor en el mundo. Como continuación de los avances logrados en Salamanca 2004, el Observatorio Internacional de Justicia Juvenil, perteneciente a la Fundación Diagrama, ha colaborado en la elaboración de un Dictamen sobre “La prevención de la delincuencia juvenil, los modos de tratamiento de la delincuencia juvenil y el papel de la justicia del menor en la Unión Europea” presentado ante el Comité Económico y Social Europeo (CESE), por D. José María Zufiaur, Presidente del Comité de Seguimiento América Latina, y Consejero del CESE. Por este motivo, la Segunda Conferencia Internacional del Observatorio Internacional de Justicia Juvenil tendrá lugar en Bruselas (Bélgica) el 24 y 25 de octubre de 2006.
La temática de esta nueva conferencia nace del reto de promover la reflexión sobre la conveniencia de un mayor grado de armonización de las legislaciones, así como sobre la creación de líneas de acción comunes en las políticas de prevención, de tratamiento e inserción respecto a los menores y jóvenes en conflicto con la ley. El análisis se centrará en los cuatro ejes siguientes:

INFORMACIÓN SOBRE BRUSELAS
El Observatorio Internacional de Justicia Juvenil-OIJJ-, creado en el año 2003, tiene como principal objetivo promover una justicia juvenil sin fronteras guiada siempre por la Convención de los Derechos del Niño, adoptada por las Naciones Unidas en 1989, y por las Reglas de Beijing sobre la Administración de la Justicia de Menores, aprobadas en 1985. Para ello, el OIJJ ofrece un servicio internacional y permanente destinado a promover el estudio y el análisis de la justicia juvenil en el mundo y a permitir el encuentro de profesionales de distintos ámbitos: Derecho, Criminología, Policía, Psicología, Sociología, Educación, etc. A través de estos encuentros, el OIJJ genera un forum de ámbito mundial en el que se analizan e intercambian conocimientos y experiencias sobre legislaciones, modelos de intervención e investigaciones relacionadas con la problemática de la delincuencia juvenil. Mediante el fomento de la creación y el seguimiento de estos grupos internacionales de justicia juvenil, el OIJJ tiene como meta contribuir en el avance y la mejora de las legislaciones nacionales así como favorecer el desarrollo de nuevos programas de intervención educativa y de investigaciones centradas en los menores en riesgo de exclusión social. El Observatorio ofrece también a sus usuarios y colaboradores una amplia base de datos, actualizada diariamente, en la cual se contienen más de 10.000 documentos de todo tipo (prensa, eventos, informes, legislación, formación,…) relacionados con la delincuencia juvenil y la justicia del menor. Dictamen Europeo: "La prevención de la delincuencia juvenil, los modos de tratamiento de la delincuencia juvenil y el papel de la justicia del menor en la Unión Europea". El Observatorio Internacional de Justicia Juvenil ha colaborado en la elaboración de un Dictamen Europeo de Prevención de la Delincuencia Juvenil ante el Comité Económico y Social Europeo, presentado por D. Sr. José María Zufiaur, Presidente del Comité de Seguimiento América Latina, y Consejero del Comité Económico y Social Europeo. La Recomendación del Comité de Ministros del Consejo de Europa, del 24 de Septiembre de 2003, señala que la delincuencia juvenil es una cuestión de gran preocupación en la mayoría de los países europeos, destacándose igualmente la necesidad de promover nuevas respuestas y nuevos métodos de intervención a nivel europeo desde una dimensión multidisciplinar, y de coordinación de las instituciones implicadas. Partiendo de los principios de la Recomendación mencionada, el Dictamen Europeo de Prevención de la Delincuencia Juvenil pretende promover la homogeneización de una política de prevención frente a la delincuencia juvenil y desarrollar un catálogo de buenas prácticas que permita establecer criterios y líneas comunes de actuación en Europa. El Proyecto de Dictamen fue sometido a votación el día 15 de marzo de 2006 en el plenario del CESE, y adoptado por 98 votos a favor, ninguno en contra. Ver anexo: página 187

Collect of good European practices in the field of juvenile crime that fall into three main areas: prevention, educational treatment in the local community or centres, and socio-occupational integration. Information on the laws of the MS on juvenile delinquency in order to establish an inventory of relevant projects and submit it to European Crime Prevention Network (EUCPN) of MS for further consideration. Studies could be possibly financed by the Commission to analyse and to compare the legislation of all 25 MS. There is a need for operational cooperation between all services involved so that juvenile delinquency can be addressed on an interdisciplinary and multi-institutional basis. European crime prevention will have to match up to a comparative analysis between instruments of different nature as well as evaluations with regards to the effectiveness of policy blends, for instance in the cases of European mass events, with regard to the prevention of juvenile crime or as concerns multi-disciplinary co-operation of stakeholders in the context of local security and/or community safety policies. The statistics action plan recently adopted by the Commission will measure juvenile crime and juvenile justice and try to identify policy needs while developing indicators taking into account current work by international organisations."

As a result of his perseverance in 1985, the bill of rights was finally created and in January, 1986, the United Nations General Assembly passed the newly drafted bill of rights which is called, “The United Nations Standard Minimum Rules on the Administration of Juvenile Justice”. These rules have an effect on the lives of millions of young offenders around the world and many more millions of young offenders in the future. 'The United Nations bill of rights for young offenders: What has happened since 1986?.' Abstract: In September, 1980 when I attended the Sixth Congress on the Prevention of Crime and the Treatment of Offenders held in Caracas and presented my paper on the need for a bill of rights for young offenders, the United States delegation agreed with my proposal and the next day they brought forth a resolution asking the delegates to instruct the United Nations Secretariat to conduct world-wide meetings for the following five years to draft up such a standard. In 1985, the proposed bill of rights, called the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (the Beijing Rules) was discussed at length at the Seventh Congress held in Milan and the Rules were accepted and finally approved by the delegates and then they were latter adopted by the U.N. General Assembly in January 1986. The Rules were to have an effect on millions upon millions of children around the world, children in need of protection from abuse in our justice and correctional systems. To the children in trouble with the law in many of the signatories to the convention, the Rules were a godsend.

She was formerly the director of the “Research and Documentation Centre of the Ministry of Justice” in the Netherlands (WODC). For many years, she chaired a selected committee of experts on Juvenile Delinquency at the council of Europe, and at many other international institutions. In 1989, she received the Sellin-Glueck Award of the American Society of Criminology for her "International contributions to Criminology." She has published many books, articles and research reports which mainly related to “juvenile delinquency”, “the treatment of young delinquents” and “youth criminal law”. She is currently a visiting professor in Criminology at the University of Lausanne and a research fellow at the E.M. He has a long-standing interest in drugs, crime and the penal systems of Europe, and in evaluations of projects that aim to reduce social exclusion. He is experienced in multi-national projects that integrate quantitative and qualitative research methods. Alex has managed a range of transnational projects sharing practice on social exclusion.These include a Leonardo da Vinci project that produced the Stepping Stones multimedia package for people with learning disabilities, three ESF EQUAL Development Partnerships and ‘Participatory Projects in Mainstream Governance’, a four-country examination of how disadvantaged communities can be enabled to participate in decision-making and. He has published work in the fields of social exclusion, participation, drugs and criminal justice. Brian has vast experience of working with young people in a variety of settings both statutory and non-statutory. He also has experience of managing a variety of institutions from school departments through to PRUs and Youth and Community Centres. Brian also has a background in counselling and training. He has been involved in a wide range of projects from Combating Disaffection among African-Caribbean Males to working as an Associate Lecturer with Brunel writing and delivering a PGC course in Guidance and Counselling Skills. Brian established the Pupil Parent Partnership in 1995 and as well as working with the young people he heads many current projects ranging from a Gun Crime and Substance Misuse project to an ESF pan European project; Europeace, finding innovative ways of addressing violence and discrimination among young people. 'A Framework for Effective engagement of Young Offenders.' Abstract: Establishing a theoretical framework to support social interventions for children at risk of offending. PPP Ltd. is an NGO, based in West London, that was set up in 1993 as a result of repeated riots in Southall. This violent behaviour was mainly perpetrated by male youth or young men. There was a request from the Metropolitan Police to the London Borough of Ealing to set up an innovative project that would focus on responding to this particular client group. The brief for the PPP, therefore, was to devise an effective model of working with violent and criminal behaviour. The PPP has been engaged in this process for the past 13 years. We now work with about 250 young people and their families every year in an effort to facilitate changes in their behaviour and ability to lead independent and purposeful lives. We have also led a ‘Youth’Action 5 Project, involving 5 other countries (Norway, The Netherlands, Bulgaria, Serbia and Slovakia) around the theme of Children & Violence. It is the research, delivery an training experience gathered from these activities that has enabled the PPP to begin formulating a theoretical framework to support social interventions for children and families at risk. It is a model that emphasises the ‘Why’ and ‘How’rather than the ‘What’. We feel that an enormous amount of ideas are generated around different types of interventions in an effort to initiate changes of behaviour in this client group. An equal focus on our motives and devising more effective was of delivering services would

generate greater success. The model is based on a foundation of three practices: Reflexive Practice: The ability to consider a variety of influences in decision making, including personal history. Non-oppressive Practice: being able to approach all relationships with an awareness of possible prejudices. Multi-Disciplinary Practice: The ability to think and act professionally in a variety of disciplines. The model then emphasises the importance of human qualities, such as Honesty, Integrity, Trust and Resilience, that are critical to service delivery and yet not the focus of any practitioner or policy maker training. Theories devised by academics, researchers and practitioners around the subject of children and families also deserve consideration. Theories such as attachment, attunement or brain development should shape the delivery of services. Finally, the model focuses on the application of the above, underlining aspects such as evaluation, training and professional supervision. It is a model that is still evolving, but that we believe should be used in all service delivery to children and families. We look forward to the opportunity to develop this important work.

(abramson111@yahoo.com) Biography: Mr. Abramson is a human rights attorney based in Geneva, where he has been specializing in the Convention on the Rights of the Child since 1992. As a former Assistant Attorney General for the State of Alaska, Mr. Abramson was responsible for juvenile delinquency and child abuse and neglect cases. Mr. Abramson has also served as the Attorney General of the Republic of the Marshall Island during that country’s transition to independence. 'Gender: Without paying attention to boys, there is no prevention.' Abstract: Boys make up the overwhelming majority of juvenile offenders, and inmates in detention facilities. And yet advocacy for juvenile justice reform ignores the gender dimension of the problems. Likewise, in the children’s rights/ human rights movement, the gender aspect of all issues, including detention and other juvenile justice concerns, is focused on girls. In order for delinquency strategies and programs to work, we have to overcome the resistance to talk about boys. My presentation will make three points: (i) Juvenile justice is about boys, primarily. (ii) The needs and rights of boys are routinely and systematically overlooked in favour of girls. (iii) Prevention requires gender (i.e., boys)-specific interventions.

La protección del menor frente a este tipo de agresiones, como sujeto especialmente vulnerable, ha de constituir una prioridad para la sociedad de en conjunto, y para los poderes públicos en particular, pues el sujeto pasivo de aquellos hechos delictivos (abandono, lesiones, agresiones sexuales...), además del menor víctima, que ha de ser tratado como persona y como titular de derechos inalienables y es el que sufre los efectos inmediatos del delito (el daño a su integridad física y psíquica) y aquellas secuelas derivadas del mismo que ponen en peligro su desarrollo psicosocial y su capacidad de adaptación, lo es también toda la sociedad en cuanto, este contexto, según numerosos informes psicológicos y sociológicos, repercute en el menor delincuente, de modo que existe un alto grado de probabilidad de que si dentro de los hogares se dan comportamientos violentos el menor tendrá plena disposición hacia la violencia, que no será ya solamente juvenil, sino que puede extenderse al resto de su vida.

She evaluated a restorative practice for crimes such as assaults and armed robberies, committed by juveniles and published various articles on the topic. She is currently vice-chair of the European Forum for Restorative Justice, after being the chair of its Research Committee (2000-2005). She was a partner in the Grotius project “Victim Offender Mediation for Juveniles in Europe”(2002-2004). Her research interests lay in juvenile criminology, victimology and restorative justice. Mrs. Annemieke Wolthuis. Defence for Children International. Netherlands. (a.wolthuis@defenceforchildren.nl) Biography: Annemieke Wolthuis is project coordinator of the section Dutch youth Law at Defence for Children International in The Netherlands. For more than ten years she is involved in research and lobby work in the field of children's rights. Recent publications and reports of her hand are mainly in the area of juvenile justice and alternatives such as restorative justice. She is also a member of the editorial board of the Dutch journal on Restorative justice. She has a law degree from the University of Maastricht and an LLM in International Law and Human Rights of the Raoul Wallenberg Institute in Lund, Sweden. 'Trends in the Dutch Juvenile Justice Policy.' Abstract: The Dutch Juvenile Justice system is based on pedagogical pillars. A youngster should be able to learn from a mistake. Detention should be a measure of last resort. However these days we see a trend towards more punitive sanctions. The number of young detainees is growing, there are discussions about detaining more youngsters in one cell and correctional homes such as Glenn Mills have the interest of politicians. We also see in some severe cases that adult criminal law is used for youngsters aged 16 or 17 at the age of the crime. At the same time there is also interest and room for more alternatives. Restorative justice practices are slowly finding their way in the Dutch juvenile justice arena. In addition to HALT which has restorative elements, there are successful projects on police level and carried out by schools and in the youth care. At the level of the public prosecutor some steps have been taken. So far the Dutch (juvenile) courts have not participated in the restorative justice practices. In other countries such as New Zealand, Canada, Belgium and Austria more experience exists. International instruments force the state to undertake more efforts and to make mediation in penal cases a fact. Especially for more serious offences the process of a meeting with victim, offender and important people from their social networks is a promising method. Children should learn from their mistakes. By confronting them with the results of their acts and giving them a possibility to repair the harm this can be realized. At the same time the victim and society can also benefit. Useful aspects of these experiences will be placed in the Dutch juvenile justice context.

At the national level, Doina Balahur has developed several research projects on the Reform of Romanian Juvenile Justice and also on Restorative Justice and the Reform of Romanian Justice System. Among the international professional organizations she is affiliated with, the most important are: International Sociological Association, Research Committee for Sociology of Law, European Sociological Association, European Forum for Restorative Justice etc. Her recent publications include, Child and Childhood in Romania, Restorative Justice and Probation in Romania, Probation and Community Reintegration Child’s Rights Protection, etc. 'The Reform of Juvenile Justice in Romania: Restorative Justice and Diversion Strategies and Measures.' Abstract: The paper presents the results of the research activity carried out by the author as a member of the Steering group organized by the Romanian Minister of Justice in order to implement the UK/DFID project on the alternative strategies and measures. It makes an analysis on the legal, organizational, professional and educational steps taken in order to bring Romanian Juvenile Justice System in line with the UN documents, rules (guidelines) and regulations in the matter –especially with UN Convention on the Rights of Child - and with the European standards (set up both by the European Union and by the Council of Europe) in the field of the treatment of child in conflict with criminal law. Analytically, the study will approach the process of the development of the Romanian national system of probation and the victims of crime assistance, and the process of the institutionalizing of the juvenile courts. as well. Statistics at national and regional level are provided; case studies are presented in order to illustrate the development of a new Juvenile Justice System in Romania focussed on the children and teenagers reintegration and juvenile delinquency prevention. These analyses are accompanied by comparative perspectives with former communist countries. As a manager of the Romanian Network of Restorative Justice and member of the management committee of the European program COST A21, Restorative Justice Developments in Europe, the author will also present the steps taken by Romania in order to implement RJ practices within the Juvenile Justice system.

He graduated in psychology and criminology from the University of Ottawa, Canada in 1984 and in 1987 was awarded the degree of MA in Criminology. In 1988 he was awarded an MPhil in Criminology at Cambridge University where he went on to work as a researcher and amongst other projects completed a national evaluation of the youth justice system in England and Wales. In 1995 he was appointed as lecturer in Youth Justice at the Institute of Criminology and Criminal Justice, at the School of Law, Queen’s University, Belfast and was promoted to senior lecturer in 2002. David is presently directing a research study with colleagues from Queen’s University, the University of Ulster, University of Sheffield and University of Wales examining restorative justice practices with young offenders. During the latest 10 years made a great number of prison studies among others on behalf of the Ministry of Social Affairs and the Department of Corrections mainly in order to describe the outcome of different projects for criminal drug addicts. Main issue of research: Reactions to crime towards different groups of citizens. 'Juvenile justice in the Scandinavian Countries - Juveniles on the edge of society: between support and force.' Abstract: Juvenile Justice in the Scandinavian Countries – Juveniles on the edge of society: between support and force. The main issue in the presentation is the legal protection of children and juveniles suspected of or convicted for crime. Particular juvenile justice systems do not exist in Scandinavia. There are, however, exceptions from the general system in order to maintain needs, interests and rights of children and juveniles. Some common characteristics as for instance diversion of juveniles from prison into social welfare measures and the prohibition of placing children in jail are described. Individual characteristics in each of the Scandinavian countries are pointed out as well. Introduction of secure social institution as an alternative to imprisonment in Sweden and Denmark is one, mediation processes with children as parties in Finland and Norway is another. Not least the diversion and alternative strategies towards juveniles places juveniles on the edge of two societal systems namely the social welfare system and the penalty system. It is argued that from the point of view of legality the demands for legal rights are of greatest importance in prosecution and punishment matters whereas social welfare support not to the same degree concern about such questions. But more consideration might be given to the field where the two systems meet/confront each other. If time allows a few examples of the Scandinavian countries challenging the UN Convention on the Rights of the Child and the short distance between constructive pragmatism and destructive loss of principles as legality, equality and proportionality will be enlightened.

(goerdeler@dvjj.de) Biography: Studied law in Frankfurt am Main till 1996; legal clerkship in Wiesbaden till 1999; Judicial Officer in the Green parliamentary party in the German Bundestag, Berlin, till 2002; Since 2002: chief executive officer of DVJJ, Hannover. ‘Jugendhilfe” (Youth Welfare Service), Police and Criminal Justice – a multiagency and multi-disciplinary approach in Germany.’ Abstract: The presentation will deal with the institutional interfaces in German juvenile justice system. During youth (age 14 – 18) and adolescence (19 – 21) young people are only limited liable in criminal law and are thought to be educated rather than punished. This regards the criminal justice system. But there is rather a lack of an approved and elaborated educational principle or concept to the judicial sanctions. Besides the “classical” judicial measures (penalty, short time arrest, prison sentence) the juvenile court can also issue instructions, that the defendant is to participate at measures of the youth welfare service.

Since both institutions are supposed to “educate”delinquent young people, there is an unclear situation of competency, responsibility and methods between courts and youth service. The youth survive “educates” rather in the sense of “empowerment”. The youth service system of granting (educational and advisory) help follows the principle of voluntariness and confidence, in reach the honest willingness to participate. Similar problem are in the field of crime prevention, where the police and youth service are bond to cooperate. The situation becomes even more complicated since police and justice on one hand and the youth service on the other are run by different bodies: responsible for crime prevention and criminal justice are the federal states, whereas the youth services are run by the communal authorities (town or county authority). The presentation will analyse the aims, methods and instruments the different agencies have at their disposal. It will deal with the problems arising in interdisciplinary crime prevention projects and point out some ideas to advance situation.

Italy (sciappi@yahoo.it) Biography: Silvio Ciappi is a university researcher (professor of criminology at the University of Pisa, Italy) and an expert consultant of Don Calabria Institute in Verona. He is also an honorary juvenile judge and he spent more than 10 years working in corrections. He wrote more than 70 scientific articles and 9 books on different topics regarding the more general issue of criminology and criminal justice (see for instance the last book: 'Periferias de l'Impero', Pontificia Universidad Javeriana, Bogotà, Colombia, 2006). ‘Juvenile Delinquency and illicit drug abuse: the italian multi-disciplinary approaches.’ Abstract: Drug treatment and drug services in the correctional area are specific interventions which reflect a multidisciplinary approach. The Italian experience since the '70s carried out different forms of treatment and prevention of juvenile drug abusers trying to connect the private sector and the public area. This National Drug Strategy was more likely to be a prison administration Drug Strategy, depending on the availability of funding, trained staff and partnerships with NGOs providing drug services in the community. Multidisciplinary working experiences are recognised to be both important and vital in the delivery of services to juveniles.

Il importe alors, dans un cadre contenant, de leur permettre de vérifier qu’admettre avoir une souffrance psychique n’est pas dangereux. Il s’agit souvent de dépressivité et d’auto dépréciation. Parfois ils peuvent s’engager dans un vrai travail psychique. Les modalités de leur prise en charge proposées dans le service seront décrites à l’aide d’exemples.

Bill leads on the YJB’s Health partnership work with national and regional stakeholders to improve access to services for young people in the Youth Justice System. Bill has lead the development of improved substance misuse services for young people in custody and the development of the Board’s new Resettlement and Aftercare Provision (RAP). Bill has worked as a social work practitioner in New Zealand and London for ten years in Hospital, Local Authority and Adult Community Mental Health Teams, and has practiced as an Approved Social Worker managing assessments under the Mental Health Act. He spent 2 years as a research associate with the Sainsbury Centre for Mental Health before joining District Audit as a Value for Money auditor of Local Authority and Health Services, from which he was seconded to the YJB in 2002. 'Working in partnership - to meet the mental health needs of young people in the Youth Justice System in England and Wales.' Abstract: Young people in the Youth Justice system in England and Wales have 3 times the prevalence of mental health needs compared to the general population. This workshop presentation will provide an overview of the Youth Justice system in England and Wales and will define critical partnerships that are required to address offending behaviour and the complex needs of young offenders, including mental health issues and substance misuse. Key findings of research published by the Youth Justice Board into the mental health needs of young people serving community and custodial sentences will be discussed. The work of the Youth Justice Board, Youth Offending Teams and the custodial estate in identifying and addressing the needs of young people will be discussed providing a focus on early screening and assessment, access to Child and Adolescent community

Desde 1989 trabaja en el campo del tratamiento de los trastornos adictivos. Desde 2004 en la intervención terapéutica en menores infractores. ‘Mental disorders in young offenders in custody’ Abstract: Introducción. Se ha relacionado el historial antilegal en la adolescencia con factores sociofamiliares como la pobreza, el hacinamiento, la emigración, el estilo de vida paren tal y los antecedentes patológicos familiares y también con la predisposición individual, especialmente la presencia de comorbilidad psicopatológica y el uso de drogas. El ingreso de menores con trastornos mentales en el sistema judicial refleja un fallo en los sistemas asistenciales de la salud mental y requiere la realización de un screening psicopatológico en los jóvenes arrestados para ofrecerles las mejores alternativas de reinserción. Es objetivo de esta ponencia profundizar en el estudio de la prevalencia de psicopatología en los jóvenes delincuentes y en la importancia que ésta debe tener en la toma de decisiones judiciales educativas y terapéuticas. Material y método. Se ha llevado a cabo una revisión en diversas bases de datos internacionales sobre artículos científicos a cerca de la prevalencia de trastornos mentales en jóvenes internados por actos contra la ley. También se presentan los resultados del estudio de una muestra de menores ingresados en el Centro Educativo Terapéutico Pi Margall en Burjassot (Valencia). Resultados. Los estudios revisados coinciden en la alta prevalencia de enfermedades mentales (del 69 al 100%) entre los jóvenes internados en centros por actos disociales, así como en la alta frecuencia de comorbilidad. Los trastornos externalizantes, especialmente los trastornos de conducta y los trastornos relacionados con sustancias son los más prevalentes, pero se han detectado sorprendentemente altas tasas de otros trastornos, como el TDAH, las psicosis, y trastornos internalizantes (ansiedad y depresión). En una muestra (n=35) en la que estudiamos la incidencia durante 2005 en el centro educativo terapéutico Pi Margall, el 97 % de los menores presentaron algún trastorno psiquiátrico y hemos encontrado la siguiente distribución: T. R. Sustancias (68,57 %), T. Conducta (54,29 %), T. Personalidad (27,61 %), Retraso Mental (20 %), T. Psicóticos (5,71 %), otros (5,71 %). De todos ellos, 2/3 cumplían criterios para el diagnóstico de más de un trastorno psiquiátrico. Conclusiones. Es un hecho científicamente probado la morbilidad psiquiátrica entre los jóvenes con historiales antilegales más graves. Es necesario estudiar en profundidad las características psiquiátricas de esta población para poder ofrecer intervenciones educativas y terapéuticas que cubran las necesidades de la misma. En el aspecto individual, el conocimiento de la realidad psicopatológica de cada menor nos daría la posibilidad de intervenir de manera individualizada y reducir el riesgo de reincidencia. Abstract: Based on Danish experiences with a new sanction for young offenders the problems regarding

treatment in institutions will be discussed. Focus will be on the risk of developing a negative or an antisocial youth culture as unintended consequences of residential treatment. Furthermore, lack of treatment integrity seems to be a problem facing many institutions for young offenders. For these and other reasons, residential treatment of young offenders often is ineffective and sometimes even may prove contra productive.

'New ways of the prevention of the child and juvenile crime.' Abstract: In the last few years the statistics data and characteristics of child- and juvenile crime changed in the worse. This focused the attention to the importance of the child- and juvenile crime prevention. The related international documents emphasize the importance of the role of the community and NGOs. In 2003 “The National Strategy of Social Crime Prevention” was adopted. This document has a special part concerning the fight against the child and juvenile criminality. In the last two years in result of this strategy several projects have opened with governmental support. Most of the preventional projects operate with the cooperation of the state institutions and NGOs. There is a wide scale of solutions and methods as well as the results and experiences are different.

Abstract: L'évolution de la société et celle de la politique pénale ainsi que le rôle et l'importance accrus du droit international ont rendu indispensable une refonte de la législation, notamment pénale du droit en Suisse. A l'instar d'autres pays, une réforme judiciaire importante est en cours. Le 1er janvier 2007, le code pénal suisse modifié qui prévoit un nouveau droit des sanctions entre en vigueur en même temps que le code pénal militaire ainsi qu'une nouvelle loi fédérale régissant la condition pénale des personnes mineures. En Suisse, les cantons et la Confédération ont des compétences propres et partagées. Aussi, pour remplir leurs missions, les cantons qui ont gardé leur statut d'Etats souverains ont développé une collaboration horizontale par le biais d'accords intercantonaux (les concordats) qui peuvent avoir des effets normatifs. Cela étant, les processus notamment législatifs sont lents. Le nouveau droit des mineurs est distinct du code pénal. Il met l'accent sur l'auteur plutôt que sur l'acte répréhensible et il est fondé sur l'idée d'intégration de la personne mineure par l'éducation. Il n'y aura plus obligation d'appliquer le monisme judiciaire mais le dualisme facultatif et le système des peines est élargi et assoupli concrétisant par exemple la pratique de la médiation, les prestations personnelles et la mise en place de mesures protectrices. Néanmoins, ce droit contient des éléments punitifs plus sévères que précédemment réservés exceptionnellement à des mineurs qui se mettent en danger mais aussi qui mettent en danger la collectivité publique. En plus, plusieurs règles procédurales ont été introduites dans le droit matériel, dans le souci d'une harmonisation et pour tenir mieux compte encore des instruments internationaux. Les questions d'exécution tant pour les mesures particulières que pour les peines sont fixées dans le droit fédéral. Eu égard aux nouvelles exigences de ce droit (législation spéciale/autres buts), les cantons latins ont décidé d'adhérer au concordat du 24 mars 2005 sur l'exécution de la détention pénale des mineurs qui devrait entrer en vigueur le 1er janvier 2007. Un dispositif constitué de trois établissements se met progressivement en place. Par ailleurs, la problématique des prises en charge à but thérapeutique en établissement fermé est l'objet d'un projet spécifique. Ce nouveau droit a tenu compte des nouvelles tendances de la délinquance. Il offre des garanties supplémentaires et permettra en particulier de traiter les personnes.

Abstract: Le parlement belge vient d’adopter une nouvelle législation réformant la loi relative à la protection de la jeunesse de 1965 ( mai 2006) qui se veut une «modernisation de la loi de 1965 consacrant une série de pratiques novatrices qui se sont développées tant au niveau des parquets que des tribunaux de la jeunesse. Cette législation venant d’entrer en vigueur veut permettre la combinais des différentes tendances observées au niveau international dans la justice des mineurs: l’intervention extrajudiciaire développée par les parquets, la reconnaissance du sujet de droits, la consécration des mesures réparatrices, responsabilisation du mineur, responsabilisation des parents, droits de la victime… sans oublier la protection de la société. Nous présenterons les différents axes de la réforme: les mesures visant la responsabilisation des parents, le renforcement du rôle des parquets, l’augmentation et la diversification des mesures mises à la disposition des juges de la jeunesse (et des parquets) (alternatives au placement, mesures restauratrices spécifiques) ainsi que les sanctions visant la prise en charge des mineurs délinquants récidivistes. Ces nouvelles perspectives consacrant de nouvelles pratiques seront analysées à la lumière des tendances de mise en cause de la logique protectionnelle (du régime du «welfare») de la justice des mineurs et relevées dans de nombreuses législations en Europe. Le système belge cherche à articuler des mesures dites alternatives par lesquelles le mineur est amené à jouer un rôle actif, avec des mesures protectionnelles ou éducatives et des mesures plus sanctionnelles. Nous questionnons ce dispositif hybride, bien que correspondant aux recommandations du Conseil de l’Europe, en prenant en considération l’expérience de jeunes délinquants et leur vécu de ces différents types de mesure.

Como Asesora del Gabinete del Ministro de Justicia ha desempeñando diversos cometidos relacionados fundamentalmente con la legislación penal. Desde mayo 2004 es Asesora Parlamentaria y, para los asuntos penales, del Gabinete del Ministro de Justicia. Ha participado en la elaboración y tramitación parlamentaria del Proyecto de Ley Orgánica por la que se modifica la Ley Orgánica 5/2000, de 12 de enero, reguladora de la responsabilidad penal de los menores. ‘The reform of the penal justice system in Spain’ Abstract: 1. LA JUSTIFICACIÓN DE ESTA REFORMA: El Gobierno aprueba un proyecto de reforma de la ley orgánica de responsabilidad penal del menor (LORPM) y lo hace por dos razones: Existe, en efecto, una previsión legal que trae causa en la D.A. Sexta de la LO 5/2000, tras la reforma de la L.O. 15/2003. En ella se ordena al Gobierno a que impulse una reforma para “sancionar con más firmeza y eficacia los hechos delictivos cometidos por personas que, aun siendo menores, revistan especial gravedad, tales como los previstos en los artículos 138, 139, 179 y 180 del Código Penal” y añade que, para tal fin “se establecerá la posibilidad de prolongar el tiempo de internamiento, su cumplimiento en centros en los que se refuercen las medidas de seguridad impuestas y la posibilidad de su cumplimiento a partir de la mayoría de edad en centros penitenciario”. El balance de la ley tras cinco años de vigencia es netamente positivo, pero, en su aplicación, se han producido algunas disfunciones que es conveniente y posible corregir: 2. CRITERIOS GENERALES QUE INSPIRAN ESTA REFORMA: • El Gobierno continúa apostando por los principios, criterios y orientaciones generales que marcan la vigente ley para luchar contra la criminalidad de los menores que se caracteriza por tener naturaleza especial (fuerte presencia principio de oportunidad, orientación educadora de las medidas, interés superior del menor, flexibilidad en la elección y sustitución o suspensión del catálogo diverso de medidas y, amplio margen de discrecionalidad del Ministerio Fiscal y del Juez. • En los casos de delitos muy graves se ofrece una ampliación del marco temporal de las medidas de

internamiento para reforzar la individualización de la respuesta judicial: necesario balance entre el criterio de proporcionalidad con relación a la gravedad del hecho cometido, el interés superior del menor y el valor de la seguridad. Apuesta por el interés tuitivo y las garantías del menor con la consagración expresa de los criterios de aplicación de la pena (error, grado de participación, grado de ejecución, imprudencia, etc), para hacer efectiva la aseveración de que el menor no puede ser tratado de peor condición que el adulto infractor Se han incluido reglas garantistas y eficaces para los casos de concurso de delitos en un mismo o distintos procesos.
3. CONTENIDOS DE LA REFORMA: I. es necesaria una mayor potenciación de la protección a la víctima; II. también se ofrece respuesta frente al nuevo fenómeno de la integración de menores delincuentes en bandas y grupos organizados; III. se da una más ponderada respuesta en los casos de delincuencia violenta y frente a todo delito grave IV. y, por último, es necesario introducir algunas mejoras técnicas

His fields of research mainly covers “legal professions”, such as lawyers and judges, and the “socio-legal and penal systems” (youth justice, alternative modes of settlement, etc.). ‘The French Juvenile Justice System: Between the imperative of education and the temptation of repression’ Abstract: Le système français de justice des mineurs repose sur de solides fondations posées dans les années 40 et 50 autour de la spécialisation du juge, de l’exigence d’éducabilité, et de la double compétence, en protection du mineur en danger et en traitement des illégalismes juvéniles. Ce système a donné lieu à des modes de traitement mettant l’accent sur une approche protective et clinique de l’inadaptation au détriment de tout caractère pénal. Ceci a justifié un soupçon de complaisance envers les mineurs délinquants qui persiste aujourd’hui alors que la création de mesures à caractère plus pénal s’est multipliée au fil des ans. Mesures sur lesquelles nous insisterons ici car elles donnent leur identité hypermoderne au système judiciaire des mineurs, qui tend à se polariser entre protection et pénalisation. Mais le mouvement de pénalisation ne se réduit pas à des mesures strictement répressive: elles témoignent également d’une transformation de la méthode éducative, plus tendue vers l’acte et le comportement déviants que vers la «personnalité» (réparation pénale, centres éducatifs renforcés). Reste que la tendance la plus récente verse effectivement vers une tentation répressive, autour de la notion de « sanction éducative » et de centres fermés pour mineurs. Que reste-t-il des bases du système français dans ce contexte ? Quel est l’avenir des différentes approches éducatives (clinique, restaurative, répressive) dans ce contexte?

Currently Hugo de Seabra is Numena’s Vice-President, is enrolled in the forth year of the PhD Program in Sociology of ISCTE (Work and Enterprise Science High Institute), is engaged in numerous research projects relating to immigration, racism and criminality, and is a consultant on immigration issues at the Calouste Gulbenkian Foundation. ‘Pulas and Blacks: a case study on institutionalized young delinquents in Portugal’ Abstract: Hugo Martinez de Seabra intends to present some of the limitations existing in the Portuguese official justice system statistics to detect the involvement of immigrant minors in juvenile delinquency events. He will also present a summary of the findings of his Master's thesis in which he made 'quasiparticipant' observation within an official justice institution for young delinquents and he tried to identify possible differences between black and white juvenile delinquents.

She has had a number of articles and research papers published including work on black young people's experiences of the youth justice system, anti-social behaviour orders, children who display sexually harmful behaviour and the management of sex offenders. Prior to working on UK policy issues, Elizabeth worked for a research consultancy specialising in international development issues and poverty reduction. 'Just Justice: 'A study into black young people's experiences of the youth justice system.' Abstract: The over-representation of black young people in the youth justice system in England is well documented. Yet relatively little is known about how young black people experience and perceive the just system.
The Just Justice research project consists of four connected studies. Three of these explore different aspects of the justice system – looking in turn at young black people’s experiences of policing in the community; their experiences of custody; and their retrospective views after leaving custody. The fourth part is a study following young people’s contacts with the system over a period of time. Just Justice explores young people’s perceptions of their day-to-day encounters with the individuals and agencies working in the system and the strategies they employ in relation to these encounters. The Children’s Society believes that only by listening to young people can we fully understand their experiences and seek more effective solutions to the challenges they face. By giving black young people a voice Just Justice makes a substantial contribution to our understanding of what it means to be young and black in England, as well as contributing to our understanding of the way in which black young people experience the youth justice system.

(rowena.finnegan@yjb.gov.uk) Biography: Rod Morgan became Chair of the Youth Justice Board in April 2004. He was formerly HM Chief Inspector of Probation for England and Wales, a post he took up in August 2001. Before that he was Professor of Criminal Justice in the faculty of law at the University of Bristol, where he remains Professor Emeritus. Rod is the author of many books and articles on aspects of policing, criminal justice and penal policy and, during his academic career. For over 20 years, he was a lay magistrate, chairman of a youth court and a member of an independent monitoring board for a remand centre. Rod has long served as an expert advisor to the Council of Europe and Amnesty International on custodial conditions and process, and the prevention of torture – a topic on which he has written several books, including the Council of Europe's own guide to the Work of the European Committee for the Prevention of Torture. He is the co-editor of the principal text in the field of criminology in the UK, The Oxford Handbook of Criminology (3rd Ed, OUP, 2002), and is currently preparing a similar text on probation policy, research and practice. ‘Integrating Youth Offenders’ Abstract: A high proportion of young offenders are socially and economically marginal. They are characterised by multiple problems among which are: lack of educational engagement and achievement; family breakdown; precocious sexual activity and use of alcohol and illicit drugs; and behavioural disorders. That is, they are already not well integrated in mainstream socio-economic life. Criminalisation of their behaviour tends to exacerbate rather than diminish their social exclusion. Criminalisation should therefore be a last resort, other pre-court means being used to address offending behaviour in situ - in schools, in families, in neighbourhoods. Further, where criminalisation is necessary in the interests of justice or public protection, socially excluding consequences should wherever possible be mitigated or resolved. Among the promising re-offending reducing initiatives being pursued in England and Wales are reparative and restorative justice schemes, use of volunteer mentors, and intensive supervision and surveillance schemes either as an alternative to custody or as part of resettlement schemes. Expanding the scope of these approaches is however difficult in a political climate where the principal political parties have for several decades been engaged in an auction to out-tough each other.Young offenders have been particularly badly hit as a result of this punitive climate.

She has researched and published widely in the areas of children's rights and youth justice and is author of The Child and the European Convention on Human Rights (1999) and Youth Justice in Ireland: Tough Lives Rough Justice (2006). She has undertaken primary research into the rights of children in custody in Northern Ireland (2002) and into the operation of the youth court system in Ireland (2005) . She is a founder member of the Irish Youth Justice Alliance, an umbrella group set up to lobby for reform in the Irish youth justice system. In UCC, she teaches Youth Justice on the LLM (Criminal Justice). 'The Irish Juvenile Justice System: Positive Approaches to Young People in conflict with the law.' Abstract: The Irish juvenile justice system is in a period of great change. Although largely based on the antiquated Children Act 1908, the adoption of the Children Act 2001 represented a commitment to put in place a modern statutory framework for the treatment of young people in conflict with the law. It has many positive features including diversionary schemes, family conferencing and holistic approaches to young offending. It enshrines the principle of detention as a measure of last resort and puts in place a wide range of community based sanctions including mentoring, residential supervision and education and vocational programmes in order to make this principle a reality. In 2006, further reform of the area has lead to the addition of new initiatives to address young offending, including the establishment of a new Youth Justice Service to oversee change and the drafting of a new youth justice policy. While there are also many negative developments in the Irish context, the Irish experience is one of positive potential. It can therefore offer guidance to other states and to the EU in the search for common ground in the area of juvenile justice.
Mrs. Irma Van der Veen. Workwise. Netherlands. (irmavanderveen@hetnet.nl) Biography: Irma van der Veen is managing director of the Joint Venture Work-Wise Nederland. In 1998 she initiated the development of the Work-Wise programme and is as such one of the founders of this method. Until 2000 she was the director of a school for children with learning disabilities linked to a judicial juvenile institution. Subsequently she focused fully on the further development of Work-Wise, the foundation of Work-Wise Nederland, and advising in the implementation and execution of the method and the profiling of Work-Wise, nationally as well as transnationally. ‘A reintegration programme for juveniles with a judicial sentence or measure.’

Abstract: Work-Wise is a broadly established programme for youths in judicial juvenile institutions. This programme offers juveniles an individual routing towards an independent place in society, in which work is key. Research and experience have shown that having a job is crucial for juveniles with behavioral problems. Work provides structure, status, and above all self confidence. Therefore the activities within Work-Wise are mainly focused on schooling, training and job experience. Furthermore this programme offers coaching in the field of housing, restoring relationships, social skills and coping with leisure time. The programme originates from practice in judicial juvenile institutions. Since these institutions have cooperated more and more closely, a well described frame has been developed, with which everyone involved – external parties included – can work. This frame has been established in handbook ‘Work-Wise Method’. Since Work-Wise is a broad programme, the activities are split up in three sub-routings, that can be run through simultaneously. During the first routing: Work and Schooling, the juvenile is being prepared on functioning in a job and/ or course, among others by schooling, job application training and apprenticeships. The second routing: Living independently and Coping with leisure time, is focused on structure in daily life and dealing with responsibilities. Finally, during the third routing: Building a social network, the juvenile receives intensive coaching in the field of socially acceptable behaviour, keeping relationships and social skills. The force of the programme is threefold: from the first day in the institution an individual employment counselor (IEC) is appointed to the juvenile, this IEC is the key figure who through all phases of the routing is focused on creating preconditions (schooling, training, skills, apprenticeship, work, housing, etc.). The second force is the cooperation of the judicial juvenile institutions concerned within the joint venture WorkWise Nederland. By means of the Work-Wise programme, 13 of the 14 judicial juvenile institutions work together in developing instruments and research. All affiliated institutions make use of the Work-Wise method, in such a manner that when a juvenile is transferred from one institution to another, the individual routing can be seamlessly continued. The third force is after care. During six months after release youths are still coached by the IEC. In this after care phase there is very close cooperation with the (Juvenile) Prison Service or the Youth Care (family) guardian. The IEC does not perform all the tasks of the other organization, but together they will determine what has to be done, make appointments regarding responsibilities and the IEC gradually withdraws in the course of the after care routing.

She is the Director of the Miami-Dade County Juvenile Services Department which has a mission to serve both arrested juveniles and juveniles at risk of being arrested. Previously known as the Miami-Dade Juvenile Assessment Centre (JAC), it is the largest juvenile arrest processing centre in the United States. Wansley developed and heads a national demonstration project with the U.S. Department of Justice and over 30 national researchers in the field of juvenile justice. Her Department also partners with the White House Office of Drug Control Policy and serves as a national model.She currently serves on the Miami-Dade Juvenile Justice Board and the Miami-Dade Youth Crime Task Force. She is a Board member of the Florida Juvenile Justice Association and Chair of the Children’s Mental Health Committee for the District 11 Florida Department of Children and Families. Abstract: MIAMI-DADE COUNTY, FLORIDA, U.S.A. JUVENILE JUSTICE INTIATIVE In May, 2005, Miami-Dade County, Florida changed the nationally recognized juvenile arrest facility, the Miami-Dade Juvenile Assessment Center (JAC), into a Juvenile Services Department (JSD). This positions Miami-Dade County to use successful juvenile justice tools and systems with children who are at risk but not under arrest. By building the structure around an arrest facility, help is available 24 hours a day. This is a natural progression of the work of the National Demostration Project with the U.S. Department of Justice Office of Juvenile Justice and Delinquency Prevention (OJJDP) and national researchers that is ongoing since 2000 with the ultimate objective to reform an active, functioning system. The proposed session will provide an overview and historical perspective of how a major urban area plagued with a high arrest rate and dysfunctional arrest process set out to reform juvenile justice. The objective of the session is to provide the background and strategies on how systemic change can successfully occur in a community. The Department has data on over 100.000 juvenile arrests and includes ethnic backgrounds. This has proven to be a critical point in how appropriate interventions can have better outcomes. Also discusssed will be how successful research was implemented throughout a complex system and how it is working with service delivery. The White House’s Office of National Drug Control Policy recognized Miami-Dade County, Florida’s Juvenile Assessment Center (JAC) as an “exemplary program”in the President’s 2004 Drug Strategy Report. The JAC was noted as a facility that is leading the charge in developing ways to “Intervene Early”. To provide a background, the JAC is a centralized processing, referral, and evaluation center for all juveniles arrested in Miami-Dade County operating since late 1997. While community assessment centers have developed nationally, in Florida, a JAC is a centralized arrest processing facility by statute. This has proven to be an efficient model of processing that has allowed the State of Florida and local communities to achieve system and fiscal efficiencies. In 2000, the Miami-Dade JAC implemented a National Demostration Project with the U.S. Department of Justice Office of Juvenile Justice and Delinquency Prevention (OJJDP) and national researchers. The National Demonstration Project has allowed Miami-Dade County to develop the foundation needed to effectively plan and strategically apply specialized, research-proven interventions and programs based on the needs of the children in the system. In a time of limited resources, it is possible to provide an alternative to the “cookie-cutter” way of dealing with an entire population of juvenile offenders. It has also provided a foundation to document systems savings of over $50 million in this community since the opening of the arrest facility. Since the beginning of the initiative, Miami-Dade County, with a population of over 2 million, has reduced juvenile arrests by 25%.

'Latin Gangs in Spain.' Abstract: El fenómeno de las Bandas Latinas, también denominadas “maras” es un problema social de extremada importancia en Centroamérica y Sudamérica, más si consideramos que según estimaciones policiales en Centroamérica el número de jóvenes integrados en estas bandas supera los 600.000. Aunque la implantación de estos grupos juveniles violentos en España, ha sido reciente, ya han surgido los primeros grupos, y sus acciones, amplificadas y en ocasiones distorsionadas por los medios de comunicación, han ocasionado una incipiente alarma social en la sociedad española. Si bien la importancia de estos grupos y sus acciones están muy lejos de sus homónimos en el continente americano, de no adoptarse medidas oportunas, podríamos vernos envueltos en una espiral de violencia y conflictos sociales muy difíciles de controlar. En España, estas bandas se distribuyen por todo el territorio nacional, destacando la Comunidad Valenciana, Murcia, Madrid y Barcelona coincidiendo con las zonas donde se da una mayor presencia de inmigrantes originarios de América Latina. Disponen de una estructura organizativa y un fuerte sentimiento de territorialidad, lo que ocasiona que sus actividades delictivas tengan como principal objetivo lograr el control y dominio del territorio en el que se encuentran asentadas, llegándose a producir enfrentamientos con bandas rivales donde es habitual la utilización de armas blancas, que en ocasiones han producido la muerte de alguno de sus componentes. La mayoría de sus miembros tienen entre 14 y 23 años, con un porcentaje del 60% de menores de edad. Suelen ser consumidores de droga y se mueven en el entorno de los colegios, institutos de educación secundaria, parques públicos, zonas de ocio y deportivas, donde realizan actividades de captación de nuevos adeptos. La extensión y actividad delictiva de estos grupos en España, presenta notables diferencias respecto a otros países de Centroamérica, principalmente por la ausencia de actividades criminales a gran escala, como tráfico de estupefacientes, extorsiones, secuestros y control masivo de la actividad delictiva de su territorio. Pese a que se puede considerar que las bandas juveniles son un fenómeno emergente en España, la Secretaría de Estado de Seguridad, recientemente ha elaborado una Instrucción, para la implantación, desarrollo y ejecución del "Plan de Actuación y Coordinación Policial contra Grupos Organizados y Violentos de Carácter Juvenil", con el objeto de intensificar las medidas policiales y establecer instrumentos necesarios para mantener un control adecuado de estos grupos, habilitando medidas legislativas, educativas, de sensibilización así como, específicamente policiales tanto preventivas como, en su caso, represivas. Esperamos que la aplicación de este Plan de Actuación aumente el control y evite la extensión de las bandas juveniles en España.

'Minors and organized delinquency in Bari: an multi-institutional preventive approach.' Abstract: Bari, ciudad capital de la región Pulla, en el sur de Italia, registra desde hace mas de 10 años no solamente una presencia de grupos criminales organizados de mayores, sino también un preocupante y creciente involucramiento de menores de edad en las actividades ilícitas de los grupos mencionados. Las repetidas denuncias del Tribunal para Menores y de la Procuraduría General en Bari a lo largo de la última década no han tenido la oportuna reacción de las Instituciones Políticas y Académicas que raramente se han interesado de manera eficaz al asunto. Se considera útil proponer la presentación de un proyecto elaborado por el Observatorio sobre el Proceso Penal Juvenil y que, a través de la acción coordenada de numerosas Instituciones Políticas, Judiciales y Policiales, apunta a lograr los siguientes objetivos: - Establecer una política social y criminal, basada en las Convenciones de las Naciones Unidas y en los demás documentos aprobados a nivel internacional, que, con el objetivo de la tutela del menor sea capaz de implementar medidas legislativas y sociales que rompan el enlace entre menores y grupos criminales organizados. - Aplicación sistemática de las medidas legislativas y sociales individuadas. - Armonizar, a través de la coordinación, el trabajo que las Instituciones desenvuelven de manera no organizada. - Incrementar el conocimiento científico sobre el tema al fin de determinar la elaboración de recomendaciones legislativas y de política social. - Verificar la eficacia de un modelo aplicable en otros Países del mundo afectados por problemas similares.

'What is doing a Prosecutor like you in a place like this?, Is a social policy the juvenile penal justice?' Abstract: A nadie le debe ser desconocido que ante las infracciones penales de menores, en cuya etiología concurren múltiples causas, se debe de responder atendiendo a la complejidad de las mismas desde un enfoque multidisciplinar donde se combine lo psicológico, familiar, educativo, social y jurídico relativo al menor. Desde hace tiempo lancé una reflexión sobre las razones que estimo hacen impracticable o inviable en algunos aspectos la Ley española Penal del Menor (Ley Orgánica 5/2000, de 13 de enero, reguladora de la responsabilidad penal del menor, en adelante LORPM) . En síntesis, creo que la derivación de casos a la jurisdicción de menores que no son propios de una intervención penal sino de servicios sociales han colapsado a esta jurisdicción dedicando sus esfuerzos a resoluciones de conflictos imposibles de realizar en el ámbito jurídico-penal e impidiendo que puedan dedicarse los escasos recursos personales y materiales de la jurisdicción penal de menores a los casos que realmente sí necesitan esa intervención penal. A ello ha coadyuvado cierta concepción equivocada, desde mi modesto punto de vista, del Derecho Penal de Menores como un Derecho de Asistencia Social, cuando ni la mejor doctrina ni la normativa internacional ni la realidad de las cosas lo configura como tal sino como un Derecho Penal, esto es de control social, que establece un marco de garantías jurídico-penales frente al poder punitivo del Estado con la finalidad de

proteger el libre ejercicio de los derechos y libertades de los ciudadanos y el superior interés del menor. Quisiera destacar cierta paradoja que me produce el estudio de la materia que pretendo exponer cifrada en lo que llamo la impracticabilidad de la LORPM. Desde el terreno de los principios, condensados en la normativa internacional al uso ( ), atendida la pretendida desjudicialización que se postula de la Justicia de Menores, no es de extrañar que la LORPM tenga vocación de que no sea practicada, al menos, en lo que se refiere al agotamiento de todas sus fases procesales, siendo la misma sólo aplicada en su inicio, precisamente para resolver que no debe de ser aplicada (v.gr. art. 18 sobre el desistimiento de la incoación del Expediente, ó art. 19 sobre el desistimiento de la continuación del Expediente). Desde esta perspectiva, es una Ley en la que en su práctica se busca su impráctica. Ahora bien, desde otro ángulo de vista, la Ley no es impracticable porque así se quiera por el legislador sino como consecuencia de o bien de su mala regulación técnica, que la hace inviable en la práctica o bien de la carencia de infraestructuras personales y materiales adecuadas para llevarla a la práctica. Por ello, para la reflexión, es bueno hacerse estas preguntas: ¿es la LORPM una Ley impracticable deliberadamente?, es decir, ¿la impráctica de la Ley responde a unos principios desjudicializadores o tan sólo desvela la impotencia de hacer realidad su finalidad educativa para no ser nada, causando impunidad, o ser meramente sancionadora?. ¿cuál es la eficacia social de la Ley?.

Current: assistant at the University of Munich. ‘How to treat a young offender, who is a victim himself?’ Abstract: Usually the police, the prosecutors and the judges have to deal, on the one hand, with the offender and, on the other hand, with the victim. However, in some cases, the number of which is increasing, the delinquent juvenile is a victim himself; for example a victim of human trafficking, who is made to work as for example a thief, a prostitute or a drug dealer. Therefore, they are mostly forced to commit minor crimes. Shouldn’t these young offenders obtain a higher level of protection than a “conventional”offender? If they should, what can authorities do to protect this special group? In certain cases it may be possible to apply some of the rights of a victim or a victim acting as a witnesses also to the offender, in the case were he/she is the accused. Although these provisions, the protections rules for offenders and for victims, have different aims, they are not generally in direct conflict, and can be combined. In practice, it is not so easy to find a balance between the needs of the offender as the offender and as a victim, the interests of the society, and the political considerations. Although some ideas, on how to treat these “victim-offenders” will be presented. Inter alia it may be necessary for police officers to be specially trained, as these juveniles can be traumatised. In some cases, the prosecutor should be able to close the proceedings, although he must follow the principle of compulsory prosecution.

At present she is a PhD student in Criminology. She is a practising lawyer and has worked for several European research projects in collaboration with the Aristotle University (Department of Criminal Law and Criminology, Department of International Law) and NGOs (Save the Children – Greece) related to the protection of human rights of children in conflict with the law, children in detention and children at risk. She has also worked for EC EuropeAid human rights projects in Latin America and Asia. During 2001-2004 she co-ordinated the Youth Programme Action 5 Support Measures for the Department of Criminal Law and Criminology, a programme of educational intervention in the juvenile prisons of Thessaloniki, Groningen, Roma and Bremen. 'Young Detainees meeting Law Students; an effort to bridge the gap.' Abstract: The Department of Criminal Law and Criminology of the Law School of the Aristotle University of Thessaloniki implements, since October 2001, a quite innovative project aimed to address the needs for socialisation and integration of young offenders held in closed correctional institutions such as the Judicial Prison of Thessaloniki. Having in mind that adequate education is very limited if non-existent and combined with total exclusion from any form of social activity or exchange, the Department formulated a non-formal educational programme aimed to promote a range of skills and competencies. The programme actually addresses two main groups of beneficiaries; the young detainees (aged 13 -21) on one hand and the young students (aged 19 -21) on the other, and seeks to develop interpersonal communication skills, active interaction, teamwork and social inclusion. Furthermore, it seeks to give the young participants the opportunity to familiarise themselves with the idea of volunteerism and active participation to social activities aiming at the promotion of human rights, tolerance and human dignity. Finally it offers both the groups, and especially the young detainees, the opportunity to express their views through the creation of an exhibition which will be the vehicle for the presentation to the public of their thoughts, their problems and anxieties experienced within the juvenile justice system and the prison environment. The programme is divided into five major parts that last two years: a. Introductory seminars regarding the juvenile justice administration system by professionals (academics, social workers, psychologists, police officers and judges) to volunteer students before entering the prison; b. Exploratory visits to prisons, introduction of the programme, motivation of young detainees and familiarisation of both the groups with the environment and with each other; c. Organisation and carrying out of group activities, with the participation of young detainees and students including literature, painting, music, drama, photography; d. Organisation and carrying out of personal interviews with the young detainees regarding their critical opinion towards the penitentiary system, the prison conditions, their possibilities after release, their future plans and wishes; e. Organisation and carrying out of an exhibition (at the university, court, etc.) displaying the material collected during the previous activities, paintings, poems, texts, photos, extracts from the interviews. The programme started with funds by the European Commission (Youth Project Action 5 Support Measures) and the participation of the University of Groningen, the University of Bremen and the Italian NGO Cooperativa and lasted two years. It was warmly welcome by the young detainees and soon attracted the

interest and enthusiasm of volunteers, mainly law students. It was its final success and positive impact to both groups of young people that made its scientific supervisors decide to continue its implementation even, at the present, without further subsidise by the EC. This paper deals with the methodology and results of the project in Greece, the difficulties faced during its implementation as well as its future orientations. Abstract: El día 4 de agosto pasado, se publicó en el Boletín Oficial de la Comunidad de Madrid, un Decreto del Consejo de Gobierno, que establece por primera vez un marco jurídico propio para la educación reglada de los menores y jóvenes infractores que cumplen medidas en medio cerrado. El propósito de este nuevo marco jurídico, y nuestro reto profesional, no es otro que hacer compatible el derecho a una educación de calidad, con el deber de cumplir una mediada judicial en régimen de privación de libertad.

'European Arrest Warrant - an instrument of co-operation in the juveniles matters in the EU?' Abstract: The paper presents an overview of the regulations on extradition and surrender of juveniles accused of committing crimes. The presentation focuses on the possibility of applying European Arrest Warrant in the cases of juveniles in criminal proceedings and in juvenile proceedings, and also discusses the possibilities for the harmonization of EU Member States juvenile justice systems. The factual basis for the paper is a case of a young Pole who is – at the moment – sought by Belgium for murdering a teenage boy in Brussels. Although he reached the age of criminal responsibility in the light of Polish substantive criminal law, he is still a juvenile in Belgium and he is sought for conducting juvenile proceedings. This raises many questions, the most fundamental one – as to the admissibility of applying European Arrest Warrant.

'The social and educational reintegration process of young offenders in custody.' Abstract: La presente experiencia trata de mostrar un proyecto pionero en nuestra Comunidad Autónoma de Las Islas Baleares, que se inició hace seis cursos escolares como fruto de un convenio entre dos Direcciones Generales: la de la Consejería de Educación y la de la antigua Consejería de Bienestar Social, ahora Consejería de Presidencia y Deportes. El proyecto defiende y trabaja el proceso de la reinserción escolar y/o formativa de menores con medidas judiciales de privación de libertad (las cuales las cumplen en centros socioeducativos, es decir, centros donde se ejecutan las medidas de privación de libertad para menores, según ley 5/2000, en todos sus regímenes) y catalogados como inadaptados, social y escolarmente. Hablamos de muchachos que hasta el momento habían estado ausentes del circuito escolar ordinario, puesto que dentro de éste no habían encontrado la respuesta adecuada a sus necesidades y que como consecuencia de formarse “en la calle”habían empezado a presentar conductas disruptivas y/o delictivas. Desde el Centro y desde el Programa Escolar se aboga por una línea normalizadora e integradora y se trabaja día a día por la búsqueda de alternativas escolares y/o formativas que colaboren en su camino de regreso a su contexto socio – familiar. Hemos intentado siempre trabajar en las condiciones y en el entorno más normalizados posibles, siendo la situación escolar, a nivel administrativo, de los alumnos internados en nuestro Centro como la de cualquier otro. Es decir, todos los alumnos internados por una medida judicial desde el primer momento han sido matriculados en un centro escolar o formativo de zona (en función de su domicilio familiar, tal y como marca el principio de sectorización). Se ha desarrollado un trabajo coordinado entre ambos centros (escolar y socioeducativo), siempre partiendo de las directrices básicas (tanto didácticas como curriculares) de su centro de referencia y potenciando el proceso de retorno desde el primer día de internamiento, puesto que el regreso ha representado el objetivo final y prioritario del proyecto que nos ocupa. Nuestro proyecto ha sido fruto de la reflexión sobre nuestra práctica diaria con el objetivo de poder dar respuesta a menores considerados o catalogados como infractores, menores que en realidad son alumnos con unos deberes pero también con unos derechos, que por sus características personales, su problemática socio - familiar o la conjunción de ambas, no han encontrado su lugar en el sistema educativo dónde hasta ahora habían sido ubicados. Como punto final podemos añadir que los resultados cada año han ido siendo más satisfactorios y que actualmente (datos del curso 2005-06) podemos hablar de un 90% de éxito en los procesos de reinserción trabajados.

Abstract: La primera parte de la ponencia recoge un resumen de los resultados de la investigación que ha realizado el Centre d’Estudis Jurídics i Formació Especialitzada (CEJFE), organismo autónomo adscrito al Departamento de Justicia de la Generalitat de Catalunya, sobre la reincidencia en el delito en la justicia de menores. La investigación analiza una muestra de 2.903 menores que han finalizado una medida de justicia juvenil en el año 2002 y los ha seguido hasta diciembre de 2004, para saber si en este periodo máximo de 3 años de seguimiento han cometido nuevos delitos, y por tanto puede considerarse reincidencia. La muestra seleccionada es representativa de toda la población infractora juvenil catalana.

En esta parte de la ponencia se exponen las tasas de reincidencia en el delito juvenil en Catalunya, así como el perfil de los jóvenes infractores y las principales variables que influyen en la reincidencia. En la segunda parte de la ponencia se explica la puesta en marcha del proyecto sobre gestión del riesgo. A partir de las conclusiones del estudio de reincidencia, se concretó la recogida de las variables personales, sociofamiliares y criminológicas de los menores infractores más significativas para evitar la reincidencia en las anamnesis de los menores y el control sistemático de su evolución. Así mismo se explican como se implementan una serie de procedimientos más homogeneizados en el trabajo de los profesionales de Justicia juvenil.

His work principally covers 2 fields of investigation: - “Youth Justice”,“Delinquency prevention”, and “Public Policies in the city”; - “The processes and procedures of the marginalized populations‘s integration or reintegration. He has researched and published extensively in respect to those subjects. 'Evolutions of penal juvenile justice in Europe. From the welfare-model to the neoliberal model.' Abstract: Cet exposé s'appuie sur une recherche que nous menons avec Yves Cartuyvels (Université SaintLouis à Bruxelles) depuis le début de l'année 2000 et qui doit se poursuivre jusqu'en 2009. Par rapport à ce long programme de recherche qui se décline en trois phases, je vais m'appuyer essentiellement au cours de cet exposé sur la seconde phase des travaux (2003-2006) dont les résultats viennent d'être publiés en France et qui doivent l'être, l'année prochaine, en Angleterre ( ). Il s'agissait, dans cette seconde phase, de faire le point sur le fonctionnement de la justice pénale des mineurs dans treize pays européens (Allemagne, Belgique, Espagne, France, Hongrie, Grèce, Italie, Pologne, Portugal, Royaume-Uni, Slovénie, République Tchèque, Norvège) et le Canada. Notre travail était guidé, pour borner l'analyse des transformations du fonctionnement de la Justice pénale des mineurs, par une série d'hypothèses tant sur le fond (neuf éléments) que la forme (quatre éléments) issues de la première phase de nos travaux ( ). Après avoir présenté brièvement les hypothèses, j'exposerai les principaux résultats de cette recherche en m'appuyant sur cinq points principaux: •
Le premier point concerne les deux hypothèses générales de la recherche: - Liaison entre politiques sociales et politiques judiciaires de la jeunesse? - Orientation et/ou inflexion néo-libérale?

La transformation des regards portés sur l'enfant, l'enfance, l'adolescence et la jeunesse depuis les années quatre-vingt. Le jeune est aujourd'hui, dans une majorité de pays, perçu plus comme un problème social, une figure ou un générateur de risque et d'insécurité qui appelle une réponse en terme de rappel à la norme, à la Loi ou à la sanction que comme une source de développement, d'enrichissement économique et social. La transformation, dans la mise en oeuvre concrète d'une réponse judiciaire, de la notion de responsabilité. On constate l'abandon, presque général, de la définition pratique de cette notion judiciaire sous régime welfare - caractérisée par un jeu dialectique entre, d'une part, la responsabilité du jeune face à son acte transgressif et, d'autre part, la responsabilité sociétale face à aux conditions d'éducation, de vie du mineur - au profit de la seule responsabilité "individuelle" du jeune. Un changement de position et de stratégie de l'État dans la gestion des problèmes sociaux et ceux d'ordre public. Cette nouvelle orientation des activités de l'État conduit à un changement du régime de la pénalité et à une contradiction, porteuse d'injonctions paradoxales, quant au rôle et à la position sociale des jeunes. Une focalisation des procédures judiciaires sur certaines populations ciblées, en particulier les étrangers ou les jeunes issus de l'immigration et une amplification de l'application de mesures coercitives ou privatives de liberté: un durcissement de la réponse pénale.
